HomeMy WebLinkAbout0453 Ord (Repealing Sections 89-117, Elections, & Amending)312 • I • ORDINANCE NO. 453 AN ORDINANCE REPEALING SECTIONS 89 THROUGH 117 OF ARTICLE IV TITLED "ELECTIONS" OF THE STILLWATER CITY CHARTER AND AMENDING SAID ARTICLE IV AS SET FORTH HEREIN. WHEREAS The Charter Commission of the City of Stillwater has recommended the Charter amendment hereafter set forth to the City Council for passage, and WHEREAS Pursuant to the Provisions of Chapter 33 of the Extra Session Laws, 1967, the Common Council of the City of Stillwater has held a public hearing on the said recommendation after published notice as provided for therein, NOW,THEREFORE, THE COMMON COUNCIL OF THE CITY OF STILLWATER DO ORDAIN: Section 1. That Sections 89 through 117, including all of the sub- divisions thereunder, of Article IV of the Stillwater, Minnesota City Charter be and the same are hereby repealed. Section 2. Article IV entitled "Elections" of the City Charter for Stillwater, Minnesota, shalt be amended to read as follows: ARTICLE IV. ELECTIONS Section 4.01. Nominations by Petition. All elective officers provided for by this Charter shalt be nominated by Petition. The name of any elector of the City shall be printed upon the ballot as a candidate for an office whenever a petition signed by twenty (20) registered voters of the City of Stillwater has been filed with the City Clerk in his behalf not more than forty (40) nor less than thirty (30) days before the primary election. No elector shall sign petitions for more candidates for any office than the number of persons to be chosen for that office at the section; should he do so, his signature shall be void as to the petition or petitions last filed. Section 4.02. The signature to the Nomination Petition need not all be appended to one paper, but to each separate paper shall be attached an affidavit of the circulator thereof stating the number' of such signers of such paper and that each signature appended thereto was made in his presence and is the genuine signature of the person whose name it purports to be. With such signature shall be stated the residence of the signer, giving the street and number or other description sufficient to identify the same. The form of the Nomination Petition shall be substantially as follows: Nomination Petition We, the undersigned electors of the City of Stillwater hereby nominate John Doe whose residence is for the office of Councilman, to be voted for at the election to be held on the day of , 19 ; and we individually certify that we are qualified electors and that we have not signed more nomination petitions of candidates for this office than there are persons to be elected thereto. Name Street and Number , being duly sworn, deposes and says that he is the circulator of the foregoing petition paper containing _ signatures and that the signatures appended thereto were made in his presence and are the signatures of the persons whose names they purport to be. I hereby indicate my willingness to accept the office of if duly elected thereto. Section 4.03. Expenditures, Limits. Minnesota Statutes 211.06 shall govern the expenditures of candidates in campaigns for nomination and election to municipal office for the City of Stillwater, subject to the limitation that no such candidate or hie personal campaign committee shall expend more than $500.00 in the aggregate in a campaign for nomination and election to municipal office for the City of Stillwater. Section 4.04. Procedure at elections. Subject to the provisions of this Charter and applicable State laws, the Council may by ordinance further regulate the conduct of municipal elections. Except as otherwise provided in this Charter or in ordinance adopted pursuant thereto, the general laws of the State of Minnesota pertaining to elections shall apply to municipal elections. Section 3. The amendment above set forth shall become effective ninety (90) days after publication of said Ordinance, unless within sixty (60) days after the publication of said Order a petition for a referendum is filed with the City Clerk pursuant to said Chapter 33 of the 1967 Extra Session Laws.
