RESOLUTION NO. e274
RESOLUTION ORDERING HEARING ON IROrOSED ADDITIONAL ASSESSMENTS IN CONNECTION WITH
SEWER IMPROVEMENT NG. 1-1959
WHEREAS, the City Clerk has calculated the proper amount proposed to be assessed
against each assessable lot, piece or parcel of land abutting on but not previously
assessed for Sanitary Sewer Improvement No. 1-1959, and has notified the Council
that such proposed assessment roll has been completed and filed in his office and
is now open to public Inspection;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Stillwater, Minn-
esota:
1. That a meeting of the City Council be hell in the Council Chambers at the City
Hall in said City of Stillwater on Thursday, the 16th day of February, 1961, at
7:30 o'clock F.M. at which time and place the Council will consider said proposed
additional assessments.

2. Th+:t the City Clerk be and he is hereby directed to cause a notice oC said
hearing to be published once in the Still ator Evening Gazette, official news-
paper of the City, no less than two weeks prior to the date of said meeting, said
notice to state the date, time and place of said meeting, the eeneral nature of
the improvement, the area proposed to be assessed and that written or oral ob-
jections will be considered by the Council; and that a copy of such published
notice be mailed to the owner of each lot, piece or parcel of land proposed to be
assessed at his last known address no less than ten (10) days prior to the date
of said hearing.

RESOLUTION DETERMINING TO IROCEED 'WITH THE WORK OF CONSTRUCTING SANITARY SEWER
CONNECTIONS FHOY MAIN SEWER TO iEOFERTY LINES.
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER:
1. That it is hereby determined to proceed with the work of constructing sani-
tary sewer connections from the main sewer to the property lines of the following
.described lots consisting of approximately 180 lineal feet of 6 inch V.C.P. or
6 inch C.I.P.
Lots Ten (10), Eleven (11), Twelve (12) and Thirteen (13), Block Nine (9),
MCKinstry and Seeley's first addition.
Lots One (1), Two (2) and Three (3), Block Five (5), McKinstry and Seeley's
first addition.
Lots Ten (10), Eleven (11) and Twelve (12), Block Five (5), MCKinstry and
Seeley's first addition.
Lot One (1), Block Eleven (11), Walter Nelson's Lakeview Addition.
Lot Three (3), Block Eleven (11), Walter Nelson's Lakeview Addition.
Lot Four (4), Block Ten (10), Walter Nelson's Lakeview Addition.
2. That the City Clerk Is hereby directed to advertise for bids returnable at
a regular meeting of the Council to be held to the Council Chamber in the City
Hall on Tuesday, the 7th day of March, 1961, at 7:30 F.M. for the doing and furnish-
ing of the required comvoditles, labor and services to complete said work in ac-
cordance with the plans and specifications therefor.

1960 and January 10, 1961, be, ant the same are, hereby discontinued and abandoned.

RESOLUTION CONTINUING FIRE 9Ei ARTYENT EMPLOYMENT. AND FIRING CJN: EtlSATION THEREOF
BE IT RESOLVED By the City Council of the City of ftillwater, Minnesota, that the
appointment of Louis Caravelia as acting Captain of the Fire Department and the
appointment of Arnold iaeltier a acting Lieutenant of the said Department be, and
they are hereby, reaffirmed and continued for and during the absence of Captain
William Kress, or until other prior determination by the Council, and that while
acting In said capacities the said Louis Garavalia and Arnold _eltier shall be paid
as compensation for services rendered the sums of 2390.00 per month and-:360.00
per month, respectively, said rates of compensation to be effective from February
15, 1961.
BE IT FURTHER RESOLVED That the employment of Reynold Wert and George Murphy as
temporary firemen 1n the Fire De,ar`tr.ent of ter: City be, and the same is hereby,
extended for a periol not to exceed six (6) months from and after February 15, 1961,
or until other prior determination by the Council, and that as compensation for
services rendered from and after said date they each shall be }:aid the sun of
8350.00 per month.

RESOLUTION AUTHORIZING ANNUAL APPROPRIATION FOR ARMORY
RESOLVED BY THE COUNCIL OF THE CITY OF STILL'WATER, that upon the request of the
Armory Board, National Guard Armory of Stillwater, for annual appropriation by
the City of Stillwater for maintenance of said Armory during the year 1960, en
appropriation in the amount of $250.00 is hereby granted under and pursuant to
N.S.A. 193.35.
And the Mayor and City Clerk are hereby authorized and directed to draw their
warrant upon the City Treasurer accordingly.

RESOLUTION ADOPTING ADDITIONAL ASSESSMENTS SEWER IMPROVEMENT N0. 1-1959
WHEREAS, pursuant to proper notice duly given as required by law, the Council
has met and heard and passed upon all objections to the proposed additional
assessment for the construction of a sewage treatment plant and related facil-
ities.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Stillwater,
Minnesota:
1. That such proposed assessment, which is now on file in the office of the
City Clerk, be, and the same is hereby, adopted as the special assessment against
each lot, piece or parcel of land described therein which is hereby found to be
benefited by said improvement, in the amount of the assessment levied against it.
2. That such assessment shall be payable in equal annual installments extend-
ing over a period of twenty (20) years, the first of said installments to be
payable to the County Treasurer on the first Monday in January, 1962, and shall
bear interest at the rate of six percent (6%) per annum from the date of the
adoption of this Resolution. To the first installment shall.beadded interest
on the entire assessment from the date of this Resolution until December 31,
1962. To each subsequent installment shall be added interest for one year on
all unpaid installments.
3. That the owner of any property so assessed may at any time prior to certifi-
cation of the assessment to the county auditor pay the whole of the assessment
on such

within thirty (30) days from the adoption of this Resolution. He may thereafter
pay to the county treasurer the installment and interest in process of collec-
tion on the current tax list, and he may pay the remaining principal balance of
the assessment to the city treasurer.
4. That the assessment roll pertaining to this assessment shall remain in the
office of the City Clerk, who shall certify annually to the county auditor

or before October loth of each year, commencing October 10, 1961, the total
amount of installments and interest which are to become due in the following
year on the assessment against each lot, piece or parcel of land included in
said assessment roll.

