RESOLUTION AMENDING RESOLUTION ::). 2533
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STILLWATER, MINNESOTA,
as follows:
1. Paragraph No. 5 of Resolution No. 2583, adopted December 27, 1963, is
hereby repealed and the following substituted in lieu thereof:
"5. The City Clerk shall annually compute interest on
each unpaid assessment and collect said assessments in
the manner provided by law."

RESOLUTION NO. 2594
RESOLUTION AUTHORIZING PAYMENT TO AMERICAN NATIONAL BANK OF ST. PAUL
BE IT RESOLVED BY THE CITY COUNCIL OF TFIE CITY OF STILLWATER, MINNESOTA,
that the sum cf $300.00 be paid to the American National Bank of St. Paul,
to be deposited in the Escrow Account in connection with advance refunding
bonds. This resolution adopted pursuant to a request from Springsted, Inc.,
the City's bond consultant, dated December 30, 1963. And that a warrant upcn
the City Treasurer be drawn and issued accordingly.

RESOLUTION NO. 2595
RESOLUTION ORDERING HEARING ON SANITARY SEWER AND WATER MAIN IMPROVEMENTS
AND PREPARATION OF PLANS AND SPECIFICATIONS.
WHEREAS, this Council did, on the llth day of June, 1963, receive the preliminary
report of the City Engineer that the following described improvement is feasible
and may beet be made as proposed and not in conjunction with any other improve-
ments at an estimated cost of $13,361.61, said improvement consisting of con-
struction of 8" sanitary sewer and 6" cast iron water main Southerly in Borup
Street from existing facilities in West Pine Street to City Limits;
AND WHEREAS, the area proposed to be assessed includes all abutting and non -
abutting property benefited thereby;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STILLWATER,
MINNESOTA:
1. That this Council shall meet at the City Hall in said City on Tuesday, the
llth day of February, 1964, at 7:30 o'clock P. M., for the purpose of holding a
public hearing on the making of the above described improvement, and that the
City Clerk be. and he is hereby, authorized and directed to cause public notice
of the time, place and purpose of said meeting to be published in the official
newspaper of the City twice, a week apart, the last of said publications to be
not less than three days prior to the date of said hearing, and mailed to each
owner of property included in the area proposed to be assessed not less than two
weeks prior to the date thereof.
2. That the City Engineer be, and is hereby, designated as engineer for this
improvement and that he proceed with the preparation of plans and specifications
for the making thereof.

RESOLUTION FIXING COMPENSATION OF CITY ATTORNEY
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STILLWATER, MINNESOTA,
that the compensation of Vacil D. Kalinoff, City Attorney, is hereby fixed
at the sum of $350.00 per month, effective January 1, 1964, and he shall
be entitled to all other benefits of City employment.

RESOLUTION NO. 2599
RESOLUTION ADOPTING ASSESSMENT LOCAL IMPROVEMENT NO. 41-1963
WHEREAS, pursuant to proper notice duly given as required by law, the Council
i-• has met and heard and passed upon all objections to the proposed sment
for Street Surfacing in West Moore Street from North Martha Street to North
William Street.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota:
1. That such proposed assessment is hereby accepted and shall
constitute the special assessment against the lands named therein, and each
tract of land therein included is hereby found to be benefited by the proposed
improvement in the amount of the assessment levied against it.
2. Such ment shall be payable in equal annual installments ex-
tending over a period of 10 years, the first of the installments to be payable
on the first Monday in January. 1965, and shall bear interest at the rate of
6% per annum from the date of the adoption of this assessment resolution. To
the first installment shall be added interest on the entire aseesanent from
the date of this resolution until December 31, 1965. TO each subsequent install-
ment, when due. shall be added interest for one year on all unpaid installments.
3. The owner of any property so assessed may, at any time prior to
certification of the assessment to the County Auditor, pay the whole of the
assessment on such property with interest accrued to the date of payment, to
the City Treasurer, except that no interest shall be charged if the entire
assessment is paid within 30 days from the adoption of this resolution; he may
thereafter pay to the County Treasurer the installment and interest in process
of collection on the current tax list, and he may pay the remaining principal
balance of the assessment to the City Treasurer.
4. The Clerk shall file the assessment roll pertaining to this assess-
ment in his office and shall certify annually to the County Auditor on or before
October 10 of each year the total amount of installments and interest which are
to be due in the following year on the assessment on each parcel of land in-
cluded in the assessment roll.

for Construction of Sanitary Sewer and Watermain in Oak Ridge Road from
Laurie Lane to Darrell Place.

constitute the special anent against the lands named therein, and each
tract of land therein included is hereby found to be benefited by the proposed

WHEREAS, a contract has been let for the surfacing of South Water Street
from East Chestnut Street to East Nelson Street: and the contract price for
such improvement is $9,300.45; and the expenses incurred or to be incurred
in the making of said improvement amount to $2,222.00 made up as follows:

so that the total cost of said improvement will be $11,522.45; and of this
cost the City will pay $2,880.61 as its share of the cost;

Council that such proposed assessment has been completed and filed in his
offi^e for public inspection;

