RESOLUTION APPROVING Eb:PLOYMENT OF POLICE DEPARTMENT DISPATCHER
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that
the employment of Arthur Andrews as a dispatcher In the Police Department of
the City from and after December 1, 1962, be, and the same is hereby, approved;
and that as compensation for services rendered in such employment, the said
Arthur Andrews shall receive the sum of 4190.00 per month and shall be entitled
to all other benefits of City employment.

RESOLUTION FOR HEARING ON PROPOSED ASSESSMENT -LOCAL IMPROVEMENT No.29 - 1961
WHEREAS, a contract has been let for the improvement consisting of grading
and surfacing of West Pine Street, between South Grove Street and South Brick
Street, and South Hemlock Street, between West Olive Street and West Pine
Street, and West Moore Street, between North Fourth Street and North Martha
Street, including curbs and gutters, and the contract price for such improve-
ment is 027,424.80, and the expenses incurred or to be incurred in the making
of said improvement amount to 034 950.4o and of this cost the City will pay
38,737.60 as its share of the cost;
AND, 'WHEREAS, the City Clerk assisted by the City Engineer has prepared a
proposed assessment of the cost of said improvement and has notified the Coun-
cil that such proposed assessment has been completed and filed in his office
for public inspection;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Stillwater,
Minnesota:
1. That the cost of such improvement to be assessed is hereby declared to be
y26,212.30.
2. That a hearing shall be held on the 1.3th day of February, 1963 et 7:31
o'clock, P.N., in the City Hall, to peas upon such proposed assessment and at
such time and place all persons owning property affected by such improvement
will be given an opportunity to be heard with reference to such assessment.
3. That the City Clerk be, and he is hereby, directed to cause a notice of
said hearing to be published once in the Stillwater Evening Gazette, official
newspaper of the City, at least two weeks prior to the date of said hearing
and to be mailed to each property owner known to be affected by said improve -
men`, at least ten days prior thereto, said notice to specify the total cost
of said improvement.

WHEREAS, a contract has been let for the improvement consisting of:
Project No. 1: Construction of 8" sanitary sewer on North Fourth Street from
!lest St. Croix Avenue North to a point ten feet North of the South side of
Moore Street.
Project No. 2: Construction of 3" sanitary sewer on Oak Ridge Road from the
County HighwayVest to Laurie, on Laurie Lane Northerly to Fairmeadows Road
and on Hanson Place from Oak Ridge Road Northerly to Fairmeadows Roed, end con-
struction of 10" sanitary sewer on Fairmeadows Road from Laurie Lane 'Westerly
to the County Highway and thence Northeasterly to the intersection on Oakes and
Olive Streets.
Project No. 3: Construction of 8" sanitary sewer en South Everett Street from
a point approximately 150 feet South of Anderson Street Southerly to a proposed
sewage pumping station near the intersection of South Everett Street and Orleans
Street and construction of sanitary sever force main from said proposed sewage
pumping station to discharge into the existing sanitary sewer on West Churchill
and Everett Street.
Project No. 12: Construction of 8" sanitary sewer on West St.Croix Avenue from
Ror h Carnelian Street to North William Street, thence South on North William
Street for a distance of approximately 60 feet to .Pest St. Croix Avenue, and
thence East on West St.Croix Avenue for a distance of approximately 200 feet to
nonnect with existing 6" sewer.
Project No. 13: Construction of 8" sanitary sewer on West Hancock Street from
South Everett Street to the East line of Ritzer's Subdivision,
and the contract price for such improvement is $58,962.00, and the expenses
incurrred or to be Incurred in the making of said improvement amount to
$59,753.39 and of this cost the City will pay $none as its share of the cost;
AND, WREREAS, the City Clerk assisted by the City Engineer has prepared a pro-
posed assessment of the cost of said improvement and has notified the Council
that such proposed assessment has been completed and filed in his office for
public inspection.;
NOW, THEREFORE, BE IT RESOLVED by the C1ty Council of the City of Stillwater,
Minnesota:
1. That the cost of such improvement to be assessed is hereby declared to be
$59,753.39.
2. That a hearing shall be held on the 13th day of February, 1963 at 7:30
o'clock P.M., in the C1ty Hall, to pass upon such proposed assessment and at
such time and place all persons owning property affected by such improvement
will be given an opportunity to be heard with reference to such assessment.
3. That the City Clerk be, and he is hereby, directed to cause a notice of
said hearing to be published once in the Stillwater Evening Gazette, official

he is hereby, commended; that recognition be given to the fact that for the
period of years he has been in office, the said James L. Simpson dedicated

RESOLUTION ORDERING DARING ON PROPOSED IMPROVEMENT
WHEREAS, the City Engineer has reported to the Council that the improvement con-
sisting of the grading and surfacing of South Everett Street, between West Ander-
son Street and West Orleans Street, including construction of necessary cubs,
gutters and sewer and water lateral connections, is feasible and may best be made
in conjunction with the improvement consisting of the grading and surfacing of
West Moore Street, between North Martha Street and North William Street, including
construction of necessary curbs and gutters;
AND, WHEREAS, the Cityµ Engineer has further reported that the es.imated cost of
said improvements are 9,165.00 and $9,272.00, respectively;
AND, WHEREAS, the area proposed to be assess ed includes all benefited property
abutting upon the portions of the streets above mentioned;
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that
this Council shall meet at the City Hall in said City on Wednesday, the 13th day
of February, 1963, at 7:30 o'clock, P.M., for the purpose of holding a public
hearing on the making of the above described improvements, and that the City Clerk
be, and he is hereby, authorized and directed to cause proper notice of the time,
place and purpose of said meeting to be published in the official newspaper of the
City and mailed to the owner of each parcel of land within the area proposed to be
assessed as prescribed by law.

