INDIVIDUALS & DELEGA TIONS
Joseph Manheim -Request for four-plex construction Mr. Manheim appeared before the Council regarding their denial of his request for a special use to construct a four-plex in a two-family zone.
The lot grades and size were discussed and it was brought out that the house was previously a three-p 1 ex.
On motion by Councilmember Bodlovick, seconded by Councilmember Kimble, the Council set a public hearing to re-hear the request for a special use permit by Joseph Monheim, to construct a four-plex in a two-family zone, for July 3, 19B4, at 7:30 p.m. All in favor.
PETITIONS
Vacation of Portion of Broadway Street Sondra Gozzi sent a petition to the Council, requesting the vacation of a portion of Broadway Street thatis located in front of Vittorio's property.
On motion by Councilmember Kimble, seconded by Councilmember Farrell, the Council set a public hearing for con sideration of the vacation of a portion of Broadway Street, for July 3, 1984, at 7:30 p.rn. All in favor.

Public Works
On motion by Councilmember Kinble, seconded by Councilmember Bodlovick, the Council
moved to have a backwater valve installed at 206 Deerpath, in order to remedy a long -
existing problem. All in Favor.
Ken Meister will work with Jack Shelton to come up with a solution to the drainage
problem at the Stillwater Golf Course, that is causing the water to drain into the
basement at 1903 N. 5th Street.
Dave Magnuson is to meet with Jack Shelton regarding regulations and procedures for
assuring that contractors repair streets to their original condition after digging
them up.
The "SLOW CHILDREN PLAYING" signs on Deerpath will be changed to "SLOW" signs.
Fire Department
On motion by Councilmember Farrell, seconded by Councilmember Bodlovick, the Council
authorized two members of the fire department to attend the National Fire Academy in
1984. All in favor. Chief Chial explained that this academy will only cost the city
$11/day per person as the balance is federally funded.
Consulting Engineer
Linson and Wildwood Pines Improvements - On motion by Councilmember Bodlovick, seconded
by Councilmember Kimble, the Council moved to extend the construction time to July 30,
1984, for Linson and Wildwood Pines Improvements, per request by Crossings, Inc. All
in favor.
Lowell Park Rip -Rap (L.I.210-2) - On motion by Councilmember Kimble, seconded by Councilmember
Bodlovick, the Council granted an extension, exact length to be determined upon lowering
of water level, to Crossings, Inc. for rip -rapping of Lowell Park (L.I.210-2). All in
favor.

Request for Payment - Merrill Lynch - On motion by Councilmember Kimble, seconded by
Councilmember MacDonald, the resolution was introduced, "RESOLUTION AUTHORIZING PAYMENG
OF COUPON NO. 21 FROM BOND NO. 203". Ayes-5 Nays-0 (Resolution 97328)
Ice Arena Part Time Employees - On motion by Councilmember Kimble, seconded by Councilmember
MacDonald, the resolution was introduced, "RESOLUTION APPROVING PART TIME EMPLOYMENT"

City Coordinator
Property Conveyance - On motion by Councilmember Kimble, seconded by Councilmember MacDonald,
the Council moved to approve conveyance of part of Ferry Falls Road adjacent to Oscal Kress
property, to the Kresses for a fee of $100 over expenses involved. All in favor.
Emergency Feeder System - On motion by Councilmember Kimble, seconded by Councilmember
Bodlovick, the Council moved to pay the city share of $500 for an Emergency Feeder System
for Police and Fire back-up communications. This system is in conjunction with Washington
County. All in favor.
On motion by Councilmember Bodlovick, seconded by Councilmember MacDonald, the meeting

0n motion by Councilmember Bodlovick, seconded by Councilmember Farrell, the minutes of
the following meetings were approved. All in favor.

PUBLIC HEARINGS
Inrovement Hearing for Local Improvement #218 - W. Orleans Street Improvements
this is the day and time set for the public hearing on Local Improvement #218, construction
of W. Orleans Street from County Road #5 to Washington Avenue. Notice of this public
hearing was published in the Stillwater Gazette and mailed to property owners according
to law.
Ken Meister, Consulting Engineer, reviewed the project and total costs, along with cost
breakdowns and approximate assessment figures. These costs were as presented in the
feasibility study. Jim Forseth, representing owners of the Stillwater Industrial Park
land, stated that he wished to be on record as opposing additional assessments on this
land. This land was assessed when Washington Avenue was extended (approx. $200,000)
and adding these assessments is not benefiting the sale of the property. There is a
lot of property zoned Industrial and the demand for this property is not there at the
present time. The proposed improvement only opens up more land for Industrial use and
the question arises regarding where the market is for this land.
Robert Post asked why the assessments on the north side of Orleans Street were $2,000 per
acre and the south will be only assessed $100/acre. Ken Meister explained that there
will be assessments in the future for storm sewer improvements on the south side of
Orleans Street that will bring the total close to what the north side paid.
Mayor Peterson closed the hearing.