RESOLUTION ORDERING SANITARY SEWER AND WATERMAIN IMPROVEMENTS, APPROVING PLANS
AND SPECIFICATIONS AND DIRECTING THE CITY CLERK TO ADVERTISE FOR BIDS
WHEREAS, by resolution, adopted January 7, 1964, this Council did fix a date
for a public hearing on proposed improvements consisting of B" Sanitary Sewer
and 6" Cast Iron watermain Southerly in Borup Street from existing facilities
in West Pine Street to City Limits:
AND WHEREAS, pursuant to notice duly published in the Stillwater Evening
Gasette, official newspaper of the City, on the 27th day of January, 1964, and
on the 3rd day of February, 1964. and mailed as required by law. said hearing
was held at the City Hall at 7:30 P. M. on Tuesday, the llth day of February.
1964. at which time and place all persons desiring to be heard on said matter
were given an opportunity to be heard.
ROW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater.
Minnesota:
1. mat the aforesaid improvements be, and each is hereby, ordered as
proposed at the estimated cost of $7,554.71 and $5,806.90, respectively, and
that final detailed plans and specifications therefor, prepared by the City
Engineer pursuant to Council resolution, be, and the same are hereby, approved

2. That the City Clerk be, and he is hereby, authorized and directed
to advertise for bids on the construction of said improvements, publication
thereof to be made at least once in the official newspaper of the City not less
than 10 days prior to the date hereinafter set for opening and consideration of

BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF STILLWATER, MINNESOTA,
that the employment of DeLoris J. Larson as a bookkeeper in the City. Clerk's
office, from and after January 20, 1964, be, and the same is hereby, approved;
and that as compensation for services rendered for such employment, the said

RESOLUTION ACCEPTING BID AND AUTHORIZING EXECUTION OF CONTRACT
BE TT RESOLVED. BY THE CITY COUNCIL OF THE CITY OF STILLWATER. MINNESOTA,
that the bid of Stillwater Motor Company, Stillwater, Minnesota, in the
amount of $6.100.00, for the sale and delivery to the City of a new 1964
Chevrolet truck, Model No. C8203, which bid is hereby found to be the
lowest responsible bid, be, and the same is hereby, accepted; and the Mayor
and the City Clerk are hereby authorised and directed to enter into a con-
tract on behalf of the City with the said Stillwater Motor Company for the
purchase of said 1964 Chevrolet truck, said contract to be in accordance
with the specifications and the proposal of the bidder which are on file in
the office of the City Clerk.

RESOLUTION POR REARING ON PROPOSED ASSESSMENT PARKING FACILITIES IMPROVEMENT
WHEREAS. the Council of the City of Stillwater, Minnesota. has approved con-
struction of parking lots in the business district of said City. and bonds
for the purpose have been issued in the amount of $200,000., of which $100,432.20
has heretofore been assessed. the balance of which is now proposed to be
is $21.088.00:
AND NMEtEAS, the City Clerk, assisted by the City Engineer, has prepared a
proposed supplemental amassment amounting to $21,088.00 and has notified the
Council that such proposed msnt has been completed and filed in his office
and Ss open to public inspection:

SE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OP STILLWATER, MINNESOTA,
that the City of Stillwater concurs in the interest of the Federal Government
in the construction of a new post office building in the City of Stillwater.

RESOLUTION NO. 2612
RESOLUTION ADOPTING ASSESSMENT LOCAL IMPROVEMENT NO. 44-1963
WHEREAS, pursuant to proper notice duly given as required by law, the Council
has :met and heard and passed upon all objections to the proposed assessment
for Street Surfacing on South water Street from East Chestnut Street to East
Nelson Street.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota:
1. That such proposed assessment is hereby accepted and shall constitute
the special assessment against the lands named therein, and each tract of land
therein included is hereby found to be benefited by the proposed improvement in
the amount of the assessment levied against it.
2. Such assssawnt shall be payable in equal annual installments extend-
ing over a period of 10 years, the first of the installments to be payable on
the first Monday in January, 1965, and shall bear interest at the rate of 6%
per annum from the date of the adoption of this assessment resolution. To the
first installment shall be added interest on the entire assessment from the date
of this resolution until December 31, 1965. To each subsequent installment,
when due, shall be added interest for one year on all unpaid installments.
3. The owner of any property so ed may, at any time prior to certi-
fication of the assessment to the County Auditor, pay the whole of the assess-
ment on such property with interest accrued to the date of payment, to the City
Treasurer, except that no interest shall be charged if the entire assessment is
paid within 30 days from the adoption of this resolution; he may thereafter pay
to the County Treasurer the installment and interest in process of collection
on the current tax list, and he may pay the remaining principal balance of the
assessment to the City Treasurer.
4. The Clerk shall file the assessment roll pertaining to this assessment
in his office and shall certify annually to the County Auditor on or before
October 10 of each year the total amount of installments and interest which are
to be due in the following year on the assessment on each parcel of land included
in the assessment roll.