RESOLUTION 2486
RESOLUTION ADOPTING ASSESSMENT - LOCAL IMPROVEMENT O. 29 - 1961
WHEREAS, pursuant to proper notice duly given as required by law, the Council
has met and heard and passed upon all objections to the proposed assessment
for the improvement consisting of the grading and surfacing of West Pine Street
between South Grove Street end South Prick Street, and South Hemlock Street be-
tween West Olive Street and lest Pine Street, and 'West Moore Street between
North Fourth Street and North Martha Street, including curbs and gutters.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota:
1. That such proposed assessment is hereby accepted and shall constitute the
special assessment against the lands named therein, and each tract of land
therein included is hereby found to be benefited br the proposed Improvement in
the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending over
a period of 15 years, the first of the installments to be payable on the first
Monday in January, 1964, and shall hear interest at the rate of 6 per cent per
antrum from the date of the adoption of this assessment resolution. To the first
installment shall be added interest on the entire assessment from the date of
this resolution until December 31, 1964. To each subsequent installment when
due shall be added interest for one year rt all unpaid installments.
3. The owner of any property so assessed may, at any time prior to certifica-
tion of the assessment to the County Auditor, pay the whole of the assessment
on such property, with interest accrued to the date of payment, to the City
Treasurer, except that no interest shall be charged if the entire assessment is
paid within 30 days from the adoption of this resolution. He may thereafter
pay to the County Treasurer the installment and interest in process of collec-
tion on the current tax list, and he may pay the remaining principal balance
of the assessment to the City Treasurer.
4. The City Clerk shall file the assessment rolls pertaining to this assess-
ment in his office and shall certify annually to the County Auditor on or before
October 10 of each year the total amount of installments and interest which are
to be due in the following year on the assessment on each parcel of land inclu-
ded in the assessment roll.

RESOLUTION FOR HEARING ON PROPOSED STREET LIGHTING ASSESSMENT
WHEREAS, a contract has been let for the improvement consisting of the construction
of a residential street lighting system in Forest Hills Addition to the City of Still-
water andlthe contract price for such improvement is $11,900.00, and the expenses in-
curred or to be incurred in the making of said improvement amount b $11,912.75 and of
this cost the City will pay $ none as its share of the cost;
AND, WHEREAS, the city clerk assisted by the city Engineer has prepared a proposed
assessment of the cost of said improvement and has notified the Couacll that such pro-
posed assessment has been completed and filed in his office for public inspection.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Stillwater, Minn-
esota;
1. That the cost of such improvement to be assessed is hereby declared to be $11,912.75.
2. That.a hearing shall be held on the 12th day of March, 1963, at 7:30 o'clock, P.M.,

Council shall meet at the City Hall in said city on Tuesday, the 12th day of March,
1963, at 7:30 o'clock, P.M., for the purpose of holding a public hearing on the mak-

RESOLUTION ADOPTING ASSESSMENT
WHEREAS, pursuant to proper notice duly given as required by law, the Council
has met and heard and passed upon all objections to the proposed assessment for
the improvement consisting of the construction of a residential street lighting
system in Forest Hills Addition to the City of Stillwater.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota:
1. That such proposed assessment is hereby accepted and shall constitute the
special assessment against the lands named therein, and each tract of land there-
in included is hereby found to be benefited by the proposed improvement in the
amount of the assessment levied against it.
2. Such assessment shall be payable in one installment the installment to be
payable on the first Monday in January, 1964, and shall bear interest at the rate
of 6 per cent per annum from the date of the adoption of this assessment resolu-
tion, to said installment shall be added interest on the entire assessment from the
date of this resolution until December 31, 1964.
3. The owner of any property so assessed may, at any time prior to certification
of the assessment to the County Auditor, pay the whole of the assessment on such
property, with interest accrued to the date of payment, to the City Treasurer, ex-
cept that no interest shall be charged if the entire assessment is paid within 30
days from the adoption of this resolution. He may thereafter pay to the County
Treasurer the installment and interest in process of collection on the current tax
list.
4. The City Clerk shall file the assessment roll pertaining to this assessment in
his office and shall certify same to the County Auditor on or before October 10,
1963.

RESOLUTION CONFIRMING APPOINTMENT OF POLICE OFFICER
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that
Eugene R. Hanke,heretofore appointed as a police officer of the City for a period
of six months by resolution adopted October 9, 1962, be, and he is hereby appointed
as a regular police officer with the same powers and duties as set forth in said
resolution of October 9, 1962; that said appointment shall be effective from and
after March 18, 1963; and that as compensation for services rendered as such police
officer, the said Eugene R. Henke shall receive the sum of $370.00 per month to-
gether with all other benefits of employment in the Police Department of the City.

RESOLUITION RELATING TO COMPENSATION OF PIRE AND POLICE DEPARTMENT EMPLOYEES
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that here-
after any person employed in the Fire Department or Police Department of the City,
who shall return to duty on a day when he Would otherwise not be required to do so
for the purpose of replacing another member of the Department who is sick, disabled
or on vacation, shall be compensated for each day. or portion thereof, of such addi-
tional service at a rate to be based upon the compensation of such replacing member
effective at the time of replacement.

to -wit:
Protect No.l; Construction of water main in Pairaeadows Road from the
east line of Crestwood Terrace to a point 50 feet west of the center
line of Dundee Place end in Dundee Place from Fairmeadows Road to County
Highway No. 5; construction of sanitary sewer main in Dundee Place from
Pairmadows Road to County Highway Mo. 5 and in County Highway No. 5
from Dundee Place to Pairmeadows Road; and construction of all necessary
-sewer and water lateral service connections;
Protect No. 2: Street grading and surfacing on Pairmeadows Road from
County Highway No. 5 to a point 50 feet west of the center line of Dun-

WHEREAS, it appears that Houliston Contracting Company, Inc., of Taylors Palls.
Minnesota, is the lowest responsible bidder for the construction of said Pro-
ject No. 1 with a bid of $14.444.85; and that Ray Sina Contracting Company,
Ina., of New Brighton, Minnesota, is the lowest responsible bidder for the
construction of said Project No. 2 with a bid of $11,959.01.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota;
IMO 1. That said improvement be, and it is hereby. ordered as proposed.
2. Ibat said bids of Houliston Contracting Company. Inc., and Ray Sina Con-

sidewalks and other miscellaneous construction items on Myrtle Street from Main

RESOLUTION ORDERING HEARING ON SANITARY SEWER AND WATER MAIN IMPROVEMENTS
AND PREPARATION OF PLANS AND SPECIFICATIONS
WHEREAS. this Council did on the 21st day of Hay, 1963, receive the prelimi-
nary report of the City Engineer that the improvements, consisting of con-
struction of sanitary sewer and water main extensions in Oak Ridge Road west-
erly from existing facilities at Laurie Lane to Darrell Drive, are feasible,
provided that said sanitary sewer improvement be limited to a distance of
only 275 from said existing facilities at Laurie Lane, rather than as pro-
posed; and
WHEREAS, the City Engineer has further reported that the estimated cost of
said sanitary sewer improvement is $1,492.00 and that the estimated cost of
said water main improvement is $1.629.00;-and
WHEREAS, the area proposed to be assessed for the cost of said improvement
includes all abutting and nonabutting property benefited thereby;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stil
Minnesota;
1. That this Council shall meet at the City Hall in said City on Tuesday. the
llth day of June, 1963, at 7330 o'clock, P.M., for the purpose of holding a
public hearing on the making of said improvements, and that the City Clerk be.
and he is hereby, authorised and directed to cause proper notice of the time,
place and purpose of said meeting to be published in the official newspaper