Vacation of North Third Street
aid the day and t me set ar the public hearing on the vacation of all or a portion
of North Third Street, between Aspen Street and Wilkins Street. Notice of the hearing
was published in the Stillwater Gazette and mailed to adjacent property owners.
Mr. Lockyear, originator of the petition, stated that he wishes to withdraw his request
and request that he be able to put a private driveway on the North Third Street right-
of-way, to the south of Wilkins Street. He also stated that he would like to request

assume responsibility for maintenance and realizes that it would be subject to easements.
Dave Magnuson stated that the ordinance does not address the issue of required frontage
on a public street.
Discussion followed regarding drainage in the area, access for emergency vehicles and
responsibility for the driveway maintenance.
Dorothy Spaise asked how this would affect property ovmers on the other
side ide of questioning

Street. She is going to sell two lots (as one parcel) across the street
access. She was told that this parcel would have access from Aspen Street.

Mike Sobieski, prospective buyer of the parcel on the corner of Wilkins and North Third,
asked if a separate hearing was to be held for the driveway issue, as the hearing was
called for the street vacation. Dave Magnuson stated that the right-of-way issue is an
administrative matter and does not have to be considered under public hearing. Sobieski
stated that he is opposed to the driveway going on the street right-of-way, as this
would adversely affect his property. He questioned maintenance, sewer, water and fire
vehicle access to this parcel.
After discussion, it was moved by Councilmember Kimble, seconded by Councilmember Farrell,
to continue this matter until the July 3, 1984 meeting, so that the property in question
can be reviewed closer by the Council. All in favor.
Case No. 542 - Grant Ranum, 522 W. Hickory Street, Variance
Per request of Mr. Ranum, this hearing is continued until July 3, 1984 at 7:30 p.m.
Case No. 543 - Fredric Schmidt, 518 North 3rd Street, Variance
This is the day and time set for the public hearing on Case No. 543, submitted by Fredric
Schmidt, 518 North 3rd Street, for a variance to erect an eight foot privacy fence one inch
off of the property line to guarantee privacy to the residents. Fence to be of no -maintenance
material. Notice of hearing was published in the Stillwater Gazette and mailed to property
owners within 300'.
It was noted that the Planning Commission did not hear this case, as Mr. Schmidt did not appeal
at the June II, 1984 meeting. Mr. Schmidt stated that he did not receive his meeting notice
until June 12.
0n motion by Councilmember Bodlovick, seconded by Councilmember Kimble, this hearing is
continued until July 3, 1984, at 7:30 p.m. All in favor.
Case No. 544 - David Eichten, 517 W. Moore Street, Variance
This is the day and time set for the public hearing on Case No. 544, submitted by David
Eichten, 517 W. Moore Street, for a 3' variance so that the drip line on a detached garage
can be on the property line. Notice of the hearing was published in the Stillwater Gazette
and mailed to property owners within 300'.
Mr. Eichten explained that he is changing his request from a 3' variance to a 1/e variance.
It was explained that the property owners that objected previously to his plans, do agree
with the change to 1:' variance.
Councilmember Farrell explained that he feels that this request should be denied because
there is no sign of hardship in this case. Mr. Eichten has a lot that is more than adequate
to comply with the zoning regulations.
Mayor Peterson closed the hearing.
On motion by Councilmember Farrell, seconded by Councilmember Kimble, the Council moved to
deny the request for variance as submitted by David Eichten as there is no hardship shown
in this case. Ayes; Councilmembers Farrell, Kimble and MacDonald. Nays; Mayor Peterson.
Abstain: Councilmember Bodlovick. Motion carried.
Case No. 545 - Delwin Peterson, 1303 S. 4th Street, Variance
This is the day and time set for the public hearing on Case No. 545, submitted by Delwin
Peterson, 1301 W. Orleans Street, for a minor subdivision to split a 1.3 acre lot with
existing house, into three lots. Included is a request for two lots for duplexes with
"a. zero lot line. Notice of this public hearing was published in the Stillwater Gazette
and mailed to property owners within 300'.
Mr. Peterson presented his plans to the Council. The hardship of the present position
of the garage at this residence, requiring backing onto 4th Street for access, was presented.
With his proposed plan, he would have access to the garage on Marsh Street, with his drive
being directly opposite a drive on the opposite side of the street.
Mayor Peterson closed the hearing.
On motion by Councilmember Bodlovick, seconded by Councilmember Farrell, the Council moved
to approve the variance requested in Case No. 545, by Delwin Peterson. All in favor.
Case No. 546 - Norton Tucker, 1301 W. Orleans Street, Minor Subdivision
This is the day and time set for the public hearing on Case No. 546, submitted by Norton
Tucker, 1301 W. Orleans Street, for a minor subdivision to split a 1.3 acre lot with
existing house, into three lots. Included is a request for two lots for duplexes with
zero lot line. Notice of this public hearing was published in the Stillwater Gazette and
mailed to property owners within 300'.
Mr. Tucker explained that he wishes to withdraw the request for zero lot lines, but still
wishes the subdivision. After much discussion regarding the question of utility construction,
land required for a cul-de-sac turn -around in the area, and conformance with the other
residences in the neighborhood, it was moved by Councilmember Farrell, seconded by Council -
member Kimble to have this subdivision re -engineered and reconsidered by the Planning Commission,
followed by reconsideration by the Council. All in favor.

moved to remove the parking meter located near the entrance to Del's Lawn & Log on South
Third Street. All in favor.
