RESOLUTION AUTIORIZINO PAYMENT UNDER CIVIL DEFENSE ACT.
WHEREAS, the City of Stillwater has, through its Civil Defense Director, made application
to the Federal Civil Defense Administration requesting financial contribution toward
the purchase of certain organizational equipment, to -wit; 2 each - 50 to 6o watt dyna-
motor two frequency transmit, two frequency receiver 39.50 - 39.58 megacycles Motorola
model MT 51 nID-4A-SP or equal and installation of above units; and
WHEREAS, of the total cost of said equipment, $'1,300.00, the share of the City of
Stillwater is 501, or 1650.00;
BE IT RESOLVED BY TEE COUNCIL OF THE CITY OF STILLWATER, MINNESOTA, that in pursuance
of the Minnesota civil. Defense Act of 1951, the City shall pay the sum of 8650.00 into
the state treasury, in trust, as its share of the cost of snid organizational equipment
required by the federal government to be paid in advance, and a warrant is hereby
ordered drawn upon the City Treasurer, accordingly.

RESOLUTION `I0. 1981
RES^LUTION DESIGNATING ADDITIONAL COMPENSATION TO BE PAID TT MUNICIPAL JUDGE.
WHEREAS, there is in the City of Stillwater but one presiding Judre of Municipal
Court who also arts as Conciliation Judge; and
WHEREAS, under ".S.A. 491.01 it is provided that in such case the governing body
of the city may, by resolution, designate additional compensation to be paid to
said presiding Judre for services in said Conciliation Court;
EE IT RESOLVED BY TIE COUNCIL OF THE CITY OF STILLWATER, MLLIESOTA, that from and
after the first day of January, 1958, the presiding Judge of Municipal Court shall
receive additional compensation of Six 'kindred Dollars ($600.00) per year for
services in the Conciliation Court.

WHEREAS, the City has determined to discontinue municipal collection of garbage
and refuse and place said service in the hands of licensed private collectors;

cribed vehicle, to -wit:
One 1956 G.".C. 2-ton Truck, Equipped with 1953 Heil Model

appraisers at Three Thousand Two Hundred
WHEREAS, Leighton D. Charlsen of Stillwater, Minnesota, has offered to purchase
said vehicle for its said appraised value;
BF IT RESOLVED BY THE COUNCIL OF THE CITY OF STILLWA.TER, MI11ESOTA, that said offer
be and the same is hereby accepted; and that said vehicle be sold and delivered
to said Leighton D. Charluen in consideration of the sum of Three Thousand Two
Hundred Dollars (43,200.00).

That the assessments made arainst the several lots, parts of lots and parcels of
land as presented to the Council for its consideration and approval at a regular
meeting held on Tuesday the 4th day of February, 1958, at 7:30 o'clock P.M. for
-defraying a portion of the cost of bituminous seal coating of certain streets

RESOLUTION CREATING NEW EMPLOYMENT.
BE IT RESOLVED BY TUE COUNCIL OF TYE CITY OF STILLWATER, MINNESOTA, that Doris Rutz
be employed by the City to act as a Deputy Clerk of the Municipal Court; and that her
compensation for such services be fixed at $100.00 per month, together with medical,
surgical and hospitalization insurance benefits as in the case of other City employees,
this appointment to be effective as of January 1, 1958.

RESOLUTION APPROVING STREET LIGHTING CONTRACT.
RESOLVED that the City Council of the City of Stillwater Washington County, Minnesota, ire
hereby accepts the offer of the offer of the NORTHERN STATESMEN COMPANY, a Minnesota
corporation, to furnish electric energy, lamp and gleesware renewals, and other services
for the operation and maintenance of the City's ornamental street lighting system,
consisting oft
Eighty-seven (87) fluorescent units, each with
4 - F72T12 lamps
Ten (10) incandescent units, each with
1 - 6,000 lumen lama
all located or to be located in said City, and hereby approves all rates, terms,
conditions, and specifications contained in the proposed form of Ornamental -Street
Lighting Contract made a part of the offer of said Company, and the proper offieere
of the City are hereby authorised and directed to execute the aforesaid contract for
-and in the name of the City, and to affix the corporate seal thereto.

RESOLVED BY THE COUNCIL OF TIE CITY OF STILLRATER:
WHEREAS: Washington County, under authority of Chapter 943, Minnesota Session Laws
of 1957, has designated certain streets within the corporate limits of the
City of Stillwater, Minnesota as County State Aid Iighways of which the fol-
lowing were concurred in and aoproved by Resolutions passed by the City Council
August 13. 1957 and December 3, 1957, as follows;
County State Aid Iivhway No. 5.
over W. Olive Street, from City limits to S. Owens Street; over
N. & S. Owens streets W. Sycamore Street, thence over W. Sycamorel .9 miles
Street to City limits.
County State Aid Highway No. 12.