RESOLUTION DESIGNATING DEPOSITORIES OF PUBLIC FUNDS
BE IT HEREBY RESOLVED, that the following named banks authorised to do a
banking business in Minnesota, be. and hereby are, designated depositories
of the public funds of the city of Stillwater. County of Washington, Minnesota,
for the term commencing with the 1st day of May. 1964, and ending with the 30th
day of April, 1967, to wit:
The First National Bank of Stillwater, Minnesota, in sums not to
exceed in the aggregate One Hundred Thousand Dollars ($100,000.00)
at any one timer
The Farmers & Merchants State Bank of Stillwater, Minnesota in
sums not to exceed in the aggregate One Hundred Thousand Dollars
(6100,000.00) at any one time:
The Cosmopolitan State Bank of Stillwater, Minnesota, in sums not
to exceed in the aggregate Pour Hundred Thousand Dollars ($400,000.00)
at any one time;
upon the terms and conditions following, to wit:
To secure such funds, the said depositories shall deposit with the City
Treasurer such bond or other collateral as is required or permitted by law.
The total in amount of such collateral computed at its market value shall be
at least ten percent (10%) more than the limit of deposit which would be per-
mitted if a corporate or personal surety bond was furnished. The depositories
may in their discretion furnish both a bond and collateral aggregating the re-
quired amount. Any collateral so deposited shall be accompanied by an assign-
ment thereof to the City, which assignment shall recite that such depository
shall pay over to the Treasurer or his order on demand all moneys deposited
therein at any time during the period such collateral shall be so deposited;
and, that in case of any default on the part of any depository, the City shall
have full power and authority to sell such collateral, or as much thereof as
may be necessary, to realise the full amount due the City and to pay over any
surplus to such depository or its assigns. The depositories may in their
discretion deposit collateral of a value less than the total designation and
may from time to time, during the period of their designation, deposit addition-
al collateral and make withdrawals of excess collateral. or substitute other
collateral for that on deposit or any part thereof. Before any collateral is
deposited with the Treasurer, it shall first be approved by the City Council.
but no such authority shall be necessary for the withdrawal of collateral. If
both bond and collateral are furnished by the depositories, all or any part of
the collateral may be withdrawn without in any way impairing the full force
and effect of the bond unless it shall contain a provision that the collateral
shall not be withdrawn without the consent of the surety thereon. If a cor-
porate surety bond is furnished by either of the depositories, it shall be in
a penal sum not to exceed the amount designated as the limit of deposit herein,
notwithstanding any other provisions of law to the contrary.
At no time shall the Treasurer maintain a deposit in the depositories against
collateral in excess of ninety percent (90%) of the market value thereof. Any
bond furnished shall be approved by the City and filed in the office of the
County Auditor as provided by law, and all collateral deposited shall likewise
be approved by the City and after such approval, deposited with the Treasurer,
unless the City Council shall by resolution fix and determine some other place
for the safekeeping of such collateral. Such collateral shall not be re-
deposited in the designated depositories. The depositories at any time they
deem it advisable or desirable may substitute obligations of the United States
of America for all or any part of the securities pledged. The collateral so
substituted shall be approved by the City at its next official meeting. Such
securities so substituted shall, at the time of substitution, have a market
value sufficient. together with the market value of the original securities
for which no substitution is made, to equal or exceed $110.00 for every $100.00
of public deposits.

Each of said depositories shall pay on demand all deposits therein subject to
payment on demand and shall pay on demand all time deposits therein, with
accrued interest, at or after the end of the periods for which the same shall
have been deposited. All of said disbursements shall be made by order or
warrant signed in an appropriate place by the City Treasurer and by the President
of the City Council or, in the absence of the President. by the Vice President
r.• of the City Council. which warrants when so signed and issued, shall become a
check upon the said City depositories.

WHEREAS, a contract has bean let for Street Surfacing on Pairmeadows Road from
C.S.A.H. No. 5 to 50' W. of Center line Dundee Place; and Dundee Place from
Fairmeadows Road to C.S.A.H. No. 5. And the contract price for such improvement
is $11.959.01: and the expenses incurred or to be incurred in the making of said
improvement amount to $3,016.55, so that the total cost of said improvement will
be $14.975.56; and of this cost the City will pay $3,743.89 as its share of the
cost:
AND WHEREAS, the City Clerk assisted by the City Engineer has prepared a pro-
posed assessment of the cost of said improvement and has notified the Council
that such proposed went has been completed and filed in his office for
public inspection;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OP THE CITY OP STILLWATER.
MINNESOTA:
1. That the cost of such improvement to be specially assessed is hereby
declared to be $11,231.67.
2. That a hearing shall be held on the 7th day of April, 1964. at 7:30
P. M. in the City Hall. to pass upon such proposed assessment, and at such time
and place all persons owning property affected by such improvement will be given
an opportunity to be heard with reference to such assessment.
3. That the City Clerk be. and he is hereby, directed to cause a notice of
said hearing to be published once in the Stillwater Evening Gazette. official
newspaper of the City, at least two weeks prior to the date of said hearing and

RESOLUTION ORDERING IMPROVEMENT AND ACCEPTING BID FOR CONSTRUCTION OF LOCAL
IMPROVEMENT *47 AND KCAL IMPROVEMENT 849-1964
WHEREAS. pursuant to notice duly published in the Stillwater Evening Gazette,
official newspaper of the City, on February 18, 1964 and again on February 25,
1964, a hearing was held on the construction of the following described im-
provements, to -wit:
Local Improvement M47-1964 - South Borup Street
Sanitary Sewer consisting of approximately 950 lineal feet of
8" V.C.P. together with appurtenances; Water Main consisting
of approximately 965 lineal feet of 6" C.I.P. together with
appurtenances;
Local Improvement *49-1964 - West Pine and South West Streets
Sanitary Sewer consisting of approximately 1,015 lineal feet of
8" V.C.P. together with appurtenances;
at which time all persons desiring to be heard were given an opportunity to be
heard, and
WHEREAS, the Council did, by resolution adopted March 10, 1964, authorize and
direct the City Clerk to advertise for bide, returnable at 4:30 o'clock P. M. on

Clerk that, pursuant to said resolution, an advertisement for bide for each of
the above described projects was duly published in the Stillwater Evening Gazette,
official newspaper of the City;
AND WHEREAS, it appears that Erwin Montgomery Construction Company of St. Croix
Falls, Wisconsin, is the lowest responsible bidder for the construction of said
improvements 847-1964 and 049-1964, with a bid of $15,068.98.
NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF STILLWATER,
MINNESOTA:
1. That said improvement be, and it is hereby, ordered as proposed.
2. That said bid of Erwin -Montgomery Construction Company be, and the same
is hereby, accepted; and that the Mayor and the City Clerk are hereby authorized
and directed to enter into a contract with said contractor in the name of the City
for the construction of said improvements for the contract price aforesaid; said
contract to be in accordance with the plans and specifications which are on file
in the office of the City Clerk.
3. That the City Clerk shall retain the deposits made with the three lowest
bids on said improvements for thirty days from and after April 7. 1964, or until

