HomeMy WebLinkAbout0471 Ord (Establish Commission to Plan Physical Development of City & Relative to Zoning Plan)342 • • ORDINANCE NO. 471 AN ORDINANCE ESTABLISHING A COMMISSION TO PLAN FOR THE PHYSICAL DEVELOPMENT OF THE CITY OF STILLWATER AND TO MAKE RECOMMENDATIONS RELATIVE TO THE ZONING PLAN OF THE CITY OF STILLWATER. THE CITY COUNCIL OF THE CITY OF STILLWATER DOES ORDAIN: Section 1. Establishment of Commission. The City Planning Commission for the City of Stillwater heretofore created by Resolution sahereby confirmed and established. The Commission shall be the City's planning Section 2. Members and Terms. Subdivision 2.1. Such Planning Commission shall consist of nine members, of all of whom shall be appointed by the City Council. Those members who are presently members of the Commission shall continue in office for the duration of their term, subject to said right of removal by the Council. Subdivision 2.2. These successors shall be appointed for terms of three years. Both the present members and successive appointees shall hold their offices until their successors are appointed and qualified. Vacancies during a term shall be filled by the Council for the unexpired portion of the term. Every appointed member shall, before entering upon the discharge of his duties, take an oath that he will faithfully dischaage the duties of his office. All members shall serve without compensation. Section 3. Organization. Subdivision 3.1. The Commission shall select a may irmantfrom among its appointed ppoinedtiemas besiffor raa termrofnoone year and the Commission re an suc Subdivision 3.2. The Commission shall hold at least one regular meeting each month. It shall adopt rules for the transaction of business and shall keep a record of its resolutions, transactions and findings, which record shall he a public record. On or before January lst of each year, the Commission shall submit to the City Council a report of its work during thelreceding year. Expenditures of the Commission shall be within amounts appropriated for the purpose by the City Council. Section 4. Adoption of a Program of Work. The Commission shall proceed with the preparation and adoption of a resolution of a program of work outlining activities proposed to be undertaken in the exercise of its powers and the performance of its duties. This program of work shall, by resolution, be revised not less than annually and progress on said program shall be included within the annual report to the City Council of its work during the preceding year. Section 5. Comprehensive Citv Planning. It shall be the function and duty of the Planning Commission to review the Comprehensive Plan of the City of Still- water, heretofore adopted, and from time to time recommend amendments or additions to said Plan or section thereof for adoption by the City Council whenever changed conditions or further study by the Commission indicate that such amendments or additions are necessary. Said Comprehensive Plan when completed should include but not be limited to proposed public buildings, sreet st use arrangements and improve density of manta, public utility services, parks, p y9gs population and similar matters relating to the development of the City. It shall be the duty of the Planning Commission to recommend to the City Council reasonable and practical means for putting into effect such plan or section thereof in order that the same will serve as a pattern and guide for the physical, economical and social development of the City. Section 6. Procedure for Amendments. No change shall be made in the Comprehensive Plan or any portion thereof or regulations governing the platting of land after such plans or regulations have been adopted by the City Council until the proposed change has been referred to the Planning Commission for report thereon and a copy of such report has been filed with the Council; and no Ordinance or Resolution establishing any such plans or regulations shall be adopted by the City Council until such ordinance or Resolution has been referred to the (continued on page 343) fa 5 • • n4:i • (Ordinance No. 471 - continued) CV.-c) • planning Commission for a report thereon and a copy of such report has been filed with the Council. Failure of the Planning Commission so to report within forty five days or such longer period or may be designated by the Council after such reference shall be deemed to be approval of the proposed change. Section 7. Zoning Ordinance. The Planning Commission shall review the Zoning Ordinance heretofore adopted by the City of Stillwater and may recommend for adoption to the City Council from time to tine amendments or additions to said Zoning Ordinance whenever changed conditions or studies by the Commission indicate that such amendments or additions are necessary. In addition, the Commission shall exercise such powers given to it by said Zoning Ordinance with respect to administration of requests for variances, and special use permits and for general project review. Section 8. Official Mao. Subdivision 8.1. The Planning Commission, after adoption of a major thoroughfare plan and community facilities plan, may, and upon instructions by the City Council, shall prepare an official map of the platted and unplatted portions of the City and adjoining territory or portions thereof, indicating upon such map the land that is needed for future street purposes and as sites for other necessary public facilities and services within the City. Subdivision 8.2. After such map has been prepared it shall be sub- mitted to the Council which shall thereupon consider such map and may adopt it or any part of it with such amendments as it deems advisable. Before such adoption by the Council, a public hearing shall be held upon the proposal at least ten days after a notice of the time, place and purpose thereof has been published in the official City newspaper. After such map has been adopted by the Council and filed with the Register of Deeds, whenever any street or highway is widened or improved or any new street is opened or interest in land for other public purposes are acquired by the City, it is not required in such proceedings to pay for any building or structure placed without a permit or in violation of conditions of the permit within the limits of the mapped street or outside of any building line that may have been established upon the existing street or within any area thus identified for public purposes. Section 9. List of Recommended Public Works. Each officer, department, board or commission of or in the city whose functions include recommending, preparing plans, for, or constructing public works shall, at least three months before the end of each fiscal year, submit to the Planning Commission a list of the proposed public works recommended by such officer, department, board, or commission for planning, initiation, or construction during the ensuing fiscal year. The Planning Commission shall request from the local school district a similar list of its proposed public works. The Planning Commission shall list and classify all such proposed public works and shall prepare a coordinated program of proposed public works for the ensuing fiscal year. Such program shall be recommended by the Commission to the Council and to such other officers, departments, boards or public bodies as have jurisdiction over the recommending. planning or constructing of such public works. A copy of such recommended program of public works shall be included in the annual report of the Planning Commission provided for in Section 3. Section 10. Compliance with Plan. After a Comprehensive Plan or section thereof has been adopted the city Council, no property within the City shall be acquired or disposed of by a governmental agency, nor shall any capital improve- ment be authorized by a governmental agency until after the Planning Commission has reviewed the proposed acquisition, disposal or capital improvement and reported in writing to that agency, its findings as to compliance of the proposed acquisition, disposal or improvement with the Comprehensive Plan. Failure of the Planning Commission to report on the proposal within 45 days after such a reference, or such other period as may be designated by the City Council shall be deemed to have satisfied the requirements of this subdivision. The City Council may by Resolution, adopted by two-thirds vote dispense with the requirements of this (continued next page) • (Ordinance No. 471 - continued) subdivision when in its judgment it finds that the proposed acquisition or disposal of real property or capital improvement has no relationship to the Comprehensive Plan.
