RESOLUTION RELATING TO COvPENSATION OF STREET DEPARTMENT EMFLOY..PS
BE IT RESOLVED by the City Jouncil of the City of Stillwater, Minnesota, that
employees of the City Street Department who are compensated for services rendered
as such on an hourly basis shall hereafter be entitled to compensation at the
hourly rate prescribed for their particular employment on the following holidays,
namely: New Year's Day, Good Friday, Memorial Day, the 4th of July, Labor Day,
Thanksgiving Day and Christmas Day, provided that the observance of any such holi-
day falls upon a day of the week other than a Saturday or a Sunday.

RESOLUTION AUTHORIZING EMPLOYMENT OF MECHANIC
BE IT RESOLVED by the City Councilof the City of Stillwater, Minnesota, that
effective January 1, 1960, the compensation of Paul Doerr for services rendered
as a fireman of the City be fixed at $335.00 per month; and that the said Paul

hour if such services be performed by him during the hours he iseff duty as than as0800

per month.

RESOLUTION No.2176
RESOLUTION AUTHORIZING EXECUTION OP LICENSE AGREEMENT
BE IT RESOLVED by the City Council of the City of Stillwater Minnesota, that
the Mayor and the City Clerk be, and they are hereby, authorised to execute in
behalf of the City a proper agreement with the Chicago, Milwaukee, St.Paul and
Pacific Railroad Company and the Chicago and North Western Railway Company, li-
censing and permitting the City to construct, maintain and use an interceptor
dower upon the property and under the tracks of the said railroad companies.
BE IT FURTHER RESOLVED that upon the execution of said license agreement, and
in consideration of the privileges granted therein, the City shall pay to the
Chicago and North Western Railway Company the cum of One Hundred Dollars ($100.00)
for the longitudinal occupation of the said Chicago and North Western Railway
Company solely owned property, and that a warrant be drawn upon the City Treas-
ury accordingly. -

RESOLUTION AUTHORIZING THE ISSUE AND SALE OF CERTIFICATES OF INDEBTEDNESS

levied or to be levied on property specially benefited by sanitary sewer, desig-
nated as Local Improvement No.22-1959.
ALL OF SAID CERTIFICATES shall be dated February 24, 1960, and shall be payable
to the bearer on or before December 31, 1970, at the office of the City Treasurer,
City Hall, Stillwater, Minnesota, and shall bear interest at the rate of Five
(5) per cent per annum from date of issue until paid.
ALL OF SAID CERTIFICATES shall be numbered and in the amounts as follows:
Two certificates, numbered 43 and 44, each in the amount of $1000.00 and One cer-
tlfioate numbered 45, in the amount of $404.29.
TREY SHALL BE SIGNED IN THE NAME OF THE CITY by its Mayor and City Clerk and
shall bear the official seal of the City. They shall be payable primarily from
said special assessments but the full faith and credit of the CITY are hereby

RESOLUTION AUTHORIZING INVESTMENT OF FUNDS
BE IT RESOLVED by the City Council of the City of Stillwater, Minnesota, that
the City Treasurer be, and he is hereby, authorized and directed to invest the
sum of $8,e00.00,surplus in the Sanitary Sewer Revenue Fund not presently needed
to pay the normal, reasonable and current costs of administering, operating and
maintaining the sewer system and facilities of the City, in general obligations
of the United States of America as in such case made end provided by law.

RESOLUTION No. 2183
RESOLUTION ACCEPTING BID FOR CONSTRUCTION OF SANITARY SEWERS-MCKUSICK LAKE AREA
WHEREAS, it appears from the Affidavits of Publication presented by the City
Clerk that pursuant to the resolution of this Council adopted December 8, 1959,
an advertisement for bids for the construction of sanitary sewers in the MOKusick
Lake area of the City of Stillwater, Minnesota, was duly published in the Con-
struction Bulletin on January 14, 1960, and in the Stillwater Evening Gazette,
the official newspaper of the City, on January 14, 1960 and on January 21, 1960;
and
WHEREAS, pursuant to said advertisement for bids for said improvement, the follow-
ing bids, which bids are on file in the office of the City Clerk and are incor-
I•0 porated hereinby reference the same as if set out in full, were received, to -wit:

