The meeting was called to order by Mayor Peterson at 7:30 p.m. Members Present: Councilmembers Bodlovick, Farrell, MacDonald and Mayor Peterson Members Absent: Councilmember Kimble Others Present: City Coordinator, Kriesel City Clerk, Kirtz City Attorney, Magnuson Zoning Administrator, Zepper Planning Commission Chairperson, Vania Citizens: Mary Oswald, Joseph Monheim, Dan Meyer, James Huntsman The Invocation was given by the City Clerk. PUBLIC HEARINGS Case No. 537 - Joseph Monheim, 1004 North Fourth Street - Special Use This is the day and time set for the public hearing on Case No. 537, sdhmitted by Joseph Monheim, 1004 North Fourth Street, for a special use permit to construct a four-piex in a two-family zone. Notice of hearing was published in the Stillwater Gazette and mailed to property owners within 300'. Mr. Monheim stated that the home at 1004 North Fourth Street was a three-plex in the past and is situated on a lot that is 115' x 150'. He stated that two of the units will exit on 4th Street and two will exit on Aspen Street. Ms. Vance stated that the Planning Commission denied this request because the four-plex doesn't conform to the neighborhood and this is not a hardship case. There was discussion regarding the square footage needed for a duplex lot and for two duplexes on a lot. It was noted that Monheim is short footage for two duplexes or a four-piex. Mayor Peterson closed the public hearing. On motion by Councilmember Bodlovick, seconded by Councilmember Farrell the Council moved to deny the request for a special use permit for a four-plex in a two-family zone as rccomnended by the Planning Commission. All in favor. Case No. 538 - Warm World - Conditional Use This is the day and time set for the public hearing on Case No. 538, submitted by Warm World Child Development Center, for a conditional use permit to allow child day care at the Trinity Lutheran Church site at 115 N. 4th Street. Notice of hearing was published in the Stillwater Gazette and mailed to property owners within 300'. Mary Oswald, Director of Warm World, stated that they would like to move the toddlers, pre-school and school -age children into the Trinity Luthern Church site at 115 N. 4th Street. She stated that the future of the Croix Center building is not certain at this time. Allen Zepper stated that the church building has been altered to conform with standards for exits, etc. and was built with the intention for child day care. There was discussion regarding school bus pick-up and Ms. Oswald stated that the bus routes are determined by the school and that they have nothing to say about where the children are picked up. Mayor Peterson closed the hearing. It was noted that the Planning Commission unanimously approved this request. 0n motion by Councilmember MacDonald, seconded by Councilmember Bodlovick, the Council moved to approve the conditional use pernut request by Warm World to use Trinity Lutheran Church site for day care. All ayes. Case No. 540 - James Huntsman - 416 South Fourth Street - Variance This is the day and time set for the public hearing on Case No. 540, submitted by James Huntsman 476 South Fourth Street, for a 12' variance to extend a porch in the rear yard. Notice of hearing was published in the Stillwater Gazette and mailed to property owners within 300'. Mr. Huntsman reviewed his plans and presented a support petition from his neighbors. He stated that the present porch is 4' wide and he would like to extend this to make a 10' screened porch. Mayor Peterson closed the public hearing. On motion by Councilmember Bodlovick, seconded by Councilmember MacDonald, the variance submitted by James Huntsman, for a 12' variance to extend a porch in the rear yard, was approved. June 12, 1984 Case No. 541 - Dan Meyer, 2122 Oakridge Road - Variance This is the day and time set for the public hearing on Case No. 541, submitted by Dan Meyer 2122 Oakridge Road, for a 2' sideyard variance and 4'2" between buildings. Notice of this public hearing was published in the Stillwater Gazette and mailed to property owners within 300'. Mr. Meyer presented his plans to the Council. Ms. Vania stated that the Planning Commission felt that Mr. Meyer could satisfy his needs if he limited the size of the garage to conform with the sideyard setback, and decreased the space between buildings to 2'3". Mr. Meyer stated that he could live with this alteration. Mayor Peterson closed the hearing. On motion by Councilmember