RESOLUTION NO. 2848
RESOLUTION DIRECTING THE PAYMENT OF BILLS
RESOLVED, by the Council of the City of Stillwater, that the following bills

RESOLUTION NO.2849
RESOLUTION VACATING A PART OF EAST POPLAR STREET
WHEREAS, at a meeting of this Council held on the 16th day of November, 1965,
a petition was presented praying for the vacation of a part of East Poplar
Street in the City of Stillwater, hereinafter described; and
WHEREAS, at said meeting the Council did, after due consideration deem it
expedient to proceed with said matter and did order the said petition to be
filed in the office of the City Clerk; and
WHEREAS, the City Clerk did thereupon and thereafter give notice by publication
in the Stillwater Evening Gazette, official newspaper of the City, for four
successive weeks beginning on Friday, December 17, 1965, and thereafter on
Friday of each week to and including January 7,1966, to the effect that said
petition had been filed as aforesaid and stating concisely its objects and that
said petition would be heard and considered by the Council at the CityytHall 30in
the City of Stillwater, Minnesota, on the llth day of January,
o'clock P. M.; and
WHEREAS,at the time and place appointed in said notice, the Council, at a duly
called and held meeting thereof, did investigate and consider said matter and
wdid har the hichemeetingtestand hearingand
thereevidence
was no oppositionftoall
said vacation�eeted, at
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota, that the said petition be and the same is hereby granted and that
the following part of said street, as presently laid out and dedicatted in said
City be, and the same is hereby, vacated absolutely and forever,
A11 that part of East Poplar Street in said City of
Stillwater lying and being between North First Street
and North Second Street;
BE IT FURTHER RESOLVED, that the Council deems substantial benefits will accrue
to the City from the vacation of that part of said street as herein provided,
and thn public benefits will be such that said vacation is hereby ordered
without payment or compensation.
BE IT ALSO FURTHER RESOLVED, that upon publication of this resolution according
to law, a transcript thereof, together with a duplicate of the plat showing the
part of said public street vacated hereby, certified by the City Clerk, shall
be filed for record and recorded in the office of the Register of Deeds of
Washington County, Minnesota.

RESOLUTION NO. 2851
RESOLUTION AUTHORIZING EXECUTION OF EASEMENT
WHEREAS, it appears that Edward L. Bliss may have some interest in the lands
hereinafter described, more specifically, a right of ingress and egress over
said lands owned by the City of Stillwater;
THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater, that
the City convey by easement deed a right of ingress and egress as described
in said deed, over the northerly portion of Lot 3, Block 21, Original Town,
now City of Stillwater, according to the plat thereof now on file and of nrecord
in the office of the Register of Deeds in and for Washington County,
BE IT FURTHER RESOLVED, that the proper officers of the City execute and
deliver to the said grantees, an easement deed for said ingress and egress.

RESOLUTION NO. 2852
RESOLUTION FIXING DATE OF OPENING OF SANITARY DUMP
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that
the Sanitary Dump to be used by the citizens of said City shall be open for use
on January 3, 1966, and located on the following described land, to wit:
All that part of the Southeast Quarter of the Northwest
Quarter (SE' of NWT) and of the Northeast Quarter (NE:)
of the Southwest Quarter (SW;) of Section Twenty-nine (29)
in Township Thirty (30) North of Range Twenty (20) West,
lying Southerly of the Public Highway, excepting therefrom
those parts thereof conveyed by deeds as follows:
Deed from William MCKusick, as Trustee under the Will of
John MCKusick, deceased, to Myrta L. Wilson, dated April 4th
1902, recorded April 16th, 1902, in book No. 55 of Deeds,
page 107, and re -recorded May 17, 1912, in book No. 74 of
Deeds, page 421; Deed from William McKusick, as Trustee
under the Will of John McKissick, deceased, to Myrta L. Wilson,

RESOLUTION NO. 2856
RESOLUTION ACCEPTING BID AND AUTHORIZING EXECUTION OF CONTRACT
BE IT RESOLVED, by the City Council of the City of Stillwater, Minne-
sota. that the bid of Erickson Post Company, Stillwater, Minnesota, in
the amount of $1,598.00, for the sale and delivery to the City of a
new 1966 Ford Custom Two -door Sedan, which bid is hereby found to be the
lowest responsible bid be. and the same is hereby, accepted; and the
Mayor and the City Clerk are hereby authorized and directed to enter into
a contract on behalf of the City with the said Erickson Post Company for
the purchase of said 1966 Ford, said contract to be in accordance with
the specifications and the proposal of the bidder which are on file in
the office of the city Clerk.

RESOLUTION FIXING COMPENSATION FOR TEMPORARY CLERICAL ASSISTANCE
BE IT RESOLVED, by the City Council of the City of Stillwater. Minnesota,
that the City Clerk be, and he is hereby, authorised to employ Grace
Thompson for such temporary clerical assistance as may be from time to
time necessary. and that the compensation to be paid by the City for
such temporary clerical assistance is not to exceed the sum of $2.50
per hour; said compensation to be paid at such times and in such manner
as in the case of other City employees.

RESOLUTION APPROPRIATING FUNDS TO STILLWATER ARMORY BOARD
BE IT RESOLVED. by the City Council of the City of Stillwater, Minnesota,
that under and pursuant to the provisions of Minnesota Statutes 193.35,
the sum of Two Hundred Fifty ($250.00) Dollars be, and the same is hereby.
appropriated to the Stillwater Armory Board for use in maintaining and
equipping the Armory, located in the City, during the year 1966; and that
a warrant be drawn upon the City Treasurer accordingly.

RESOLUTION MD. 2859
RESOLUTION CONFIRMING APPOINTIIER? OF POLICE OFFICER
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that Ronald Edward Johnson, heretofore appointed as a police officer of
the City for a period of six months by resolution adopted August 30, 1965
be, and he is hereby, appointed as a regular police officer with the same
powers and duties as set forth in said resolution of August 30, 1965;
that said appointment shall be effective from and after February 1, 1966,
and that as compensation for services rendered as such police officer,
the said Ronald Edward Johnson shall receive the sum of. $475.00 per month,
together with all other benefits of employment in the Police Department
of the City.