WHEREAS, a contract has been let for the construction of Street Surfacing on
Myrtle Street from Main Street to Fifth Street, and the contract price for such
improvement is $94,805.50; and the expenses incurred or to be incurred in the
making of said improvement amount to $30,463.59, so that the total cost of said
improvement will be $125,269.09; and of this cost the City will pay $112,011.09
as its share of the cost (Municipal State Aid Fund - $76,374.00; Sewer Revenue
Fund - $35,637.09);
AND WHEREAS, the City Clerk, assisted by the City Engineer, has prepared a pro-
posed ment of the cost of said improvement and has notified the Council
that such proposed assessment has been completed and filed in his office for
public inspection;

ordered by Resolution #2571 of this Council has been duly calculated upon the
basis of benefits, without regard to cash valuation, in accordance with the

RESOLUTION AUTHORIZING FORMATION OF CENTRAL WASHINGTON COUNTY PLANNING
COMMISSION, AUTHORIZING MEMBERSHIP IN SAID COMMISSION, AND AUTHORIZING THE
EXPENDITURES OF FUNDS THEREFOR
WHEREAS, the City of Stillwater recognizes the need and desirability of
community planning as a means of helping to assure sound and orderly growth
and development; and
WHEREAS, it is desirable for community development plans to be coordinated
with those of neighboring communities and the region as a whole; and
WHEREAS, the proper development of plans can beat be accomplished through the
aid and assistance of professional planners which necessitates the expenditure
of funds for said aid and assistance; and
WHEREAS, planning expenditures can be reduced to a minimum by the cooperative
and joint efforts of several communities employing the same professional
planner who will aid in the development of local plans and relate each to the
cther to form a regional or district development plan; and
WHEREAS, various communities in Central Washington County are contemplating
the formation of a joint planning effort in the form of a District Planning
Commission which will serve as a single agent to contract with the State De-
partment of Business Development and a consultant planner to provide technical
and professional services for the individual communities and the group as a
whole; and
WHEREAS. it is desirable to utilize Federal financial assistance in the planning
effort and such financial assistance can be made available to the individual
communities through a joint planning effort; and
WHEREAS, the City of Stillwater finds that participation in the planning effort
of the proposed Central Washington County Planning Commission would provide
an efficient, suitable, and economical agent for the development of a Compre-
hensive Development Plan for all participating communities;
NOW, THEREFORE, BE IT RESOLVED:
The City of Stillwater agrees to become an associate member of the Central
Washington County Planning Commission which shall meet regularly once each month
at a designated meeting place for purposes of (1) developing a district develop-
ment plan and local development plans through contractual agreements between
the Commission, the State of Minnesota, and a planning consultant; (2) acting
as a forum for the discussion of planning and development problems common to all
communities in Central Washington County; and (3) providing advice and recommen-
dations to the member and associate member communities in a manner commonly
practiced by all planning commissions in the State of Minnesota.
Be it further resolved, the City of Stillwater shall be represented on the
Central Washington County Planning Commission by one elected official and one
member of the Stillwater Planning Commission.
Further resolved, that the City of Stillwater hereby agrees to deposit with the
Secretary -Treasurer of the Central Washington County Planning Commission the sum
of Two Hundred Dollars ($200.00) to be used exclusively for the purpose of pro-
viding the local share required to participate in a planning program under terms
of a Federal Grant from the Urban Renewal Administration of the Housing and Home
Finance Agency, under the Urban Planning Assistance Program authorized by Section
701 of the Housing Act of 1954, as amended. It is further stipulated that the
Central Washington County Planning Commission shall submit an annual report to
all member and associate member communities containing a financial statement and
summary of work progress.
Further resolved, the City of Stillwater shall consider a Central Washington
County Planning Commission to be in existence at such time as two or more
communities in Washington County have appropriated funds for purposes as described
herein; the Commission has elected a Chairman, Vice -Chairman, and Secretary -
Treasurer; the Commission has adopted by-laws or rules of procedure, and has

established a bank account in the name of the Commission with the Secretary -
Treasurer authorised to pay all bills of the Commission subject to a majority
vote of the members in attendance at any regular meeting.
Further resolved, upon completion of the district Comprehensive Development
Plan as herein authorized, the City of Stillwater may maintain its associate
membership in the Central Washington County Planning Commission in the recog-
nition of a need for area -wide coordination of planning and the discussion of
development problems that transcend political boundaries. The City of Stillwater
may from time -to -time appropriate additional funds to the Central Washington
County. Planning Commission if a clear need is demonstrated and such funds would
provide a clear and tangible benefit to the people of Stillwater.

BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that
for the purposes of off street parking, the purchase of certain property owned
by the Northern Pacific Railway Company, is hereby authorised, said property
situated in Washington County, Minnesota, being more particularly described as
follows, to -wit:
All that part of Block Eighteen (18) in the original
town (now City) of Stillwater as surveyed and platted
by Harvey Wilson, and of record in the office of the
Register of Deeds in and for said County, bounded as
follows:
Beginning at a point on the north line of Commercial
Avenue one hundred (100) feet easterly from the east
line of Main Street; thence running northerly on a line
parallel with said east line of Main Street a distance
of fifty (50) feet: thence east a distance of twenty
(20) feet; thence south parallel with said east line of
Main Street a distance of fifty (50) feet; thence west
a distance of twenty (20) feet to the point of beginning;
being a portion of the premises described in that certain

WHEREAS, pursuant to proper notice duly given as required by law, athese Councncil
has met and heard and passed upon all objections to the proposed
for Street Surfacing on Myrtle Street from Main Street to Fifth Street;

1. That such proposed assessment is hereby accepted and shall
constitute the special assessment against the lands named therein,
and each tract of land therein included is hereby found to be
benefited by the proposed improvement in the amount of the assess-
ment levied against it.
2. Such assessment shall be payable in
nequal annual ual installments
extending on-r a period of ten (10) years,
installments to be payable on the first Monday in January, 1965,
and shall bear interest at the rate of 6% per annum from the date

Treasurer the installment and interest in process of collection on

Auditor on or before October 10 of each year the total amount of in-

WHEREAS, the Chief of Police did report to the Mawr of the City of Stillwater
that one of the policemen has accepted a position in another municipality:
AND WHEREAS, the Chief of Police has presented the following proposal: that
a replacement not be hired, and that the salary which has been paid to the
policeman now resigning be used to compensate the remaining policemen for the
additional tine or. duty necessary to afford adequate police protection for the
citizens of Stillwater:
AND WHEREAS, after careful consideration. the Council members consider this to
be a satisfactory arrangement, and that this will not be an additional cost of
police operation;
NOW, THEREFORE, SE IT RESOLVED. by the Council of the City of Stillwater. that
the saving to the City occasioned by operating the department with one less
policeman, be used to compensate the remaining policemen for additional time on
duty; their salaries to be fixed as follows, effective June 15, 1964:

RESOLUTION NO. 2661
RESOLUTION CONFIRMING STILLWATER CIVIL DEFENSE EMERGENCY PLAN AND ITS OPERATION
BE IT RESOLVED, by the City Council of the City of Stillwater. Minnesota. that
the City of Stillwater, political subdivision of the County of Washington,
State of Minnesota, will cooperate to the full extent of our capabilities with
the County of Washington, State of Minnesota and the Federal Government, in the
study and development of the Stillwater Civil Defense Emergency Plan and its
operation, providing a maximum of protection of life and property through the
Stillwater Emergency Plan and operations.
BE IT FURTHER RESOLVED. that a director shall be appointed to direct all
Stillwater Civil Defense activities and planning, taking an oath in writing
as prescribed by the Minnesota Statutes, Chapter 12. Sec. 12.43, and he shall
be assisted by such volunteers as the Stillwater City Emergency Plan calls for.
BE IT FURTHER RESOLVED. that under the Stillwater Emergency Plan, some form of
shelter will be planned for its citizens for Civil Defense emergencies, natural
and atomic disasters. It is hereby found and declared to be necessary:
1. To establish a City Civil Defense organization;
2. To provide for the exercise of necessary powers during
Civil Defense emergencies and at the time of natural
disaster;
3. To provide for the necessary planning and training
needed to meet the requirements of the City Council;
4. To provide for the rendering of mutual aid between this
City and other county subdivisions with respect to
carrying out Civil Defense functions when called upon
by Washington County and/or State Civil Defense and
Federal Government.

RESOLUTION ENTERING INTO AGREEMENT WITH LEIGHTON CHARLSEN, D/B/A CHARLSBN
TRUCKING SERVICE
WHEREAS, Leighton Charlsen, d/b/a Marlsen Trucking Service, has agreed to purchase
land suitable for a sanitary land -fill, and that he will allow the residents of the
City of Stillwater, for a ten year period, to dispose of rubbish, and has agreed
to furnish a land -fill operation for the sum of $4,500.00 per year;
NOW, THEREFORE, BE IT RESOLVED, by the council of the City of Stillwater, Minnesota,
that the City enter into an agreement with the said Leighton Charlsen, d/b/a
Charlsen Trucking Service, as set forth above, and the Mayor and City Clerk are
hereby authorized and directed to execute said agreement in behalf of the City of
Stillwater.

RESOLUTION RELEASING OPTION
WHEREAS, the Northern States lower Company is desirous of acquiring real estate,
owned by O. Skooglun and Esther B. Skooglun, husband aim wife, described as
follows, to -wit:
Pi. of Gov. Lot 5, Sec 34, T30, R20, being
all lying -aetween the C. M. & St. P. Railroad
and the C. St. P. M. & O. Railroad, except the
N. 7O0 it.;
AND WHEREAS, the City of Stillwater, Minnesota, has first right and option to
purchase the Northerly two (2) acres of the foregoing described real estate;
and this option interferes with the proposed transaction between the Northern
States Power Company and O. Skooglun and Esther B. Skooglun insofar as obtaining
a clear title to this property;
AND WHEREAS, the Northern States Power Company has requested that the City of
Stillwater release its option on the foregoing described real estate; and after
the transaction is completed between the Northern States Power Company and
O. Skooglun and Esther B. Skooglun, said Northern States Power Company agrees to
give the City of Stillwater first right and option to purchase the Northerly two
(2) acres of the foregoing described real estate at a price to be determined by
three disinterested appraisers; one to be appointed by the City of Stillwater,
one to be appointed by the Northern States Power Company, and the third to be
appointed by the two so appointed;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota, that the first right and option, to purchase the Northerly two (2)
acres of the foregoing described real estate, between O. S. Skooglun and Esther

bid. be, and the same is hereby accepted: and the Mayor and the City Clerk are
hereby authorized and directed to enter into a contract on behalf of the City
with the said Bahia Motor & Implement, Inc. for the purchase of said 1959
International, said contract to be in accordance with the specifications and
the proposal of the bidder which are on file in the office of the City Clerk.