WHEREAS, by resolution adopted May 21, 1963, this Council did fix a date for a

and Fifth Street; and

day of May, 1963, and mailed as required by law, said hearing was held at the
City Hall at 7:30 o'clock, P.M., on Tuesday. the llth day of June, 1963, at

an opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota:
1. That the improvement of Myrtle Street aforesaid, consisting of construction
of bituminous surfacing. curbs, gutters, sidewalks and other miscellaneous con-
struction items, be, and the same is hereby,ordered as proposed at an estimated
cost of $80,870.63, and that final. detailed plans and specifications therefor,
prepared by Banister Engineering Co., St. Paul, Minnesota, pursuant to Council
resolution, be, and the same are hereby, approved and ordered filed in the
office of the City Clerk; providing, however, that the foregoing determination
to proceed with said improvement and approval of plans and specifications is
subject to the approval of the Commissioner of Highways of the State of Minnesota
under and pursuant to Minnesota Statutes 162.09 to 162.14, inclusive, establish-
ing a Municipal State -Aid street system, and the rules and regulations promul-
gated thereunder.
2. That in conjunction with the foregoing improvement it is necessary to first
replace approximately 1,600 feet of sanitary sewer line; that, accordingly, the
doing of such work is hereby ordered and final, detailed plans and specifications
therefor, prepared by Banister Engineering co., St. Paul, Minnesota, being hereby
approved and ordered filed in the office of the city Clerk; and that the cost of
said work shall be paid by the City out of funds available for the purpose.
3. That the City Clerk be, and he is hereby, authorized and directed to adver-
tise separately for bids on the following:
(a) Street surfacing, construction of curbs, gutters, sidewalks and
sanitary sewers.
(b) Removal and reinstallation of eleven fluorescent luminaires,
steel standards and associated wiring.
Publication of each of said advertisements shall be made twice a week apart in the
Stillwater Evening Gazette, official newspaper of the City. and three times a week
apart in the Construction Bulletin, the first of said publications to be not less
than three weeks prior to the date hereinafter set for the opening and consideration
of bids. Said advertisements shall specify the work to be done, shall state that

bid of E. J. Prescott & Company, Minneapolis, Minnesota, & Assocs., to purchase the
$125,000 Improvement Bonds of 1963 of the City to be issued in accordance with the
resolution adopted June 11. 1963, and the published notice of sale, at a price of
par and accrued interest, bonds of said issue maturing in the years set forth below
to bear interest from date of issue until paid at the annual rate set forth oppo-

receiving and approving preliminary engineering reports and holding public

tion of certain improvements, and after advertisement for bids having been
published in the manner provided by law, contracts for construction of

And to defray the expenses of constructing said improvements it is neces-
sary and in the best interest of the City to issue general obligation bonds
of the City in the total principal amount of $125,000, which bonds have now
been duly sold this date.
2. All acts, conditions and things required by the Constitution and laws
of the State of Minnesota, including Chapters 429 and 475, Minnesota Statutes,
as amended, and the Charter of the City, to be done, to exist, to happen and
to be performed precedent to the issuance of said bonds have been done, do
exist, have happened and have been performed in regular and due form, time
and manner as so required.
3. The bonds to be issued to Finance the improvement hereinabove de-
scribed shall be designated as "Improvement Bonds of 1963", and shall be
dated as of July 1, 1963. The bonds shall be in the total principal amount
of $125,000, and shall be 125 in number and numbered from 1 through 125, each
in the denomination of $1000. The bonds shall mature in order of serial
numbers and without option of prior payment on January 1 in the years and
amounts set forth below, and bonds maturing in such years and amounts shall
bear interest from date of issue until paid at the annual rate set forth op-
posite such years and amounts, respectively:

Each of said bonds shall bear additional interest, to be represented by a
separate"B" coupon appurtenant to each bond, from January 1, 1964, to July 1,
1964. at the rate of 2% per annum. Interest on the bonds will be payable on
July 1, 1964, and semiannually thereafter on January 1 and July 1 of each
year. Both principal of and interest on the bonds shall be payable at the
Richfield Bank & Trust Co., in Richfield, Minnesota, and the City hereby agrees
to pay the reasonable and customary charges of said paying agent for the receipt
and disbursement of bond principal and interest moneys.
4. Said bonds and coupons appurtenant thereto shall be in substantially the
form presented by the City Clerk and approved by the Council this date.
5. Said bonds shall be printed under the direction of the City Clerk and shall
be executed on behalf of the City by the manual signature of the Mayor, attested
by the manual signature of the City Clerk, and the corporate seal of the City
shall be affixed thereto. On the reverse side of each bond shall be printed a
copy of the legal opinion rendered by bond counsel, authenticated by the certi-
ficate and facsimile signatures of the Mayor and City Clerk. The interest cou-
pons appurtenant to each bond shall be executed and authenticated by the printed,
engraved or lithographed facsimile signatures of the Mayor and City Clerk. When
the bonds have been so executed and authenticated, the City Treasurer shall
cause them to be delivered to the purchaser upon receipt of the purchase price
heretofore agreed upon, and the purchaser shall not be obligated to see to the
application of the purchase price.
6. There are hereby created separate and special improvement funds for each
of the improvements described in paragraph 1 hereof, each such fund to be held
and administered by the City Treasurer separate and apart from all other funds
of the City. The proceeds of sale of the improvement bonds herein authorized
less the accrued interest received upon delivery, shall be credited and paid
into said funds in the amount of the estimated cost of each improvement stated
in paragraph 1 hereof. There shall also be credited to eac'. fund. until com-
pletion of the improvement on account of which it was created, all collections
of special assessments levied to pay the cost of such improvement. The moneys
E.t on hand in each fund shall be used solely to defray the expense of construct-
ing the improvement on account of which it was created, and to pay principal of
and interest on the improvement bonds herein authorized. Upon the completion
of each improvement and payment of all costs thereof any balance of bond pro-
ceeds remaining in the fund pertaining thereto may be transferred by the Council
to the fund of any other improvement instituted under M.S.A., Chapter 429. All
moneys remaining in any such fund and not so transferred, and all subsequent
receipts of special assessments levied with respect to the improvement, shall
be credited and paid into the Improvement Bond Account heretofore established
in the sinking fund of the City, which account shall be continued and main-
tained in said sinking fund until the bonds herein authorized and all other
general obligation improvement bonds designated by the Council as payable there-
from shall have been fully paid with interest, in accordance with M.S.A., Chapters
429 and 475. Into said account shall also be paid the taxes hereinafter levied
for payment of the bonds herein authorized.
7. It is hereby covenanted and agreed with the purchaser and holders from time
to time of the bonds herein authorized, that not less than 20% of the cost of
said improvements shall be assessed against properties specially benefited there-
by. It is presently estimated that not less than $117,000 of the cost of said
improvements shall be paid by the special assessments to be levied upon all lots,
pieces and parcels of land subject to assessment and lying within the areas here-
tofore determined to be assessable for sal.: improvements, which assessments shall
be in amounts proportionate to the benefits received by said lots, pieces and
parcels of land respectively. Said assessments shall be payable in 10 equal for
$42,000, and 15 equal for $75,000 consecutive, annual installments, and shall be
levied according to law and spread upon the tax rolls of the City for the years
commencing with the year 1963, and continuing thereafter until paid, with interest
upon th-' unpaid principal balance thereof from time to time remaining unpaid at
the rate of 6% per annum. The City hereby covenants and agrees that it will do
and perform all acts and things necessary for the final and valid levy of special
assessments for the payment of a portion of the cost of said improvements. In
the event that any such assessment be at any time held invalid with respect to
any lot, piece or parcel of land, due to any error, defect or irregularity in any

proceedings as shall be required by law to make such assessment a valid and
binding lien upon raid property. It is presently estimated that of the a-
mount estimated above to be specially assessed, $ -0- thereof will be pre-
paid.
8. The full faith, credit and taxing powers of the City are hereby pledged
to the payment of principal and interest on the bonds herein authorized.
For the purpose of providing, together with estimated collections of said
special assessments, mounts not less than 5% in excess of the amounts needed
to meet when due the principal and interest payments on each and all of the
bonds herein authorized, there shall be and is hereby levied a direct, annual,
ad valorem tax on all taxable property within the City for the years and in
the amounts as follows:

Said levies shall be irrepealable except as to the extent and in the manner

Auditor of Washington County a certified copy of this resolution and to ob-
tain from said County Auditor a certificate setting forth the registration of
said bonds in his register in accordance with the provisions of Minnesota
Statutes 1961, Section 475.63, as amended, and stating that the tax required
by law for the payment of sai:+. bonds has been levied.
10. The officers of the City and the County Auditor of Washington County
are hereby authorized and directed to prepare and furnish to the purchaser
of said bonds and to the attorneys approving the legality thereof certified
copies of all proceedings and records relating to said bonds and to the fi-
nancial affairs of the City, and such other affidavits, certificates and
information as may be required to show the facts relating to the legality
and marketability of said bonds as the same appear from the books and records
under their custody and control or as otherwise known to them, and all such

BE IT RESOLVED by the City Council of the City of Stillwater. Minnesota,
that the bid of Douglas Securities, Inc., of Chicago, Illinois, to purchase
the $270,000 Refunding Bonds of 1963 of the City to be issued in accordance
with the resolution adopted June 11, 1963, and the published notice of sale
at a price of par and accrued interest plus a premium of $550.80, bonds of
said issue maturing in the years set forth below to bear interest from date
of issue until paid at the annual rate set forth opposite such years, re-
spectively:

RESOLUTION AUTHORIZING THE ISSUANCE AND PRESCRIBING THE FORM AND DETAILS
OF $270,000 REFUNDING BONDS OF 1963, PROVIDING A FUND FOR THE PAYMENT
THEREOF, AND PROVIDING FOR THE REFUNDING OF OUTSTANDING BONDS OF AN
ISSUE OF REFUNDING BONDS
BE IT RESOLVED by the City Council of the City of Stillwater, Minnesota,
as follows:
1. Pursuant to the provisions of Resolution No. 2214, duly adopted on
May 9, 1960, entitled "A Resolution Fixing the Form and Details of
$350,000 Refunding Bonds, and Creating a Sinking Fund for Their Payment".
the City has duly issued its Refunding Bonds, dated as of April 1, 1960.
Said bonds are now outstanding in the total principal amount of $270,000.
maturing on January 1 in the amount of $40,000 in the year 1964, $35,000
in each of the years 1965 through 1968, and $30,000 in each of the years
1969 through 1971, all without option of prior payment. Bonds of said
issue maturing in the years 1964 through 1967 bear interest at the rate
of 3.40% per annum, and bonds maturing in the years 1968 through 1971
bear interest at the rate of 3.60% per annum. payable on January 1 and
July 1 of each year. All of the principal and interest coming due on all
bonds of said issue from the date of issuance thereof through July 1, 1963,
has been duly paid or deposited for the purpose of payment with the paying
agent for said bonds, being the Northwestern National Bank of Minneapolis,
in Minneapolis, Minnesota.
2. It is hereby found, determined and declared that by the refunding of
those bonds described in paragraph 1 hereof maturing in the years 1964
through 1983, in the total principal amount of $270,000 by the issuance of
refunding obligations, the interest cost to the City will be reduced, and
the issuance of refunding obligations for such purpose is therefore author-
ized by Minnesota Statutes, Section 475.54, as amended by Laws of Minnesota
1963, Chapter 825. For the purpose of such refunding the City has adver-
tised and contracted to sell, in accordance with Chapter 475, Minnesota
Statutes 1961, as amended, and upon the terms and conditions hereinafter
stated, its Refunding Bonds of 1963 in the total principal amount of
$270,000. The proceeds of the Refunding Bonds of 1963, including any
premium and accrued interest from the date of said bonds to the date of
delivery thereof to the purchaser, plus the sum of $4,000 now on hand and
available for this purpose in the fund heretofore established for payment
of the 1960 Refunding Bonds, or so much of this sum as may be required,
plus the income to be realized from the investment of the foregoing amount
as provided below, are irrevocably appropriated for the payment and re-
demption of the outstanding bonds of the 1960 issue due in the years 1964
through 1971, at their respective maturities, and for the payment of
interest to become due on such bonds on or before the respective dates on
which they mature and are to be paid. The City Treasurer is hereby auth-
orized and directed, simultaneously with the delivery of the bonds herein
authorized, to deposit the proceeds thereof, including any premium and
accrued interest, and so much of said additional sum as may be required,
in escrow with The American National Bank of Saint Paul, in St. Paul,
Minnesota, a banking institution whose deposits are insured by the Federal
Deposit Insurance Corporation and whose combined capital and surplus is
not less than $1,000,000 and shall invest the funds so deposited in secur-
ities authorized for such purpose by Section 475.54, subdivision 5, as
amended, maturing or callable at the option of the City on such dates and
bearing interest at such rates as shall he required to provide funds
sufficient, with cash r_tained in the escrow account, to pay when due the
interest to accrue on the 1960 Refunding Bonds to their respective maturity
dates, and to pay the principal amount of each of said 1960 bonds at
maturity. A list of such securities purchased from the escrow account shall
be attached to the minutes of this meeting, and the escrow fund and all in-
vestments thereof are hereby irrevocably appropriated and shall be held in
safekeeping by the escrow agent for this purpose.
3. In evidence of the respective obligations of the City and the escrow
agent with reference to the funds and securities of the escrow account,

