• ORDINANCE NO. 466 AN ORDINANCE REGULATING THE USE AND OPERATION OF SNOWMOBILES IN THE CITY OF STILIALATER AND PROVIDING PENALTIES FOR VIOLATIONS THEREOF AND REPEALING ORDINANCE NO. 437. The City Council of the City of Stillwater do ordain as follows: Section 1. Adoption by reference. Minnesota Statutes, Section 84.81 through 84.88 are hereby adopted as a snowmobile regulation ordinance of the City of Stillwater, Washington County, Minnesota, and made a part of this Ordinance by reference as if fully set forth herein. Section 2. Additional Requirements. In additibn to the restrictions and regulations contained in said Minnesota Statutes, the following provisions shall apply within the City of Stillwater: A. Place of Operation. It shall be unlawful to operate a snow- mobile in any of the following places and conditions: (a) Upon private property without written permission of the owner or persons in lawful possession. (b) Upon any school grounds. skating rinks, park property, playgrounds, recreation area or golf course except as and at such times as the proper authorities may authorize or designate. (c) Upon any street or alley except in the right hand traffic lane of that portion ordinarily used for vehicular traffic.. (d) Upon any public sidewalk or walkway. (e) Upon public lakes and rivers in the City of Stillwater within 25 yards of any fisherman or pedestrian. (f) In any other area where the use of a snowmobile may be considered to be hazardous to others. B. Youthful Operators. No parson under 14 years of age shall operate a snowmobile upon any public street or highway within the limits of the City of Stillwater. A person 14 years of age or older, but less than 18 years of age, may operate a snowmobile upon a public street or highway within the city limits of the City of Stillwater only if he has in his immediate po ion a valid snowmobile safety certificate issued by the Commissioner of the Department of Natural Resources. C. Hours of Operation. Except as is specificially authorized by Minnesota Statutes. Section 84.81 through 84.88. no persons shall operate a snowmobile within the city limits of the City of Stillwater, whether upon private or public property. after the hour of 11:00 o'clock P. M. or before the hour of 7:00 o'clock A. M. on Sunday through Thursday and after the hour of 12:00 o'clock midnight or before the hour of 7:00 o'clock A. M. on Friday and Saturday except in the following cases: a. In the case of an emergency when and where snow on a roadway renders travel by automobile impractical. b. In the case of emergency when requested by an officer of the police department or fire department of the City of Stillwater. D. Manner of Operation. Snowmobiles shall at all uncontrolled intersections yield the right-of-way to all other traffic which is approaching such intersections so closely as to constitute an immediate hazard. Snowmobiles shall be operated in single file except when passing. • nnn • Section 3. Repeal. Ordinance No. 437 of the City of Stillwater and all other ordinances or sections of ordinances inconsistent hereto are hereby repealed. Section 4. This ordinance shall take effect from and after its passage and publication in accordance with the provisions of the Charter of the City of Stillwater.