said advertisement; and
WHEREAS, it appears that Peter Lametti Construction Co. of St. Paul, Minnesota,
is the lowest responsible bidder for the construction of said improvement with
a base bid of $76,494.20.
NON, THEREFORE, BE IT RESOLVES by the City Council of the City of Stillwater,
Minnesota, that the foregoing bid of the said Peter Lanett]. Construction Co.,
lowest-esponsible bidder, be, and it is hereby, accepted, and that the Mayor
and t ^sty Clerk be, and they are hereby, authorized and directed to enter
into a ccn:ract in the name of the City of Stillwater with the said Peter La-
metti Construction Co. for the construction of said improvement, said contract
to be in accordance with the plans and specifications for said improvement on
file in the office of the City Clerk.
BE IT FURTHER RESOLVED that the City Clerk be, and he is hereby, authorized
and directed to return forthwith to all bidders the deposits made with their

an advertisement for bids for the construction of a sewage pumping station in
connection with sanitary sewers in the McKusick Lake area of the City of Still-

WHEREAS, by resolution adopted March 8, 1960, this Council did fix a date for
a public hearing on the proposed improvement of South Fourth Street between
Orleans Street and Willard Street in conjunction with certain storm sewer and
water main improvements in said South Fourth Street between Orleans Street and
Pint Street; and
WHEREAS, pursuant to notice duly published in the Stillwater Evening Gazette,
official newspaper of the City, on the llth day of March, 1960 and on the 18th
day of March, 1960, as required by law, said hearing was held at the City Hall
at 7:30 o'clock P.M. on Tuesday, the 22nd day of March, 1960, at which time
and place all persons desiring to be heard on said matterwere given an oppor-
tunity to be heard.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Stillwater,
Minnesota:
1. That the improvement of South Fourth Street, consisting of the widen-
ing and resurfacing thereof, together with replacement of 1,400 square yards
of sidewalk, construction of curbs and gutters and construction of lateral

posed at an estimated cost of $97,857.00, and that final detailed plans and
specifications therefor, prepared by Banister Engineering Co. of St.Paul, Minn-
esota, pursuant to Council resolution be, and the same are hereby, approved and
ordered to be filed in the office of the City Clerk provided, however, that the
foregoing determination to proceed with said improvement and approval of plans
and specifications is subject to the approval of the Commissioner of Highways
of the State of Minnesota, under and pursuant to Minnesota Statutes 162.09 to
162.14, inclusive, establishing a municipal State -aid street system, and the
rules and regulations promulgated thereunder.
2. That in conjunction with the foregoing improvement, the making of
certain improvements to and upon that portion of the water distribution system
of the City in South Fourth Street 'between Orleans Street and Pine Street, in-

Armory Board, National Guard Armory of Stillwater, for annual appropriation by
the City of Stillwater for maintenance of said Armory during the year 1959, an
appropriation in the amount of v250.00 is hereby granted under and pursuant
to M.S.A. 193.35.
AND THE MAYOR AID CITY CLERK are hereby authorized and directed to draw their

RESOLUTION DESIGNATING DEPOSITORIES OF PUBLIC FUNDS
BE IT HEREBY RESOLVED, that the following named banks authorized to do a bank-
ing business in Minnesota, be, and hereby are designated depositories of the
public funds of the City of Stillwater, County of Hashington, Minnesota, for the
term commencing with the oth day of May, 1960, and ending with the 31st day of

To secure such funds, the said depositories shall deposit with the City Treas-
urer such bond or other collateral as is required or permitted by law. The
total in amount of such collateral computed at its market value shall be at
least ten per cent (10%) more than the limit of deposit which would be permitted
if a corporate or personal surety bond was furnished. The depositories may in
their discretion furnish both a bond and collateral aggregating the required
ofotot theAny

over to the Treasurer or his order on demand all moneys deposited thereinaettin
any time during the period such collateral shall be so deposited; and,
case of any default on the part of any depository, the City shall have full

sary, to realise the full amount due the City and to pay over any surplus to
such depository or its assigns. The depositories may in their discretion de-
posit collateral of a value less than the total designation and may from time to
time, during the period of their designation, deposit additional collateral
and make withdrawals of excess collateral, or substitute other collateral for
that on deposit or any Dart thereof. Before any collateral is deposited with
the Treasurer, it shall first be approved by the City Council, but no such
authority shall be necessary for the withdrawal of collateral. If both bond
and collateral are furnished by the depositories, all or any part of the collat-
eral may be withdrawn without in any way impairing the full force and effect of
the bond unless it shall contain a provision that the collateral shall hot be

