ORDINANCE NO. 458
AN. ORDINANCE ADOPTING THE MINNESOTA PLUMBING CODE OF JUNE, 1969 AS THE
PLUMBING CODE OF THE CITY OF STILLWATER BY REFERENCE.
Section 1. Adoption of Minnesota Plumbing Code. Except as hereinafter
specifically amended, the City Council of the City of Stillwater, for the
purpose of prescribing regulations governing the installation, maintenance
and repair of plumbing systems in the City of SLillwater, hereby adopt that
certain code known as the Minnesota Plumbing Code, including appendixes A
thru E, filed with the Secretary of State, Department of Administration of
the State of Minnesota, June, 1969, by the Minnesota State Board of Health,
of which Code one copy there of marked as the official copy has been filed
for the use and examination by the public in the office of the City Clerk
of the City of Stillwater. Said Code is hereby adbpted & incorporated as
fully as if set out at length herein and from the date on which this Ordin-
ance shall take effect the provisions thereof shall be controlling within the
limits of the City of Stillwater, Washington County, Minnesota.
Section 2. Amendments to State Code. The following provisions of the
Minnesota Plumbing Code are hereby amended as follows:
1. MHD 122 (g) is amended to read as follows:
Where either a public sewer or water supply system or both are not
available,an individual water supply or sewage disposal system, or
both, may be installed if approved by the City Council. Such
approval shall be granted only if extensions of city facilities
are not reasonably practical. If authority for such installation
of individual facilities is granted, the installation shall conform
to standards determined by the City.
2. MUD 123 (d) (2) entitled "WATER SERVICE PIPE" is amended by deleting
paragraphs (bb), (ee), (gg), and (ii).
3. MHD 123 (d) (4) entitled "Building Sewers" is amended by deleting
paragraphs (cc) and (gg).
4. MHD 130 (d) (1) entitled "WATER SUPPLY CONTROL VALVES" is amended
by amending paragraph (gg) to read as follows:
(gg) Valves for Sill Cocks: All sill cocks and wall hydrants shall
be separately controlled by a valve inside the building unless
frost proof sill cocks and wall hydrants are used.
5. MHD 131 (a) (5) is amended to read as follows:
(5) PROVISION FOR FUTURE FIXTURES. When provision is made for future
installation of fixtures, those provided for shall be considered
in determining the required sizes of drain and vent pipes. "Where
waste outlets for future fixtures are provided, the vents for
same shall be connected to the stack or vent stack and the waste
openings plugged or capped." "In the basement of every building,
if no fixtures are being installed, there shall be provided at
least one two (2) inch vent properly connected to the main vent
stack for any future fixtures." ,in the dwellings a waste open-
ing, properly vented, must be provided for laundry facilities.
6. MHD 132 (f) entitled "WET VENTING" is amended by adding a new para-
graph to read as follows:
(4) A 2" vent from a water closet drain may br a wet vent with the
drainage of a maximum of Two (2) fixtures units provided that
the fixture is on the same floor and a distance from the trap
to vent conforms to table 132 (1) (1).

7. MHD 134 (d), the first paragraph is amended to read:
(d) METHOD OF TESTING. The plumbing system shall be subjected to an
air or water pressure test and to a final inspection in such a
manner as will disclose all leaks and imperfections in the work.
The tests shall be applied to the plumbing drainage system in
its entirety or in sections. Sections which are found satisfac-
tory need not be retested after completion of the entire system
unless considered necessary by the proper administrative authority,
Section 3. Enforcement. The Building Inspector of the City of Stillwater
shall enforce the Code hereby adopted. Wherever the designation "administrative
authority" is used in said Code, it shall be held to mean the City Council of the
City of Stillwater and its agents and employees, including but not limited to the
Building Inspector of said City.
Section 4. Permits. No person shall proceed with installation or repair of
any plumbing system in the City of Stillwater without obtaining from the Building
Inspector of the City of Stillwater a permit for the same. Permit fees shall be
computed on the basis of the actual cost to the owner of the proposed work. The
person making application for a plumbing permit shall be responsible for correctly
reporting the actual cost to the owner. Fees for plumbing permits shall be as
follows:
1. For work up to and including $100.00, the fee shall be $2.00.
2. For work costing in excess of $100.00 and up to $50,000.00, the
fee shall be $2.00 plus $.75 for each $100.00 of cost, or fraction
thereof, in excess of $100.00.
3. For work costing in excess of $50,000.00 up to and including
$100,000.00, the fee shall be $376.25 plus $.50 for each $100.00
of cost, or fraction thereof, in excess of $50,000.00.
4. For work costing in excess of $100,000.00, the fee shall be $626.25,
plus $.25 for each $100.00 of cost, or fraction thereof, in excess
of $100,000.00
If the final cost to the owner of the proposed plumbing work cannot be d4tarmined
at the time of application, an initial permit for a reasonable estimated cost shall
be issued. Upon final determination of the cost to the owner, the permit fee shall
be corrected to reflect the actual cost and an additional fee shall be paid or a
refund made.
Application for such permits shall be made on such form and containing such
information as shall be required by the Building Inspector.
Section 5. Appeals. Whenever the Building Inspector of the City of
Stillwater shall disapprove an application or refuse to grant a permit applied
for or when it is claimed that the provisions in the Code do not apply or that
the true intent and meaning of the Code have been misconstrued or wrongfully
interpreted, the applicant may appeal from the decision of the City Building
Inspector to the City Council of the City of Stillwater within 30 days from the
date of the decision of appeal.
Section 6. Plumber's License Required. No person shall engage in or work
at a business of a master plumber in the City of Stillwater unless licensed to do
so by holding a State of Minnesota Master Plumber's License.
Section. Penalties. Any person who shall violate any of the provisions
of the Code hereby adopted or fail to comply therewith, or who shall violate or
fail to comply with any order made thereunder, or who shall build in violation
of any detailed statement of specifications or plans submitted and approved there-
under, or any certificate or permit issued thereunder, and from which no appeal

has been taken, or who shall fail to comply with such an order as affirmed or
modified by the City Council or by a court of competent jurisdiction, within
the time fixed herein, shall severally for each and every such violation and
non-compliance respectively, be guilty of a misdemeanor, punishable by a fine
of not more than $300 or by imprisonment for not more than 90 days, or by both
such fine and imprisonment. The imposition of one penalty for any violation
shall not excuse the violation or permit it to continue, and all such persons
shall be required to correct or remedy such violations or defects within a
reasonable time. and when not otherwise specified, each day that prohibited
conditions are maintained shall constitute a separate offense.
The application of the above penalty shall not be held to prevent the
enforced removal of prohibited conditions.
Section 8. Repeal of Conflicting Ordinances. Ordinance No. 341 and all
other former ordinances or parts thereof conflicting or inconsistent with the
provisions of this ordinance or of the code hereby adopted are hereby repealed.
Section 9. Date of Effect. This ordinance shall be in full force and
effect from and after its passage and publication according to law.
Adopted by the City Council of the City of Stillwater this 8th
day of September, 1970.