RESOLUTION ACCEPTING WORK FOR CONSTRUCTION OF INTERCEPTOR SEWERS, PROJECT NO.
2, SEWER IMPROVEMENT N0. 1-1959
WHEREAS, pursuant to a written contract signed with the City on September 9,
1959, Barbarossa & Sons, Inc. of St. Cloud, Minnesota, have satisfactorily com-
pleted 1-1959,cinetruction accordancefwithe heptor termsswers, Project and conditions so. 2, Sewer of said contract.
NOW, THEREFORE, BE IT RESOLVED By the City Council of the City of Stillwater,
Minnesota, that the work so completed under said contract 1s hereby accepted,
and approved, and that a warrant be drawn upon the City Treasurer for the sum
of $4,077.55 in full and final payment due to the contractor under said con-
tract.

RESOLUTION NO. 2296
RESOLUTION AUTHORIZING MODIFICATION OF CONTRACT FOR CONSTRUCTION 0P PROJECTS
NO. 1 AND NO. 3, SEWER IMPROVEMENT NO. 1-1959
WHEREAS, a contract was entered into by and between the City of Stillwater and
the Acton Construction Co. of St. Faul, Minnesota, on the 26th day of October,
1959, for the construction of Projects No. 1 and No. 3 in connection with Sewer
Improvement No. 1-1959, mach contract, among other things, provides that the
City will make payments to the contractor on the basis of monthly estimates
certified by the engineer, retaining fifteen percent (15%) thereof until final
completion and acceptance of all work covered thereby; and
WHEREAS, the City and the Contractor have agreed to a modification of said con-
tract so as to permit retention of a lesser percentage of said monthly estimates.
NOW, THEREFORE,BE IT RESOLVED By the City Council of the City of Stillwater,
Minnesota, that said contract be, and the same is hereby,modified, subject to
written ap;rovel of the surety on the contractor's bond, so as to permit pay-
ment to the Acton Construction Co. of the sum of $54,802.14 in addition to pay-
ments heretofore made by the City on the contract for construction of Frojeet
No. 1 and the sum of $19,389.29 in addition to payments heretofore made by
the City on the contract for construction of Project No. 3, and that a warrant
or warrants be drawn upon the City Treasurer accordingly.

RESOLUTION NO. 2287
RESOLUTION RELATING TO ANNEXATION OF A PORTION OF THE FLAT OF FAIHNEADOWS N0. 1
TO THE CITY OP STILLWATER
WHEREAS, a petition has been presented to the Council of the City of Stillwater,
Minnesota, which petition prays for the annexation to said City of the land de-
scribed as follows, to -wit:
Lots One , to Ten (1 to 10), inclusive, Twenty -One (21), Twenty -Two (22),
Twenty -Five (25), Twenty -Six (26). Twenty -Seven (27), Forty (40) and
Forty -One (41), of Fairmeadows No, 1, according to the plat thereof
on file and of record in the office of the Registrar of Titles of
Washington County, Minnesota, together with all parts of public streets
or roadways abutting on said lots, respectively, and legally appurte-
nant thereto;
and,
WHEREAS, a hearing on the proposed annexation was held by the City Council at
7:30 o'clock P.M. on Thursday, the 16tt day of February, 1961, at which time
all persons interested were given an opportunity to be heard; and,
WHEREAS, it appears that thirty (30) days posted notice of said hearing was
given as required by law.
BE IT RESOLVED By the City Cow eli of the City of Stillwater, Minnesota, that
the annexation proposed in said petition will be to the best interests of the
City and of the territory affected, and that an Ordinance declaring the land
hereinbefore described annexed to the City be introduced.

I RESOLUTION AP}ROVING CONTRACT F0fi INSTALLATION OF HEATING SYSTEM
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that
the contract dated February 21, 1961, by and between Bliss Plumbing & Heating
Co. and the Board of Directors of the Stillwater Public Library, an agency of
the City,tor the removal of the existing steam heating plant located In the
Carnegie Public Library building, and the installation of a new gas fired heat-
ing system be, and the same Is hereby, in all things apyroved, aid that upon
satisfactory completion of the work required under said contract by the con-
tractor, the contract price of $3,500.00 shall be paid out of the Real Property
Fund of the City.

RESOLUTION DESIGNATING DEPOSITORIES 0P PUBLIC FUNDS
BE IT HEREBY RESOLVED, That the following named banks authorized to do a banking
bualness in Minnesota, be, and hereby are, designated depositories of the public
funds of the City of Stillwater, County of Washington, Minnesota, for the term
commencing with the 1st day of May, 1961, and ending with the 30th day of April,
1964, to -wit:
The First National Bank of Stillwater, Minnesota, In sums not to exceed in
the aggregate One Hundred Thousand Dollars ($100,000.00)at any one time;
Cosmopolitan State Bank of Stillwater, Minnesota, in sums not to exceed in
the aggregate One Hundred Thousand Dollars ($100,000.00) at any one time;
Farmers & Merchants State Bank of Stillwater, Minnesota, in sums not to exceed
in the aggregate Four Hundred Thousand Dollars ($400,000.00) at any one time;
upon the terms and conditions following, to -wit:
To secure such funds, the said depositories shall denosit with the'City
Treasurer such bond or other collateral as is required or permitted by law. The
total in amount of such collateral computed at its market value shall be at least
ten percent (10%) more than the limit of deposit which would be permitted if a
corporate or personal surety bond was furnished. The deoo:ltorles may la their
discretion furnish both a bond and collateral aggregating the required amount. Any
collateral so deposited shall be accompanied by an assignment thereof to the City,
which assignment shall recite that such depository shall pay over co the Treasurer
or his order on demand all moneys deposited therein at any time during the p•plod
such collateral shall be so deposited; and, that In case of any default on the Hart
of any depository, the City shall have full power and authority to sell such collateral,
or as much thereof as may be necessary, to realize the foil amount due the City and
to nay over any surplus to such depository or Its assigns. The depositories may in
their discretion deposit collateral of a value less than the total designation and
may from time to time, during the period of their designation, deposit additional
collateral and make withdrawals of excess collateral, or substitute other collateral
for that on deposit or any nart thereof. Before any collateral Is deposited with
the Treasurer, 1t shall first be approved by the City Council, but no such authority '-
shall be necessary for the withdrawal of collateral. If both bond and collateral are
furnished by the depositories, all or any Hart of the collateral may be withdrawn without
In any way impairing the full force and effect of the bond unless it shall contain a
orovislon that the collateral shall not be withdrawn without the consent of the
surety thereon. If a corporate sur ty bond is furnished by either of the depositories,
it shall be in a penal sum not to exceed the amount designated as the limit of deposit
herein, notwithstanding any other nroolsions of law to the contrary. eA