WHEREAS, Hooley's Super Markets, Inc. has made application to the Council for
special permission to use for commercial purposes certain premises owned by
it and described as follows, to -wit:

and
WHEREAS, it appears to the Council that the intended use of said premises is to

the total sum of $281,000, in anticipation of collection of special assess-
ments levied, or to to levied, on properties specially benefited by the fol-

BE IT RESOLVED by the City Council of the City of Stillwater, Minnesota,
as follows:
1. This Council has investigated the factsnecessary to ascertain and does
hereby find, determine and declare:
1.1 That this Council has heretofore by Resolution No. 2197, adopted on larch
8, 1960, authorized the sale and issuance of $350,000 Genoral Obligation bonds
of 1960 of the City, for the purpose of refunding outstanding certificates of
indebtedness issued in accordance with the provisions of the City Charter, and
to finance local improvements undertaken in accordance with the provisions of
said Charter and of Minnesota Statutes, Chapter 429; that the sale of said is-
sue of bonds was duly awarded in accordance with the published notice of sale to
Allison -Williams Company, of Minneapolis, Minnesota, and associates, on March
23, 1960; that said bonds should forthwith be issued and delivered to said

2. This City shall forthwith issue and deliver to the purchaser thereof its
negotiable coupon general obligation bonds in the total principal amount of
$350,000, as heretofore duly authorized and sold at public sale. Said fonds shall
be dated as of April 1, 1960, shall be 350 in number, and numbered 1 through
350, each in denomination of 11,000, and shall mature serially, in numerical
order, on January 1, in the amount of $40,000 in each of the years 1962 through
1964, $35,000 in each of the years 1965 through 1968, and $30,000 in each of tie
years 1969 through 1971, all without option of prior payment. The bo..ds mat-
uring in the years 1962 through 1967 shall bear interest at the rate of three
and forty -hundredths per cent (3.40%) per annum, and those maturing in the years
1968 through 1971 shall bear interest at the rate of three and sixty -hundredths
per cent (3.60%) per annum, and all bonds shall bear interest at the rate of
two per cent (2.00%) per annum, from July 1, 1960, to January 1, 1961, such
additional interest to be represented by a separate "B" coupon. All interest
shall be payable on January 1, 1961, and semiannually thereafter on each July 1
and January 1. Both principal and interest shall be payable at the main office
of the Northwestern National Bank of Minneapolis, in Minneapolis, Minnesota, and
the City hereby agrees to pay the reasonable and customary charge of said paying
agent for the receipt and disbursement of the principal and interest moneys.
3. Said bonds and the interest coupons to be attached thereto shall be in

For the prompt and full payment of such principal and interest as the same become
due, the full faith, credit and taxing powers of the City are hereby irrevocably

This bond Is one of an issue of $350.000 aggregate principal amount, all of like
date and tenor except as to maturity and interest rate, issued by said City for the
purpose of refunding valid outstanding certificates of indebtedness issued under
authority of the Charter of said City for the purpose of financing the construc-
tion of certain local improvements therein, and 1s issued pursuant to resolutions

IT IS HEREBY CERTIFIED AND RECITED that all acts, conditions and things required

en and to be performed precedent to and in the issuance of this bond have been
done, do exist, have happened and have been performed in regular and due form,
time and manner as so required; that prior to the issuance hereof, the City has
levied, or covenanted and agreed to levy, special sssessments upon property bene-
fited by such improvements for the years and in the amounts sufficient to pro-
duce not lees than $% in excess of the principal and interest payments on bends of
this issue as they become due, which special assessments have been pledged and
appropriated to the sinking fund from which principal of and interest on bonds of
this issue are payable, and general ad valorem taxes may be levied upon all tax-
able property in said City for the purpose of paying such principal and interest,
without limitation as to rate or amount; and that issuance of this bond did not
cause the outstanding indebtedness of the City to exceed any constitutional, stat-
utory, or charter limitation of indebtedness, nor did the indebtedness funded
hereby exceed any such limitation on the dates it was incurred.