RESOLUTION NO. 2860
RESOLUTION CONFIRMING APPOINTMENT OF FIREMEN
BE IT RESOLVED, by the City Council of the City of Stillwater, Minne-
sota, that the following named persons, heretofore appointed as fire-
men of the City for a period of six months by resolution adopted
August 30, 1965 be, and they are hereby, appointed as regular firemen;

and that said appointments shall be effective from and after February 1,
1966. As compensation for services rendered as such firemen, the said
persons shall receive the sum of $450.00 per month, together with all

RESOLUTION NO. 2861
RESOLUTION ACCEPTING PRTITION AND ORDERING PREPARATION OF PRELIMINARY
REPORT
WHEREAS, a petition was presented by James Simpson and Robert Norgren,
d/b/a J 6 B Realti Co.; and said petition was found to be adequate and
was accepted by the Council. It has been proposed to construct the
following described improvement and to assess the benefited property
for all or a portion of a cost thereof, viz;
Sewer extension to Blocks 12, 13 and 14 of Webster's
3rd Addition to the City of Stillwater;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Still-
water, Minnesota, that the said proposed improvement be referred to the
City Engineer and to the Banister Engineering Company of St. Paul, Minne-
sota, for study and report; advising the Council in a preliminary way as
to whether the proposed improvement is feasible and as to whether it
should be made as proposed or in connection with some other improvement,
and the estimated cost of the improvement as recommended.

RESOLUTION EMPLOYING ENGINEERING SERVICES
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that the Banister Engineering Company of St. Paul, Minnesota, be and they
are hereby, employed to prepare preliminary plans, specifications and esti-
meted costs, and perform other engineering services necessary in connection
with certain improvements now proposed, as follows:
Satyr and water extensions in South Fourth Street between
Myrtle Street and Linden Street (to site of new Municipal
Building)/
Reconstruction of Union Street between Myrtle Street and
Chestnut Street.

RESOLUTION NO. 2863
RESOLUTION ADOPTING ASSESSMENT LOCAL IMPROVEMENT NO. 54
WHEREAS, pursuant to proper notice duly given as required by law, the
Council has met and heard and passed upon all objections to the proposed
assessment for installation of Sanitary Sewer and Watermain in South
Sixth Street from West Marshal Street to West Orleans .Street;
NOW, THEREFORE, RE IT RESOLVED, by the City Council of the City of Still-
water, Minnesota:
1. That such proposed assessment is hereby accepted and shall constitute
the special intent against the lands named therein, and each tract of
land therein included is hereby found to be benefited by the proposed im-
provement in the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments extend-
ing over a period of ten (10) years, the first of the installments to be
payable on the first Monday in January, 1967 end shall bear interest at the
rate of six (6) per cent per annum from the date of the adoption of this
anent resolution. To the first installment shall be added interest on
the entire assesanent from the date of this resolution until December 31,
1967. To each subsequent installment when due shall be added interest for
one year on all unpaid installments.
3. The owner of any property so assessed may, at any time prior to the
certification of the assessment to the County Auditor, pay the whole of
the assessment on such property, with interest accrued to the date of pay-
ment, to the City Treasurer, except that no interest shall be charged if
the entire assessment is paid within 30 days from the adoption of this reso-
lution: he may thereafter pay to the County Treasurer the installment and
interest in process of collection on the current tax list and he may pay the
remaining principal balance of the assessment to the City Treasurer.
4. The Clerk shall file the assessment roll pertaining to this assess-
ment in his office and shall certify annually to the County Auditor on or
before October loth of each year the total amount of installments and in-
terest which are to be due in the following year on the sment on each
parcel of land included in the assessment roll.

NHBREAS, on March 8, 1966, the City Council of the City of Stillwater, Minnesota,
unanimously approved a motion to offer its full support to the local radio
station's desire for longer broadcasting hours:
AND WHEREAS, it is the feeling of this Council that longer hours will enable
Radio Station NAM to perform a definite public service need in the immediate
Stillwater area and throughout the entire St. Croix Valley:
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater.
Minnesota, that said Council hereby strongly urges the Federal Communications
Commission to give every consideration to the request for extended broadcasting
hours for said VAVN radio.

lands hereinafter described, which lands at one time formed a part of
John Street, said street having long since been abandoned but never vacated;
and the City Council now considers said lands to be of no value or use to
the Cityt
THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER, that the
City convey by quit claim deed to Village Hanes, Incorporated, for One Dollar
(51.00) and other good and valuable consideration, the following described
land, situate in the City of Stillwater, Washington County. Minnesota, to -
wit:
All that portion of John Street lying between the south line
of lot Six (6), Block Twenty-four (24) of MCKinstry and
Seeley's Second Addition to Stillwater, according to the plat
thereof on file and of record in the office of the Register

WHEREAS, this Council did, on the 14th day of March, 1966, receive the pre-
liminary report of the City Engineer that the following described improvement
is feasible and may best be made as proposed, viz:
Watermain• Sanitary Sewermains, Water and Sewer Services on West
Olive Street from South Owens Street to C. S. A. H. No. 5; and
on C. S. A. R. No. 5 to South Corporate limits of the City
and has prepared plans and specifications for said improvement and has pre-
sented same to the Council for approval;
AND WHEREAS, the City Engineer has further reported to the Council that the
estimated cost of said improvement, including the cost for construction of
a sidewalk on one side of West Olive Street from South Owens Street to Pine
Street, which will be constructed by Washington County and for which the City
will reimburse said Washington County, is $31,689.40;
AND WHEREAS, the area proposed to be assessed for said improvement includes

