RESOLJTION NO. 1911.
RESOLUTION UPC7 THE SERVICE OF I. A. BERGEN AS rOIJNCILMAi.
WHEREAS, the term of office of Councilman I. A. Bergen expired December 31, 195b, and
he chose not to be a candidate for re-election; and,
WHEREAS, the members of the C1ty Council deem his departure from the Council of suffi-
cient importance to instruct the C1ty Clerk to make permanent upon the Council minutes
appropriate mention of Councilman Percents leaving;
THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF STILLI:ATER that the following
remarks concerning Mr. Bergen be made a part of the record: It was with deep regret
that the Council members learned of his decision not to be a candidate for re-election.
Councilman Bergen was appointed September 4, 1951, to complete the unexpired term of
Councilman Albert Hoyoss who resigned as he was moving from Stillwater. Councilman
Perron became a candidate for re-election for the four-year term oeginning January,
1953, and was successful in that election. He thus served the people of Stillwater,
as Councilmen, for a total of five years and four months. His record as Councilmen
is outstanding. He devoted a vast amount of time and energy to City affairs and scarcely
ever missed attending a Council meeting. 91s judgment and decisions were sound and
equitable. 91s presence will to missed by the City Council.

to Mr. Per,en.

RESOLUTION PERMITTING PAYMENT IN INSTALLMENTS OF ASSESS!.'ENTS FOR GRADING AND BITUMINOUS
SURFACING OF SOPTH EVERETT STREET.
RESOLVED BY T!!E COUNCIL OF THE CITY OF STILLWATER, that all assessments covering the
fallowing project:
Grading and bituminous surfacing of South Everett Street between West Willard and West
Abbott Streets, within the City of Stillwater during the years 1955 and 1956, as con
firmed by the Council on December 4, 1956, may be made in installments as follows;
one -fifth payable within thirty days after publication of notice of the City Treasurer
that he is in receipt of a warrant for the collection of said assessments as provided
In section 244 of the City Charter; one -fifth on or before October 1, 1958; one -fifth
on or before October 1, 1959; one -fifth on or before October 1, 1960; one -fifth on or
before October 1, 1961. Interest at the rate of five (5`I) per cent per annum shell
be paid upon such installments, beginning thirty days after the publication of said
notice by the City treasurer.
In order for the owner or anyone interested in any of the lots sc assessed to obtain
the right to pay said assessments in aald installments, such owner or interested party
shall, within thirty days after the publication of said notice of the City Treasurer,
make a request to the City Treasurer, in writing, in duplicate, to pay said assessments,
1n said installments, in accordance with section 245 of the City Charter.

Minnesota, hereby accepts the offer of the NORTHERN STATES POWER COMPANY, a
Minnesota corporation, to furnish illumination for street lighting produced by:
23 - 6,000 Lumen Incandescent Lamps
108 - (1,000 Lumen Incandescent Lamps
2 - 2,500 Lumen Incandescent Lamps
265 - 1,500 Lumen Incandescent Lamps
all located or to be located in said City, and hereby annroves all rates, terms,
crnditions, end specifications contained in the proposed form of Overhead Street
Lighting Contract made a part of the offer of said Company, and the proper officers

WHEREAS, Amendment No. 2 was adopted by the voters of the State of Minnesota for
the purpose of authorizing 915 of all highway

State Legislature.
NOW THEREFORE, it is resolved and recommended by the Council of the City of

THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER that the City of
Stillwater opposes and objects to the said application

further requests that no change whatsoever be made or permitted in the operation of
said swing bridge as regards its hours of operation. A reduction in the number of hours
of the operation of said swing bridge would place the city of Stillwater and surronding
are* at a disadvantawe compared to other river communities in realizing the economies
and other benefits of commercial water transportation. A very substantial tonnage by
river transportation entered Stillwater last year and is expected to during this year
and future years and this tonnage would be drastically reduced or impeded by the reduction
in hours of the operation of said swing bridge across the river at Hudson. A very
considerable sum o= money was expended last year on the improvement of dock facilities
at Stillwater to Improve and Increase the receiving end unloading of shipments by water

said railroad bridge across the St. Croix reiver would work an economic hardship on
yacht basins and similar places and on all merchants in this area, as well.
BE IT FURTHER RESOLVED that the City Clerk be authorized end directed to promptly trans-
mit a certified copy of this Resolution to the U. S. Army Engineer District, Corps
of Engineers, St. Paul, Minnesota.