At no time shall the Treasurer maintain a deposit in the depositories against
collateral in excess of ninety percent (90%) of the market value thereof. Any
bond furnished shall be approved by the City and filed In the office of the County
Auditor as provided by law, and all collateral deposited shall likewise be approved
by the City and after such approval, deposited with the Treasurer, unless the City
council shall by resolution fix and determine some other place for the safekeeping
of such collateral. Such collateral shall not be re -deposited in the designated
depositories. The depositories at any time they deem It advisable or desirable may
substitute obligations of the United States of America for all or any Dart of the
securities pledged. The collateral so substituted shall be approved by the City at
its next official meeting. Such securities so substituted shall, at the time of
substitution, have a market value sufficient, together with the market value of the
original securities for w hlch no substitution 1s made, to equal or exceed $110.00
for every $100.00 of public deposits.
Each of said depositories shall pay on demand all deposits therein subject to
payment on demand and shall pay on demand all time deposits therein, with accrued
Interest, at or after the end of the periods for which the same shall have been
deposited. All of said disbursements shall be made by order or warrant signed in
an appropriate place by the City Treasurer and by the President of the City Council
or In the absence of the President by the Vice President of the City ouncll, which
warrants when so signed and Issued, shall become a check upon the said City depos-
itories.

RESOLUTION RELATING TO COMPENSATICN OF PIRE DEPARTMENT EMPLOYEES
BE IT RESOLVED By the City Council of the City of Stillwater, Minnesota, that
for a period of sixty (60) days from and after March 6, 1961, any regularly employed
officer or fireman of the Fire Department of the City, who shall have heretofore or
shall hereafter return to duty on a day when he would otherwise not be required to
do so for the purpose of replacing another sick or disabled officer or fireman
regularly employed by the Denartment, shall be compensated for each day of such
additional service at a rate to be based upon the effective compensation of fire-
men in the Department for each day of regularly scheduled service.

RESOLUTION FIXING COMPENSATION OF AUXILIARY FIREMEN
BE IT RESOLVED by the City Council of the City of Stillwater, Minnesota, that
from and after the 1st day of April, 1961, the compensation to be raid to auxiliary
firemen of the Stillwater Fire Department shall be fixed In the following amounts:
Captain $176.00 ner year
Lieutenant 168.00 per year
Driver 160.00 per year
Fireman, First Class 152.00 per year
Fireman, Second Class 108.00 per year
and that the compensation hereby prescribed shall be payable quarterly after
effective date hereof.

RESOLUTION ORDERING HEARING ON STREET IMPROVEMENTS
WHEREAS, The City Engineer has renorted to this Council that the improvement
consisting of the grading and surfacing of West Pine Street, between South Grove
Street and South Brick Street, and South Hemlock 6treet, between West Olive Street
and West Pine Street, including construction of necessary curbs, gutters, storm
sewers and sewer and water lateral connections, Is feasible and may best be made
in conjunction with the improvement of West Moore Street, between North Fourth
Street and North Martha Street, and the improvement of West Marsh Street, between
South Fifth Street and South Sixth Street, consisting of the grading and surfacing
of each of said streets, including construction of necessary curbs and gutters; and
WHEREAS, The City Engineer has further reported that the estimated cost of said
improvement to West Pine Street and South Hemlock is $47,004.75, the estimated
cost of said Improvement to West Moore Street Is $9,487.86 and the estimated cost
of said improvement to West Marsh Street is $6,634.95; and
WHEREAS, the area proposed to be assessed for Said Improvements includes all
property abutting on the above mentioned streets,
BE IT RESOLVED By the City Counoll of the City of Stillwater, Minnesota, that this
Council shall meet at the City Hall In said City on Tuesday, the 9th day of May, 1961,
at 7:30 o'clock P.M. for the purpose of holding a public hearing on the making of the
above described improvements, and that the Clerk be, and he Is hereby, authorized
and directed to cause proper notice of the time, place and purpose of said meeting to
be published In the Stillwater Evening Gazette, official newspaper of the City, in the
issues of said parer dated April 21, 1961 and April 28, 1961,

BE IT RESOLVED by the City Council of the City of Stillwater, Minnesota, that
the Mayor and the City Clerk be, and they are hereby, authorized and directed
to execute in behalf of the City an easement in favor of the State of Minnesota
for highway purposes over and across the following described real estate in the
County of Washington, State of Minnesota:
All that part of the following described tract:
That part of Government Lot 3 of section 34, township 30 north, range
20 west, bounded as follows: Beginning at low water mark on the shore
of Lake St. Croix on the line between Government Lots 2 and 3 in said
section 34; thence west on said line 100 feet, more or less, to the
center of he main track of the Chicago, St. Paul, Minneapolis and
Omaha Railway Company; thence southerly along the center line of said
railroad track to a point where the north line of Lot 5, Block 1 of
Hersey, Staples and Company's Addition to City of Stillwater, if pro-
duced westerly would intersect the center line of said railroad track;
thence east along said line on said line, if produced eaetwardly to
Lake St. Croix, at low water mark; thence northerly along the shore of
said Lake St. Croix to the place of beginning;
which lies northeasterly of the northeasterly right of way line of said
railway and southwesterly of a line run parallel with and distant 130
feet northeasterly of the following described line:

RESOLUTION RELATING TO LNIFORM ALLOWANCES
BE IT RESOLVED by the City Council of the City of Stillwater, Minnesota, that
to clarify the policy of the City in making allowances to policemen and fire-
men for uniforms, a policeman's uniform shall consist of coat, pants, cap and
overcoat and a fireman's uniform shall consist of coat, pants and cap.