RESOLUTION AUTHORIZING ISSUANCE AND SALE OF CERTIFICATES OF INDEBTEDNESS
IN ANTICIPATION OF COLLECTION OF REMAINDER OF FEDERAL DISASTER ASSISTANCE
IN ACCORDANCE WITH THE FEDERAL DISASTER ACT (PUBLIC LAW 81-875)
RESOLVED, BY THE COUNCIL OF THE CITY OF STILLWATER, MINNESOTA, that there
shall be issued and sold Certificates of Indebtedness of the City of Still-
water in the total sum of Thirty Thousand ($30,000.00) Dollars in anticipa-
tion of collection of remainder of Federal Disaster Assistance in accordance
with the Federal Disaster Act (Public Law 81-875) as a result of flood dam-
age during the month of April, 1965, and rain storm damage of Nay 31st and
June lst, 1965, to said City.
ALL OF SAID CERTIFICATES shall be dated as of the day of sale, and shall be
payable to the bearer on or before December 31, 1966, at the office of the
City Treasurer, City Hall, Stillwater, Minnesota, and shall bear interest at
the rate of five (5%) per cent per annum from date of issue until paid.
ALL OF SAID CERTIFICATES shall be numbered and in the amounto as follows:
Three Certificates, numbered One, Two and Three, each in the amount of Ten
Thousand ($10,000.00) Dollars.
THEY SHALL BE SIGNED IN THE NAME OF THE CITY by its Mayor and City Clerk and
shall bear the official seal of the City. They shall be payable primarily
from said Federal Disaster Assistance in accordance with the Federal Diaas-
ter Act (Public Law 81-875), but the full faith and credit of the City are
hereby pledged for the full payment of said principal and interest. They
shall be sold by the City Clerk as needed or as soon thereafter as possible
at par.
THE PRINCIPAL AND IHPEREST OF SAID CERTIFICATES shall be a first charge on
all the monies received from the collection of said Federal Disaster Assist-
ance.
THE CITY TREASURER shall endorse upon each certificate when presented to
him, the name and post office address of the holder and shall keep a record
in his office of the names and addresses of all such holders.

WHBRBAS, this Council did, by resolution adopted September 7, 1965, declare
itself in favor of and in support of a plan to construct an Emergency Operat-
ing Center with the help of Federal Matching Funds provided for this purpose,
AND WHEREAS, in said resolution, the Council authorised the use of a reason-
able sus of monies not to exceed4400.00 from the City Hall Building Fund to
be matched by the Federal Government and used to determine the feasibility
of such a project/
AHD WHEREAS, it has now been reported that said project is feasible, and can

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,

of Washington and State of Minnesota, described as follows, to -wit:
That part of Block Fourteen (14) in SABIN'S ADDITION to the City
of Stillwater, and Section Twenty-eight (28), Township Thirty (30),
Range Twenty (20), described as follows:
Commencing at a point on the East line of Center Street One Hundred
sixty-two (162) feet North of the Southwest corner of Lot Thirteen
(13) in Block Pourteen (14); thence East on a line parallel to the
North line of Linden Street, Three hundred thirty (330) feet to the

WHEREAS, by resolution adopted March 14, 1966, this Council did fix a date for a
public hearing on proposed improvements consisting of the following, to -wit:
Installation of Watermain, Sanitary Sewermains, Water and Sewer
Services on West Olive Street from South Owens Street to C.S.A.H.
No. 5, and on C.S.A.H. No. 5 to South Corporate Limits of the city;
AND WHEREAS, pursuant to notice duly published in the Stillwater Evening Gazette,
official newspaper of the City, on the 8th day of April, 1966. and on the 15th
day of April, 1966, and mailed as required by law, said hearing was held at the
City Hall at 7:30 o'clock P. M. on Tuesday, the 19th day of April, 1966, at which
time and place all persons desiring to be heard on said improvement were given an
opportunity to be heard.
AND WHEREAS, by resolution adopted March 14, 1966, this Council did authorize

NHERREAS, this Council did, on the 3rd day of May. 1966, receive the pre-
liminary report of the Banister Engineering Company that the following
described improvement is feasible and may be made as proposed and not in
conjunction with any other improvement at an estimated cost of $42,800.60;

Construction of Sanitary Sewermain. Lift Station and appurtenances
for Blocks 1, 6, 7, 8, 9, 10, 11, 12, 13 and 14 of Webster's
Third Addition, Blocks 1, 4 and 5 of Ndlillan a Cooley's Addition;
and Block 14 of NcIsnty's Addition, lying and being within the
Corporate Limits of the City of Stillwater;

1. That this Council shall meat at the City Hall in said City on

WHEREAS, a contract has been let for the improvement consisting of Sanitary
Sewer in Nest Millard Street from South Brick Street to Lake Drive, and in
Lake Drive from West Millard Street to Dead End South, and the contract price
for such improvement is $6,048.54, and the expenses incurred or to be incurred
in the making of said improvement amount to $519.50, so that the total cost
of said improvement will be $6;568.04, and of this cost the City will pay
Saone as its share of the cost;
AND MISMIEAS, the City Clerk, assisted by the City Engineer, has prepared e

public hearings on proposed improvements consisting of the following, to -wit:
Reconstruction of Greeley Street from Myrtle Street to Churchill
Street; reconstruction of storm sewer and other appurtenances:

RESOLUTION AUTHORIZING ANNETION PROCEEDINGS BEFORE THE MINNESOTA MUNICIPAL
COMQUSSICN ANNEXATION
WHEREAS, it is necessary, advisable and in the best public interest that the
City of Stillwater, Minnesota, petition the Minnesota Municipal Commission
for a hearing relative to the annexation of certain lands located in the
Township of Stillwater, Township of Baytown, and the Village of Oak Park
Heights;
AND WHEREAS, in order to plan an integrated economy whereby more economical
and efficient governmental services, such as water system, sewage disposal,
road maintenance, public recreation and planning can assure a vigorous and
vital future for the following described lands:
Commencing at a point where County Highway 96 and the
Northwest City Limits of the City of Stillwater meet;
thence westerly along said highway to the westerly
water
said boundryry of ofTownship;
Township to the Northwest
corner of Baytown Township. Thecae, south along the
westerly boundry of Baytown Township to the southerly
boundry of Section Seven (7) in said Township: thence
east along County Highway 14 to its intersection with
County Highway 21; thence in a northerly direction
along said County Highway 21 to the northerly boundry
of Bayport, Minnesota; thence easterly along the
northerly boundry of the Village of Bayport to the
St. Croix River. Included herein is the Village of Oak
Park Heights, Minnesota.
NOW, THEREFORE, BE IT RESOLVED, by the City of Stillwater, Minnesota,
Washington County, Minnesota, that a petition be filed, and all necessary
proceedings be undertaken, for a hearing before the Minnesota Municipal

