ESTABLISHING BOND AND FEES FOR THE SAME. AND PROVIDING FOR PENALTIES FOR VIOLATION THEREOF. THE COUNCIL OF THE CITY OF STILL4ATER DO ORDAIN AS FOLLOWS: Section 1. License Required. No person shall sell or attempt to sell any property within the City limits of the City of Stillwater at auction without securing a license from the City Clerk of the City of Stillwater. This require- ment shall not extend to sales made by sheiffs, coroners, constables, collectors of taxes, or sales of personal property under chattel mortgage or other lien, or to the sale by an individual or company of property owned by him for at least six (6) months. Section 2. Persons Eligible. Only those persons licensed as auctioneers pursuant to Chapter 330 of Minnesota Statutes shall be qualified to secure an auctioneer's license in the City of Stillwater, Section3. Application for License. Application for license shall be made to the City Clerk of the City of Stillwater on a form provided by the City Clerk and shall be accompanied by a bond in the amount of not less than Five Thousand and no/100 Dollars ($5,000.00) conditioned upon said licensee's faithful conformanceto the provisions of this Ordinance and the faithful accounting by him of all money and property of persons with whom he deals as an auctioneer in the City of Stillwater. Section 4. Fee. Before the Clerk shall issue such license, the applicant shall pay a fee in the amount of $25.00. The Clerk shall then issue a license to conduct auctions in the City of Stillwater for a period of one (1) year. Section 5. Account of Sales. Every auctioneer shall keep an accurate accounting of all property sold by him, the names of persons from whom the same was received and of those to whom it was sold and the price received for the same. Section 6. Penalties for Violation. Any person violating the provisions of this Ordinance shall be guilty of a misdemeanor, and upon conviction thereof be penalized by a fine of not to exceed Three Hundred and no/100 Dollars ($300.00) and ninety (90) days in jail. Section 7. Repeal. Those provisions of Ordinances No. 284 and 286 of the City of Stillwater dealing with licensing of auctioneers are hereby repealed.
