HomeMy WebLinkAbout0426 Ord (Establish Procedures for Collection & Disposal of Garbage & Rubbish)278 r • • ORDINANCE NO. 426 ,AN ORDINANCE ESTABLISHING PROCEDURES FOR THE COLLECTION AND DISPOSAL OF GARBAGE AND RUBBISH WITHIN THE LIMITS OF THE CITY OF STILLWATER AND PROVIDING FOR THE IMPOSITION AND COLLECTION OF FEES BY THE CITY FOR THE COLLECTION AND DISPOSAL OF GARBAGE AND RUBBISH. THE CITY COUNCIL OF THE CITY OF STILLWATER DOES ORDAIN: SECTION 1. Definition. For the prupose of this ordinance, garbage and rubbish are defined to include refuse of all kinds, both organice and inorganice, that accumulates in the ordinary operation of a household, including grass trimmings, ashes, tree branches, leaves and other refuse small enough to go into a 30 gallon garbage can, but specifically excluding rocks and dirt. SECTION 2. Purpose. The purpose of this ordinance is to maintain and protect the public health and sanitation by the removal of garbage and rubbish from residences in the City of Stillwater and to prevent the unregulated and unrestricted hauling of garbage and rubbish by other means than through the garbage and rubbish collection system established by this ordinance so as to eliminate the dispersal of garbage and rubbish along the streets, roads and other properties in and near the City of Stillwater. SECTION 3. Collection by the City. All garbage and rubbish accumulated in residences in the City shall be collected, conveyed and disposed of by -the City or by its duly authorized contractor. No person shall collect or dispose of any garbage or rubbish accumulated on residential premises of the City except the City or its designated contractor. SECTION 4. Garbage and rubbish containers Garbage and rubbish containers shall be equipped with suitable handles and tight -fitting covers. and shall be watertight. Such containers shall have a capacity of not more than 30 gallons. SECTION 5. Storage of containers. Except on days scheduled for collec- tion, garbage and rubbish containers shall be stored out of view of the public street and on the day of collection shall be made readily accessible to the collector. SECTION 6. Collection Practices. (a) Frequency of collection. Garbage and rubbish shall be collected at least once each week according to a schedule to be determined and notice given by the City from time to time. (b) Limits on quantity. There shall be no limit as to quantity so long as it is placed in appropriate containers. SECTION 7. Storage of garbage and rubbish. No person shall place any garbage or rubbish in any street, alley or other public place or upon any private property, whether owned by such person or not, within the limits of the City of Stillwater, unless it is in proper containers for collection, nor shall any person throw or deposit any garbage or rubbish in any stream or other body of water. Any unauthorized accumulation of garbage or rubbish on any premises is hereby declared to be a nuisance and is prohibited. No person shall cast, place or deposit anywhere within the City any garbage or rubbish in such a manner that it may be carried or deposited by the elements upon any street, sidewalk, alley, sewer, parkway or other public place or into any occupied premises within the City. 0.44t'''9J- SECTION 8. Fees, A charge of $2.20 per month shall be levied upon A,i-. — K.t,,/each occupied residential structure in the City of Stillwater. The City ✓i. 1rSaJ may levy such additional charge for residential structures containing two '57$ or more dwelling units as is deemed by the City to be commensurate with the volume of rubbish and degree of difficulty of collection involved for each individual multiple dwelling unit, provided, however, that such charge shall in no event exceed $2.20 per unit of such multiple dwelling. It is further provided that any residential unit in which not more than two persons reside iszto 279 aa and in which the head of the household or his spouse is more than 65 years of"'"� "��•/ age, the head of the household may so certify to the City Clerk and said collection fee on subsequent billings days shall thereafter be reduced to $1.00 monthly. SECTION 9. Financing. The cost of operation of the garbage and rubbish collection system herein established shall be paid from a separate fund here established for that purpose and known as the Garbage and Rubbish Collection Fund. A11 receipts derived from fees herein established shall be deposited in said fund and said fund shall be used exclusively for the purpose of paying the cost of the maintenance and operation of the garbage and rubbish collection system, including but not limited to the contracting for services, purchase of equipment and administrative expenses. In addition, the Council shall each year levy :such ad valorem tax as it may deem necessary to finance any deficiency in the projected cost of operation of the garbage and rubbish collection service for the following year. SECTION 10. Collection of charges. Monthly fees shall be collected by the City Clerk and shall be due and payable quarterly in advance. Such charge Shall be Placed on the account of the owner or occupier of the premises so served, or both, and when paid, shall be deposited in the garbage and rubbish collection fund. All accounts shall be delinquent if not paid within thirty days after the statement. is rendered. Such charges shall be a charge against the owner, lessee or occupier of any residentialunit and any such charge properly billed and unpaid maybe collected in a civil action in a court of competent jurisdiction or at the discretion of the City Council may be certified to the County Auditor with taxes against the property so served. SECTION. 11. Penalty. Any person, firm or corporation violating any provision of :.this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not more than $100.00 or imprisonment in the County jail for not more than ninety (90) days. SECTION 12. Effective Date. This ordinance shall be in full force and effect on July 1, 1968 and from and after its passage and publication according to law and the Charter of the City of Stillwater. SECTION 13. Repeal. All ordinances or sections or ordinances inconsistent herewith are hereby repealed.