5. There is hereby created a separate "Sinking Nand for g350,000 Refunding 'once%
which fund shall be kept by the Treasurer apart from all other funds of the City
and used for no purpose other than the payment of principal of and interest on
said refunding bends, provided that, if any payment of principal or interest on
said bonds shall become due when there is not sufficient money in said sinking
fund therefor, the Treasurer shall pay the same from moneys in any other fund of
the City and such other funds may be reimbursed for such advances out of the
next moneys thereafter paid into said fund. Into said sinking fund shall be
paid all collections of enecial assessments heretofore or hereafter levied for
the purpose of paying the costs of the improvements financed by the issuance
of the certificates of indebtedness refunded by said bonds, ell accrued interest
received upon the delivery of said bonds to the purchaser thereof, all collections
of general ad valorem taxes which may be levied for the purpose of making good
any deficiencies in collections of special assessments pursuant to Minnesota Stat-
utes, sections 475.61 and 475.74 and any and all other moneys from time to time
received for or appropriated to the payment of said bonds and interest. It is
hereby estimated that the collections of such special assessments will produce at
least S% in excess of the amount needed to meet when due the prineipal.and inter-
est payments on said bonds.
6. The officers of the City and the County Auditor of Washington County are
hereby authorized and directed to prepare and furnish to the purchaser of said
bonds, and to the attorneys approving legality of the issuance thereof, certified
copies of all proceedings and records of the City relating to such bonds and
to the financial condition and affairs of the City, and such other affidavits,
certificates, and information as may be required to show the facts relating to
the legality and marketability of the bonds as the same appear from the books
and records under their custody and oontrol or as otherwise known to them; and
all such certified copies, certificates, and affidavits, including any heretofore
furnished, shell be deemed representations of the City as to the truth of the facts
purported to be shown therein.
7. The Clerk is hereby authorized and directed to file with the County Auditor
of Washington County, Minnesota, a certified copy of this resolution, together
with such other information as the County Auditor may require, and to obtain from
the County Auditor a certificate that the tax required by law for payment of the

Engineer, for construction of a sewer in South Sixth Street beginning at a
point 166 feet North of North property line of Marsh Street for a distance
of 321.90 feet thence Eaat through Lot 23 of Block 2 of Marrsh's Addition to
the City of Stillwater a distance of 128.10 feet, thence Northeast a distance
of 45.68 feet to a point on the Eaat property line of Lot 23 and West property
line of Loy 2 of Block 2, Marsh's Addition, thence East a distance of 165.50
feet to the existing manhole in South Fifth Street Which is 69.50 feet South
of South property line of West Hancock Street, in the City of Stillwater,

RESOLUTION DETERMINING TO PROCEED WITH THE WORE OF CONSTRUCTING A SEWER AND
DIRECTING THE CITY CLERK TO ADVERTISE FOR BIDS.
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER, MIU'NESOTA:
1. That it is hereby determined to proceed with the work of constructing a
sewer in the following street in the City of Stillwater, Minnesota, in
accordance with the plans and specification therefore, and as approved by
the City Council, September 6, 1960:
South Sixth Street beginning at a point 160 feet North of North property
line of Marsh Street for a distance of 321.90 feet thence East through
Lot 23 of Block 2 of Marsh's Addition to the City of Stillwater a distance
of 126.10 feet, thence Northeast a distance of 45.66 feet to a point on the
East property line of Lot 23, and West property line of Lot 2 of Block 2,
Marsh's Addition, thence East a distance of 165.50 feet tot he existing
manhole in South Fifth Street which is 69.50 feet South of South property
line of West Hancock Street.
2. That the City Clerk is hereby directed to advertise for bids, returnable
at a regular adjourned meeting of the City Council to be held in the Coun-
cil Chambers in the City Hall, on Tuesday the 20th day of September, 1960,
a* 7:30 o'clock P.M. for doing and furnishing the required commodities,
labor and services to complete said work in accordance with the plans and
specifications therefore.