RESOLUTION FIXING C0MPEiSATION OF BATHING uEACiI PERSONNEL FOR 1957 SEASON.
RESOLVEL BY THE COUNCIL OF THE CITY OF STILLWA'TER that, effective May 30, 1957, the com-
pensation to be paid to the employees at the City's two bathing beaches during the 1957
season is hereby set in the following amounts:
Junior Life -guard 4155.00 per month;
Senior Life -guard 160.00 per month;
Water Safety Instructor 165.00 per month;
Beach Help (Common Labor) 1.40 per hour
BE IT FURTHERRESOLVELthat in addition ;.o the above stated compensation, any employee
performing the above types of work is to receive the sum of Five (5) Dollars per month
for each year of prior service he or she has rendered to the Stillwater Recreation
Commission. The regular monthly salaried life -guards and Water Safety Instructors
at both beaches may elect to work at the beach, 1f so requested, on the days which they
would otherwise be off duty, and if they do so work on such days, they are to be paid
at the rate of $1.25 per hour for each hour that they so work on such days. A11 com-
pensation shall be payable aeml-monthly.
AND THE MAYOR AND CITY CLERK are hereby authorized and directed to draw their warrants
upon the City 'Treasurer accordingly.

RESOLUTION NO. 1930
RESOLUTION REVISING THE WORKING ARRANGEMENT BETWEEN THE CITY AND JOSEPH JUNKER AND DAVID
JUNM RR.
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER that effective April 1st, 1957, the
following revised arrangement between the City and Joseph Junker for the collection
and disposal of garbage and rubbish shall be in effect, and which new arrangement has
been agreed to by the City and said Joseph Junker.
1. Said Joseph Junker shall collect and dispose of all garbage and rubbish from the
premises of persons who have a signed contract with the City for this service, at an
hourly rate of pay for truck rental end labor equivalent to Eleven Hundred Seventy-
five (1175) Dollars per month;
2. Said Joseph Junker shall pay the premium due on liability insurance covering his
operations after the present policy expires;
3. Said Junker shall pay for any costs in connection with a dump site;
4. His working hours shall be eight (8) hours on Mondays and six (6) hours per day

5. Based upon the foregoing arrangement, the hourly wage would amount to E3.65 per

6. The schedule of working hours per month for one year commencing in April, 1957,
shall be that schedule as shown in the Council minutes for the regular adjourned meeting
held March 19, 1957.

RESOLUTIOY NO. 1931
RESOLUTION DESIGNATING DEPOSITORIES FOR PUDLIC FUNDS.
RESOLVED BY TILE COUNCIL OF THE CITY OF STILLWATER:
1. That for a term ending April 30, 1958, the following banks in Stillwater are hereby
designated depositories of public funds belonging to the City:
Cosmopolitan State bank of Stillwater in an amount not to exceed 4100,000.00;
Farmers and Merchants State bank of Stillwater in an amount not to exceed 4015,000.00.
First National bank of Stillwater in an amount not to exceed 425,000.00.
2. That before any deposits of any kind are made in any of the said banks, each of
ram them desiring to receive such deposits shall comply with all provisions of law per-
taining to security to be given the City for all deposits of Public Funds.
3. That should any of said banks, for purposes of safe -keeping, desire to have said
securities held in escrow by another custodian, instead of by the City Treasurer, said
banks are hereby authorised to deposit said securities, in escrow by another custodian,
instead of by the City Treasurer, said banks are hereby authorized to deposit said
securities, in escrow, with the respective custodians shown below:
Cosmopolitan State Bank - with Northwestern National Bank of Minneapolis, Minnesota;
Farmers and Merchants State bank - with Manufacturer's Trust Company of New York, N.Y.,
and the First National Bank of St. Paul, Minnesota;
First National Bank - with the Federal Reserve Bank of Minneapolis, Minnesota.
And upon receipt of any of said securities by such permitted custodians, such cus-
todian shall furnish the City with written evidence that they hold the same, in
escrow, subject to the terms and conditions of this resolution and the assignment
of such securities to the City pursuant to the terms of this resolution.
4. Should any depository elect to withdraw as a depository at any time during said
term, said depository may do so by giving at least fifteen (15) days' written notice
to the City, addressed to the City Clerk, of such election.
Upon such withdraw', the bond given by such depository, if any has been given, shall
be cancelled and the principal and sureties thereon discharged and the City
'"'" Treasurer shall then deliver to such depository all collateral securities given by
it to secure the deposit of the funds of the City therein, likewise such custodian
holding collateral securities in escrow shall surrender and return the same to the
proper depository, but no bond shall be cancelled and no securities shall be returned
until such depository has delivered to the City Treasurer all moneys in its possession
belonging to the City; should the City elect to withdraw its designation of any such
depository during such term, it may do so by giving a similar notice of such election
to such depository, upon the designation of any depository being so withdrawn, such
depository shall deliver to the City Treasurer all funds belonging to the City in its
possession.