'..+ RESOLUTION AUTHORIZING ISSUANCE AND SALE OF GENERAL OBLIGATION WATERWORKS -
REVENUE BONDS OF 1958.
BE IT RESOLVED by the City Council of the City of Stillwater, Minnesota, as follows:
1. This Council has investigated the facts necessary to ascertain and does
hereby find, determine and declare:
1.1 That the City of Stillwater now owns and operates as a public revenue -
producing convenience and utility a waterworks plant and system for the supply
and distribution of water for the use of the City and its inhabitants and other
customers, and said utility 1s in immediate need of improvement by the addition
of a new tank and line connecting therewith, equipment of tanks with altitude or
control valves, acquisition of a new diesel generator, telemetric controls, pumps
and communications equipment, laying of new mains and the making of other mis-
cellaneous improvements, all at a cost of apnroximatel.y 1130,000.00, which sum
must be provided by borrowing money;
1.2 That there are no outstanding bonds, certificates -or other obligations
of the City constituting a lien arainst the current net revenues of said utility;
1.3 That it is necessary and expedient for the City to sell and issue at
this time its general obligation revenue bonds as anthorizeC by Sections 197 to 201
of the City Charter and as hereinafter described, payable from and constituting a
first lien on the net revenues of said 'utility, for the-purpose'of paying the' cost
of Said improvements, end the net revenues thebe derived from reasonable charges for

2. For the purpose of paying the cost of said improvement the City shall forth-
with sell to the highest bidder therefor, after advertisement for bids as required by
law, its General Obligation Waterworks Revenue Bonds of 1958 in the total principal
amount of 1)130,000.00 to be dated as of April 1, 1958. Said bonds shall be numbered
serially from 1 to 130, inclusive, each in the denomination of 1)1,000.00, and shall
mature serially on July 1 in the amount of el0,000.00 in each of the years 1959 through
1971. Ponds numbered 1 through 70 (maturing in the years 1959 through 1965) shall
be payable as aforesaid without option of prior payment. Bonds numbered 71 through
130 (maturing in the years 1966 through 1971) shall be each subject to redemption and
prepayment in inverse order of serial numbers, on July 1, 1965, and any interest payment
date thereafter, at a price of par and accrued interest, plus a premium of 515,00 for
each bond redeemed prior to July 1, 1968, or no premium for any bond redeemed on or
after July 1, 1968. The City Treasurer is hereby authorized end directed to mail notice
ofeall of any of said bonds for redemption at least thirty days prior to the date speci-
fied for redemption to the holder, if known, and to the bank at which principal and
interest are then payable. Said Treasurer shall maintain a record of the names and
addresses of holders of prepayable bonds, so far as such information is made available
to him, for the purpose of giving such notice. Said bonds shall bear interest at the
beat rate or rates obtainable upon their public sale, which interest shall be payable
on January 1, 1959, and semiannually thereafter on each July 1 and January 1. Principal
of and Interest on said bonds shall be payable at any suitable state or national bank,
to be designated by the purchaser of the bonds, and the Board shall pay the reasonable
and customary charges of such bank as anent for payment of said bonds and interest, and
said charges shall be accounted for as a cost of the operation of the utility.
3. The City Clerk shall cause printed bonds and coupons to be prepared for said
Issue in form as directed by the Council, and said bonds shall be executed in behalf
of the City by the signature of the Mayor, attested by the City Clerk, and by affixation
of the official corporate seal of the City: and the interest coupons tc be thereto
attached shall be executed by the facsimile signatures of said Mayor and Clerk, and
such signing and sealing shall operate as ratification and confirmation of the printed,
engraved or lithographed facsimile signatures to be printed on the coupons. When so
prepared and executed, the bonds shall be delivered by the City Treasurer to the pur-
---chaser thereof, upon payment to the Treasurer of the agreed purchase price, and the
purchaser shall not be obligated to see to the use and application thereof, but such
proceeds shall be used and applied only as herein ordered.
4. For the convenient and proper administration of the moneys now to be borrowed
on the revenue bonds herein authorized, and to make adequate and specific security
to the purchaser and holders from time to time of said bonds, the Board of Water
Commissioners shall establish in its Water Works Fund subdivisions as hereinafter
described, and maintain the same until said bonds and interest thereon are fully paid,
and said subdivisions shall be administered for the purpose and in the manner prescribed
herein. The Board shall credit end pay into said fund, as promptly as received, all
gross revenues derived from rates and charges for water services furnished by the
municipal waterworks plant and system to the City and its inhabitants and all other
customers. The Secretary and Treasurer of said Board, and all other City officials
and employees concerned therewith, shall establish and maintain financial records of
the receipts and disbursements of moneys appropriated to said fund as herein provided,
and in such records there shall be established and maintained separate subdivisions
of said fund for the purposes and in the amounts as follows:
4.1 A Capital Expenditures Account, into which shall be paid all of the moneys
borrowed hereunder except the accrued interest and premium, if any, paid by the pur-
chaser upon delivery of said bonds, There shall be charged to and paid from said
Capital Expenditures Account all, but only, the items of capital expenditures made for
the improvement of the waterworks plant and system as hereinabove described. Any moneys
remaining in said account upon completion of said improvement shall be transferred to
the Revenue Bond Account hereinafter described, to restore any deficiencies therein,
or shall be transferred to the Surplus Account and held asa part of the reserve therein.
4.2 An Operation and Maintenance Account, to which ther shall be charged and from
which there shall be paid all, but only, the items of disbursements which by sound
accounting practices constitute normal, reasonable and current costs of operation and
maintenance of the waterworks plant and system. Open each distribution of moneys re-
ceived as gross revenues of said utility there shall be credited to the Operation and
Maintenance Account such portion thereof as is needed to enable the Board to make
prompt payment of all costs of such operation and maintenance for the current month,
plus a reasonable excess to be held as a reserve for operation and maintenance emergen-
cies. A11 gross revenues from time to tine received in excess of the amounts hereby
appropriated to the Operation and Maintenance Account are herein termed net revenue.
4.3 A Revenue Bond Account, from which there shall he paid the principal of and
interest on said bonds, as such principal and interest become due. There shall be
credited initially to said account the accrued interest paid by the purchaser upon
delivery of the bonds issued hereunder. Thereafter there shall be credited and paid
monthly into said account, out of said net revenues, an amount equal to at least one-
twelfti. of the sum of the principal and interest payable within the then next succeeding
twelve months on the ponds herein authorized, and on any additional bonds which may
hereafter be issued payable from said account on a parity therewith, as provided in
paragraph 5.3 hereof. Forthwith upon issuance and delivery of the bonds herein authorized,
there shall 'also be credited and paid into said account, from surplus moneys now on
hand in the Meter Works Fund, the cum of T15,000.00 which shall constitute a reserve
for the security of the payment of the principal of and interest on the bonds herein

