HomeMy WebLinkAbout0483 Ord (Amend Zoning)• • • P ORDINANCE N0. 483 AN ORDINANCE AMENDING ORDINANCE NO. 383. THE ZONING ORDINANCE, PROVIDING FOR A FLOOD PLAIN OVERLAY ZONING DISTRICT. THE CITY COUNCIL OF THE CITY OF STILLWATER DOES ORDAIN: Section 1. Amending. Section 10. Use Districts, of Ordinance No. 383, the Zoning Ordinance, is amended to add the following new subdivision: • 8. FP - Flood Plain Overlay District i Section 2. Amending. The Flood Plain Overlay District shall consist of that -'area of the City which would be inundated by a Regional Flood known to have occurred in the area and reasonably characteristic of what can be expected to occur on an average frequency in the magnitude of the 100 year recurrence interval. This area is delineated on the Zoning Map of the City. Lots partially within the Flood Plain Overlay District are considered to be entirely within it. Section 2. Scope. Within the Flood Plain Overlay District, in addition to adhering to all requirements as prescribed herein, all structures constructed or altered to the extent of greater than fifty per cant (50%) of their current market value shall be required to adhere to the Zoning Requirements Relating to Non Conforming Uses and Prescribing Permitted Uses and Area Requirements for the lot on which they are located. Section 3. Flood plain Building Requirements. 3.01 General. All structures hereafter constructed within the Flood Plain Overlay District or altered to the extent of greater than fifty percent (5016) of their current market value shall be required to adhere to standard flood proofing techniques and practices as required herein. by the State of Minnesota's Department of Natural Resources, and by the U. S. Army Corps of Engineers up to the Flood Protection Elevation. This is that point not less than one (1) foat above the water surface profile associated with a regional flood, plus and increases in flood stages attributable to encroachments upon the flood plain, as defined. The Flood protection Elevation within the City of Stillwater is deemed to be 696 feet above sea level. 3.02 Flood Proofing. Where flood proofing is incorporated into new buildings or structures, and into alterations or additions to existing non conforming structures, flood proofing measures shall be provided to the Flood Protection Elevation and designed to withstand flood velocities, depths. durations, forces and any other factors associated with the regional flood. A plan or document certified by a registered professional engineer or architect that the flood proofing measures are adequately designed to withstand regional flood conditions shall be submitted to the City for approval before authorization is granted for the proposed work. Authorized flood proofing measures shall include such provisions as the anchorage of structures to prevent flotation. the installation of water tight barriers over openings, the reinforcement of walls to resist water pressures, the use of materials to reduce wall seepage, the construction or modification of water supply and waste disposal systems to prevent entry of flood waters, the placement of essential utilities above the flood protection elevation, and the installation of pumping facilities for internal and subsurface drainage. Electrical and heating equipment within these structures, shall be at or above the flood protection elevation for the site or shall be adequately flood proofed. 3.03 Residential Areas. The finished surface of the first floor or basement floor of any residential building or structure to be erected, constructed. reconstructed, altered or moved on the flood plain shall ordinarily be placed on fill at or above the flood protection elevation. The fill shall extend at such elevation at least 15 feet beyond the limits of any structure or building erected thereon. Where existing streets or utilities are at elevations which make strict compliance with this provision impractical, the City council may • 4u2 e • ORDINANCE NO. 483 - continued 3 C CC authorize use of flood proofing or other measures or methods to provide y protection to the flood protection elevation. 3.04 Commercial Areas. Commercial Buildings or structures generally are to be constructed on fill with no first floor or basement floor below the flood protection elevation, or otherwise flood proofed to the flood protection elevation. Accessory land uses such as yards, railroad tracks and parking lots may be at lower elevations. 3.05 Manufacturing and Industrial Areas. Manufacturing and industrial buildings, structures and appurtentant works shall be protected to the Flood Protection Elevation. Measures shall be taken to minimize interference with normal plant operations. Certain accessory Jand uses such as yards, railroad tracks and parking lets may be at lower elevations. 3.06 Storage of Materials. Materials that, in time of flooding. are buoyant, flammable, explosive, or could be injurious to human, animal or plant life. shall be stored at or above the flood protection elevation, flood proofed. or protected by structural measures consistent with the standards set forth herein. Furthermore, storage of materials likely to cause pollution of the waters, as defined in Minnesota Statutes 1969. Paragraph 115.01, if subject to flooding are prohibited unless adequate safeguards approved by the Minnesota Pollution control Agency are provided. Section 4. Administration. A11 requests for Building Permits in the Flood Plain Overlay District shall be referred to the City Engineer for review to determine if plans are in compliance with the Ordinance. Section 3. Effective Date. This Ordinance shall be in full force and effect from and after its passage and publication according to law. Passed by the City Council this 7th day of December. 1971.
