That such proposed assessment, which is now on file in the office of the City Clerk, be, and the same is hereby, adopted as the special assessmetc against each lot, piece o^ parcel of land described therein which is hereby found to be benefited by said improvement, in the amount of the assessment levied against it; 2. That such assessment shall be payable in equal annual installments extend- ing over a period of ten (10) years, the first of said installments to be pay- able Lo the County Treasurer the first Monday in January, 1963, and shall bear Interest at the rate of six percent (6%) per annum from the date of adoption of this Resolution. To the first installment shall be added interest on the entire assessment from the date of this Resolution until December 31, 1963. To each subsequent installment shall be added interest for one year on all unpaid Installments; 3. That the owner of any property so assessed may at any time prior to certi- fication of the assessment to the County Auditor pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within thirty (30) days from the adoption of this Resolution. He may thereafter pay to the County Treasurer the installment and interest in process of collection on the current tax list, and he may ray the remaining principal balance of the assessment to the City Treasurer. 4. That the assessment roll tertalning to this assessment shall remain in the office of the City Clerk, who shall certify annually to the County Auditor on or before October loth of each year, commencing October 10, 1962, the total amount of installments and Interest which are to become due In the following year on the assessment against each lot, piece or parcel of land included in said assessment roll. Adopted by the Council this 6th day of February, 1962 Published: February 14, 1962 ayor Attest: City Clerk RESOLUTION NO. 2374 RESOLUTION AUTHORIZING TRANSFER OF FUNDS BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that the City Treasurer be, and he is hereby, authorized and directed to transfer the sum of Nine Thousand Nine Hundred Fifty Dollars ($9,950.00) from the "Sani- tary Sewer Revenue Fund" to the "General Fund" and that said sum be, and it is hereby, appropriated for payment of the purchase price of a four wheel drive loader pursuant to a contract between the City and Road Machinery & Supplies of Minneapolis, Inc. BE IT FURTHER RESOLVED, that said sum shall be returned to the "Sanitary Sewer Revenue Fund" by transfer from the "General Fund" as follows: The sum of Four Thousand Nine Hundred Seventy-five Dollars ($1i,915.00) on or before the 31at day of December,r, 1962, and a like sum of Four Thousand Nine Hundred Seventy- five Dollars ($4,975.00) on or before the 31st day of December, 1963: to the first such transfer shall be added interest at the rate of four (4) percent per annum on the entire sum of Nine Thousand Nine Hundred Fifty Dollars ($9,950.00) from the date hereof to the date of payment, and to the second such transfer like interest shall be added on the unpaid balance of said sum of Nine Thousand Nine Hundred Fifty Dollars ($9,950.00) from the date hereof to the date of such payment. Published February 16, 1962 Attest: City ` ayor • 73!w RESOLUTION NO. 2375 RESOLUTION AUTHORIZING PURCHASE OF LAND WHEREAS, the Chicago, Milwaukee, St.Paul and Pacific Railroad Company has offered to convey to the City certain real estate described as follows, to -wit: The Grantor's so-called abandoned 100-foot right of way for its former line of railroad across the northeasterly part of Govern- ment Lot 2 in Section 3, Township 29 North, Range 20 West, in the County of Washington and State of Minnesota, situated north of the south line of Mill Road, which south line is parallel to and 297.91 feet south of the north line of said Section 3, con- taining 0.72 acre, more or less, for and in consideration of the sum of One Thousand Dollars ($1,000.00); and WHEREAS, it appears that the acquisition of said real estate is required by tb governmental purposes of the City; BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that the said offer of the Chicago, Milwaukee, St. Paul and Pacific Railroad Company be, and the same is hereby, accepted; and that upon tender to the City of a good and sufficient deed of said property, a warrant shell be drawn upon the City Treasurer in payment of the purchase price therefor as hereinbefore ex - pressed. BE IT RESOLVED by the City Council of the City of Stillwater, kinnesota, that the streets described as follows, to -wit: That part of Section 101, Segment 030, Broadway Street, lying north of Pine Street; All of Section 105, 2nd Street; All of Section 105, Main Street; A11 of Section 106, Street; Segment 030, Mulberry Street from 4th Street to Segment 040, Mulberry Street, from 2nd Street to Segment 010, end Street, from Pine Street to Nelson That part of Section 106, Segment 020, End Street, lying south of Olive Street; be, and hereby are revoked es Designated Municipal State Aid Streets of said City, subject to the approval of the Commissioner of Highways of the State of Minnesota. BE IT FURTHER RESOLVED, by the City Council of the City of Stillwater, Minne- sota, that the streets described as follows, to -wit: That all of Pine Street from County State Aid Highway No. 5 (St. Paul Road) to Hemlock Street; That all of Olive Street from 2nd Street to Main Street; be, and hereby are established, located, and designated as Municipal State Aid Streets of said City, subject to the approval of the Commissioner of Niguwaya of the State of Minnesota. BE IT FURTHER RESOLVED, that the City Clerk is hereby authorized and directed to forward two certified copies of this resolution to the Commissioner of High- ways for his consideration, and that upon his approval of the designation of said streets or portion thereof, that sane be constructed, improved and main- tained as a Municipal State Aid Street of the City of Stillwater, end to be numbered by the State Commissioner of Highways of Minnesota and known as Muni- cipal State.Aid Streets. Full Base Pay for officers or employees compensated on an hourly basis shall be determined by multiplying the hourly rate of pay of such officers or employees at the time of illness or injury by 140. Daily benefits shall be 1/5 of the full base pay as hereinbefore determined. The benefits to which any officer or employee is entitled shall be the benefits available at the beginning of the disability period. Should "a disability period extend from one "benefit year" to a subsequent "benefit year", that portion of benefits paid for absence occurring in the subsequent "benefit year" shall be off- set against like benefits available to such officer or employee during such subse- quent "benefit year"; i.e., full pay will be offset against full pay and half pay will be offset against half pay. Benefits not used during a particular "benefit year" may not be carried over to any subsequent "benefit year." In the event any officer or employee shall receive income benefits under the State Workmen's eshall beensation deductedlaw framuthegbenefits available eriods of ato suchlofficerlory, such employeeen- hereunder. No benefits shall be paid if absence is due to pregnancy or the result of fighting, intoxication and the like. It shall be the responsibility of the department head to maintain contact with employees absent from work to determine the cause of absence and whether same may be covered by this plan. Such applica- tion shall be accompanied by a physician's certificate to the effect that such dis- abled officer or employee has not recovered sufficiently to return to work. The City Council shall thereupon, with the aid of the department head, determine whetter or not the position held by such disabled officer or employee can be held open; and, be- fore such leave of absence becomes effective, fully explain to such officer or em- ployee the facts relative tnereto including the possibility of placement in other suitable work upon his or her return. • • • • • 113 • • Upon return to active employment following absence because of disability, an officer or employee shall retain previously accumulated service credit for time worked prior to disability, but shall receive no service credit for the period of absence. Service credit will be given for the first continuous 12 months of work and thereafter following absence due to disability. The City reserves the right to require medical evidence of disability at any time as a prerequisite to the payment of benefits or the continuation thereof.