RESOLUTION.
.en WHEREAS, me City of Stillwater is critically in need of an Inclosed, automatic garbage
unit and truck for picking up garbage, and if such is not received within the next ten
days the health and safety of the people of gtillwater may be seriously endangered because
of the effects of the approaching warm weather, and that the present method being used
.Insanitary and impossible to efficiently pick up garbage, and
WHEREAS, the urgency of this situation does not permit compliance with normal requirements
that bide be advertised for before property of this kind is purchased by the City of
Stillwater, end,
WHEREAS, it has further been ascertained that new equipment is not available for delivery
for a period of possibly nix weeks after the determination of bide, and
WHEREAS, a 1956 GMC, 2 ton Cab and chassis and a Heil model A 612-19 Collecto-Pak Garbage
Collector that is used can be purchased for the sum of 44600.00 from Gustav H. Glasrud,
and that the City Council is satisfied that said equipment is of good quality and adequate
to the needs of Stillwater, and that the price for which it can be purchased is reasonable.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Stillwater, that the City of Stillwater
purchase the above described equipment for the sum of $4600.00, and
BE IT FURTHER RESOLVED that the sum of 46600.00 be appropriated from the General Fund of
the City of Stillwater for the purchase of the above described equipment, and that the
Mayor and the Clerk execute the necessary instruments to carry out the terms of this
Resolution, and issue an order for 44600.00 and deliver it to the seller upon delivery
by the seller to the City of Stillwater of the property herein described.

RESOLUTION ORDERING HEARING ON INC,TALIATION OF NEW FFS1:IESS DISTRICT STREET
LIG9TING SYSTEM.
t'alEREAS it has been proposed to the Council of the City of Stillwater, Minnesota,
that a new street lighting system be installed in the business district to replace
the present system; end
WHEREAS the Council has been competently advised by persons selected by it that
the proposed improvement is feasible and should best be made as proposed, and
not in conjunction with some other improvement; and that the estimated cost thereof
as recommended is '65,250.00;
BE IT RESOLVED by the Council of the said City of Stillwater, Minnesota, as follows:
1. That the Council shall meet at the City Hall, in the City of Stillwater,
Minnesota, on Tuesday, the lbth day of July, 1957, at 7:30 o'clock P.M., for
the purpose of holding a public hearing on said proposed improvement under
and pursuant to minnesota Statutes Annotated, Chapter 429, as amended by Laws
of Minnesota 1957, Chapter h30.
2. That the area pronosed to be assessed for said improvement may be described
as follows, to -wit:
That part of the downtown business district lying and being
within and along the following described streets: North and South
Main Street from a point Two Hundred (200) feet South of the South
line of Nelson Street to a point Two Hundred (200) feet North of
the North line of Mulberry Street; North and South Second Street
from the South line of Nelson Street to a point One Hundred Fifty
(150) feet North of the 'forth line of Commercial Avenue; North and
South Third Street from a point Two Hundred Fifty (250) feet South
of the South line of Chestnut Street to a point One Hundred (100)
feet North of the north line of Myrtle Street; East Olive Street
from a point One Hundred (100) feet "lest of the West line of Sec-
ond Street to the West line of Main Street; East Chestnut Street
from the Test line of Third Street to the main line track of the
Northern Pacific Railway Co; and East Myrtle Street from a ooint
One Hundred (100) feet West of the Rest line of North and South
Third Street to a point One Hundred (100) feet East of the East
line of "orth and South Main Street.
3. That the City Clerk he, and he hereby 1s, euthorired and directed to give

