HomeMy WebLinkAbout0502 Ord (Repeal Construction Codes-Implement Minnesota Building Code-Fire)393 ORDINANCE NO. 502 AN ORDINANCE REPEALING CITY CONSTRUCTION CODES AND PROVIDING FOR THE IMPLEMENTATION OF THE MINNESOTA BUILDING CODE BY DEFINING FIRE ZONES AND PERMIT FEES. THE CITY COUNCIL OF THE CITY OF STILLNATER DOES ORDAIN: SECTION 1. REPEALING. Ordinances Nos. 336. 337, 341, 359 and 395, Building Code, Ordinance No. 362, the Mechanical Code, Ordinance No. 392, the Electrical Code and Ordinance NO. 458, the Plumbing Code of the City of Stillwater are hereby repealed in their entirety. SECTION 2. ADOPTING. The Minnesota Building Code, prepared and published by the State of Minnesota, Department of Administration, three copies of which are on file in the office of the City Clerk, is hereby adopted as the Building Code of the City of Stillwater. Except as hereinafter modified, every provision contained in such Code is hereby adopted and made a part of this Ordinance as fully as if set forth explicitly herein. SECTION 3. FIRE ZONES. 3.01 Pursuant to Appendix C of the State Building Code, the following described area is declared to be in Fire Zone No. 1. - Beginning at a point in said City of Stillwater. Minnesota, where the north line of east Pine Street extended easterly would intersect the west shore of Lake St. Croix, and running thence northerly along said shore of said Lake St. Croix to a point where said Lake St. Croix intersects with the south line of East Elm Street extended to the shores of said Lake St. Croix; thence westerly along the south line of said East Elm Street extended -to the east line of North Second Street; thence southerly along the east line of North Second Street to the southerly line of East Mulberry Street; thence westerly along the south line of said East Mulberry Street, to a point 150 feet westerly from the west line of North Second Street; thence southerly along the center line of Block Nineteen (19), of said city to a point in the south line of Commercial Avenue if extended westerly; thence westerly along said extension of the south line of Commercial Avenue to the east line of North Third Street; thence southerly along the east line of North Third Street and the east line of South Third Street, to the north line of east olive Street; thence easterly along the north line of east Olive Street to the east line of South Second Street; thence southerly along the east line of South Second Street, to the south line of East Nelson Street; thence easterly along the south line of East Nelson Street to a point Seventy-five (75) feet westerly from the west line of South Main Street; thence southerly on a line drawn parallel with and seventy- five (75) feet westerly from the said west line of South Main Street to a point in the north line of East Pine Street if extended easterly; thence easterly along said easterly extension of East Pine Street to the point of beginning. 3.02 All other properties in the City are declared to be in Fire Zone No. 3. SECTION 4. APPEALS. Appendix D of the State Building Code is amended to read as follows: Section 4. Appeals. Whenever the Building Inspector shall disapprove an application or refuse to grant a permit applied for or when it is claimed that the provisions in the Code so not apply or that the true intent and meaning of the Code have been misconstrued or wrongfully interpreted. the applicant may appeal from his decision to the city Council within 30 days from the date of the decision to be appealed. SECTION 5. BUILDING PERMIT FEES. Pursuant to Section 3a of Appendix E of the State Building Code, the following Building Permit Fees are hereby established: • • 394 e ORDINANCE NO. 502 - continued Each application for a building permit shall be accompanied by a fee for the proposed remodeling, new construction, moving or wrecking as follows, to -wit; For Residential Construction from Two Hundred Fifty ($250.00) Dollars to Five Hundred ($500.00) Dollars of value the fee shall be Three ($3.00) Dollars. b. For Residential Construction from Five Hundred ($500.00) Dollars to One Thousand ($1,000.00) Dollars of value the fee shall be Eight ($8.00) Dollars. For each additional One Thousand ($1,000.00) Dollars of value of Residential Construction, the fee shall be an additional additional Two ($2.00) Dollars per thousand, or any fraction thereof. ' For construction of multiple Dwellings, commercial and/or industrial structures, the fee shall be Ten ($10.00) Dollars for the first One Thousand ($1,000.00) Dollars of value, and Three ($3.00) Dollars for each additional One Thousand ($1,000.00) Dollars or any fraction thereof of value. a. c. d. e. Construction costs shall be all costs to the Builder exclusive of plumbing and mechanical installations. SECTION 6. PLUMBING PERMTT PEES. Pursuant to Section 3a of Appendix E of the State Building Code, the following Plumbing Permit Fees are hereby established: Permit fees shall be computed on the basis of the actual cost to the owner of the proposed work. The person making application for a plumbing permit shall be responsible for correctly reporting the actual coat to the owner. Fees for plumbing permits shall be as follows: a. For work up to and including $10C of value, the fee shall be $2.00. b. For work costing in excess of $100 and up to $50,000 of value, the fee shall be $2.00 plus $.75 for each $100 of cost, or fraction thereof, l_ n in excess of $100. 1 c. For work costing in excess of $50,000 up to and including $100,000 of value, the fee shall be $376.25 plus $.50 for each $100 of cost, or fraction thereof, in excess of $50,000. d. For work costing in excess of $100,000 of value, the fee shall be $626.25, plus $.25 for each $100 of cost, or fraction thereof, in excess of $100,000.00. sr sr SECTION 7. MECHANICAL PERMIT FEES. Pursuant to Section 3a of Appendix E of the State Building Code, the following mechanical Permit Fees are hereby established: a. For work up to and including $500 in value, the fee shall be b. For work in value in excess of $2,500, the fee shall be $10.00 plus an additional $.50 Der $1,000 in value or fraction thereof in excess of $2,500. SECTION 8. SERVICE AVAILABILITY CHARGE. Holders of Building Permits for all new residential, commercial or industrial construction issued after Januaryl, 1973, shall be required to pay a Sewer Service Availability Charge in accordance with the following schedules in addition to sewer connection charge established by ordinance No. 377. • • 395 • • ORDINANCE NO. 502 - continued a. The Service Availability Charge shall be levied according to the following schedule: 1973: $275 per unit 1974: $300 per unit 1975: $325 per unit 1976: $350 per unit 1977: $375 per unit e b. All in addition to charges imposed by Ordinance No. 377. SECTION 9 EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after its passage and publication according to law. passed by the City Council this 28th day of November. 1972.
