Attest: 0 tv tv mam .,a e • • • • r 2 Sbi RESOLUTION No.2176 RESOLUTION AUTHORIZING EXECUTION OP LICENSE AGREEMENT BE IT RESOLVED by the City Council of the City of Stillwater Minnesota, that the Mayor and the City Clerk be, and they are hereby, authorised to execute in behalf of the City a proper agreement with the Chicago, Milwaukee, St.Paul and Pacific Railroad Company and the Chicago and North Western Railway Company, li- censing and permitting the City to construct, maintain and use an interceptor dower upon the property and under the tracks of the said railroad companies. BE IT FURTHER RESOLVED that upon the execution of said license agreement, and in consideration of the privileges granted therein, the City shall pay to the Chicago and North Western Railway Company the cum of One Hundred Dollars ($100.00) for the longitudinal occupation of the said Chicago and North Western Railway Company solely owned property, and that a warrant be drawn upon the City Treas- ury accordingly. - Adopted by the Council this 29th day of January, 1960. Attest: s Mayor me two • • • • RESOLUTION No. 2183 RESOLUTION ACCEPTING BID FOR CONSTRUCTION OF SANITARY SEWERS-MCKUSICK LAKE AREA WHEREAS, it appears from the Affidavits of Publication presented by the City Clerk that pursuant to the resolution of this Council adopted December 8, 1959, an advertisement for bids for the construction of sanitary sewers in the MOKusick Lake area of the City of Stillwater, Minnesota, was duly published in the Con- struction Bulletin on January 14, 1960, and in the Stillwater Evening Gazette, the official newspaper of the City, on January 14, 1960 and on January 21, 1960; and WHEREAS, pursuant to said advertisement for bids for said improvement, the follow- ing bids, which bids are on file in the office of the City Clerk and are incor- I•0 porated hereinby reference the same as if set out in full, were received, to -wit: Moelter Construction Company $ 98,083.15 Peter Lametti Construction Co. 76,494.20 Lametti & Sons, Inc. 87,686.30 Barbarossa & Sons, Inc. 87,527.15 James D.Wolff Construction Co. 100,747.25 Montgomery Construction Co. 88,060.20 Austin P. NON, THEREFORE, BE IT RESOLVES by the City Council of the City of Stillwater, Minnesota, that the foregoing bid of the said Peter Lanett]. BE IT RESOLVED by the City Council of the City of Stillwater, Minnesota, as follows: 1. It is hereby found and determined that Banister Engineering Co. has re- ported to this Council that the following described improvement is feasible and may best be made as proposed and nut in conjunction with any other improve- ments, and that the estimated cost of said improvement to the City is $93,932.60; said proposed improvement consists of the widening and resurfacing of South Forth ofucurbs tand tgutters and lconstruction aof lateral storm nd Willrd tsewer ltogether with uding construction between all necessary appurtenances. 2. This Council shallmeet at the City Hall in the City of Stillwater on Tuesday, March 22, 1960 at 7:30 o'clock P.M. for the purpose of holding a public hearing on the making of the above described improvement and the assessment of the abut- ting property for all or a portion of the cost of such improvement. 3. The total in amount of such collateral computed at its market value shall be at least ten per cent (10%) more than the limit of deposit which would be permitted if a corporate or personal surety bond was furnished. The depositories may in their discretion de- posit collateral of a value less than the total designation and may from time to time, during the period of their designation, deposit additional collateral and make withdrawals of excess collateral, or substitute other collateral for that on deposit or any Dart thereof. Before any collateral is deposited with the Treasurer, it shall first be approved by the City Council, but no such authority shall be necessary for the withdrawal of collateral. WHEREAS, the City of Stillwater has commenced condemnation proceedings in the ri District Court of Washington County, Minnesota, for the taking of certain lands owned by Robert A. Peters and Helen Peters, for sanitary sewer purposes, which lands designated as Parcel :lc. 1 are more particularly described therein; and WHEREAS, the owners of said property have appealed from the Commissioners' award of damages to them as a result of the taking of said lands; BE IT RESOLVED By the City Council of the City of Stillwater, Minnesota, that the Mayor and the City Clerk be, and they are hereby, authorized to make the S following proposal of settlement to the said Robert A. Any collateral so deposited shall be accompanied by an assignment thereof otthehe City, which assignment shall recite that such depositore shall pay over Treasurer or his order on demand all moneys deposited therein at any time during the period such collateral shall be so deposited; and, that in case of any de- fault on the part of any depository, the City shall have full power and authority to sell such collateral, or as much thereof as may be necessary, to realize the full amount due the City and to pay over any surplus to such depository or its assigns. If both bond and collateral are furnished by the depositories, all or any part of the collateral may be withdrawn without in any way Impairing the full force and effect of the bond unless it shall contain a provision that the collateral shall not be withdrawn without the consent of the surety thereon. If a corporate surety bond is furnished by either of the depositories, It shall be in a penal sum not to exceed the amount designated as the limit of deposit herein, notwithstanding any other provisions of law to the contrary. At no time shall the Treasurer maintain a deposit in the depositories against collateral in excess of ninety per cent (90%) of the market value thereof. Any bond furnished shall be approved by the City and filed in the office of the County Auditor as provided by law, and all collateral deposited shall likewise be approved by the City and after such approval, deposited with the Treasurer, unless the City Council shall by reso- lution fix and determine some other place for the safekeeping of such collateral. Such collateral shall not be re -deposited in the designated depositories.
