HomeMy WebLinkAboutHPC Resolution 2023-34 APPROVING A DEMOLITION PERMIT FOR DEMOLITION OF A PRE-1946 STRUCTURE FOR 1509 PINE STREET WESTCity of Stillwater Washington County, Minnesota RESOLUTION HPC 2023-34 APPROVING A DEMOLITION PERMIT FOR DEMOLITION OF A PRE-1946 STRUCTURE FOR 1509 PINE STREET WEST WHEREAS, the City of Stillwater received a demolition permit application from Martha Button ("Applicant"), located 1509 Pine Street West, legally described as in Exhibit A (the "Property"), regarding the demolition of a single-family home built in 1890; and WHEREAS, the demolition is to facilitate the removal of single-family dwelling; and WHEREAS, the primary reason constituting the demolition is due to the existing hazardous and deteriorated condition of the foundation and floor joist systems and lack of cultural significance; and WHEREAS, on the October 18, 2023, the Heritage Preservation Commission for the City of Stillwater considered the request. NOW, THEREFORE, BE IT RESOLVED, that the Heritage Preservation Commission of the City of Stillwater hereby approves the demolition. The approval of the demolition is based on the following findings: FINDINGS The proposed demolition meets the requirements of the Stillwater Demolition Ordinance, Sec. 31-215: 1. Demolition of the resource has been evaluated against and, on balance, has been found supportive of the goals and policies of the comprehensive plan, especially those dealing with the health, safety and welfare of the community, and relevant area plans, taking into account factors such as: the merits of proposed new development on the site, the merits of preserving the resource, and the area's desired character; and 2. Denial of a demolition permit would effectively deprive the owner of all reasonable use of the site as the owner would be unable to convert the property to a compatible and conforming use in its present condition. There is a situation substantially inadequate to meet the applicant's needs because of specific health and safety issues. CONDITIONS OF APPROVAL 1. Plans shall be consistent with those included in this report. 2. All minor modifications to the plans shall be approved in advance by the Community Development Department. All major modifications shall be approved in advance by the HPC. Determination of the distinction between "major" and "minor" is defined in the Zoning Ordinance.