authorized. Moneys in said account shall be used only for the payment of maturing
principal and interest on said bonds, and on any additional bands issued in accor-
dance with nararraph 5.3 hereof, and said reserve shall he used only when other
moneys In the account are insufficient for such payment. In the event that said
reserve shall be used for such payment, It shall be restored to the amount of
' not less than k15,000.00 out of any moneys then on hand in the Surplus Account
described below, or, if arch moneys are not then available, out of the next net
revenues thereafter received, or out of the collections of taxes levied pursuant
to paragraph 6 hereof, or out of moneys transferred from other City funds pursuant
to said Paragraph 6. The moneys constituting such reserve may from time to time
to invested and reinvested in direct obligations of the United States of America.
4.4 A surplus Account, to which there shall be credited, as received, all
surplus net revenues over and above the amounts appropriated to the Revenue Bond
' Account; provided, that if additional bonds shall at any time be issued payable
from said surplus net revenues, in accordance with paragraph 5.4 hereof, surplus
net revenues may be pledged to a separate aecount for the payment of such bonds
and interest thereon. Moneys from time to time on hand in the Surplus Account
which are not required to meet the current requirements of the foregoing accounts
may be held as a reserve for replacement and depreciation of said plant, or may
-. be used to redeem andprepay revenue bonds which by their terms are then prepayable,
or may be used for any other municipal purpose stated in such resolutions and auth-
orized by applicable provisions of the City Charter oP the state laws.
5. The City of Stillwater and its Board of Tater Commissioners hereby certify
and represent to and covenant and agree with the purchaser and holders from time
to time of each bond payable from said Revenue Bond Account as follows;
5.1 The Board will ;arse proper and adequate books and records of account
to be kept, reflecting all receipts and disbursements relating to said utility and
its operation, which books and records shall be open to inspection and copying
at all reasonable times by the holder of any of said bonds or his agent or attorney,
and the Board w111, without cost, furnish copies of any portions thereof reasonably
requested by any bondholder. The Board will cause annual operating statements
of the utility to be prepared promptly upon the close of each fiscal year, and will
cause said books and records to be audited annually by a competent public account-
ant, and will furnish a copy of said operating statement and audit without cost
to the purchaser of said bonds, and will furnish a cony of said annual operating
statement without cost to any bondholder requesting the same.
5.2 The Board will at all times impose and collect rates and charges for
the services of the utility according to the schedules such that the net revenues
collected will be at least sufficient to meet all payments of principal and inter-
est on said bonds and to maintain the reserve therefor es above defined, and will
revise the same whenever necessary for said purpose. Such schedules shall include
reasonable rates and charges for services supplied to the City, or any Board or
Department thereof.
5.3 The appropriation and pledge of net revenues hereinabove made to the
Revenue Bond Account shall at all times conatltute an irrevocable pledge
and appropriation of such net revenues for the benefit and security of the holders
of bonds issued hereunder; provided, that (a) additional bonds or other revenue
obligations may be issued and sold If needed for capital improvements to the utility,
and made payable as to principal and interest out of net revenues appropriated to
the Revenue Pond Account, on a parity with the bonds of the issue herein authorized,
provided that the net revenues received in the fiscal year immediately preceding
the issuance of such additional obligations shall have been not less than the
highest amount of principal and interest due in any of the calendar years of the
remaining term of the then outstanding obligations payable from said account, on
such outstanding obligations and on the additional obligations so to be issued;
and (b) additional bonds may be issued and sold if and to the extent needed to refund
maturing bonds of the issue herein authorized, in case of any deficiency in the
Revenue Bond Account, which refunding bonds may be placed on a parity as to
interest payments with the bonds issued hereunder, but shall mature subsequent
to all then outstanding bonds payable from said account.
' 5.4.. Except as authorized in part 5.3 hereof, the City will not issue any
additional bonds, warrants, certificates or evidences of indebtedness, or incur
or suffer to be incurred any obligation which shall be payable from or a charge
upon the net revenues, unless such obligations are expressly made subject and
junior to the lien or charge on the net revenues in favor of the bonds of the
issue herein authorized.

