HomeMy WebLinkAbout2024-015 (Granting Parking Stall Reservation to Rivertown Transportation, LLC dba Stillwater Trolley for Operation of Trolley Tours in 2024-Rescinding Resolution 2021-021)City of Stillwater Washington County, Minnesota RESOLUTION 2024-015 RESOLUTION GRANTING PARKING STALL RESERVATION TO RIVERTOWN TRANSPORTATION, LLC DBA STILLWATER TROLLEY FOR THE OPERATION OF TROLLEY TOURS IN 2024 AND RESCINDING RESOLUTION 2021-021 WHEREAS, Rivertown Transportation, LLC dba Stillwater Trolley has made a request to renew permission to reserve two parking stall on Nelson Street to operate, a trolley tour, on City roadways downtown; and WHEREAS, the City Council of the City of Stillwater approved Resolution 2021-021 on February 2, 2021 for permission to operate the trolley tour business in 2021, 2022, and 2023; and WHEREAS, the business will operate in substantially the same manner in 2024, NOW THEREFORE BE IT RESOLVED that the Stillwater City Council hereby grants a license to Rivertown Transportation, LLC dba Stillwater Trolley to reserve two parking stalls to operate a trolley tour on City roadways subject to the following conditions: 1. Review and approval by the Police Department and the Public Works Department. 2. This resolution is valid through December 31 of the year issued. Any new permission requires a new application from the City Clerk. 3. No approval will be granted without proof of general liability insurance in the minimum amount of $1,500,000 per occurrence. 4. Operating restrictions and conditions: a. No tour vehicle may be operated upon a publicsidewalk. b. No tour vehicle may use any public street orother public property as a waiting area unless such area is a legal motor vehicle parking area. c. Public safety is paramount in the operation of any multiple -purpose tour cycle. Consequently, each multiple -purpose tour cycle must be equipped with the following: i. Front and rear turn signals ii. Head lights iii. Taillights iv. Any other equipment required to comply with applicable federal and state laws d. All multi -purpose tour vehicles are, at all reasonable times, subject to inspection by the City of Stillwater. e. Tour vehicle operators must have in their possession a valid driver's license while in control of any multiple -purpose tour vehicle, and shall operate the tour vehicle in compliance with all applicable federal, state, and local traffic laws, and in a manner so as to assure the safety of persons and property. f. All tour vehicle operators must obey and comply with any lawful order or direction of any police officer, traffic control agent, or regulatory services inspector. g. The City reserves the right to alter or limit tour vehicle operations to specified routes and streets if required for public safety reasons. h. If Mulberry Point should be limited to pedestrian traffic only, the City reserves the right to eliminate the tour vehicle access to this area. i. The City reserves the right to require that any idle tour vehicle be parked in a specified location while idling or waiting for customers. j. Upon receipt of any substantiated complaints, as determined by the City Administrator, the resolution will be placed on the next available City Council agenda for review. 5. During periods of flooding, tour vehicles will not be allowed to operate on Water Street. 6. The rate for the reserved on -street parking space on Water Street is $9 per day. The fee for 2024 will be $1,512. This must be paid by April 30th. Adopted by the Stillwater City Council this 6th day of February, 2024.
