HomeMy WebLinkAbout0437 Ord (Regulating Use & Operation of Snowmobiles)• ORDINANCE N0. 437 AN ORDINANCE REGULATING THE USE AND OPERATION OF SNOWMOBILES IN THE CITY OF STILLWATER AND PROVIDING PENALTIES FOR VIOLATIONS THEREOF. The City Council of the City of Stillwater, Washington County, Minnesota, do ordain as follows: Section 1. Adoption by reference. Minnesota Statutes, 1967, Sections 84.81 through 84.88 are hereby adopted as a snowmobile regulation ordinance of the City of Stillwater, Washington County, Minnesota, and made a part of this Ordinance by reference as if fully set forth herein. Section 2. Additional Requirements. In addition to the restrictions and regulations contained in said Minnesota Statutes, the following provi- sions shall apply within the City of Stillwater: A. Place of Operation. It shall be unlawful to operate a snowmobile in any of the following places and conditions: (a) Upon private property without written permission of the owner or persons in lawful possession. (b) Upon any school grounds, park property, playgrounds, recrea- tion area or golf course except as and at such times as the proper authori- ties may authorize or designate. (c) Upon any street or alley except that portion ordinarily used for vehicular traffic. (d) Upon any public sidewalk or walkway. (e) Upon public lakes and rivers in the City of Stillwater with- in 25 yards of any fisherman or pedestrian. (f) In any other area where the use of a snowmobile may be con- sidered to be hazardous to others. B. Manner of operation. It shall be unlawful to operate a snowmobile so as to create a loud, unnecessary or unusual noise so as to disturb or inter- fere with the peace and quiet of other persons. C. Equipment required. It shall be unlawful to operate a snowmobile in the City of Stillwater without the following equipment: (a) Mufflers. Every snowmobile shall at all times be equipped with a muffler in good working order to prevent excessive or unusual noise. No person shall use a muffler cut-out, by-pass or any similar device upon a snowmobile. The exhaust system shall not emit or produce sharp popping or. crackling sounds. Exception to this section is permissible for special races or tournaments only when approved and authorized by the City Council upon re- quest at the regular monthly meetings. (b) A safety or dead man's throttle which automatically cuts the fuel supply to the engine whenever the operator releases pressure on the throttle. Section 3. Hours of operation. No persons shall operate a snowmobile within the City of Stillwater upon public property or upon private property after the hour of 12:00 o'clock midnight or before one-half hour before sun- rise on any day except: A. In the case of an emergency when and where snow on a roadway renders travel by automobile impractical. B. In the case of emergency when requested by an officer of the police department or fire department of the City of Stillwater. Isz en en et 295 • • Section 4. Penalty. Any person who shall do any act forbidden or fail to perform any act required in this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not to exceed $100.00 or by imprisonment in the county jail for not more than ninety days. Section 5. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication according to Law.