RESOLUTION ACCEPTING WORK - DEMOLISHING BUILDINGS FOR PARKING FACILITIES
WHEREAS, pursuant to written contract signed with the City on the 24th day
of June, 1964, Griffen Wrecking Service of Moorhead, Minnesota, has satis-
factorily completed demolition of the Erickson. Humphrey and Pino buildings
in accordance with such contract;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota, that the work completed under said contract is hereby accepted and
approved, and that a warrant be drawn upon the City Treasurer in the sum of
$5,222.00 and issued to the contractor for the final payment of said contract.

RESOLUTION ACCEPTING BID FOR CONSTRUCTION OF LOCAL IMPROVEMENT NO. 50 - 1964
WHEREAS, the Council did authorize and direct the City Clerk to advertise for
bide returnable at 4:30 o'clock P. M., on Tuesday, October 6, 1964. for the
construction of the following described improvement:
Construction of Storm Sewer - consisting of approximately
100 lineal feet of 15" and 381 lineal feet of 18" Reinforced
Concrete or Transite Pipe together with all appurtenances;
Area between South Grove Street on the East; South Hemlock
Street on the West; West Olive Street on the North; West
Oak Street on the South;
AND WHEREAS, it appears from the affidavit of publication presented by the City
Clerk that said advertisement for bids for said improvement was duly published in
the Stillwater Evening Gazette, official newspaper of the City;
AND WHEREAS, it appears that Moelter Construction company, Inc. is the lowest
responsible bidder for 'he construction of said improvement with a total bid of
$5,737.50.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STILLWATER,
MINNESOTA:
1. That the bid of the said Moelter Construction Company, Inc. be, and
the same is hereby, accepted; and that the Mayor and the City Clerk are hereby

RESOLUTION ACCEPTING WORK - DEMOLISHING BUILDING
WHEREAS, pursuant to written contract signed with the City on the 10th day
of August, 1964, Junker Landscaping of Stillwater, Minnesota, has satisfactorily
completed demolition of the old Methodist parsonage, owned by the City,
located at 107 North Fourth Street, in accordance with such contract;
NOW, THEREFORE, BE IT RESOLVED, by the City council of the City of Stillwater,
Minnesota, that the work completed under said contract is hereby accepted
and approved, and that a warrant be drawn upon the City Treasurer in the sum
of Five Hundred and Ninety-five ($595.00) Dollars, and issued to the contractor
for the final payment of said contract.

RESOLUTION - UNANIMOUS SUPPORT
Mayor
WHEREAS, surveys show that over 90% of all residents and property owners in
Washington County wholeheartedly support the location of the NSP plant on
the St. Croix River in Oak Park Heights;
AND WHEREAS, the people who must bear the burden of taxes in the area and
whose futures are linked with the economic progress of the area, know that
the advantages of the NSP plant will far outweigh any possible disadvantages,
and that the drawbacks cited by the opponents are either greatly exaggerated
or completely without foundation;
AND WHEREAS, the location of the NSP plant in the St. Croix Valley holds the
promise of a bright future for the area in which we can begin to realize our
potential for industrial development to complement our natural and recreational
resources;
AND WHEREAS, we who live and pay taxes in the Valley have the right to determine
our own future course, and reject attempts by outsiders and people who do not
pay taxes in the area to divide us and tell us that we cannot have industrial
development;
BE IT THEREFORE RESOLVED, that we, along with the great majority of other
Washington County residents, reaffirm our support of the NSP plant location in
Oak Park Heights and that we ask other persons and agencies that have become
involved in this matter to respect our rights and priorities as residents of the
affected area.

RESOLUTION NO. 2688
RESOLUTION - TO EXPEDITE HEARINGS
WHEREAS, NSP obtained the property for its steam plant in Oak Park Heights more
than 20 years ago, and
WHEREAS. NSP publicly announced plans for construction of its steam plant on the
St. Croix River in May, 1964; and
WHEREAS, the local governing bodies gave their hearty approval to the construction
of this plant; and
WHEREAS, NSP has applied to the Minnesota Water Pollution Control Commission and
to the Minnesota Department of Conservation for necessary permits to construct
the plant; and
WHEREAS, hearings have been requested to be held in November, 1964; and
WHEREAS, it is absolutely necessary that major construction of this plant begin
on the plant site early in the spring of 1965 so that the plant can be completed
in 1968;
BE IT THEREFORE RESOLVED, that we respectfully urge the Minnesota Water Pollution
Control Commission and the Minnesota Department of Conservation to expedite these
hearings and studies concerning NSP's applications and make their findings at the
earliest possible date so that NSP can maintain its construction schedule for the
benefit of all of its customers.

RESOLUTION - PARK
WHEREAS, the lower St. Croix Valley has had commerce and industry since the
fur tradin; and logging days: and
WHEREAS, commercial and industrial activities have been developed and
carried on in the valley in complete harmony with our recreational resources
and have contributed to the economy of the valley; and
WHEREAS, the apparent basic purpose of those opposing the NSP plant in Oak
Park Heights is to set aside the entire valley as a recreational area or
park solely for pleasure purposes thereby restricting industrial development,
commercial navigation, and certain types of land ownership; and
WHEREAS, the establishment of such a park or recreational area would require
the public acquisition of large tracts of land along the river and the
acquisition of rther areas for public access to the river across private
lands; and
WHEREAS, the establishment of a park would raise the question as to whether
or not existent commercial and industrial enterprises would be allowed to
remain in the area;
BE IT THEREFORE RESOLVED, that we are opposed to the establishment of a park
or recreational area that would do away with present and future industrial
development in the valley.