5.5 As long as any of said bonds are outstanding the City and said Board will
continue its ownership and operation of said utility as a revenue -producing utility
and convenience, and will not authorize or enfranchise the establishment or operation
of any other utility providing services or commodities in competition therewith, and
will maintain said utility free from all liens on the physical properties thereof and
in good and efficient operating condition.
5.6 If any properties constituting capital assets of said utility shall be sold
or disposed of, it shall be only at their fair market value, and the proceeds of such
sale or disposition shall either be used to procure other capital assets or applied
to pay principal of and interest on obligations payable from the Revenue Bond Account.
MO such sale or sales shall he made at times or prices such as to imperil the prompt
and full payment of said obligations and the interest thereon.
5.7 The Board will procure and keep in force insurance on said utility protecting
against loss or damage by fire, tornado, windstrom, flood, and all other causes custom-
arily inured against for like properties by prudent owners thereof, and will procure
and keep in force suitable fidelity bonds covering employees handling moneys of said
utility, such policies and bonds to be given by insurers In good standing and in such
amounts as the Board shall determine will be adequate to protect the City and the holders
of obllgatlons payable from the Revenue Bond Account against loss due to any such cas-
ualty, and in event of any such loss the proceeds shall be used to repair or restore
the damage or to retire such obligations.
5.8 Each and all of the foregoing provisions of this resolution, which in anywise
tend to secure or assure prompt and full payment of the obligations payable from the
Revenue Bond Account will be promptly and faithfully performed and carried out by the
City and its Board of Teter Commissioners and other officers and agents.
5.9 The holders of 201 or more in aggregate principal amount of bonds issued under
this resolution and at any time outstanding may, either at law or in equity, by suit,
action or other proceedings, protect and enforce the rights of all holders of bonds.

of the covenants and duties herein specified on the part of.the City or its officers
and agents to be performed, including the fixing and maintaining of rates and charges
and the collection and proper segregation of revenues and the application and use thereof.
6. For the prompt and full payment of principal of and interest on the bonds herein
authorized, as the same respectively become due, the full faith, credit and unlimited
taxing powers of the City of Stillwater are hereby irrevocably pledged. On or before
October 1 of each year, the City hereby covenants and agrees that it will determine
whether or not there is any deficiency in or impairment of the $15,000.00 reserve in
the Revenue Bond Account described in paragraph 4.3 hereof, and if it is found that
said reserve has been impaired, the City will levy a general ad valorem tax on all
taxable property in the City sufficient in amount to restore said reserve, and cause
such levy to be forthwith certified to the County Auditor for collection with other
taxes in the following year; provided, that instead of levying such tax, the City
may cause the deficiency in said reserve to be restored by transfer of available moneys
in other funds of the City. The City further covenants and agrees that if any payment
of principal or interest on said bonds falls due when moneys In the Water Works Fund
are insufficient, the same shall be advanced from any funds of the City available there-
for, and such advances may be repaid out of the Water Works Fund when moneys are avail-
able therein.
7. The City Clerk, City Treasurer, Secretary of the Board of Water Commissioners,
and other officers and servants of the City, are authorized and directed to prepare
and furnish to the purchaser of said bonds, and to the attorneys approving the legality
thereof, certified copies of all ordinances and resolutions of the City and said Board
relating to the construction and operation of said utility and the issuance of said
bonds and all other proceedings and records reasonably required to show the validity
or marketability of the bonds to be issued hereunder; and all such certified copies,
certificates, and other documents shell be deemed the representations of the City of
Stillwater es to the truth of the statements therein contained.
8. All prior resolutions and other acts and proceedings of this Council which
in any way are inconsistent with the terms of this resolution are hereby repealed,
rescinded, or amended to the extent necessary to give full force and effect to this
resolution.