WHEREAS, this Council did, on the 5th day of July, 1966, receive the final
drawings and specifications of Peter L. Racchini, the City'a architect, for
Furnishings for the Municipal Building for the City of Stillwater, and has
presented said final drawings and specifications to the Council for approval:
AND WHEREAS, Peter L. Racchini, the City's architect has further reported to
the Council that the estimated cost of said Furnishings is $10,000;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota:
1. That said drawings and specifications be, and the same are hereby
approved and ordered filed in the office of the City Clerk,
2. That the City Clerk is hereby authorized and directed to prepare and

WHEREAS, pursuant to proper notice duly given as required by law, the Council
has met and heard and passed upon all objections to the proposed assessment
for installation of Sanitary Sewer in West Willard Street from South Erick
Street to Lake Drive, and in Lake Drive from West Millard Street to Dead End
South:
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater.
Minnesota:
1. That such proposed amen is hereby accepted and shall constitute
the epeeist sment against the lands named therein, and each tract of land
therein included is hereby found to be benefited by the proposed improvement
in the amount of the assessment levied against it.
2. That such anent shall be payable in equal annual installments
extending over a period of ten (10) years, the first of the installments to
be payable on the first Monday in January, 1967 and shall bear interest at
the rate of six (6) per cent per annum from the date of the adoption of this
assessment resolution. To the first installment shall be added interest on the
entire assessment from the date of this resolution until December 31.1967. To
each subsequent installment when due shall be added interest for one year on
all unpaid installments.

3. The owner of any property so assessed may, at any time prior to
the certification of the assessment to the County Auditor, pay the whole of
the ssssssment on such property, with interest accrued to the date of payment,
b the City Treasurer, except that no interest shall be charged if the entire

thereafter pay to the County Treasurer the installment and interest in pro-
cess of collection on the current tax list and he may pay the remaining princi-
pal balance of the assessment to the City Treasurer.
4. The Clerk shall file the sment roll pertaining to this ssssss-
mmt in his office and shall certify annually to the County Auditor on or be-
fore October loth of each year the total amount of installments and interest
which are to be due in the following year on the ement on each parcel of

RESOLUTION ACCEPTING BID AND AUTHORIZING EXECUTION OF CONTRACT
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that the bid of Bloom Motor Co.. Stillwater, Minnesota, in the amount of
$2,349.00, for the sale and delivery to the City of a new 1967 Dodge A-100
Sportman (Civil Defense van), which bid is hereby found to be the lowest
responsible bid meeting specifications be, and the same is hereby,accepted;
and the Mayor and the City Clerk are hereby authorised and directed to
enter into a contract on behalf of the City with the said Bloom Motor Co.
for the purchase of said Civil Defense van, said contract to be in accord-
ance with the specifications end the proposal of the bidder which are on
file in the office of the City Clerk.

RESOLUTION NO. 2937
RESOLUTION AUTHORIZING PURCHASE OF LAND
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that
for the purpose of providing land for use of the City Street Department, but
not restricted thereto, the purchase of certain property owned by Albert J.
Ritser and Helen J. Ritser, husband and wife, is hereby authorized; said prop-
erty situated in Washington County, being more particularly described as fol-
lows, to -wit:
All that part of the North One -Half of the Northeast
Quarter (NII of NEW of Section 8, of T. 30N-R.20W.
Except: that part bounded by a line starting at the Southwest
corner of said one-half quarter section, and progressing North
1.020 feet along West boundary to a point on west boundary,
thence Easterly on a line perpendicular to West boundary and
parallel to South boundary 1,000 feet to a point, thence South-
erly on a line parallel to West boundary to a point on South
boundary, along South boundary to the point of beginning, ac-
cording to the records of the Register of Deeds in and for said
Washington County, Minnesota.
BE IT FURTHER RESOLVED, that in consideration of the conveyance of said prop-
erty free and clear of all encumbrances except real property taxes payable in
1966, the sum of $17,000 be, and the same is hereby appropriated and that upon
delivery of a good and sufficient contract for deed, accompanied by an abstract
of title evidencing good title in said Albert J. Ritzer and Helen J. Ritser, hus-
band and wife, a warrant shall be drawn upon the City Treasurer and issued ac-
cordingly:
$5,000.00 on the date of execution of said Contract for Deed;
$5,000.00 one year from the date thereof;
$5.000.00 two years from the date thereof; and
$2.000.00 three years from the date thereof;
with interest at the rate of 6% on the unpaid balance thereof;
Further, the City of Stillwater has the privilege of paying any additional
amount at any time during the life of said contract.

RESOLUTION AUTHORIZING MEMBERSHIP IN THE METROPOLITAN SECTION OP THE
LEAGUE OF MINNESOTA MUNICIPALITIES.
RESOLVED, that the City of Stillwater, Minnesota, approve the by-laws of
the Metropolitan Section of the League of Minnesota Municipalities adopted
by the Metropolitan Affairs Committee of the League en June 8, 1966,
RESOLVED, further that the City of Stillwater join the Metropolitan Section
of the League of Minnesota Municipalities commencing in the membership
year 1966-1967, payment by the Council, hereafter, membership dues in ac-
cordance with such by-laws;
RESOLVED further that in no event shall membership of this City in the
Metropolitan Section become effective until at least twenty-five eligible
municipalities representing a majority of the aggregate population of all
eligible municipalities have approved the by-laws of the Metropolitan Section
and have agreed to pay the prescribed dues for the 1966-67 membership year.

