ORDINANCE NO. 484
AN ORDINANCE PROHIBITING THE DEPOSIT OF CERTAIN MATERIALS ON CITY STREETS.
Section 1. No person shall deposit, cause to be deposited or through
any negligence allow to be deposited upon a City street any wood, vegetation,
stones, earth or mud resulting from either the erosion of property or the
transport of said materials.
Section 2. Violators of the provisions of this Ordinance Shall
remove all such deposits from City streets within 24 hours of reception of
notice by certified letter from the City that a violation has occurred.
Failure to do so shall be considered to be a nuisance and all costs of abate-
ment of the nuisance by either City crews or contract labor shall be assessed
to the property or properties deemed to be the cause or the source of the
nuisance.
Section 3. The property damage liability insurance of violators of
the provisions of this Ordinance who are contractors shall be drawn upon to
cover the costs of abating the nuisance.
Section 4. Owners of property determined to be a nuisance, in
addition to being subject to the provisions of Section 2, above, shall take
permanent measures to eliminate the cause or source of the nuisance within
30 days of the receipt of the notice of the violation.
Section 5. Penalty. Any person or firm who shall violate any of the
provisions of this Ordinance, shall, upon conviction thereof, be found to be
guilty of a misdemeanor. Each and every day that a violation exists shall
constitute a separate violation.
Section 6. Effective Date. This Ordinance shall be in full force and effect
from and after its passage and publication according to law.