WHEREAS, Henry Radle of Stillwater, Minnesota, has presented to the Council certain
plans for the modification and revision of Radle's Sunny Slope Addition to the City
of Stillwater, platted upon lands owned by him; and
WHEREAS, in order to effectuate said modifications and revisions as proposed, It 1s
necessary that the said Henry Radle acquire parts of certain lands located in said
Addition and heretofore dedicated as public parks and playgrounds, described as follows,
to -wit:
The West Thirty (30) feet of the park fronting on Rest Linden Street
and bounded on the North by the South line of West Linden Street
and on the South by the South line of the Twenty (20) foot alley
lying North of Block Two (2), and
The South Twenty-three (23) feet of the park lying South of Lot

W9EREAS, at a regular meeting of the City Council of the City of Stillwater, Minn-
esota, held on the 4th day of March, 1958, a Petition was presented praying for
the vacation of parts of certain streets and alleys in Radle's Sunnyslope Addition
in said City; and
WHEREAS, at said meeting the Council did after due consideration deem it eioe-
dient to proceed with said matter and did order the said Petition to be filed
in the office of the City Clerk; and
WHEREAS, the City Clerk did thereupon give notice by publication in the
Stillwater Evening Oezette, official paper of the City, for four seccesslve weeks
beginning on Tuesday, March 11, 1958, and thereafter an Tuesday of each week to
and including April 1, 1958, to the effect that said Petition had been filed as
aforesaid and stating concisely its object, and that said Petition would be heard

right and nrivilege to enter upon said vacated portions of said streets and alleys, x
at such tires as may be necessary for the purpose of the construction, maintenance and AP
repair of any sewers, drains, water mains or gas mains thereon or thereunder. Should
the City exercise any of the orivileges so reserved to it, it shall do so under obli-
ration to leave the surface of the vacated pert of said street, after such sewers, drains,
water mains or gas main%ere constructed, maintained or repaired, in condition as rood
as existed immediately before such privileges were exercised, due consideration to be
given, however, to the character of the work necessarily done in exercisingsaid priv-
ileges.
PE IT FURTHER RESOLVED, that the Council deems substantial benefits well accrue to the
City from the vacation herein provided, and the public benefits are such, that said
vacation is hereby ordered without the payment of any compensation by the persons seeking
same other than that to be derived from the agreements of said persons relative to
certain improvements affecting the parks and playgrounds located in said Addition.

a transcript thereof, together with a duplicate of the plat showing the parts of said
public streets and alleys vacated hereby, certified by the City Clerk, shall be filed

RESOLUTION DESIGNATI90 DEPCSITCRY OF PUBLIC FUNDS.
RESOLVED by the City Council of the City of Stillwater, washiu^ton County, Minnesota,
that for a period of two years from and after the date hereof the First National Fsnk
of Stillwater, Stillwater, Minnesota, be hereby designated as a depository of City
funds, not to exceed at any one time during said period the sum of S100,000.00, and that
to secure such funds, the said depository shall deposit with the City Treasurer rich
bond or other collateral as is required or permitted by law. The total in amount of
such collateral computed at its market value shall be at least ten per cent more
than the limit of deposit which would be permitted if a corporate or personal surety
bond was furnished. The depository may in its discretion furnish both a bond and
collateral aggregating the required amount. Any collateral so deposited shall be
accompanied by an assignment the-eof to the City, which assignment shall recite
that such depository shall pay over to the Treasurer or his order on demand all
moneys deposited therein at any time during the period such collateral shall be so
deposited: and that, in case of any default on the part of the depository, the City
shall have full power and authority to sell such collateral, or as much thereof as
may be necessary, to realise the full amount due the City and to pay over any sur-
plus to the depository or its assigns. The depository may in its discretion de-
posit collateral of a value less than the total designation and may from time to
time, during the period of its designation, deposit additional collateral and make
withdrawals of exccss collateral, or substitute other collateral for that on
deosit or any itp

by the City and filed in the office of the County Auditor as provided by law, and all

RESOLUTION FIXING COMPENSATION OF BAT9ING BEACH PERSONNEL FOR 1958 SEASON.
RESOLVED PY THE C01'?ICIL OF THE CITY OF STILLWATER that, effective May 10, 1958, the
compensation to be paid to the employees at the City's two bathing beaches during
the 1958 season is hereby set in the following amounts:
Junior Life -guard R160.00 per month;
Senior Life -guard 165.00 per month;
Water Safety Instructor 170.00 per month;
Beach Help (Common labor) 1.45 per hour;
Beach Help (Skilled labor) 1.65 per hour;
BE IT FURTHER RESOLVED that in addition to the above stated compensation, Life -guards
and Water Safety Instructors, shall receive the sum of Five (5) Dollars per month for
each year of prior service he or she has rendered to the Stillwater Recreation Com-
mission. The regular Life -guards and Water Safety Instructors at both beaches may
elect to work at the beach, if so requested, on the days which they would otherwise
be off duty, end if they do work on such days, they are to be paid at the rate of '
t1.45 per hour for each hour that they so work on such days. All compensation shall
he payable semi-monthly.
AND T9E MAYOR AND CITY CLERK are hereby authorized and directed to drew their warrants
upon the City Treasurer accordingly.