Bodlovick, seconded by Councilmember Farrell, the Council roved to approve the 2'3" variance between buildings for Dan Meyer, but to require the correct sideyard setback, as recommended by the Planning Commission. All in favor. Refuse Collection Waiver On motion by Councilmember Bodlovick, seconded by Councilmember MacDonald, the Case No.12-610 was approved for refuse collection charge waiver. All in favor. Parkin at Maple Manor On intrrooduced. "RESOLUTION bDESIGGNATINGdNOs PARKING AREA" econded by �nAyes-4 bNays-0 (Resolutioner Frrell, the resolution was #7322) Local Improvement #221 - Interlachen Drive Improvement On motion by Councilmember MacDonald, seconded by Councilmember Farrell, the resolution was introduced, "RESOLUTION RECEIVING REPORT AND CALLING FOR A PUBLIC HEARING ON LOCAL IMPROVEMENT #221" Ayes-4 Nays-0 (Resolution #7323) Li bray' Improvements On motion by Councilmember Farrell, seconded by Councilmember MacDonald, the resolution was introduced, uced, ACCEPTING Ayes-4T(Resolution CCNARCHIECT'ROL AND #AND4ORDERING PLANS AND SPECIFICATIONS FOR Mayor Peterson stated that the hazard of the light fixture deterioration should also be considered. It was the Council's consensus to add this to the improvements, and onto the architect's proposal if the architect's cost for this addition is not too substantial. Dutch Elm Tree Removal Jack Shelton and George Diethert will meet with Dave Magnuson to draft a letter to be sent to property owners with diseased trees that must be removed. Emergency Feeder System Nile Kriesel informed the Council that the County is asking for $500 for the city's share for an emergency feeder system that would provide emergency radio service for the Police and Fire Departments in case of power outages. The Council requested more information on this item and will consider it at a later meeting. School Buses and School Traffic Nile Kriesel reviewed a letter that was received from Short -Elliott -Hendrickson, Inc. regarding the solutions that have been arrived at for the parking and traffic problems at the high school. Neal Avenue Surfacing Nile Kriesel informed the rouncil that Stillwater Township has requested that the City not mat Neal Avenue from Oak Glen Development to Boutwell Road. Dave Johnson has been contacted and has no problem with not having Neal Avenue matted now, but wanted something done with it in the near future. Nile Kriesel stated that the City would pay an amount to the township that would be equal to the cost of the matt, in exchange for the totally constructed street. On motion by Councilmember Bodlovick, seconded by Councilmember Farrell, the Council moved to pay Stillwater Township an amount equal to the cost of a 2" matt on Neal Avenue (Stillwater Township to pay for the street construction on Neal Avenue to Boutwell Road) and to charge this amount to the Oak Glen Development Project. All in favor. Part Time Ice Arena Employees On motion by Councilmember MacDonald, seconded by Muncilmember Bodlovick, the resolution was introduced, "RESOLUTION APPROVING PART TIME EM,LOVMENT" Ayes-4 Nays-0 (Resolution #7324) City Attorney Fees Dave Magnuson presented the Council with a proposal for legal services which will be discussed at a later meeting. Cable TV On motion by Councilmember Bodlovick, seconded by Councilmember Farrell, the Council moved to authorize the Mayor to sign a letter giving a-proval, according to the franchise, for commencement of construction on June 18, 1984. All in favor. Peddler's License Fee Waiver On motion by Councilmember Bodlovick, seconded by Councilmember MacDonald, the Council moved to waive the peddlers' license fee for the Stillwater Professional and Business Women's Association, to sell ice cream during the Stillwater Triathlon. All in favor. • June 12, 1984 Permit to Consume � motion by Counc ilmember Bodlovick, seconded by Councilmember MacDonald, the Council approve a pennit to sell and consume for the City Softball Tournament to be held on June 16 and 17, 1984, at Lily Lake and Croixwood Fields. All in favor. St i 11 water Bridge On motion by Councilmember MacDonald, seconded by Councilmember Farrell, the Council introduced the resolution, "RESOLUTION SUPPORTING CONSTRUCTION OF NEW BRIDGE TO WISCONSIN" Ayes-4 Nays-O (Resolution #7325) Regiona 1 Transit Boa rd On motion by Counc1lmember Bodlovick, seconded by Councilmember MacDonald, the resolut1on was introduced, "RESOLUTION SUPPORTING CANDIDACY OF RUTH FRANKLIN TO TRANSIT BOARD".
