RESOLUTION 2023-176
APPROVING A DEMOLITION PERMIT FOR DEMOLITION OF A PRE-1946
STRUCTURE FOR 12125 80t" STREET NORTH (CASE NUMBER CD2023-04)
WHEREAS, the City of Stillwater received a demolition permit application from
Timberland Partners ("Applicant"), for Property owned by Kelsey and Logan Martin located at
12125 80t" Street North, legally described as in Exhibit A (the "Property"), regarding the
demolition of a single-family home costructe in 1908; and
WHEREAS, the demolition is to facilitate the redevelopment of the parcel which is part
of a multi -property proposed development; and
WHEREAS, the primary reason constituting the demolition is the proposed site
development's conformance to established districted adopted guidelines; and
WHEREAS, on December 13, 2023, the Heritage Preservation Commission for the
City of Stillwater held a public hearing, received comment, considered the request, and
denied the demolition request; and
WHEREAS, on December 19, 2023, the City Council for the City of Stillwater
considered the request for demolition of a pre-1946 structure.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Stillwater
hereby approves the demolition. The approval of the demolition is based on the following
findings:
FINDINGS
Demolition of the resource has been evaluated against and, on balance, has
been found supportive of the goals and policies of the comprehensive plan,
especially those dealing with the health, safety and welfare of the community,
and relevant area plans, taking into account factors such as: the merits of
proposed new development on the site, the merits of preserving the resource,
and the area's desired character, including the planned/forecasted
redevelopment as medium density residential.
2. Demolition of the existing structure supports the Site Development's
conformance to the established districted adopted guidelines, particularly the
guidance of medium density development through a Zoning Map Amendment
to CTHR: Cove Townhouse Residential, consistent with the Comprehensive
Plan guidance as medium density residential.
3. The Property is not identified as a historic or cultural resource in the
Comprehensive Plan.
4, The Property is not in a Design Review District.
5. The Property is not listed in the City's Heirloom Homes and Landmark Sites
list.
6. There is not an existing or planned City accepted neighborhood study or
property architectural inventory.
7. A comprehensive review of cultural resources resulted in little significance for
the structure/parcel.
8. Denial of a demolition permit would impact the reasonable use and rate of
return of the Property in order to be consistent with the Comprehensive Plan.
CONDITIONS OF APPROVAL
1. Plans shall be consistent with those included in this report.
2. All minor modifications to the plans shall be approved in advance by the
Community Development Department. All major modifications shall be
approved in advance by the HPC. Determination of the distinction between
"major" and "minor" is defined in the Zoning Ordinance.