RESOLUTION NO. 2945
RESOLUTION AUTHORISING RESUMPTION OF SEWER SERVICE OUTSIDE THE
CORPORATE LIMITS OF THE CITY
WHEREAS, it has been proposed to the Council of the City of Stillwater,
Minnesota, to resume sewer service to a certain parcel of land outside
the Corporate Limits of said City; and
WHEREAS, prior to 1959 sewer service was provided a certain parcel of
land, located outisde the Corporate Limits of said City and now located
in.the Village of Oak park Heights, described as follows, to -wit:
Lots 7, 8, 9, 10, 11, and 12 in Block 4, Webster's Third
Addition to Stillwater, except the following described
part of Lots 9, 10, 11, and 12: Beginning at the north-
west corner of Lot 12, Block 4 of Webster's Third Addition,
thence east on the north line of said lot for a distance of
15.38 feet, thence in a southerly direction to the south-
west corner of Lot 9 in said block in said addition, thence
north on the west line of Lots 9, 10, 11, and 12 of said
block in said addition to the point of beginning and there
terminating, and Also Lots 10, 11, and 12 of Block 5 in
Webster's Third Addition to Stillwater, and
Also all that part of vacated St. Croix Street which has
accrued to Lot 7, Block 4, and Lot 12, Block 5 in said
Webster's Third Addition; all as surveyed and platted and
now on file and of record in the office of the Register of
Deeds of Washington County, Minnesota; and
WHEREAS, Simonet Furniture and Carpet Company is building a funeral home
on said parcel of land heretofore described; and
WHEREAS, the City of Stillwater abuts said parcel of land and therefore
for reasons of health and sanitation, it is in the beet interests of said
City to resume sewer service to said parcel of land; and -
WHEREAS, Simonet Furniture and Carpet Company agrees to pay any assessment
charges for said connection and for any subsequent assessment which may be
levied by the City of Stillwater relative to said present sewer system;
the same as property owners in said City of Stillwater, Minnesota; and
WHEREAS, Simonet Furniture and Carpet Company agrees to annex the
aforedescribed property to said City at the earliest legal opportunity,
NON, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Stillwater, Minnesota, that the City of Stillwater resumes sewer service
to the aforesaid described property in consideration of the covenants
heretofore agreed upon by Simonet Furniture and Carpet Company.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota:
1. That such proposed assessment is hereby accepted and shall consti-
tute the special sment against the lands named therein, and each
tract of land therein included is hereby found to be benefited by the
proposed improvements in the amount of the assessment levied against it.
2. That such assessment shall be payable in equal annual installments
extending over a period of three (3) years, the first of the installments
to be payable on the first Monday in January, 1967, and shall bear inter-
est at the rate of six (6) per cent per annum from the date of the adop-
tion of this sment resolution. To the first annual installment shall
be added interest on the entire assessment from the date of this resolu-
tion until December 31, 1967. To each subsequent installment when due
shall be added interest for one year on all unpaid installments.
3. The owner of any property so assessed may. at any time prior to the
certification of the assessment to the County Auditor, pay the whole of
the assessment on such property, with interest accrued to the date of pay-
ment. to the City Treasurer, except that no interest shall be charged if
the entire assessment is paid within 30 days from the adoption of this
resolution; he may thereafter pay to the County Treasurer the installment
and interest in process of collection on the current tax list and he may
pay the remaining principal balance of the assessment to the City Treasurer.
4. The Clerk shall file the assessment roll pertaining to this assess-
ment in his office and shall certify annually to the County Auditor on or
before October loth of each year the total amount of installments and in-
terest which are to be due in the following year on the assessment on each
parcel of land included in the assessment roll.

that the compensation of Dan Thomas, regularly employed by the Street
Department of the City of Stillwater be, and it is hereby, increased from
the sum of $2.50 per hour to $2.55 per hour; and that the compensation of
Harrison Hanke, regularly employed by the Street Department of the City of
Stillwater be, and it is hereby, increased from the aum of $2.25 per hour
to $2.30 per hour; said increases to be effective from and after Septem-
ber 1, 1966.

RESOLUTION NO. 2949
RESOLUTION CONFIRMING APPOINTMENT OF POLICE OFFICER
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that the appointment of James Eder as a police officer of the City for a
probationary period of not to exceed six months, commencing September 15,
1966, be, and the same is hereby, confirmed; that as such police officer
the said James Eder shall have the powers of police officers at common
law or under the laws of the State of Minnesota, and it shall be his duty
to serve warrants, summons, writs, subpoenas or other process issued by
the Municipal Court; to command the peace, suppress rioting or disorderly
conduct within the City and to arrest, with or without a warrant, as
authorized by the laws of this State, persons charged with the commission
of any public offense under the laws of the State of Minnesota or the
ordinances of the City, and to perform any and all other duties inciden-
tal to the office of a policeman as directed by the City Administrator or
the Chief of Police; and that the said James Eder shall receive as com-
pensation for services rendered as such police officer the sum of $425.00
per month.

RESOLUTION ACCEPTING PETITION AND ORDERING PREPARATION OF FEASIBILITY
REPORT
WHEREAS, a petition was presented by Colonial Investments, Inc., and said
petition was found to be adequate and was accepted by the Council, it has
been proposed to
extend West Stillwater Avenue from North Owens
Street to Williams Street
and to the benefited property for all or a portion of the cost
thereof:
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Still-
water, Minnesota, that said proposal be referred to the City Engineer for
study and report, advising the Council in a preliminary way as to whether
the. proposal is feasible, and as to whether it should be made as proposed
or in connection with some other project, and the estimated cost of the
project as recommended.

