ORDINANCE N0. 506
AN ORDINANCE ESTABLISHING A HERITAGE PRESERVATION COMMISSION.
THE CITY COUNCIL OF THE CITY OF STILLWATER DOES ORDAIN:
SECTION 1. ESTABLISHMENT OF COMMISSION.
A Heritage Preservation Commission for the City of Stillwater
is hereby established.
SECTION 2. PURPOSE.
Identify, catalog and recognize and help plan for the preservation
of buildings, lands, areas or districts of the City which possess historical
or architectural significance.
SECTION 3. MEMBERS AND TERMS.
Said Commission shall have eleven (11) members. The nine (9) members.
of the Planning Commission shall be ex-officio members of the Heritage Commission.
Two (2) additional members shall be appointed by the Washington County Historical
Society. subject to the approval of the City Council: These appointments shall
be for three (3) year terms.
SECTION 4. ORGANIZATION.
4.01 The Commission shall elect a Chairman from among its members for
a term of one (1) year and may create and fill such other positions
as it sees fit.
4.02 The Commission shall hold at least four (4) regular meetings each
year. Two meetings shall be held forty-five (45) days apart --
one in March and one in April, and two meetings forty-five (45)
days apart, one in September and one in October. Members shall
be notified of meetings by written notice. The Commission shall
adopt rules for the transaction of business and shall keep a
record of its transactions and findings, which shall be a public
record. on or before the first meeting of each year, the
Commission shall submit to the City Council a report of its work
during the preceding year.
SECTION 5. PROCEDURE.
5.01 The Commission shall prepare a list of buildings, lands. areas
or districts which are capable of receiving recognition because
of historical or architectural significance. Said list shall be
reviewed by the Planning Commission, the Board of the Washington
County Historical Society and the Minnesota Historical Society
prior to the submission to the Council.
5.02 For every building. parcel of land, area or district prnposed to
be designated for heritage preservation, the Commission shall
prepare a history of same and a guideline for its utilization.
5.03 The City Council shall by Resolution designate or describe the
specific buildings (including interiors where appropriate), land,
areas or districts to be preserved. Prior to such designation. it
shall hold a public hearing on the matter.
5.04 Upon the recommendation of the Commission, the Council may request
that certain buildings, land, areas or districts possessing unusual
architectural or historical significance be placed on the State or
National Register.

SECTION 6. PREVIEW OF PERMITS.
6.01 The Commission shall review within 45 days of submission of
plans the issuance of permits to do any of the following in a
building, area or district which has bean designated for
heritage preservation:
a. Remodeling or repairs which will change the basic
structural, exterior appearance and/or interior
appearance where designated.
b. Movement of a building.
c. Destruction of a building in whole or in part.
d. Changing the nature of appearance of preserved area.
SECTION 7. AWARDS.
Owners of buildings, land, areas or districts which have been designated
for heritage preservation shall be presented by the City with a plaque
noting same which is suitable for outside display.
SECTION 8. REGISTER OF DEEDS.
A copy of the Resolution of the City Council designating a building, land,
an area or a district for heritage preservation shall be filed with the
Register of Deeds of Washington County and shall be attached to the deed
for the property so designated.
SECTION 9. EFFECTIVE DATE.
This Ordinance shall be in full force and effect from and after its passage
and publication according to law.
Passed by the City Council of the City of Stillwater this 5th day of June,
1973.