the Mayor and City Clerk are hereby authorized and directed, simultaneously
with the delivery of the Refunding Bonds herein authorized, and the deposit
and investment thereof as hereinabove provided, to make and execute on the
part of the City an escrow agreement with the banking institution desig-
nated above, and a form of such agreement shall be attached to the minutes
of this meeting. Nothing herein shall impair or otherwise affect the obli-
gation of `he City to maintain the fund heretofore established for the
payment and security of each of the 1960 bonds refunded by the bonds herein
authorized, a'd to perform and enforce all of the covenants contained in the
resolution authorizing such bonds described in said paragraph 1 hereof, but
the principal of and interest on the bonds refunded shall be payable pri-
marily from said escrow account in the manner provided in the escrow agree-
ment.
4. The bonds herein authorized to be issued shall be designated as Refunding
Bonds of 1963, and shall be in the total principal amount of $270,000. Said
bonds shall be dated as of July 1, 1963, and shall be 270 in number and
numbered from 1 through 270, each in the denomination of $1000. The bonds
shall mature in order of serial numbers on January 1 in the amount of $40,000
in the year 1964, $35,000 in each of the years 1965 through 1968, and $30,000
in each of the years 1969 through 1971, all without option of prior payment.
Bonds of said issue maturing in the years and bearing the serial numbers set
forth below shall bear interest from date of issue until paid or until duly
called for redemption at the annual rate set forth opposite such years and
numbers, respectively:

Interest on the bonds shall be payable on January 1, 1964, and semiannually
thereafter on each July 1 and January. Both principal of and interest on the
bonds shall be payable at the Exchange National Bank of Chicago, in Chicago.
Illinois, and the City hereby agrees to pay the reasonable and customary
charges of said paying agent for the receipt and disbursement of such principal
and interest moneys.
5. The bonds and interest coupons appurtenant thereto, and the certificate
appearing on the reverse side thereof, shall be printed in substantially the
form presented to the Council this date, which form shall be placed on file
in the office of the City Clerk.
6. The Refunding Bonds herein authorized shall be printed under the direction
of the City Clerk and shall be executed on behalf of the City by the signature
of the Mayor, attested by the signature of the City Clerk, and sealed with the
official seal of the City. The interest coupons appurtenant to the bonds shall
be executed and authenticated by the printed, engraved or lithographed fac-
simile signatures of said officers. On the reverse side of each bond shall be
printed a copy of the approving legal opinion rendered by bond counsel, authen-
ticated by the certificate and facsimile signatures of the Mayor and City Clerk.
When the bonds have been executed and authenticated, the City Treasurer shall
cause them to be delivered to the purchaser thereof upon payment of the purchase
price heretofore agreed upon. The purchaser shall not be obligated to see to
the application of the bond proceeds, but the Mayor and City Clerk shall execute
the escrow agreement and the Treasurer shall invest the bond proceeds and
other funds and deposit such funds and securities with the escrow agent, simul-
taneously with the delivery of the bonds as provided above.
7. So long as any of the bonds described in paragraph 1 hereof are outstand-
ing, the City shall continue to maintain the Sinking Fund for $350,000 Refund-
ing Bonds, created and described in paragraph 5 of Resolution No. 2214, adopted
May 9, 1960, referred to in paragraph 1 hereof; provided, however, that the
1960 Refunding Bonds shall be payable primarily from the escrow account herein -
above described, and the cash and securities held from time to time in the
escrow account are irrevocably appropriated to and shall be deemed an asset of
said Sinking Fund for $350,000 Refunding Bonds. The special assessments hereto-
fore levied with respect to the local improvements financed by the issuance of
said 1960 Refunding Bonds shall continue to be collected and paid into the
Sinking Fund for $350,000 Refunding Bonds, but upon the payment of any install-
ment of principal or interest on snd 1960 Refunding Bonds as they become due,