RESOLUTION AUTHORIZING THE EXCHANGE OF LAND
WHEREAS, the John J. Kilty Co. has proposed an exchange of the following
described property, to -wit:
The North 55 feet of the following tract of land described as follows:
All that part of Block Number Eighteen (18) of the original town (now
city) of Stillwater, as surveyed and platted by Harvey Wilson, and now
on record in the office of the Register of Deeds in and for said County of Wash-
ington, bounded and described as follows: Commencing at a point in the
east line of North Main Street, in said City of Stillwater, as said street
is now laid out and opened, one hundred ten (110) feat Northerly,measur-
ing along said east line of North Main Street, with the North line Myrtle
Street, in said City; running thence Easterly and parallel with the said
North line of East Myrtle Street one hundred twenty (120) feet, more or
less, to the West line of North Water Street in said City; thence Norther-
ly along said West line of North Water Street Sixty-two (62) feet, more
or less, to a point distant thirty (30) feet Southerly, measuring along

exchange the aforedescribed property, owned by the City of Stillwater. for
the aforedesdribed property owned by the John J. Kilty Co.
BE IT FURTHER RESOLVED, that the Mayor and City Clerk are hereby authorized to
execute any and all documents necessary to effectuate a good and legal title to
the aforedescribed property owned by the city upon receipt of a warranty deed
and abstract of title continued down to date showing good and legal title in the
John J. Kilty Co.

RESOLUTION RESOLUTION NO. 2953
RESOLUTION SETTING SEWER CONNECTION FEES FOR LOCAL IMPROVEMENT No. 49-1964
WHEREAS, the City Council of the City of Stillwater, Minnesota, did, on
March 8, 1966, determine that the parcels of land hereinafter described
were benefited by Local Improvement No. 49-1964 (installation of sanitary
sewer), and that each and every home or house on said parcels wishing to
connect to the sanitary sewer system of the City should pay a fee of Four
Hundred ($400.00) Dollars for this service; and
WHEREAS, the parcels of land benefited by said Local Improvement No.49-1964
are described as follows, to -wit:
Block 20, lying westerly of Pine Tree Trail, MCKinetry a Seeley's
2nd Addition;
Lots 7, 8 a 9, and that portion of abandoned Johns Street abutting
thereon in Block 21r
Lots 1, 2, 3, 4, 5 a 6, and that portion of abandoned Johns Street

RESOLUTION AUTHORIZING THE SALE OF LAND
WHEREAS, the following described real estate is no longer of use to the City
of Stillwater, and it is to the benefit of said City to sell same; and
WHEREAS, the aforementioned real estate is described as follows, to -wit:
All that part of the Southeast quarter of the Northwest quarter
(5E11 of NA) of Section number three (3) in Township number twenty-
nine )29) North, of Range number Twenty (20) West, described as follows:
Beginning at the Southeast corner of the above mentioned tract and run-
ning thence North along the East line of said tract twenty (20) rods,
more or less, to the South line of Block number seven (7) of Beach's
Addition to Oak Park extended East fifty (50) feet across First Street;
thence West along said South line and South line extended, three hundred

WHEREAS. this Council did, on the 6th day of Septemter, 1965, receive
the report of the City Engineer that the following described improvement
is feasible and may beet be made as proposed, viz:
South Water Street - East Nelson Street to manhole
254 feet North. Sanitary Sewer Repair and Replacement
of 12" V.C.P. together with appurtenances:
and has prepared plans and specifications for said improvement and has
presented same to the Council for approvals
AND WHEREAS, the City Engineer has further reported to the Council that
the estimated cost of said improvement is $7,300.00;
NOW, T86AUPORE, BE IT RESOLVED, by the City Council of the City of
Stillwater, Minnssota:
1. That said plans and specifications be, and the same are hereby,
approved and ordered filed in the office of the City Clerk.
2. That the City Clerk is hereby authorized and directed to prepare
and cause to be inserted in the official newspaper of the City, an adber-
tisement for bids: said advertisement to specify the work to be done; that
bids will be opened and considered by the Council at 4:30 o'clock P. M.
on Tuesday, the llth day of October, 1966, in the Council Chambers at the
City Hall: that no bids will be considered unless sealed and filed with the
City Clerk and accompanied by a cash deposit, cashier's check, bid bond
or certified check, payable to the City of Stillwater for ten (10%) per
cent of the amount of such bids and that the Council shall have thirty (30)
days within which to act upon said bids.

SepteMber. 1965, Dunkley Surfacing Company, Inc., Minneapolis, Minnesota
has satisfactorily completed construction of local Improvement No. 55-1965
Blest Olive Street Storm Sewer) and Local Improvement No. 56-1965 (Watermain,
sanitary sewer and services - Myrtle and Pine Streets) in accordance with
such contract:
NOW. THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota, that the work completed under said contract is hereby accepted and
approved, and that a proper warrant be drawn upon the City Treasurer and
issued to the contractor for the final payment on said contract.

RESOLUTION AMENDING RESOLUTION NO. 2937 AUTHORIZING PURCHASE OF LAND
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that Resolution No. 2937 is hereby amended to read as follows:
'BB IT RESOLVED: by the City Council of the City of Stillwater,
Minnesota, that for the purpose of providing land for use of the
City Street Department, but not restricted thereto, the purchase
of certain property owned by Ritter Landscaping Service. Inc., is
hereby authorized: said property situated in Washington County,
being more particularly described as follows, to -wit:
All that part of the North one-half of the Northeast Quarter
(Ny of NE%) of Section 8, of T. 30N. - R.20 W.
Except: that part bounded by a line starting at the Southwest
corner of said one-half quarter section and progressing North
1,020 feet along West boundary to a point on West boundary,
thence Easterly on a line perpendicular to West boundary and
parallel to South boundary 1,000 feet to a point, thence
Southerly on a line parallel to West boundary to a point on
South boundary. along South boundary to the point of beginning,
according to the records of the Register of Deeds in and for
said Washington County, Minnesota.
BE IT FURTHER RESOLVED, that in consideration of the conveyance
of maid property free and clear of all encumbrances except real
property taxes payable in 1966. the sum of $17,000 be, and the
sae is hereby appropriated and that upon delivery of a good and
sufficient contract for deed, accompanied by an abstract of title
evidencing good title in said Ritter Landscaping Service, Inc.,
a warrant shall be drawn upon the City Treasurer and issued
accordingly:
$5.000.00 on the date of execution of said Contract for Deeds
$5,000.00 one year from the date thereof;
$5,000.00 two years from the date thereof; and
$2.000.00 three years from the date thereof;
with interest at the rats of 6% on the unpaid balance thereof;
Further, the City of Stillwater has the privilege of paying any
additional amount at any time during the life of said contract.'

