HomeMy WebLinkAbout0518 Ord (Establish Procedure for Deferral of Special Assessments for Seniors)ORDINANCE NO. 518 AN ORDINANCE ESTABLISHING PROCEDURE FOR DEFERRAL OF SPECIAL ASSESSMENTS FOR SENIOR CITIZENS. THE CITY COUNCIL OF THE CITY OF STILLWATER DOES ORDAIN: SECTION 1. PROVIDING FOR DEFERRAL OF ASSESSMENTS. From and after the adoption of this Ordinance the City Council of the City of Stillwater may, in its discre- tion, defer the payment of any special assessment heretofore or hereafter made for local improvements constructed by the City within the City of Stillwater when, in ite discretion, it determines by a three -fifths vote of the Council that the property upon which said assessment is to be levied is homestead property, that one of more of the owners of said property is sixty-five years of age or over, and that payment of the assessment would be a hardship for the owner thereof. SECTION 2.'-`APPLICATION FOR DEFERRAL. Senior citizens seeking such deferral shall make application for the sane on a form prescribed by the County Aasesor of Washington County. In the event that such forms do not require the same, the applicant shall in addition furnish to the City Council of the City of Stillwater, a statement ":under oath setting forth applicant's income and assets at the time of the making of the application. SECTION 3. DETERMINATION OF INTEREST RATE. The City Council of the City of Stillwater shall hereafter at the time of levying any special assessments, determine in addition to the interest rate to be charged to property owners on installments of said special assessments, the interest rate, if any, which will be charged to the senior citizens seeking deferral of the collection of said assessments in accordance with the provisions of this ordinance. SECTION 4. TERMINATIONS OF RIGHT OF DEFERRED PAYMENT. Deferrals granted hereunder shall terminate and the amount deferred, together with accumulated interest, shall become due upon the occnrence of any, of the following events: (a) the death of the owner, provided that the spouseis otherwise not eligible for; the benefits hereunder; (b) the sale, transfer or subdivision of"the property or any part thereof -.(c) if the property should for any reason lose its homestead status, or (d) if for any reason the taxing authority deferring the payments shall determine that there would be no hardship to require immediate or partial payment. At the time of the termination of the deferral,: the Council may, in its discretion, provide for payment of said deferred sum in installment payments in accordance with ` the terms of the original assessment. SECTION 5. EFFECTIVE DATE. This ordinance shall be in full force and effect trom and after its passage and publication. Passed by the City Council this 8th day of October, 1974.