the City Treasurer is hereby authorized and directed to transfer from
the special assessments theretofore collected and then on hand in said
Sinking Fund for $350.000 Refunding Bonds, but in no event to include
any part of the escrow account, to the fund hereinafter established for
payment of the Refunding Bonds of 1963 an amount equal to such payment
of principal or interest on the 1960 Refunding Bonds. Nothing herein
shall impair or otherwise affect the obligation of the City with respect
to the 1960 bonds, or the pledges and covenants of the City made with
respect thereto.
8. The Refunding Bonds of 1963 shall be payable from a Refunding Bonds
of 1963 Fund of the City. to be maintained by the Treasurer separate and
apart from all other funds of the City so long as any of said bonds are
outstanding and unpaid. Said Fund shaII be used for no purpose other than
for payment of principal of and interest on the bonds issued pursuant to
this resolution, provided, that if any payment of principal or interest on
the bonds shall become due when there is not sufficient money in said Fund
to make such payment, the Treasurer shall pay the same from other funds of
the City, and such other funds shall be reimbursed for such advances out
of the next moneys thereafter paid into said Fund. Into said Refunding Bonds
of 1963 Fund shall be paid the proceeds of special assessments transferred
thereto in accordance with the provisions of the preceding paragraph. The
remaining, unpaid installments of said special assessments have been certi-
fied to the County Auditor for collection with general taxes of the City.
which amounts, with interest on the unpaid installments, are presently
estimated to be sufficient to produce amounts not less than 5% in excess
of the amounts needed to meet when due the principal and interest payments
on the Refunding Bonds of 1963 and are irrevocably appropriated for said
purpose by transfers to the Refunding Bonds of 1963 Fund as hereinabove
provided. subject to the prior lien on said special assessments in favor
of the 1960 Refunding Bonds. The full faiti. credit and taxing powers of
the City are hereby irrevocably pledged to the prompt and full payment of
the principal of and interest on the Refunding Bonds of 1963 as they re-
spectively become due.
9. The City Clerk is hereby authorized and directed to file with the
County Auditor of Washington County a certified copy of this resolution
and to obtain from said County Auditor a certificate setting forth the
registration of said bonds in his register in accordance with the pro-
visions of Minnesota Statutes 1961, Section 475.63, as amended, and stat-
ing that the tax required by law for the payment of said bonds nas been

RESOLUTION RELATING TO PARKING ON MYRTLE STREET
WHEREAS, the Council has determined to proceed with the improvement con-
sisting of constructing bituminous surfacing, curb and gutter, sidewalks
and other miscellaneous construction on Myrtle Street in the City; and
WHEREAS, it has been proposed that application be made to the Minnesota
Department of Highways for release of Municipal State -Aid funds apportioned
to the City in order to defray a portion of the cost of said improvement;
and
WHEREAS, the portion of said Myrtle Street to be improved as aforesaid
does not meet minimum width standards established by the Commissioner of
Highways for streets providing parking lanes on both sides thereof;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
STILLWATER, MINNESOTA, that from and after the completion of said improve-
ment parking on Myrtle Street from Main Street to Fifth Street shall be
liwited and restricted to one parking lane, said restriction to be desig-
nated and enforced as provided by law.

P. M., on Tuesday. July 9, 1963, for the construction of the following de-
scribed improvement:
Construction of sanitary sewer in Oak Ridge Road from existing facilities at Laurie Lane to a point 275 feet
westerly thereof and construction of water main in said
Oak Ridge Road from said existing facilities to Darrell
Drive;
AND WHEREAS, it appears from the affidavits of publication presented by
the City Clerk that pursuant to said resolution an advertisement for bids
for said improvement was duly published in the Stillwater Evening Gazette,

WHEREAS, a contract has been let for the improvement consisting of con-
struction of 8" sanitary sewer and appurtenances in West Wilkin Street
from North William Street to North Owens Street and in North Owens

price for such improvement is $16,896.50, and the expenses incurred or
to be incurred in the making of said improvement amount to $17,945.15;
and of this cost the City will pay$None as its share of the cost;
AND, WHEREAS, the City Clerk, assisted by the City Engineer, has pre-
pared a proposed assessment of the cost of said improvement and has
notified the Council that such proposed assessment has been completed
and filed in his office for public inspection;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Stillwater, Minnesota:
1. That the cost of such improvement to be assessed is hereby declared
to be $17,945.15.
2. That a hearing shall be held on the 6th day of August, 1963, at
7:30 o'clock, P. M., in the City Hall, to pass upon such proposed assess-
ment and at such time and place all persons owning property affected by
such improvement will be given an opportunity to be heard with reference
to such assessment.
3. That the City Clerk be, and he is hereby, directed to cause a
notice of said hearing to be published once in the Stillwater Evening
Gazette, official newspaper of the City, at least two weeks prior to the
date of said hearing and to be mailed to each property owner known to be
affected by said improvement at least ten days prior thereto, said notice
to specify the total cost of said improvement.

RESOLUTION APPOINTING CITY ATTORNEY
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that Vacil D. Kalinoff be, and he is hereby, appointed as City Attorney, said
appointment to be effective as of August 15. 1963; and that for the period
from August 1, 1963 to August 15, 1963, the employment of the said Vacil D.
Kalinoff as special counsel for the City shall be, and the same is hereby,
authorized; and
BE IT FURTHER RESOLVED, that as compensation for services rendered as such
special counsel and City Attorney the said Vacil D. Kalinoff shall be paid as
follows:
1. The sum of One Hundred Dollars ($100.00) per month for the performance
of the following duties and services:
(a) Attendance at regular and adjourned regular meetings of the Council.
(b)
Examining all claims filed against the City and ruling upon same
as to form and legality.
(c) Furnishing legal opinions to the Mayor, the Council and all City
officials, when requested to do so, upon questions concerning
any business of the City appearing on the agenda of any regular
or special meeting of the Council.
2- For the performance of any and all other duties and services prescribed
by the City Charter for which compensation is not otherwise provided herein
the compensation shall be in accordance with prevailing fees for legal services
in this locality and shall be paid upon filing of a legal claim therefor and in
the usual course of City business.

RESOLUTION NO. 2549
RESOLUTION ADOPTING ASSESSMENT LOCAL IMPROVEMENT #32 - 1960
WHEREAS, pursuant to proper notice duly given as required by law, the Council
has met and heard and passed upon all objections to the proposed assessment
for: Construction of 8" sanitary sewer on West Wilkin Street from North William
Street to North Owens Street and North Owens Street from West wilkin Street to
West Sycamore Street.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota:
1. That such proposed assessment is hereby accepted and shall constitute
the special assessment against the lands named therein, and each tract of land
therein included is hereby found to be benefited by the proposed improvement in
the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending
over a period of 15 years, the first of the installments to be payable on the
first Monday in January, 1964 and shall bear interest at the rate of 6% per annum
from the date of the adoption of this assessment resolution. To the first install-
ment shall be added interest on the entire assessment from the date of this reso-
lution until December 31, 1964. To each subsequent installment when due shall
be added interest for one year on all unpaid installments.
3. The owner of any property so assessed may, at any time prior to
certification of the assessment to the County Auditor, pay the whole of the assess-
ment on such property, with interest accrued to the date of payment, to the City
Treasurer, except that no interest shall be charged if the entire assessment is
paid within 30 days from the adoption of this resolution; he may thereafter pay
to the County Treasurer the installment and interest in process of collection
on the current tax list, and he may pay the remaining principal balance of the
assessment to the City Treasurer.
4. The clerk shall file the assessment roll pertaining to this assessment
in his office and shall certify annually to the County Auditor on or before
October 10 of each year the total amount of installments and interest which are
to be due in the following year on the assessment on each parcel of land included
in the assessment roll.