RESOLUTION EMPLOYING ENGINEERING SERVICES
BE IT RESOLVED. by the City Council of the City of Stillwater, Minnesota,
that the Mayor and City Clark are hereby authorised to enter into a contract
with the Banister Engineering Company of St. Paul, Minnesota, for the
purpose of making a study for secondary treatment of sewage facilities at
the City disposal plant, and the necessary interceptor sewers to areas out-
side the city limits of said City which will need -a sanitary sewer system in
the future.

RESOLUTION AMENDING RESOLUTION NO. 2954 - AUTHORIZING THE SALE OP LAND
BE IT RESOLVED. by the City Council of the City of Stillwater, Minnesota,
that Resolution No. 2954, Authorizing the Sale of Land. is hereby amended
to read as follows:
"WHEREAS. the following described real estate is no longer of
use to the City of Stillwater. and it is to the benefit of said
City to sell same; and
= WHEREAS, the aforementioned real estate is described as follows,
to -wit:
A11 of Block 7 of Beach's Addition to Oak Park; and
All that part of the Southeast quarter of the Northwest quarter
(8814 of BW4) of Section number three (3) in Township number
twenty-nine (29) North, of Range number Twenty (20) West, described
as follows:
Beginning at the Southeast corner of the above mentioned tract
and running thence North along the East line of said tract twenty
(20) rods, more or lees, to the South line of Block number seven
(7) of Beach's Addition to Oak Park extended East fifty (50) feet
across First Street; thence West along said South line and South
line extended, three hundred twenty-one (321) feet, more or less,
to the Southeast corner of Block number eight (8) of said Beach's
Addition; thence South in a direct line with the East line of
Block number eight (8), twenty (20) rods, more or less, to the

RESOLUTION ACCEPTING BID AND ORDERING SANITARY SEWER REPAIR AND REPLACEMENT -
SOUTH WATER STREET
mamas, the Council did, by resolution adopted October 11, 1966, authorise
and direct the City Clerk to advertise for bids returnable at 4:30 o'clock
P. M. on Thursday, November 10, 1966, for the following described project:
SOUTH WATER STREET - East Nelson Street to manhole 254 feet
North. Sanitary Sewer Repair and Replacement of 12" V.C.P.
together with appurtenances;
AND WHEREAS, it appears from the affidavits of publication presented by the
City Clerk that pursuant to said resolution an advertisement for bids for
said project w .s duly published in the Stillwater Evening Gazette, official
newspaper of the City, on October 27, 1966, and in the Construction Bulletin:
AND WHEREAS, it appears that !bolter Construction Company, Inc. of Stillwater,
Minnesota, is the lowest responsible bidder for said project with a total
bid of $8,438.50:
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota:
1. That said Sanitary Sewer Repair and Replacement be, and it is
hereby, ordered as proposed.
2. That the bid of said [bolter Construction Company, Inc. be, and the
same is hereby, accepted; and that the Mayor and the City Clerk are hereby
authorized and directed to enter into a contract in the name of the City with
the said Metter Construction Company, Inc. for said Sanitary Sewer Repair
and Replacement for the contract price aforesaid and in accordance with the
plans and specifications therefor.
3. That no part of the cost of said project shall be . The
Council of the City of Stillwater hereby authorises and directs the City
Treasurer to pay the cost of said project from the City's Sewer Revenue Fund.
4. That the City Clerk shall retain the deposits made with the three
lowest bidders for thirty days from and after November 10, 1966, or until a
contract is signed, whichever event first occurs.

RESOLUTION ACCEPTING BID AND AUTHORIZING EXECUTION OF CONTRACT - FOR
DEMOLISHING OF BUILDING
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that the bid of Moelter Construction Co., Inc.. Stillwater, Minnesota, in
the amount of $900.00 for the demolishing to ground level of a building
known as the old Methodist Church, located on the corner of Fourth and
Myrtle Streets, Stillwater, Minnesota, which bid is hereby found to be the
lowest responsible bid, be, and the same is hereby, accepted; and the Mayor
and the City Clerk are hereby authorized and directed to enter into a contract
on behalf of the City with the said Moelter Construction Co., Inc. for the
demolishing of said building, said contract to be in accordance with the
advertisement for bide and the proposal of the bidder which are on filein
the office of the City Clerk.

RESOLUTION AUTHORIZING EXECUTION OF STREET LIGHTING CONTRACT
RESOLVED, that the City Council of the City of Stillwater, Washington
County, Minnesota. hereby accepts the proposal of the NORTHERN STATES
POWER COMPANY, a Minnesota corporation, to furnish street lighting service
with all lights located or to be located in said City, and hereby approves
all rates, terms, Conditions, and specifications in the Street Lighting
Contract made a part of the proposal of said company, and the proper officers
of the City are hereby authorized and directed to execute the aforesaid
Contract for and in the name of the City, and to affix the corporate seal
thereto.

RESOLUTION CONFIRMING APPOINTMENT OF POLICE OFFICER
Mayor
HE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that the appointment of James Fredricksen as a police officer of the City
for a probationary period of six months, commencing December 1, 1966, be,
and the same is hereby, confirmed; that as such police officer the said
James Fredrickson shall have the powers of police officers at common law or
under the laws of the State of Minnesota, and it shall be his duty to serve
warrants, summons, writs, subpoenas or other process issued by the Municipal
Court; to command the peace, suppress rioting or disorderly conduct within
the City, and to arrest, with or without a warrant, as authorized by the
laws of this State, persons charged with the commission of any public offense
and

under the laws of the State of Minnesota or the ordinances of the City.
to perform any and all other duties incidental to the cffice of a policeman
as directed by the City Administrator or the Chief of Police; and that the
said James Fredrickson shall receive as compensation for services rendered
as such police officer the sum of $475.00 per month.