79EREAS, a public meeting was held in St. Paul, Minnesota, on April 23. 1958.
called by the Minnesota Highway Department for the purpose of learning the sent-
iment of public agencies and individuals, and reasons therefor, as to the most
feasible route for the proposed new Interstate Freeway 4392 between the St. Croix
River near Hudson, Wisconsin, to St. Paul, Minnesota, being part of the proposed
freeway from Chicago to the Twin Cities; and
WHEREAS, the members of the City Council, not having Sad any detailed knowledge
of the proposal prior to that time, for the purpose at study: and
WHEREAS, a more detailed study has now been made;
NOW, THEREFOR, be it resolved by the Council of the City of Stillwater, Washington
County, Minnesota, that it go on record as favoring Route 1 (present Highway 412),
and abandoning proposed Route 2 and Route 3 for the following reasons, among many:—
.
Route 1 is an established, existing four -lane highway just being completed at a
very great expense, sufficient to carry the anticipated large volume of traffic
between Chicago and the Twin Cities, and would comply with the Federal Highway
Art of 1956 to use existing highways where practical, suitable and feasible.
"e do not believe that any good, substantial or practical reasons exist why this
Federal policy should not be respected for the protection of existing businesses
and owners.
If Route 1 is not used for the freeway, it will mean that there has been a waste-
ful and extravagent expenditure to build a four -lane highway for local, and largely
rural, traffic, and wand indicate an inexcusable lack of foresight in road plan-
ning.
Parallel four -lane highways are wasteful and unnecessary unless it can be sub-
stantially confirmed that there will be sufficient traffic to justify both of
them within the reasonably foreseeable future.
Double maintenance on two parallel highways within such a short distance of each
other wastes taxpayer's dollars which could better be spent elsewhere on more
needed roads.
Double parallel roads so close together take out of circulation forever practically
twice the land needed, and remove large real estate tax -paying areas from the
tax rolls, which the remaining real estate owners must assume and pay.
There are many other substantial reasons for our conclusion, many of which are
set out In the report dated May 1b, 1958 to the City Council of St. Paul, Minnesota,
by its Planning poard, with which we concur.

RESOLRTIOI FOR NEARING ON PROPOSED ASSESSMENT.
IEREAS, by a resolution passed by the Council on July 8, 1958, the City Clerk was
directed to prepare a proposed assessment of the ccst of installation of a new
street lighting system in the business district of the City of Stillwater,
Minnesota,
AND WHEREAS, the Clerk has notified the Council that such proposed assessment has
been completed and filed in his office for public inspection,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF STILLWATER, MINNESOTA:
1. A hearing shall be held on the 5th day of August, 1958 in the City Hall at
7:30 P.M. to pass upon such proposed assessment and at such time and place all
persona owning property affected by such improvement will be given an opportunity
to be heard with reference to such assessment.
2. The City Clerk Is hereby directed to cause a notice of the hearing on the pro-
posed assessment to be published once in the official newspaper at least two weeks
prior to the hearing, and he shall state in the notice the total cost of the
Improvement.

price for such improvement is 6.91,065.00, and the expenses incurred or to he incurred
in the making of said improvement amount to '11.50, so that the total cost of the im-
provement will be "51,076.90i and of this cost the City will pay '16,205.45 as its share
of the cost,

1. The cost of such improvement to be specially assessed is hereby declared to be
461,969.115.
2. The City Clerk, with the assistance of the City Engineer shall forthwith calculate
the proper amount to be specially assessed for such improvement apainst every assessable
lot, piece or tercel of land within the district affected, without regard to cash val-
uation, es provided by law, and he shall file a cony of such proposed assessment in
his office for public inspection.
3. The Clerk shell, upon the completion of such proposed assessment, notify the
Council thereof.

RESOLUTION AUTHORIZING PAYMENT OF EMPLOYER'S CONTRIBUTION TO PUBLIC EMPLOYEES RETIREMENT
FUND.
Section 7, Subdivisions 1 end 3; and
WHEREAS, pursuant to Laws of Minnesota 1957, Chapter 9356/Section 8, Subdivisions 1-7,
inclusive, the employer contribution of the City of Stillwater to the Public Employees
Retirement Fund for the period of July 1, 1956, to June 30, 1957, has been determined
by the Retirement Board of the Public Employees Retirement Association in the sum of
R5,929.01 and certified to the City;
AND WHEREAS, proper taxes have been levied for the payment thereof;
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that the said
sum of 85,929.01 be deposited by the City in the Public Employees Retirement Pond as

City Engineer from the lst day of May, 1918, until the date of his death, August 2nd,
1956, a continuous period of over forty years of honest, faithful, and dutiful service,
which in point of time is unequaled by any other official in the City's history;
BE 1T ABSOLVED by the Council of the City of Stillwater, Minnesota, that to perpetu-
ate the memory of the late J. A. D. Abercrombie, City Engineer and in recognition of
bis unselfish dedication to the duties of his office and the welfare of the community,
the City Clerk is hereby authorised and directed to enter this Resolution upon the
official record of proceedings of the Council and to forward a certified copy thereof
to the widow and family of the said J. A. D. Abercrombie.