WHEREAS. a contract has been let for the construction of a sanitary sewer in
South Center Street from West Pine Street to West Willard Street. and West Willard
Street from South Center Street Easement; Easement from West Willard Street over
Lot 1 of Morth Lily Lots to Walter Nelson's Addition. And the contract price br
such improvement is $7.420.25, and the expenses incurred or to be incurred in the
making of said improvement amount to $216.59, so that the total cost of said im-
provement will be $7.636.84; and of this cost the City will pay $None as its share
of the cost;
AND WHEREAS, the City Clerk assisted by the City Engineer has prepared a proposed
assessment of the cost of said improvement and has notified the Council that such
proposed ment has been completed and filed in his office for public inspec-
tion;
NOW, THEREFORE. HE IT RESOLVED BY THE CITY COUNCIL OF MR CITY OF STILLWATER.
MINNESOTA:
1. That the cost of such improvement to be specially assessed is hereby declared
to be $7,636.84.
2. That a hearing shall be held on the 8th day of October. 1963. at 7:30 o'clock
P. M. in the City Hall, to pass upon such proposed assessment and at such time and
place all persons owning property affected by such improvement will be given an
opportunity to be heard with reference to such assessment.
3. That the City Clerk be, and he is hereby, directed to cause a notice of said
hearing to be published once in the Stillwater Evening Gazette. official newspaper
of the city, at least two weeks prior to the date of said hearing and to be mailed
to each property owner known to be affected by said improvement at least ten days
prior thereto, said notice to specify the total cost of said improvement.

that David Harrison and Harrison Henke are hereby appointed as permanent
employees in the Street Department of the City. said appointments to be
effective as of October 1, 1963, and that as compensation for services
rendered said David Harrison shall receive the sum of 52.00 per hour, and
the said Harrison Hanke the sum of $1.95 per hour, together with all other
benefits of employment of the Street Department of the City.

RESOLUTION ADOPTING ASSESSMENT LOCAL IMPROVEMENT NO. 40-1962
WHEREAS, pursuant to proper notice duly given as required by law, the Council
has met and heard and passed upon all objections to the proposed assessment for:
Construction of sanitary sewer on South Center Street from West Pine Street to
West Willard Street, West Willard Street from South Center Street easement.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota:
1. That such proposed assessment is hereby accepted and shall constitute
the special assessment against the lands named therein, and each tract of land
therein included is hereby found to be benefited by the proposed improvement in
the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments extend -
in over a period of 15 years, the first of the installments to be payable on the
first Monday in January, 1965, and shall bear interest at the rate of 6% per annum
from the date of the adoption of this assessment resolution. To the first in-
stallment shall be added interest on the entire assessment from the date of this
resolution until December 31, 1965. To each subsequent installment, when due,
shall be added interest for one year on all unpaid installments.
3. The owner of any property so assessed may aprior

ficationof the assessment to the County Auditor, pay te whole of
on such property with interest accrued to the date of payment, to the City
Treasurer, except that no interest shall be charged if the entire assessment is
paid within 30 days from the adoption of this resolution; he may thereafter pay

ment to the City Treasurer.

4. The Clerk shall file the assessment roll pertaining to this
assessment in his office and shall certify annually to the County Auditor
on or before October 10 of each year the total amount of installments and
interest which are to be due in the following year on the assessment on

that Leonard Schrade, heretofore appointed as a fireman of the City for a
period of six months by resolution adopted May 7, 1963, be, and he is here-
by appointed as a regular fireman; that said appointment shall be effective
from and after November 1, 1963; and that as compensation for services
rendered as such fireman, the said Leonard Schrade shall receive the sum of
$360.00 per month together with all other benefits of employment in the Fire

RESOLUTION NO. 2581
RESOLUTION CREATING PARKING FACILITY BOND FUND, PROVIDING FOR AND
APPROPRIATING GENERAL AD VELOREM TAXES AND SPECIAL ASSESSMENTS FOR THE
SUPPORT AND MAINTENANCE THEREOF AND DIRECTING ISSUANCE OF PARKING FACILITY
BONDS OF 1963.
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
as follows:
1. This Council hereby finds and determines that it has held a public
hearing as required by law and has determined. by Resolution No. 2571 adopted
on October 24, 1963, to proceed with making a parking lot improvement and has
established the district to be assessed therefor; that the total cost of said
parking facilities is estimated to be $200,000, and such estimate is believed
to be reasonably accurate; that the total benefits resulting from said park-
ing facilities to the lots, pieces and parcels of land to be assessed there-
for, and to the City at large, will be substantially in excess of the total
cost thereof; that a proposed assessment roll has been filed with the City
Clerk, showing the lots, pieces and parcels of land to be specially assessed
for the cost of said facilities, and the proposed assessment on each lot.
piece or parcel; that the total principal amount of the assessments shown in
said roll exceeds $100,000, and such assessments are payable in 20 equal,
annual installments, the first installment to be collected in 1964, and one
year's interest at the rate of 6% per annum on all unpaid installments to be
added to each installment; that it is necessary to borrow the sum of $200,000
for the purpose of paying the costs of said improvement which cannot be paid
from funds on hand; and that such sum of $200,000 may best be borrowed by the
issuance of the general obligation improvement bonds of the City in accordance
with the provisions of Minnesota Statutes 1961, Section 459.14.
2. There is hereby created a separate fund to be designated as the
"Parking Facility Bond Fund," to be held and administered by the City Treasurer
as a separate debt redemption fund on the books of the City, in accordance
with the provisions of Minnesota Statutes 1961, Section 475.61 et seq., and
shall be continued and maintained in the manner herein specified until all all
of the bonds herein authorized and interest thereon shall have been duly paid.
There shall be credited to the said fund all collections of the general ad
valorem taxes and special assessments levied for said parking facility im-
provement; and all Accrued interest received upon delivery of said bonds.
The moneys in said fund shall be held and used only for the payment of the
principal of and interest on said bonds and on any other bonds which may here-
after be issued and made payable from said fund. The full faith and credit of
the City shall be and are hereby pledged to pay said bonds and interest, and
the principal and interest thereof shall be paid out of any funds in the treas-
ury, if the moneys on hand in said fund are at any time insufficient to meet
the payment of maturing principal and interest. The City hereby recognizes
its obligation to levy sufficient taxes to take care of deficiencies, as pro-
vided in Minnesota Statutes 1961, Section 475.61 and 475.74.
3. It is hereby determined and ordered that the sum of not less than
ONE HUNDRED THOUSAND AND NO-100 DOLLARS ($100,000) of the cost of acquiring
and constructing the parking facilities financed by the bonds herein authorized
shall be paid by special, assessments to be forthwith levied upon all assessable
lots, pieces and parcels of land benefited thereby and located within the area
proposed to be assessed, based upon the special benefits received by each such
lot, piece or parcel. It is found and determined that said sum hereafter to
be assessed for said improvement does not exceed the total benefits conferred
and to be conferred by said improvement upon all of said properties. The
City hereby covenants and agrees that it will do and perform, as soon as may
be, all acts and things necessary for the final and valid levy of special
assessments for said facilities against benefited properties in an amount not
less than above stated. In the event that any assessment hereafter levied
to pay for said facilities be at any time held invalid with respect to any
lot, piece or parcel of land, due to any error,defect or irregularity in any
action or proceeding taken or to be taken by the City or this Council or any
of the City's officers or employees, either in the making of such assessment
or in the performance of any condition precedent thereto, the City and this