at the North end thereof to Echo Lane and on private property over an
easement to be acquired between the cul-de-sac at the Southeast end of
Lookout Street and the North end of Sunnyslope Lane. The estimated cost

same is all benefited property abutting upon said streets.
Froleat No. 11:
Construction of 8" sanitary sewer on West Linden Street from a point
approximately 360 feet 'lest of the West Line of North Harriet Street
to a point approximately 10 feet West of the West Line of North Harriet
Street; thence Northwesterly across private property to West Cherry
Street and thence across additional private property, and the existing
ravine,to the existing 30" interceptor sewer which flows down the
ravine North of Cherry Street. The estimated cost of said Improvement
is $6,407.00 and the area proposed to be assessed for same Is as follows:

Construction of 8" sanitary sewer on '.Jest St. Croix Avenue from North

City Engineer has prepared plans and specifications for the improvement of
West Pine Street between South Grove Street and South Brick Street, of South
Hemlock Street between West Olive Street and West Pine Street, and of West
Moore Street between North Fourth Street end North Martha Street and has pre-
sented such plans and specifications to the Council for approval;

RESOLUTION ORDERING SEWER AND WATER IMPROVEMENTS AND DIRECTING PREPARATION OF
PLANS AND SPECIFICATIONS.
WHEREAS, by Resolution of the City Council adapted July 11, 1961, a public
hearing was ordered to be hold on Monday, July 31, 1961,,an the proposed sewer
and water improve a....a described therein; and
WHEREAS, pursuant to said Resolution notice of hearing was given as required
by law through two weekly publications in the Stillwater Evening Gazette on
July 18, 1961 and July 25, 1961, and said hearing was thereupon duly held on
July 31, 1961, at which time all persons desiring to be heard were given an op-
portunity to be -heard thereon,
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota:
1. That the construction of said improvements be, and the same are hereby,
ordered in accordance with the descriptions thereof contained in said notice of
hearing except as hereinafter provided, viz:
(a) Project No. 1 shall be reduced by eliminating therefrom con-
struction of 8" sanitary sewer on private property from Fourth
Street Weat a distance of approximately 270 feet and on Nest Syca-
more Street from North Fourth Street Uest a distance of approximate-
ly 270 feet.
(b) Project No. 3 shall be reduced bye laminating therefrom con-
struction of 8" sanitary sewer on Everett Drive in the proposed plat
of Bergen's Forest Hills Addition Westerly and Northerly to the pro-
posed sewage pumping station, on Harriet Street in the said proposed
plat of Bergen's Forest Hills Addition Northerly from Everett Drive
to Orleans Street, and on Orleans Street Xesterly from Harriet Street
in the said proposed plat to Everett Drive.
(c) Project No. 4 shall be reduced by providing for construction of
8" cast iron water main on North Fourth Street from the existing water
tower to West Sycamore Street and construction of 6" cast iron water
main on West Sycamore Street to the East right of way line of North
Fourth Street.
(d) Project No. 8 shall be reduced by limiting construction of the
6" water main therein proposed to Ritzer's Subdivision.
(e) Project No. 9 shall be reduced by providing for construction of a-
6" water main rather than a 12" water main as originally proposed.
(f) Project No. 10 shall be reduced by eliminating therefrom con-
struction of 6" water main on Sunset Drive from Myrtle Street to
Sunnyslope Lane, on Sunnyslope Lane from the cul-de-sac at the North
end thereof to Echo Lane and on private property over an easement to
be acquired between the cul-de-sac at the Southeast end of Lookout
Street and the North end of Sunnyslope Lane.
(g) Project No. 11 is eliminated in its entirety.
2. That Banister Engineering Co. of St.Paul, Minnesota, is hereby author-
ized and directed to prepare final plans and specifications for the construction
of said improvements and to submit same to this Council.

Engineering Co. of St. P-ul, Minnesota, has prepared plans and specifications
for the construction of uertain sewer and water improvements described in a Re-
solution adopted by the Council July 11, 1961, as amended by the said Resolution
of July 31, 1961, as Projects No. 1 to No. 10, inclusive, and Project No. 12,
and has further prepared plans and specifications for the construction of that
certain sewer improvement hereinafter referred to as Project No. 13;
AND, WHEREAS, it is found and determined that Banister Engineering Co. of St.Paul
Minnesota, has reported to the Council that the following described sewer im-
provement is feasible and may best be made as proposed in conjunction with the
foregoing sewer and water improvements, the general nature of said improvement,
the estimated cost thereof and the area proposed to be assessed therefor being
as follows, to -wit:
Project No. 11: Construction of 8" sanitary sewer on 'Nest Heneeck
Street from South Everett Street to the East lineofRither's Sub-
division. The estimated cost of said improvement is 41,719.25 and
the area proposed to be assessed for same 1s as follows: A11 bene-
fited property abutting upon said street.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City cf Still-
water, Minnesota:
1. That said plans and specifications be, and the same are hereby, ap-
proved and ordered to be filed in the office of the City Clerk.
2. That the City Clerk be, and he is hereby, authorized and directed to
prepare and cause to be inserted in the Construction Bulletin and in the Still-
water Evening Gazette, official newspaper of the City, an advertisement for bids
on the making of said improvements described as Projects No. 1 to No. 10, inclu-
oive, and Projects No. 12 and No. 13, the work to be done thereunder to be di-
vided into sections as follows:
Section 1: Approximately 7030 lineal feet of cast iron water main
varying in size from 6" to 10", together with appurtenances.
Section 2: Approximately 5840 lineal feet of 8" and 10" sanitary sewer
and approximately 1950 lineal feet of 6" cast iron force
main, together with appurtenances.
Section 3: One sewage pumping station.
Said advertisement to provide that Section 1 and Section 2 must be bid as a
single project and that bids may be submitted for Section 3 with or without
bids on Sections 1 and 2; that each bid shall be accompanied by a bid bond,
certified check or cash deposit in an amount equal to at least ten (10) per-
cent of the amount of the bid; and that the City reserves the right to retain
the deposits of the three lowest bidders for a period of thirty (30) days
after the time set for opening same.
3. That the said advertisement shall be published in the issues of the
said Construction Bulletin and of the said newspaper dated August 10, 1961, and
August 17, 1961, and shall state that bids will be opened and considered by the
Council at 2:30, P.M., Central Standard Time, on dednesday, the 6th day of Sep-
tember, 1961, in the Council Chambers at the City Hall.
4. That the Council shall meet at the City Hall on Wednesday, the 6th day
of September, 1961, at 3:00 P.P.F., Central Standard Time, for the purpose of hold-
ing a public hearing on the making of the above described improvement designated
as Project No. 13 as aforesaid.