RESOLUTION ADOPTING ASSESSMENT.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF STILLWATER, MINNESOTA:
1. Such proposed assessment, which Is on file in the office of the City Clerk
and made a part hereof by reference, is hereby accepted and shall constitute the
special assessment against the lands named therein, and each tract of land there-
in included is hereby found to be benefited by the proposed improvement in the
amount of the assessment levied against it.
2. Such asseeament shall be payable in equal annual installments extending
over a period of ten (10) years, the first of the installments to be payable on
or before the first Monday 1n January, 1959 and shall bear interest at the rate
resolution. To the first of six (6) per cent per annum from the date of the adoption of this assessment

WHEREAS, McXusick Lake 1s a public body of water lying wholly within the City of
Stillwater, Minnesota; and
— 'WHEREAS. after d"e consideration it appears that for the purpose of promoting the
public health, safety and welfare said Lake should be improved by raising and
maintaining the water level thereof and constructing control works essential
thereto;
BE IT RESOLVED by the Council of the City of Stillwater, Minnesota, that the Mayor
be, and he is hereby, authorized to make and execute in behalf of the City proper
written application to the Commissioner of Conservation of the State of Minnesota
for a permit to make such improvement affecting the waters of McKusick Lake.

RESOLUTION APPROVING LEASE OF RIVER TERMINAL PROPERTY AND AUTHORIZING EXECUTION
THEREOF.
WREREAS, the City of Stillwater is the owner of the following described property
—situated in the County of Washington and State of Minnesota, viz:
Part of Government Lot One (1), Section Twenty-seven
(27), and of Government Lots Two (2) and Three (3),
Section Thirty-four (34), Township Thirty (30) North,
Rance Twenty (20) Test; and
WHEREAS, said property has been leased to the Stillwater St. Croix Barge Term-
inal Co., a Minnesota Ccrooration, since the 29th day of November, 1946; and
WHEREAS, the said Stillwater S. Croix Barge Terminal Co. has requested that
a new lease be made and entered into by and between the parties; and
":REREAS, srch a lease has been drawn and presented to the Council for con-
sideration and aonroval; and
WHEREAS, the Council finds that said lease as drawn and *resented appears to be
an agreement which will be advantageous to the City and will best serve the inter-
ests and welfare of its citizens;
BE IT RESOLVED PY TIE Council of the City of Stillwater. Minnesota, that all
existing leases end agreements by and between the City and the said Stillwater
St. Croix Barge Terminal Co. be and the same are hereby cancelled and annuled;
that the proposed new lease by and between the parties be and the same is hereby
in all things approved; and that the Mayor be and he is hereby authorized to
execute same in behalf of the City; and that thereupon said lease be filed in the

At a regular meeting of the City Council of the City of Stillwater duly held on
the 7th day of October, 1958, the following Resolution was offered by Councilman
Pourdaghs, seconded by Councilman Simpson, to -wit:
WHEREAS the Commissioner of Highways has prepared plans and specifications for
the improvement of a part of Trunk Highway No. 45 renumbered as Trunk Highway
Number 212 within the corporate limits of the City of Stillwater from the South
Corporate Limits to 0.2 miles North of South Corporate Limits; and
WHEREAS said plans are on file in the office of the Department of Highways, Saint
Paul, Minnesota being marked, labeled, and identified as S.P. 8214-22 (T.H.
212n45), S. P. 0214-21 (T.9. 21245). S.P. 8214-13 (T.H. 212.45), Bridge No. 9115
and Bridge Mo. 9116; and
WHEREAS said specifications are on file in the office of the Department of Highways,
Saint Paul Minnesota, being marked, labeled, and identified as S.P. 8214-22
(T.N. 212.45), S.P. 8214-21 (T.H. 212. 45), S.P. 8214-13 (T.H. 212.45), Bridge
No. 9115 and Bridge No. 9116 which, together with the Minnesota Department of
Highways Specifications for Highway Construction, dated July 1, 1947, and
Supplement No. 1 to the Minnesota Department of Highways Specifications for Highway
Construction, effective April 15, 1953, on file in the office of the Commissioner
of Highways, constitute the specifications for said improvement of Trunk Highway
Number 45 renumbered as Trunk Highway Number 212; and

ified are also on file In the office of the City Clerk;and

RESOLUTION ACCEPTING ENGINEERING PROPOSAL.
WHEREAS, the Banister Engineering Company of St. Paul Minnesota, has submitted
to the City a written Proposal, dated October 14, 1958, for the performance of
engineering services in connection with construction!of the proposed interceptor
sewers and waste treatment works by theCity; and
WHEREAS, after due consideration said proposal is found to be fair and reasonable
and in the best interests of City;
PE IT RESOLVED by the Council of the City of Stillwater, Minnesota, that subject
to the grant of Federal assistance in the construction of said interceptor sewers
and waste treatment works and subject to the City's acceptance of such grant if
offered, the proposal of the said Banister Engineering Company be in all things
accepted and the Mayor and the City Clerk are hereby authorized to execute proper
written acceptance thereof.