Council hereby covenant and agree that they will forthwith do all such further
acts and take all such further proceedings as may be required by law to make
such assessment a valid and binding lien upon such property. Said assessments
shall be payable in 20 equal, consecutive, annual installments, the first of
said installments to be collectible during the year 1964. Deferred installments
shall bear interest at the rate of six per cent (6%) per annum from the date of
/1 the resolution levying the assessment until December 31 of the year in which
the installment is payable.
4. For the purpose of paying the cost of said facilities heretofore
determined to be paid by the City from ad valorem taxes, there is hereby levied
upon all of the taxable property in the City a direct, annual, ad valorem tax,
which shall be spread upon the tax rolls for the years and in the amounts stated
below, said levies to be collected together with and as a part of other general
property taxes in the respective ensuing years:

actually paid into the Parking Facility Bond Fund, other than the taxes and
assessments herein pledged to said fund, in accordance with the provisions of
Minnesota Statutes 1961, Section 475.61.
5. In anticipation of the collection of said special assessments and
general taxes and for the purpose of borrowing money to pay the cost of acquir-
ing and constructing automobile parking facilities, the City shall forthwith
issue and deliver to the purchaser thereof its negotiable coupon general obliga-
tion Parking Facility Bonds of 1963. Said bonds shall be dated December 1, 1963,
shall be 20 in number and numbered from 1 to 20, inclusive, each in the denomina-
tion of $5,000. Said bonds shall mature in order of serial numbers, on December
1, in the amount of $10,000 in each of the years 1965 through 1984, and the bonds
maturing in the years shown below shall bear interest at the respective rates

WHEREAS, the Council of the City of Stillwater, Minnesota, has approved con-
struction of parking lots in the business district of said City; and bonds
for the purpose have been issued in the amount of $200,000, the proposed
assessable portion thereof to be $123,544.80;
AND WHEREAS, the City Clerk, assisted by the City Engineer has prepared a pro-
posed assessment of the cost of said improvement and has notified the Council
that such proposed assessment has been completed and filed in his office and
is open to public inspection;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STILLWATER,
MINNESOTA:

main and services in C.S.A.H. No. 5 from Fairmeadows Road to Dundee Place; Dundee
Place from Fairmeadows Road to C.S.A.H. No. 5; and in Fairmeadows Road from
Crestwood Terrace to Dundee Place. And the contract price for such improvement
is $14,444.85; and the expenses incurred or to be incurred in the making of said
improvement amount to $185.31, so that the total cost of said improvement will be
$14,630.16; and of this cost the City will pay $None as its share of the cost;
AND WHEREAS, the City Clerk assisted by the City Engineer has prepared a proposed
assessment of the cost of said improvement and has notified the Council that such
proposed assessment has been completed and filed in his office for public inspec-

RESOLUTION NO. 2590
RESOLUTION FOR HEARING ON PROPOSED ASSESSMENT LOCAL IMPROVEMENT NO. 43-1963,
PROJECT #2
WHEREAS, a contract has been let for the construction of sanitary sewer, water -
main and services in C.S.A.H. No. 5 from Fairmeadows Road to Dundee Place; Dundee
Place from Fairmeadows Road to C.S.A.H. No. 5; and in Fairmeadows Road from
Crestwood Terrace to Dundee Place. And the contract price for such improvement
is $14,444.85; and the expenses incurred or to be incurred in the making of said
improvement amount to $185.31, so that the total cost of said improvement will be
$14,630.16; and of this cost the City will pay $None as its share of the cost;
AND WHEREAS. the City Clerk assisted by the City Engineer has prepared a proposed
assessment of the cost of said improvement and has notified the Council that such
proposed assessment has been completed and filed in his office for public inspec-
tion;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STILLWATER,
MINNESOTA:
1. That the cost of such improvement to be specially assessed is hereby
declared to be $14,630.16.
2. That a hearing shall be held on the llth day of February, 1964, at
7:30 P. M. in the City Hall, to pass upon such proposed assessment, and at such
time and place all persons owning property affected by such improvement will be
given an opportunity to be heard with reference to such assessment.
3. That the City Clerk be, and he is hereby, directed to cause a notice
of said hearing to be published once in the Stillwater Evening Gazette, official

newspaper of the City, at least two weeks prior to the date of said hearing
and to be mailed to each property owner known to be affected by said im-
provement at least two weeks prior thereto, said notice to specify the total
cost of said improvement.

RESOLUTION PROVIDING FOR TIME AND PLACE OF REGULAR MEETINGS OF CITY COUNCIL
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that commencing with the month of January, 1964, Regular meetings of the City
Council shall be held at the City Hall at 4:30 o'clock P. M., on the first
Tuesday of each month; provided, however, that if the first Tuesday shall fall
on or before the 5th day of any month, then the Regular meeting for such month
shall be held at the same time and place on the second Tuesday.