WHEREAS, it appears that the City of Stillwater is the owner in fee simple of
certain real estate situated in Washington County, Minnesota, described as fol-

BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that
said above described real estate be sold to Evelyn Illa of Stillwater, Minnesota,
for the sum of One Hundred Dollars ($100.00); and that upon payment of said
sum, together with the cost of publication of this Resolution, by the said
Evelyn Ilia to the City Treasurer, the Mayor and the City Clerk shall be, and
they are hereby, authorized and directed to execute and deliver to the said
Evelyn Ilia in behalf of the City a good and sufficient deed of quit claim
conveying said real estate to the said Evelyn Ilia, her heirs and assigns,
subject, however, to the covenants and conditions that the City shall reserve
the right to operate and maintain sanitary sewer facilities located thereon,
including the right to enter upon said property at any time with men, materials
and equipment for purposes of repairing or replacing said sanitary sewer
facilities, and that the said grantee, her heirs or assigns, shall not erect
or cause to be erected upon said property, or any part thereof, any building

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STILLWATER, MINNESOTA, that
the appointment by the Mayor of Eldon D. Sanders as Chief of Police of the
City effective September 1, 1961, be, and the same is hereby, confirmed;
and that as compensation for services rendered as such official the said
Eldon D. Sanders shall receive the sum of 8900.00 per month together with
all other benefit' presently inuring to other City officers and employees
such as accumulated sick leave benefits, vacation time, group hospital
and medical insurance, and the like.

RESOLUTION ACCEPTING 'WORK UNDER CONTRACT FOR GRADING AND SURFACING OF SOUTH
FOURTH STREET
WHEREAS, pursuant to a written contract signed with the City on the 5th
day of May, 1960, Solberg Construction Company of Inver Grove, Minnesota,
has satisfactorily completed street grading and surfacing in connection
with the improvement of South Fourth Street in the City in accordance with
the terms and conditions of said contract;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota, that the work so completed under said contract Is hereby accepted
and approved and that a warrant be drawn upon the City Treasurer for the
sum of $8,534.00 in full and final payment due to the contractor under
said contract.

RESOLUTION AUTHORIZING PAYMENT TO CONTRACTOR, PROJECT NO. 1, SEWER IMPROVE.
WENT NO. 1 - 1959.
WHEREAS, this Council did on July 11, 1961, adopt a Resolution accepting
work completed by Acton Construction Company under contract for construction
of Projects No. 1 and No. 3, Sewer Improvement No. 1- 1959, and author-
izing payment to the contractor of the sum of $10,019.28 in full and final
payment due to the contractor under said contract; and
WHEREAS, it has been satisfactorily made to appear to the Council that
the sum so authorized and paid to the contractor was based and determined
on the contractor's estimate No. 12 which credited the City with a payment
of $57,242.72 on the contractor's estimate No. 11 for construction of
Project Plo. 1, while the amount actually paid by the City on said estimate
No. 11 was rather $54,798.14, leaving a deficit of $2,444.58 still due to
the contractor;
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that a warrant be drawn upon the City Treasurer for the sum of $2,444.58,
payable to the order of the Acton Construction Company, in full and final
payment due to said contractor under the contract aforesaid.

RESOLUTION ACCEPTING BIDS FOR CONSTRUCTION OF SEWER AND WATER IMIBOVEMENTS
WHEREAS, this Council did, by Resolution adopted August 8, 1961, authorize
and direct the City Clerk to advert'se for bids returnable at 2:30 o'clock
P.M., on Wednesday, September 6, 1961, for the construction of sewer and
water improvements described as Projects No. 1 to No. 10, inclusive, and
Projects No. 12 and No. 13; and
WHEREAS, this Council did further, by said resolution adopted August 8,
1961, order a public hearing to be held on September 6, 1961, on the 'ruing
of proposed sewer improvement described as Project No. 13 aforesaid; and
WHEREAS, it appears from the Affidavits of Publication presented by the
City Clerk that pursuant to said Resolution an advertisement for bids
was duly published in the Construction Bulletin, a trade paper meeting
all the requirements of law, and in the Stillwater Evening Gazette, the
official newspaper of the City; and that a notice of hearing on the making
of said proposed improvement described as Project No. 13 was given as re-
quired by law through two weekly publications in the Stillwater Evening
Gazette on August 22, 1961, and August 29, 1961, and said hearing was
thereupon duly held on September 6, 1961, at which time all persons
desiring to be heard were given an opportunity to be heard thereon; and

to be published in the official newspaper of the City and in the Com-
mercial West, at Minneapolis, Minnesota, notice of the public sale of
4163,000.00 Improvement Bonds of 1961 of the City of Stillwater, to be
dated as of November 1, 1961, and to be issued for the purpose of provid-
ing moneys to finance local improvements undertaken In accordance with the
provisions of the City Charter and of Minnesota Statutes, Chapter 429;
that this Council shall meet at the Council Chambers in the City Hall on
Monday, October 16, 1961, at 4:30 o'clock F.M., to receive, open and con-
sider sealed bids theretofore received pursuant to said notice, and to
award the sale of said bonds, define the form and terms thereof, make
specific provision as to the disposition of the bond proceeds, and levy

RESOLUTION CONFIRMING APPOINTMENT OF POLICE OFFICER
BE IT RESOLVED by the City Council of the City of Stillwater, Minnesota, that
the appointment of Robert A. Shopbell as a police officer of the City be, and
the same is hereby, confirmed; that as such police officer the said Hobert A.
Shopbell shall have the powers of police officers at common law or under the
laws of the State of Minnesota, and it shall be his duty to serve warrants,
summons, writs, subpoenas or other process Issued by the Municipal Court, to
command the peace, suppress rioting or disorderly conduct within the City and
to arrest with or without a warrant, as authorized by the laws of this State,
persons charged with the commission of any public offense under the laws of