RESOLUTION AUTHORIZING SETTLEMENT OF CONDEMNATION PROCEEDING.
WHEREAS, the City of Stillwater has commenced condemnation proceedings in the
ri District Court of Washington County, Minnesota, for the taking of certain lands
owned by Robert A. Peters and Helen Peters, for sanitary sewer purposes, which
lands designated as Parcel :lc. 1 are more particularly described therein; and
WHEREAS, the owners of said property have appealed from the Commissioners' award
of damages to them as a result of the taking of said lands;
BE IT RESOLVED By the City Council of the City of Stillwater, Minnesota, that
the Mayor and the City Clerk be, and they are hereby, authorized to make the
S following proposal of settlement to the said Robert A. Peters and Helen '?eters
as fair and just compensation of damages for the taking of said lands and
t damages to adjoining lands owned by them as a result of such taking, viz:
The City shall pay to said Robert A. Peters and Helen Peters the sum of Six
Thousand Five Hundred end no/1o0ths Dollars (56,500.00), and in addition there-
to shall grant to the said Robert A. Peters and Helen Peters, their heirs snd
assigns, a permanent easement over and across that part of the'vecated right
of way of the Chicago, Milwaukee and St. Paul Railroad Company, running through
Government Lot Pive (5), Section Thirty-four (34), Township Thirty (30), Range
Twenty (20), which lies south of a line parallel to and 900 feet south from the
north line of said Government Lot Five (5), said easement to be for purposes
ri of ingress to and egress from certain lands owned by the said Robert A. Peters
and Helen Peters lying adjacent to and eaebrly of said vacated railroad right
of way.
BE IT FURTHER RESOLVED That, upon acceptance of said proposed settlement by the
said Robert A. Peters and Helen Peters, the Mayor and the City Clary are hereby
authorized and directed -to execute in behalf of the City all necessary legal
instruments to effectuate grant of the easement aforesaid, and that a warrant
for the aforesaid sum of Six Thousand Five dundred and no/loothe Dollars
($6,500.00) be drawn upon the City Treasurer and issued accordingly.

WHEREAS said specifications are on file in the office of the Department of
Highways, Saint Paul, Minnesota, being marked, labeled, and identified as
S.P. 8214-34 (T.H. 212 = 45), Minn.Proj. F 094-1 (1), which, together with
the Minnesota Department of Highways Sp cifications for Highway Construction,
dated May 1, 1959, on file in the office of the Comaissioner of Highways, con-

RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER, MINNESOTA:
1. That the plans, specifications and estimated coat as prepared by the City
Engineer for constructing Sanitary Sewer connections from the main sewer to
the property lines of the following described lots consisting of approximately
180 lineal feet of 6 inch V.C.P. or 6 inch C.I.P. 1.1 the City of Stillwater,
Minnesota, as presented to the council for its consideration and approval be,
and the same are hereby approved and ordered filed in the office of the City
Clerk.
Lots Ten (101, Eleven (11), Twelve (12), and Thirteen (13), Block Nine (9),
McKlnstry and Seeley's first addition.
Lots One (1), Two (2), and Three (3),
Seeley's first addition.

in the City Hall at a regular meeting and act in relation to the doing of the pro -
posted work and the City Clerk is hereby directed to give notice of such meeting
in accordance with provisions of the City Charter.

WHEREAS, by deed dated March 14, 1959, 0. Skooglun conveyed to the City of

BE IT RESOLVED By the City Council of the City of Stillwater, Minnesota, that
for the purpose of establishing a municipal dumping ground the purchase of can

Rosabelle Delight Ramadan, husband and wife, is hereby authorised, said property

or any part of the collateral may be withdrawn without in any way Impairing the
full force and effect of the bond unless it shall contain a provision that the
collateral shall not be withdrawn without the consent of the surety thereon. If
a corporate surety bond is furnished by either of the depositories, It shall be
in a penal sum not to exceed the amount designated as the limit of deposit herein,
notwithstanding any other provisions of law to the contrary. At no time shall
the Treasurer maintain a deposit in the depositories against collateral in excess
of ninety per cent (90%) of the market value thereof. Any bond furnished shall be
approved by the City and filed in the office of the County Auditor as provided by
law, and all collateral deposited shall likewise be approved by the City and after
such approval, deposited with the Treasurer, unless the City Council shall by reso-
lution fix and determine some other place for the safekeeping of such collateral.
Such collateral shall not be re -deposited in the designated depositories. The