RESOLUTION ESTABLISHING THE POSITION OF CITY ADMINISTRATOR AND DEFINING THE DUTIES
OF THE CITY ADMINISTRATOR
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, as
follows:
WHEREAS, the City Council has appointed a chief executive officer called a
"City Administrator" for the purpose of increasing efficiency in the administration
of municipal affairs; and
WHEREAS, the Administrator is designated the agent of the Council in carrying out
Council policies; and
WHEREAS, we, the members of the Council, have agreed to deal with the administra-
tion of the City only in a formal manner through the Administrator, and further,
have agreed that administrative functions shall at no time be delegated to
members of the Council; and
WHEREAS, the Administrator is appointed by the Council and is accountable to the
Council for the efficient coordination of all municipal functions.
NOW, THEREFORE, BE IT RESOLVED, that the duties and responsibilities of the
Administrator shall be as follows:
The Administrator shall provide the Council with information which
will enable it to determine municipal policies, shall advise the
council in matters of policy if the Council shall so desire, and
shall execute the policy determined by the Council.
The Administrator shall introduce the best principles of advanced
administrative organization and practice, and shall be held
responsible for the proper coordination of all administrative
activities under his direction.
The Administrator is empowered to make the necessary purchases and
supplies for all departments of the City; no expenditure, however,
to exceed the sum of $1,000.00, and all expenditures and payments to
be within the limits established by the budget and any other direction
by the City Council.
He shall:
Co.) 1. See that the laws and ordinances and resolutions of the City are
enforced, if within his jurisdiction, and whenever necessary shall make
recommendations for changes or additions to existing ordinances.

2. Recommend appointments of all department chiefs subject to confirm-
ation by the City Council, except Chief of Police, in which case he will recommend
appointment to the Mayor.
3. Exercise control over all departments, supervise department heads,
and shall suspend the remuneration of any employee for a period not longer than
thirty calendar days, for cause, and subject to Council review.
4. Make all such recommendations to the Council concerning municipal
affairs as shall to him seem necessary.
5. Keep the Council advised of the financial condition and future
needs of the City.
6. Prepare and submit the annual budget of the City and enforce the
budget after its adoption by the Council.
7. See that all reports are prepared and submitted to the Council, as
the Council may require.

RESOLUTION VACATING A PART OF COMMERCIAL AVENUE
WHEREAS, at a meeting of this Council held on the 6th day of October, 1964,
the City Council did, after due consideration, deem it expedient to proceed
with the matter of vacating a part of Commercial Avenue; and
WHEREAS, the City Clerk did thereupon and thereafter give notice by publication
in the Stillwater Evening Gazette. official newspaper of the City, for fo'tr
successive weeks beginning on Thursday, October 15, 1964, and thereafter on
Thursday of each week to and including November 5, 1964, to the effect that
said matter would be heard and considered by the Council at the City Hall in
the City of Stillwater, Minnesota on the 17th day of November, 1964, at 7:30
o'clock P. M.; and
WHEREAS, at the time and place appointed in said notice, the Council did
investigate and consider said matter and did hear the testimony and evidence cn
the part of all parties interested:
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota, that the following part of Commercial Avenue as presently laid out
and dedicated in said City be and the same is hereby vacated, absolutely and
forever, viz:
Between North Main Street and North Water Street,
approximately One Hundred Twenty-six (126) feet.
BE IT FURTHER RESOLVED, that the Council deems substantial benefits will accrue
to the City from the vacation of that part of said street as herein provided,
and the public benefits will be such that said vacation is hereby ordered without
payment of compensation.
BE IT ALSO FURTHER RESOLVED, that upon publication of this resolution according
to law, a transcript thereof, together with a duplicate of the plat showing the

RESOLUTION NO. 2695
RESOLUTION VACATING A PART OP EAST WILLOW STREET
WHEREAS, at a meeting of this Council held on the 15th day of September,
1964, a petition was presented praying for the vacation of a part of
East Willow Street in the City; and
WHEREAS, at said meeting the Council did, after due consideration, deem
it expedient to proceed with said matter and did order the said petition
to be filed in the office of the City Clerk; and
WHEREAS, the City Clerk did thererpon and thereafter give notice by
publication in the Stillwater Evening Gazette. official newspaper of the
City, for four successive weeks beginning on Friday, September 18, 1964,
and thereafter on Friday of each week to and including October 9, 1964, to
the effect that said petition had been filed as aforesaid and stating con-
cisely its objects and that said petition would be heard and considered by
the Council at the City Hall in the City of Stillwater, Minnesota, on the
loth day of November, 1964, at 7:30 o'clock P. M.; and
WHEREAS, at the time and place appointed in said notice, the Council did
investigate and consider said matter and did hear the testimony and evidence
on the part of all parties interested;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stil:water,
Minnesota, that the said petition be and the same is hereby granted and that
the following part of East Willow Street as presently laid out and dedicated
in said City be and the same is hereby vacated, absolutely and forever, viz:
All that part of East Willow Street lying East of
the Easterly line of the Northern Pacific Railway
Company right-of-way and West of the West line of
vacated North Lake Street, North of Block Forty-
one (41) and South of Block Fifty (50), Carli &
Schulenberg's Addition to Stillwater.
BE IT FURTHER RESOLVED, that the Council deems substantial benefits will
accrue to the City from the vacation of that part of said street as herein
provided, and the public benefits will be such that said vacation is hereby
ordered without payment or compensation.
BE IT ALSO FURTHER RESOLVED, that upon publication of this resolution accord-
ing to law, a transcript thereof, together with a duplicate of the plat
showing the part of said public street vacated hereby, certified by the City
Clerk, shall be filed for record and recorded in the office of the Register
of Deeds of Washington Count_,, Minnesota.