BE IT RESOLVED by the City Council of the City of Stillwater, Minnesota, that
the most favorable bid for the purchase of $163,000 Local Improvement Bonds of
1961 of the City, received pursuant to and complying with the terms of the notice
of sale thereof duly published, is the bid of the First American National Bank
of Duluth, Duluth, Minnesota, to purchase said bonds at a price of par and ac-
crued Interest plus a premium of $ -0-, which bid provides that bonds maturing
in the years set forth below shall bear interest from date of issue until paid
at the respective annual rates set forth opposite such maturity years:

BE IT RESOLVED by the City Council of the City of Stillwater, Minnesota, as
follows:
1. It is hereby found, determined and declared that this Council received a

sons interested with reference to the construction of said improvements and the
areas to be assessed therefor was duly called for May 9 and July 31, 1961; that
notice of said public hearing was duly published as required by law; that after
consideration of the views of all persons represented at said public hearing,
by resolution duly adopted on May 9 and July 31, 1961 construction of said im-
provements was ordered; that final plans and specifications for construction of
said improvements were prepared and approved, and advertisement for bids for
construction of said improvements was thereafter duly published, and contracts
for such construction have now been awarded and bonds securing the completion
thereof in accordance with the plans and specifications have been duly fur-
nished; that the total cost of said improvements, including every item of cost
incurred and to be incurred from inception to completion and all fees and ex-
penses in connection with the improvement and the financing thereof, is presently
estimated to be $163,000; and that it is now necessary and in the best interest
of the City to issue its general obligation bonds in the total principal amount
of $163,000, to defray in part such expense, under and pursuant to the provisions
of Minnesota Statutes 1957, Chapters 429 and 475, as amended, wh1^_h bonds have
now been duly sold.
2. All acts, conditions and things required by the Constitution and laws of
the State of Minnesota, and the charter of the City of Stillwater, to be done,

3. Said bonds shall be designated as "Local Improvement Bonds of 1961", and
shall be dated as of November 1, 1961. Said bonds shall be in the total prin-
cipal amount of $163,000, and shall be 163 1n number and numbered from 1 through
163, each in the denomination of $1,000. Said bonds shall mature in order of
serial numbers, on November 1, in the years and amounts set forth below, and
bonds maturing In such years set forth below shall bear interest from date of
issue until paid at the annual rates set forth opposite such years and principal
amounts, respectively:

Bonds bearing serial numbers 1 through 113, having stated maturity dates in

ity dates without option of prior payment. Bonds bearing serial numbers 114
through 163, having stated maturity dates to the years 1974 through 1979, shall
each be subject to redemption and prepayment, at the option of the City, In
inverse order of serial numbers, on November 1, 1973, and any interest pay-
ment date thereafter, at par and accrued interest. Interest on said bonds
shall be payable on November 1, 1962, and semiannually thereafter on each May
1 and November 1. Both principal of and interest on said bonds shall be
payable at the First American National Bank of Duluth, Duluth, Minnesota. The
City hereby agrees to pay the reasonable and customary charges of said paying
agent for the receipt and disbursement of principal and interest moneys.
4. Said improvement bonds and the coupons appurtenant thereto shall be in sub-
stantially the form presented by the City Clerk and approved by this Council
this date.
5. Said bonds shall be printed under the direction of the City Clerk and shall
be executed on behalf of the City by the manual signature of the Mayor, attested
by the manual signature of the City Clerk, and the corporate seal of the City
shall be affixed thereto. The interest coupons appurtenant to said bonds shall
be executed and authenticated by the printed, engraved or lithographed facsimile
signatures of said Mayor and City Clerk. When Said bonds have been so executed
and authenticated they shall be delivered by the Treasurer to the purchaser
thereof, upon payment of the purchase price heretofore agreed upon, and said
purchaser shall not be obliged to see to the application of said purchase price.
6. There 1s hereby created a special fund to be designated as the "1961 Water
and Sewer Improvements Fund", to be held and administered by the City Treasurer separate and apart from all other funds of the City. There 6ah11 be credited y
to said fund the proceeds from the sale of the Improvement bonds herein auth-
orized, and, until said improvements are completed, all receipts of special
assessments herein agreed to be levied with respect to said improvements, and
the receipts of taxes herein levied. Said fund shall be used solely to defray
the expenses of constructing said Improvements and for payment of principal
of and interest on the improvement bonds herein authorized. Upon the completion
of said improvements and payment of all costs thereof, any balance of the bond
proceeds remaining in said fund may be transferred by the Council to the fund
of any other improvement instituted pursuant to Chapter 429, Minnesota Statutes
1957. A11 moneys then remaining in said fund and not so transferred, and all
subsequent receipts from special assessments levied with respect to said im-
provements and taxes herein levied shall be credited and paid into an Improve-
ment Bond Account 1n the sinking fund of the City, which Account shall be con-
tinued and maintained in said sinking fund until all bonds herein authorized
and all other general obligation improvement bonds designated by this Council
as payable therefrom, have been duly paid with interest, all as provided by
Chapters 429 and 475, Minnesota Statutes 1957.
7. It Is hereby covenanted and agreed with the purchaser and holders from time
to time of the bonds herein authorized, that not less than 20% of the cost of
said improvements shall be assessed against properties specially benefltted
thereby. It is presently estimated that not less than 3157,000 of the cost
of said improvements shall be }aid by special assessments to be levied upon
all lots, pieces and parcels of land subject to assessment and lying within the
areas heretofore determined to be assessable for said improvements, which