RESOLUTION NO. 2977
RESOLUTION AUTHORIZING HIRING OF YOUNG MEN, EIGHTEEN YEARS OR OVER,
IN VOLUNTEER FIRE DEPARTMENT
WHEREAS, certain young men in the City of Stillwater have expressed
an interest in becoming Volunteer Firemen for said City; and
WHEREAS, it is to the best interest of said city to have a large Volunteer
Fire Department; and
WHEREAS, said young men, being eighteen years of age or over, will take
necessary medical examinations and training as provided by the Fire
Department of said City;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Min::esota, that the Volunteer Fire Department of said City may enlist the
services of men eighteen years of age and over, after said men have met all
requirements of the Volunteer Fire Department.

RESOLUTION IN TRIBUTE TO ARLEN A. SCHULTZ
WHEREAS, Mr. Arlen A. Schultz. age 29 years, was injured while working
on construction of the new Municipal Building in the City of Stillwater
on December 8, 1965, and subsequently died as a result of said injury
on December 21, 1965; and
WHEREAS, the Mayor and Council of the City of Stillwater deem his passing
of sufficient importance and public interest to warrant the adoption of
a resolution in his memory; and
WHEREAS, this resolution should be placed with other memorials in the
corner stone of the said Municipal Building;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota, that the City Clerk be, and he is hereby, instructed to place a
copy of this memorial resolution, as passed by the City Council on the 28th
day of Noveld;er, 1966, in the corner stone of said Municipal Building;
BE IT FURTHER RESOLVED, that the City Clerk be, and he is hereby, instructed
to place this resolution in the permanent record of the City, and forward a
a copy of said resolution to the family of Mr. Arlen A. Schultz.

RESOLUTION NO. 2980
RESOLUTION AUTHORIZING PAYMENT OF PARKING LOT LEASE
WHEREAS, the Northern Pacific Railway Company has leased certain company
station grounds to the City of Stillwater for parking lot purposes, from
August 1, 1965 to July 31, 1966, for the sum of $2,400.00; and
WHEREAS. the same lease was in effect from August 1, 1966 until the date
of termination of said lease on December 31, 1966 for the additional sum of
$1,000.00;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota, that the City Clerk Be, and he is hereby, instructed to issue a
warrant to the Northern Pacific Railway Company in tie amount of $2.400.00 for
the lease period of August 1, 1965 to July 31, 1966; and an additional sum of
$1,000.00 for the five month period of August 1, 1966 to December 31, 1966.

RESOLUTION NO. 2980A
RESOLUTION URGING RAILROAD AND WAREHOUSE COMMISSION TO APPROVE EXTENSION OF
TOLL FREE SERVICE
WHEREAS, the St. Croix Valley Area Chamber of Commerce has, during the
past six months, conducted a survey of all telephone subscribers in the
439 Exchange area, and
WHEREAS. it appears that this survey indicates that approximately 55%. of
the subscribers in this area desire to be connected with the Twin Cities
toll -free telephone service, and
WHEREAS, we, the undersigned, are informed and believe that it is the
policy of the Railroad a Warehouse Commission that the 59% affirmative response
is not, under normal circumstances, adequate to justify a change in the service
for all subscribers, but
WHEREAS, the undersigned believe that the economic and social well-being of
the 'community would clearly best be served by an extension of the Twin Cities
toll -free service to the 439 Exchange area,
NOW, TEEREFORE,.. BE IT RESOLVED by the undersigned that the Railroad a
Warehouse Commission be urged and encouraged to approve the extension of the

55%-affirmative response. keeping in mind that this area daily becomes more
closely tied to and dependent upon the Twin Cities area and that by the time
such a change could be actually effectuated, the obvious need for such service
will be even more imperative than it is today.

RESOLUTION NO. 2984
RESOLUTION AUTHORIZING ISSUANCE AND SALE OF CERTIFICATES OF INDEBTEDNESS IN
ANTICIPATION OF COLLECTION OF REMAINDER OF FEDERAL ➢ISASTER ASSISTANCE IN
ACCORDANCE WITH THE FEDERAL DISASTER ACT (PUBLIC LAW 81-875)
RESOLVED. BY THE COUNCIL OF THE CITY OF STILLWATER, MINNESOTA, that there shall
be issued and sold Certificates of Indebtedness of the City of Stillwater in
the total sum of Forty-six Thousand ($46,000.00) Dollars in anticipation of
collection of the remainder of Federal Disaster Assistance in accordance with
the Federal Disaster Act (Public Law 81-875) as a result of flood damage during
the month of April, 1965, and rain storm damage of May 31st and June 1st, 1965,
to said City.
ALL OF SAID CERTIFICATES shall be dated as of the day of sale, and shall be
payable to the bearer on or before December 31, 1967, at the office of the
City Treasurer, City Hall, Stillwater, Minnesota, and shall bear interest at
the rate of five and one-half (5W percent per annum from date of issue until
paid.
ALL OF SAID CERTIFICATES shall be numbered and in the amounts as follows:
Three Certificates, numbered One, Two, and Three; two in the amount of Fifteen
Thousand Five Hundred ($15,500.00) Dollars each, and one in the amount of
Fifteen Thousand ($15,000.00) Dollars.
THEY SHALL BE SIGNED IN THE NAME OF THE CITY by its Mayor and City Clerk and
shall bear the official seal of the City. They shall be payable primarily from
said Federal Disaster Assistance in accordance with the Federal Disaster Act
(Public Law 81-875), but the full faith and credit of the City are hereby
pledged for the full payment of said principal and interest. They shall be sold
by the City Clerk as needed or as soon thereafter as possible at par.
THE PRINCIPAL AND INTEREST OF SAID CERTIFICATES shall be a first charge on
all the monies received from the collection of said Federal Disaster Assistance.
THE CITY TREASURER shall endorse upon each Certificate when presented to him,
the name and poet office address of the holder and shall keep a record in his
office of the names and addresses of all such holders.
IN ORDER TO AVAIL ITSELF OF THE PRIVILEGE OF paying any or all of said
Certificates prior to the date of maturity shown above, the City by its
Treasurer, must give the record holder thereof ten (10) days written notice
of its intention to pay said Certificates, addressed to the last known address
of the holder thereof..
