HomeMy WebLinkAbout0555 Ord (Amend Zoning - Low Density Multiple Dwellings)ORDINANCE NO. 555 AN ORDINANCE AMENDING ORDINANCE N0. 383, THE ZONING ORDINANCE, BY PROVIDING FOR THE CONSTRUCTION OF LOW DESNITY MULTIPLE DWELLINGS. THE CITY COUNCIL OF THE CITY OF STILLWATER DOES ORDAIN: Section 1. Amending. Section 10, Use Districts of Ordinance No. 383, the Zoniig Ordinance, is amended to add the follow'ng subsection: 9. RCL - Low Density Multiple Family Residence District. Section 2. Amending. Ordinance No. 383 is amended to add the following new section: Section 13a RCL - Low Density Multiple Family Residence District. 13a01 Uses Permitted by Special Use Permit Townhouses, Group or Row Houses 13a02 Accessory,Uses . 13a02.1 Customary Home Occupations 13a02.2 Off -Street Parking and Loading Facilities 13a02.3 Private Recreation Facilities 13a03 Conditional Uses! Public Educational, Religious, and Institutional Buildings 13a04 Area Requirements 13a04.1 Minimum Lot Area shall be 20,000 square feet 13a04.2 Minimum Lot Area Per Dwelling Unit shall be 7,000 square feet 13a04.3 Maximum Building Height shall be 35 feet. 13a04.4 Minimum Open Space per dwelling unit shall be 1,500 square feet 13a05 Schedule of Allowances Same as Secticn 1305 13a06 Recreation Facilities Same as Section 1306 13a07 Yard and Setback Requirements 13a07.1 Front Yard 35 feet 13a07.2 Side Yard 50 feet 13a07.3 Rear Yard 50 feet 13a07.4 Accessory Buildings shall conform to the above requirement applying to principal buildings. 13a07.5 No principal building may be constructed within 50 feet of another. 13a08. General Requirements 13a08.1 All construction shall be in conformance with the require- ments of Sections 1308 through 1311 of this Ordinance relating to Parking, Landscaping, and Screening, Building Design and constructions, and Administrative Procedures. 13a08.2 Copies of all convenants and easements relating to the provision, use and maintenance of common open space shall be filed with the City and the requirements of these shall be held to be legally binding upon all who are a party to them. (CONTINUED ON PAGE 456) A ORDINANCE NO. 555- continued 13a08.3 When a corporation is formed to maintain space or facilities commonly held for the use of all property owners, the rules of the corporation shall state that should it fail to maintain that space or facilities, the City shall be empowered to abate any nuisance relating from the lack Al' maintenance and shall have the authority to assess the cost of the abatement to the nuisance to all property owners holding membership in the corporation SECTION 3. EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after its passage a__` publication according to law. Passed by the City Council this 20th day of September, 1977.