assessments shall be in amounts proportionate to the benefits received by said
lots, pieces and parcels of land respedtively. Said assessments shall be pay-
able in 20 equal, consecutive, annual installments, and shall be levied accord-
ing to law and spread upon the tax rolls of the City for the years commencing
with the year 1962, and continuing thereafter until paid, with interest upon
t;•e unpaid principal balance thereof from time to time remaining unpaid at
the rate of 6% per annum. The City hereby covenants and agrees that it will
do and perform all acts and things necessary for the final and valid levy of
special assessments for the payment of a portion of the cost of said improve-
ments. In the event that any such assessment be at any time held invalid with
respect to any lot, piece or parcel of land, due to any error, defect or ir-
regularity in any action or proceeding taken or to be taken by the City or by
this Council or by any of the City's officers or employees, either in the making
of such assessment or in the performance of any condition precedent thereto,
the City shall forthwith do all such further acts and take all such further
proceedings as shall be required by law to make such assessment a valid and
binding lien upon said property. It 1s presently estimated that of the amount
estimated above to be specially assessed, 416,000 thereof will be prepaid.
8. It is estimated that collections of said special assessments will be in
a sufficient amount to provide not less than 5% in excess of the amounts needed
to meet when due the principal and interest payments on each and all of the
bonds herein authorized, however, in the event they shall not be, there shall
be levied a direct, annual ad valorem tax on all taxable property within the
City for such deficiency.
Said levies shall be irrepealable except as to the extent and in the manner
provided by Minnesota Statutes 1959, Section 475.61, as amended, an all col-
lections thereof shall he credited as provided in paragraph No. 6 hereof.
9. The City Clerk is hereby authorized and directed to file with the County
Auditor of Washington County a certified copy of this resolution and to obtain
from said County Auditor a certificate setting forth the registration of said
bonds in his register in accordance with the provisions of Minnesota Statutes
1957. Section 475.63, as amended, and stating that the tax required by law
for the payment of said bonds has been levied.
10. The officers of the City and the County Auditor of Washington County are
hereby authorized and directed to prepare and furnish to the purchaser of said
bonds and to the attorneys approving the legality thereof certified copies
of all proceedings and records relating to said bonds and to the financial
affairs of the City, and such other affidavits, certificates and information
as may be required to show the facts relating to the legality and market.

custody and control or as otherwise known to them, and all such certified copies,
certificates and affidavits, including any heretofore furnished, shall be deemed
representations of the City as to the facts recited therein.

RESOLUTION CONSOLIDATING IMPROVEMENTS, AUTHORL3ING ISSUANCE OF $163,000 LOCAL
IMPROVEMENT BONDS OF 1961, CREATING A SINKING FUND FOR 1961 WATER AND SEWER
IMPROVEMENTS, AND PROVIDING FOR LEVY OF TAXES AND SPECIAL ASSESSMENTS FOR FAY-
MENT OF SAID BONDS; RESCINDING RESOLUTION NO. 2346
9E IT RESOLVED by the City Council of the City of Stillwater, Minnesota, as
follows:
1. It is hereby found and determined that this Council has heretofore taken
all proceedings required by law for the making of Sewer Improvement No. 1-1959
of the City, and has levied special assessments on account thereof on proper-
ties benefited thereby, In an amount not less than $271,000; that In Resolution
No. 2138 of the City, adopted on October 14, 1959, it was estimated that the
cost of said improvement would be $950,000, whereof $250,000 would be paid from
available cash on hand, leaving a balance of $700,000 necessary to be borrowed
to pay such cost; that said resolution accordingly authorized the issuance of
$700,000 Sewer Improvement Bonds of 1959; that the actual cost of making said
improvement has been now proved to amount to 8743,537.50 over and above avail-
able cash on hard; that In said resolution the City agreed to levy $214,000

of special assessments to pay the cost of said improvement, the remainder to
be paid from the general ad valorem taxes levied in and by said resolution,
and consequently the City has levied such special assessments in an amount not
less than $37,000 in excess of the amount required by law and by said resolution;
and that 1t is necessary to borrow $43,537.50, in addition to the borrowing of
$700,000 to 1959. in order to complete Sewer Improvement No. 1-1959, by the
issuance of improvement bonds in such amount, pursuant to the provisions of
Minnesota Statutes, Chapter 429.
2. It Is hereby further found and determined that this Council has instituted
proceedings for the making of various local improvements, all pursuant to Minn-
esota Statutes, Chapter 429, by calling and holding hearings thereon, advertis-
ing for construction bids, and awarding construction contracts, the Improve-
ments so instituted being designated as stated below, and the hearings thereon
and the award of contracts therefor having taken place on the dates set forth
below, as follows:

that the total cost of said improvements, including every Stem of cost incurred
and to be incurred fr,m inception to completion and all fees and expenses in
connection with said .mprovements and the financing thereof, is presently es-
timated to be $119,462.50; and that It is now necessary and in the best inter-
est of the City to borrow the cost of making said improvements by issuing Im-
provement bonds in such amount, pursuant to the provisions of Minnesota
Statutes, Chapter 429.
3. The proceedings for the improvements described in paragraph 2 above having
all been instituted at substantially the same dates, and it being hereby de-
termined that said Improvements, although separately instituted, can be more
economically completed if consolidated and joined as one project, the same
are hereby consolidated, and all subsequent proceedings shall be conducted
In all respects as if the various separate proceedings had originally been
instituted as one proceeding. Said consolidated improvement shall hereafter
be known and referred to as "Local Improvement 1961-A.•
4, All acts, conditions and things required by the Constitution and laws of
the State of Minnesota, and the charter of the City of Stillwater, to be done,
to exist, to happen and to be performed precedent to the issuance of said bonds,
in order to make them valid and binding general obligations of the City in ac-
cordance with their terms, have been done, do exist, have happened and have
been performed In regular and due form, time and manner as so required.
5. Said bonds shall be designated as "Local Improvement Bonds of 1961,• and
shall be dated as of November 1, 1961. Said bonds shall be in the total prin-
cipal amount of $163,000, and shall be 163 in number and numbered from 1 through
163, each in the denomination of $1,000. Said bonds shall mature in order of
serial numbers, on November 1, in the years and amounts set forth below, and
bonds maturing In such years set forth below shall bear interest from date
of issue until paid at the annual rates set forth opposite such years and
principal amounts, respectively:

Bonds bearing serial numbers 1 through 113, having stated maturity dates in
the years 1962 through 1973, shall be payable on their respective stated
maturity dates without option of prior payment. Bonds bearing serial numbers
114 through 163, having stated maturity dates In the years 1974 through 1979,
shall each be subject to redemption and prepayment, at the option of the City,
in inverse order of serial numbers, on November 1, 1973, and any interest pay-
ment date thereafter, at par and accrued interest. Interest on said bonds
shall be payable on November 1, 1962, and semiannually thereafter on each
May 1 and November 1. Both principal of and interest on said bonds shall be
payable at the First American National Bank of Duluth, in Duluth, Minnesota.
The City hereby agrees to pay the reasonable and customary charges of said
paying agent for the receipt and disbursement of principal and interest moneys.
6. Said improvement bonds and the coupons appurtenant thereto shall be in sub-
stantially the form presented by the City Clerk and approved by this Council
on October 16, 1961.
7. Said bonds shall be printed under the direction of the City Clerk and shall
be executed on behalf of the City by the manual signature of the Mayor, attested
by the manual signature of the City Clerk, and the corporate seal of the City
shall be affixed thereto. The interest coupons appurtenant to said bonds shall
be executed and authenticated by the printed, engraved or lithographed facsimile
signatures of said Mayor and City Clerk. When said bonds have been so executed
and authenticated they shall be delivered by the Treasurer to the purchaser there-
of, upon payment of the purchase price heretofore agreed upon, and said purchaser
shall not be obliged to see to the application of said purchase price,
8. There is hereby created a special fund to be designated as the "1961 Water
and Sewer Improvement Fund," to be held and administered by the City Treasurer
separate and apart from all other funds of the City. There shall be credited
to said fund $119,462,50 of the proceeds from the sale of the improvement bonds
herein authorized, and, until Local Improvement 1961-A has been completed, all

ment bonds herein authorized. Upon the completion of said improvement and pay-

ent of all costs thereof, any balance of the bond proceeds remaining In said

stituted pursuant to Chapter 429, Minnesota Statutes 1957. A11 moneys then re-
maining in said fund and not so transferred, and all subsequent receipts from
special assessments levied with respect to said improvement and taxes herein
levied shall be credited and paid into an Improvement Bond Account in the sink-
ing fund of the City, which account shall be continued and maintained in said
sinking fund until all bonds herein authorized and all other general obligation
Improvement bonds designated by this Council as payable therefrom, have been
duly paid with interest, all as provided by Chapters 429 and 475, Minnesota
Statutes 1957.
9. The remaining proceeds of the improvement bonds herein authorized, amount-
ing to $43,537.50, shall be credited to the 1959 Sewer Improvement Fund. A11
collections of the excess 437,000 of special assessments heretofore levied on
account of Sewer Improvement No. 1-1959 shall henceforth be credited to the
Improvement Bond Account in the sinking fundof the City.
10. It is hereby covenanted and agreed with the purchaser and holders from time
to time of the bonds herein authorized, that all of the cost of the improvement
described in paragraphs 2 and 3 of this resolution shall be raid by special
assessments to be levied upon all lots, pieces and parcels of land subject to
assessment and lying within the areas heretofore determined to be assessable
for said improvement, which assessment shall be in amounts proportionate to the
benefits received by said lots, pieces and parcels of land respectively. Said
assessments shall be payable in twenty equal, consecutive, annual Installments,
and shall be levied according to law and spread upon the tax rolls of the City
for the years commencing with the year 1962, and continuing thereafter until
paid, with interest upon the unpaid principal balance thereof from time to time
remaining unpaid at the rate of 6% per annum. The City hereby covenants and
agrees that it will do and perform all acts and things necessary for the final
and valid levy of said special assessments. In the event that any such assess-
ment be at any time held invalid with respect to any lot, piece or parcel of
land, due to any error, defect or irregularity in any action or proceeding taken
or to be taken by the City or by this Council or by any of the City's officers
or employees, either in the making of such assessment or In the ierformance of
any condition precedent thereto, the City shall forthwith do all such further
acts and take all such further proceedings as shall be required by law to make
such assessment a valid and binding lien upon said property.

11. It Is hereby estimated that the collections of the special assessments
pledged to the payment of the bonds herein authorized will produce at least
5 per cent in excess of the amounts needed to meet when due the principal and
interest payments on said bonds.
12. The City Clerk is hereby authorized and directed to file with the County
Auditor of Washington County a certified copy of this resolution and to obtain
from said County Auditor a'certificate setting forth the registration of said
bonds in his register 1p accordance with the provisions of Minnesota Statutes
1957, Section 475.63, as amended.
13. The officers of the City and the County Auditor of Washington County are
hereby authorized and directed to prepare and furnish to the purchaser of said
bonds and to the attorneys approving the legality thereof certified copies of
all proceedings and records relating to said bonds and to the financial affairs
of the City, and such other affidavits, certificates and information as may
be required to show the facts relating to the legality and marketability of
said bonds as the same appear from the books and records under their custody
end control or as otherwise known to them, and all such certified copies,
certificates and affidavits, including any heretofore furnished, shall be deemed
representations of the City as to the facts recited therein.
14. Resolution No. 2346 of this Council, adopted on October 16, 1961, is hereby
repealed and rescinded.

RESOLUTION ACCEPTING WORK UNDER CONTRACTS FOR CONSTRUCTION AND RELOCATION OF
WATER MAINS AND FOR CONSTRUCTION OF STORM SEWERS IN CONNECTION WITH SOUTH FOURTH
STREET IMPROVEMENT.
WHEREAS, pursuant to a written contract with the City signed on the 5th day
of May, 1960, Houliston Contracting Company, Inc., of Taylors Palls, Minnesota,
has satisfactorily completed construction of storm sewers in connection with
the improvement of South Fourth Street in the City in accordance with the terms
and conditions of said contract; and
WHEREAS, pursuant to a written contract with the City signed on the 2nd day
of May, 1960, Moelter Construction Company of Stillwater, Minnesota, has sat-
isfactorily completed construction and relocation of water mains in connection
with said Improvement of South Fourth Street in the City in accordance with
the terms and conditions of said contract;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota, that the work so completed under said contracts is hereby accepted
and approved and that warrants be drawn upon the City Treasurer for the sum
of $30,379.34 in full and final payment due to the said Houliston Contracting
Company, Inc., under its said contract and for the sum of $56,506.15 in full
and final payment due to the said Moelter Construction Company under its said
contract.

BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that
the bid of American Pipe Cleaning Company of Minneapolis, Minnesota, in the
amount of Pour Thousand Eighteen Dollars ($4,018.00), for the sale and delivery
to the City of one (1) complete new set of sewer cleaning bucket machines and
associated accessories, which bid is hereby found to be the lowest responsible
bid for ruch equipment, be, and the same is hereby, accepted; and the Mayor
and the City Clerk are hereby authorized and directed to enter into a contract
in behalf of the City with the said American Fipe Cleaning Company for the pur-
chase of said equipment., said contract to be in accordance with the specifi-
cations and the proposal of the bidder which are on file in the office of the
City Clerk.
