HomeMy WebLinkAbout0467 Ord (Adopting Fire Prevention Code)'n4 e • ORDINANCE NO. 467 AN ORDINANCE ADOPTING A FIRE PREVENTION CODE PRESCRIBING REGULATIONS GOVERNING CONDITIONS HAZARDOUS TO LIFE AND PROPERTY FROM FIRE AND EXPLOSION AND ESTABLISH- ING PENALTIES FOR VIOLATION. BE IT ORDINANCD BY THE CITY COUNCIL OF THE CITY OF STILLWATER, MINNESOTA: SECTION 1. Adoption of Fire Prevention Code. There is hereby adopted by the said City Council for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion. that certain code known as the Fire Prevention Code, Abbreviated Edition„ recommended by the American Insurance Association, being particularly the 1970 edition thereof and the whole thereof, save and except such portions as are hereinafter deleted, modified or amended (by section 5 of this ordinance), of which code not less than three (3) copies have been and now are filed in the office of the Clerk of the City of Stillwater and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date of which this ordinance shall take effect, the pro- visions thereof shall be controlling within the limits of the City of Stillwater, Minnesota. SECTION 2. Enforcement. The code hereby adopted shall be enforced by the Public Safety Director. SECTION 3. Definition. Wherever the word "Municipality" is used in the code hereby adopted. it shall be held to mean the City of Stillwater. Minnesota. SECTION 4. Establishment of Limits of Districts in which Storage of Explosives and Blasting Agents, Storage of Flammable Liquids in Outside Aboveground Tanks, and Bulk Storage of Liquefied Petroleum Gases is to be Restricted. The limits referred to in Section 53b of the code hereby adopted, in which storage of explosives and blasting agents is prohibited, the limits referred to in Section 94a of the code hereby aopted in which storage of Class I liquids in outside aboveground tanks is prohibited, and the limits referred to in Section 114 of the code hereby adopted, in which bulk storage of liquefied petroleum gas is restricted are hereby established as follows: Commence at a point on the North City Limits line at the intersection with the Easterly Right-of-way of State T. H. No. 95. Thence Southwesterly, Southerly and Westerly along the Easterly Right -of - Way line of State T. H. No. 95 to a point on the centerline of East Alder Street with the Southerly extension of said line; Thence Easterly along the centerline of East Alder Street to the intersection with the centerline of North Lake Street extended; Thence Southerly along the centerline of Nc•th Lake Street to the intersection with the centerline of East Hazel Street; Thence Easterly along the center- line of East Hazel Street to the westerly shore of Lake Saint Croix; Thence Northerly along the shore of Lake Saint Croix to a point where the North City Limits line intersects the shoreline; Thence westerly along the North City Limits line to the point of beginning. All land within the following described area, to wit: From the North line of East Poplar Street, if extended to Lake St. Croix; thence west to the center of North Main Street; Thence Southerly to the North line of East Elm Street; Thence westerly on East Elm Street to the • • 0.)0 e • East Line of North Second Street; Thence Southerly to the North line of Mulberry Street; Thence Westerly on North line of Mulberry Street to the East Line of North Fifth Street; thence Southerly on the East line of North Fifth Street to the North line of West Willard Street;Thence Easterly on the North line of West Willard Street to its junction with Brewery Lot, thence Southerly along West line of Brewery Lot a distance of 290.22 feet; Thence Northeasterly on the South line of the Brewery Lot to the center line of South Main Street and Highway #212, thence Southerly to the Southerly line of the City Limits. thence Easterly to Lake St. Croix, thence Northerly following the Lake Shore to the North line of East Poplar Street. SECTION 5. Amendments Made in the Code Hereby Adopted. All references to said Code to "Fire Chief" or "Chief of the Fire Department" shall be amended to read 'Public Safety Director." Applications for permits required by this Ordinance shall be made to the Public Safety Director, who shall have authority for issuance, cancellation and revocation of such permits as provided in said Code. where the provisions of this Ordinance are in conflict with Ordinances No. 457 and 465 of the City of Stillwater. Ordinances No. 457 and 465 shall prevail. SECTION 6. Modifications. The Public Safety Director shall have power to modify any of the provisions of the code hereby adopted upon application in writing by the owner or lessee, or his duly authorized agent, when there are practical difficulties in the way of carrying out the strict letter of the code, provided that the spirit of the code shall be observed, public safety secured, and substantial justice done. The particulars of such modification when granted or allowed and the decision of the Public Safety Director thereon shall be entered upon the records of the department and a signed copy shall be furnished the applicant and the Clerk of the Municipality. SECTION 7. Appeals. Whenever the Public Safety Director shall disapprove an application or refuse to grant a permit applied, for, or when it is claimed that the pro- visions of the code do not apply or that the true intent and meaning of the code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the Public Safety Director to the City Council within 30 days from the date of the decisions appealed. SECTION 8. Penalties. a. Any person who shall violate any of the provisions of the Code hereby adopted or fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved there- under, or any certificate or permit issued thereunder, and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the City Council or by a court of competent jurisdiction, within the time fixed herein, shall severally for each and every such violation and noncompliance respectively. be guilty of a misdemeanor, punishable by a fine of not more than Three Hundred Dollars ($300.00) or by imprisonment for not more than Ninety (90) days or by both such fine and imprisonment. The impo- sition of one penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to dorrect or remedy such violations or defects within a reasonable time; and when not otherwise specified, each ten days that prohibited conditions are maintained shall constitute a separate offense. • b. The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions. SECTION 9. Repeal of Conflicting Ordinances. Ordinance No. 402 of the City of Stillwater is hereby repealed. SECTION 10. Validity. SECTION 11. Date of Effect.