RESOLUTION 30. 2048
RESOLUTION VACATING PART OF ALDER STREET AND BOOM ROAD.
WNEREA3, et a regular meeting of the City Council of the City of Stillwater, Minn-
esota, held on the 5th day of November, 1958, a Petition was presented praying for the
vacation of parts of certain Public streets in said City described as follows, to -
wit:
A.
A11 that part of Alder Street in Cerli and
Schulenburg's Addition to Stillwater, lying
Easterly of the extended East line of Lake
Street end extending to and including all
shore line and riparian rights.
P. All of the Boom Road, sixty (60) feet in
width, and extending in a Northerly direction
from the 'forth line of Alder Street end
extending to Minnesota Righway 95 as now laid
out and traveled; and
WEEREAS, at said meeting the Council did, after due consideration, deem it expedient
to proceed with said matters and did order the said Petition to be filed in the office
of the City Clerk; and
ENRREAS, the City Clerk did thereupon give notice by publication in the Stillwater
Evening Gazette, official raper of the City, for four successive weeks beginning on
Monday, November 10, 1958, and thereafter on Monday of each week to and including
December 1, 1958, to the effect that said Petition had been filed as aforesaid and
stating concisely its object, and that said Petition would be heard and considered by
the Council at the City Nell on the 16th day of December, 1958, at 7:30 o'clock P.M.;

WREREAS, at the time and place appointed in said notice, the council did investigate
and consider the said matter and did hear the testimony and evidence on the part of
all parties interested; and

NREREAS, upon the testimony and evidence adduced at said hearing, determined that,
to protect all parties interested, the description of the part of said public
streets to to vacated should be modified to read as follows, to -wit; •
A. The South Ralf of Alder Street in Carli 4
Schulenturg's Addition to Stillwater,
lying Easterly of the extended East line
of Lake Street and extending to and including
all shore line and riparian rights.
P. The Mast Ralf of the Poom Road extending in a
Northerly direction for a distance of One
Nundred Fitty (150) feet from the North line
of Alder Street and all of said Boom Road
extending in a Northerly direction from a
point Cne Rundred Fitty (150) feet North of
the North line of Alder Street and extending
to Minnesota State !ilghway 95 es now laid out
and traveled;
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that
said Petition be and the same is hereby granted subject to the modifications here-
inbefore set forth;
BE IT FURTNER RESOLVED, that the Council deems substantial benefits will accrue
r") to the City from the vacation herein provided, and the public benefits are such,
that said vacation is hereby ordered without the payment of any compensation by
the persons seeking same other than that to be derived from the agreements of
said persons relative to certain extensive improvements in the area;
BE IT ALSO FURT9ER RESOLVED, that upon publication of this Resolution according
to law, a transcript thereof topether with a duplicate of the plat showing the
parts of said public streets vacated hereby, certified by the City Clerk, shall
be filed for record and recorded in the office of the Register of Deeds, Wash-
ington County, Minnesota.

RESOLUTION AUTHORIZING EMPLOYMENT OF SPECIAL COUNSEL.
WHEREAS, legal services required in connection with construction and financing of
the proposed interceptor sewers and waste treatment works by the City will entail
special and unusual circumstances necessitating employment of special counsel.
PE IT RESOLVED by the City Council of the rtty of Stillwater, Minnesota, that should
the City accept the offered grant of Federal assistance and proceed with said
improvement. employment of special counsel, to advise in matters of procedure
end render approving legal opinion to prospective bond purchasers, is hereby
authorized.

RESOLUTION VACATITo PART' OF EAST LOCUST STREET.
WHEREAS, at a regular meeting of the City Council of the City of Stillwater,
Minnesota, held on the 19th day of November, 1958, a Petition was presented praying
for the vacation of a part of East Locust Street in said City; and
79EREAS, at said meeting the Council did after due consideration deem it expedient
to proceed with said matter and did order the said Petition to be filed in the
office of the City Clerk; and
WHEREAS, the City Clerk did thereupon give nctice by publication in the Stillwater
Evening Casette, official paper of the City, for four seccessive weeks beginning
on Monday, Rovember 21y, 1958, and thereafter on Monday of each week to and in-
cluding December 15, 1959, to the effect that said Petition had been filed as
aforesaid and stating concisely its object, and that said Petition would be heard
and considered by the council at the City gall on the 29th day of December, 1958,
et 7:30 o'clock, P.M.; and
WHEREAS, at the time and place appointed in said notice, the Council did Investigate
and consider said matter and did hear the testimony and evidence on the part of all
parties interested;
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that
said petition be and the same is hereby granted and that part of East Locust Street
in said City hereinafter described 1e hereby vacated, absolutely and forever, vim:
A11 that part of East Locust Street, Stillwater,
Minnesota, lying between the east line of South
Third Street end the west line of South Second
Street abutting Lots numbered Six (6) end Seven
(7) of Plock Forty-four (44) and Lots One (1)
and Six (6) of Block Fifty (50) of the City of
Stillwater.
BE IT FURT'IER RESOLVED. that the Council deems substantial benefits will accrue