May, 1964, Erwin Font^omery Construction Company, St. Croix Falls, Wisconsin,
has satisfactorily completed construction of Local Improvement No. 47 and
Local Improvement No. 49 in accordance with such contract;
NOW, THEREFORE, BE IT RESOLVED, BY THE CITY OF STILLWATER, MINNESOTA, that the
work completed under said contract is hereby accepted and approved, and that a
proper warrant be drawn upon the City Treasurer and issued to the contractor
for the final payment on said contract.

RESOLUTION NO. 2700
RESOLUTION GRANTING AN OPTION TO THE POSTMASTER GENERAL OF THE UNITED STATES
TO PURCHASE CERTAIN CITY PROPERTY
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, as
follows:
WHEREAS, the City Council recognizes the necessity of replacing the present
City Hall and Fire Barn in order tc carry on efficient City government; and
WHEREAS, the Postmaster General of th• United States has approached the City
Council and expressed an interest in purchasing the aforementioned property,
located on Lots 11, 12 and 13, and the East 90 feet of Lots 14, 15 and 16,
Block 20, of the Original Plat of the City of Stillwater, Minnesota; and
WHEREAS, negotiations have been conducted between the City Council and a
representative of the Postmaster General of the United States, and as a result
thereof the City Councildeems it in the best interests of the City of
Stillwater 'to tender to :maid Postmaster General of the United States an option
to purebase the above described property for the sum of Eighty Thousand
($80,000.00) Dollars;
NOW, THEREFORE, BE IT RESOLVED, that the Mayor of the City of Stillwater,
Minnesota, execute and deliver an option to purchase Lots 11, 12 and 13, and
the East 90 feet of Lots 14, 15 and 16, Block 20 of the Original Plat of the
City of Stillwater, Minnesota, properly attested to in accordance with the
Charter of said City.

RESOLUTION FOR HEARING ON PROPOSED ASSESSMENT LOCAL IMPROVEMENT NO. 47
WHEREAS, a contract has been let for the construction of sanitary sewer and
watermain in South Borup Street from West Pine Street to South City Limits
as it intersects South Borup Street. And the contract price for such
improvement is $10.208.25; and the expenses incurred or to be incurred in
the making of said improvement amount to $1,314.10, so that the total cost
of said improvement will be $11,314.10; and of this cost the City will pay
$None as its share of the cost;
AND WHEREAS, the City Clerk, assisted by the City Engineer, has prepared a
proposed assessment of the cost of said improvement and has notified the
Council that such proposed assessment has been completed and filed in his
office for public inspection;
NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF STILLWATER,
MINNESOTA:
1. That the cost of such improvement to be specially assessed
is hereby declared to be $11,314.10.
2. That a hearing shall be held on the 9th day of February,
1965, at 7:30 P. M. in the City Hall, to pass upon such proposed assessment,
and at such time and place all persons owning property affected by such
improvement will be given an opportunity to be heard with reference to such
assessment.
3. That the City Clerk be, and he is hereby, directed to cause a
notice of said hearing to be published once in the Stillwater Evening Gazette,
official newspaper of the City, at least two weeks prior to the date of said
hearing and to be mailed to each property owner known to be affected by said
improvement at least two weeks prior thereto, said notice to specify the total
cost of said improvement.

RESOLUTION ACCEPTING PETITION AND ORDERING PREPARATION OF PRELIMINARY REPORT
WHEREAS. a petition was presented by Joseph A. Nolde, Sr.; said petition was
found to be adequate and was accepted by the Council. It has been proposed
to construct the following described improvement and to assess the benefited
property for all or a portion of the cost thereof, viz:
Installation of water in South Sixth Street from the
existing watermain in West Hancock Street connecting
to existing watermain on the South line of Lot 16,
Block 2, Marsh's Addition to the City of Stillwater.
NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF STILLWATER,
MINNESOTA, that the said proposed improvement be referred to the City Engineer
for study and report, advising the Council in a preliminary way as to whether
the proposed improvement is feasible and as to whether it should be made as
proposed or in connection with some other improvement, and the estimated cost
of the improvement as recommended.

RESOLUTION CONFIRMING APPOINTMENT OF POLICE OFFICER
EN It RESOLVED. by the City Council of the City of Stillwater, Minnesota.
that the appointment of Albert Cote as a police officer of the City for a
probationary period of not to exceed six months. commencing January 1, 1965,
be, and the same is hereby, confirmed; that as such police officer the said
Albert Cote shall have the powersof police officers at coon law or under
the laws of the State of Minnesota, and it shall be his duty to serve
warrants, summons, writs, subpoenas or other process issued by the Municipal
Court, to commend the peace, suppress rioting or disorderly conduct within
the City and to arrest Nth or without a warrant, as authorised by the laws
of this State, persons charged with the commission of any public offense
under the laws of the State of Minnesota or the ordinances of. the City. and
to perform any and all other duties incidental to the office of a policeman
as directed by the City Administrator or the Chief of Police, and that the
said Albert Cote shall receive as compensation for services rendered assuch
police officer ths sum of $425.00 per month.