RESOLUTION ORDERING STREET LIG'{TING IMPROVEMENT, APPROVING PLANS AID SPECIFICATIONS
AND ORDERING ADVERTISEMENT FOR BIDS.
B8 IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, as
follows:
1. Notice of hearing on the street lighting improvement in the business district
of the City having heretofore been published in the Stillwater Evening Gazette,
the official newspaper of the City, on July 5th and 12th, 1957, as required by
Minnesota Statutues, Chapter 429, as amended by Laws of Minnesota 1957, Chapter
430, and as ordered by resolution of this Council adopted on July 2, 1957.
2. A public hearing having been held on this date and opportunity having been
given at such hearing, to all persons to make known their views on said improvement,
and this Council, being fully advised of the pertinent facts does hereby determine
to proceed with the construction and installation thereof, in accordance with the
description thereof contained in said notice of hearing.
3. The plans and specifications for said improvement heretofore prepared by the •
Northern States Power Company, at the request of this Council, are hereby ordered to
be filed in the office of the City Clerk, and are hereby approved as the plans and
specifications in accordance with which said improvement shall be constructed and
installed, except as the same may be modified by further action by this Council,
in accordance with law.
4. The area to be assessed to pay the cost of said improvement shall include all
of the oronerty designated as the area proposed to be assessed in the published
notice of hearing.
5. The council shall meet at the City Nall in the City of Stillwater, Minnesota,
on August 6, 1957, at 7:30 o'clock P.M. for the purpose of considering bids for the
construction and installation of said improvement.
6. The City Clerk shall prepare and cause to be published twice, In the official
newspaper of the City, an advertisement for bids for the construction and install-
ation of said improvement, the first of said publications to be not less than ten
days prior to the time of said meeting, which advertisement shall specify the work
to be done, shall state the time when and the place where the bids will be opened
and considered by this Council, and shall state that no bids will be considered
unless seated and filed with the City Clerk and accompanied by a certified check
payable to the City Clerk of Stillwater in the amount of 51 of the amount of the
bid.

RESOLUTION ACCEPTING BEQUEST AID APPROPRIATING PAYMENT.
WHEREAS, the late Emma C. Olson did in her Last Will and Testament give and be-
queath to the City of Stillwater the sum of One Thousand Dollars ($1,010.00),
directing that said sum be appropriated and paid to the Board of Directors of the
Lakeview Memorial Hospital and that said Board of Directors set aside at least
the sum of Five Hundred Dollars ($500.00) thereof as a separate fund and to use
the income therefrom for the purpose of maintaining the room in said hospital
heretofore known and designated as the Trinity Lutheran Room;
BE IT RESOLVED, by the Council of the City of Stillwater, Minnesota, that said
bequest be accepted by said City with expression of profound gratitude in the
memory of the generosity and benevolence of the said Emma C. Olson, donor; and
BE IT FURTHER RESOLVED, that the City Clerk and Treasurer be, and he hereby is,
authorized and directed to receive said bequest and to pay the same over to the
Board of Directors of the Lakeview Memorial Hospital for the uses and purposes
expressed in said Last Will and Testament and as hereinbefore set forth.

WHEREAS, Frank J. Schaffer, a lifelong resident of this City, was at the time of
his death on the 15th day of September, 1957, a member of the Stillwater Pork
Commission, having served continuously in that car:!rity for many years; and
WHEREAS, the said Frank J. Schaffer did during his lifetime, as a citizen and a
devoted public servant, give generously of his time and energy, without regard
to self, and therby make significant and distinguished contribution to the general
welfare and benefit of said City;
BE IT RESOLVED, by the Council of the City of Stillwater, Minnesota, that to
perpetuate the memory of the said Frank J. Schaffer for his long and faithful
service, the City Clerk is hereby authorized and directed to enter this Resolution

RESOLUTION EMPLOYING SUPERVISOR AND SUBORDINATE EMPLOYEES FOR GARBAGE AND AMUSE
COLLECTION.
WHEREAS, it is deemed necessary and expedient for the City to employe some competent
person to supervise and manage the collection of garbage and refuse in the City,
together with a truck driver and helper to operate and man the City's sanitation
truck used in the collection of garbage and refuse; and
WHEREAS, Leighton D. Charlsen, a resident of this City, appears to be a suitable
and competent person to satisfactorily supervise and manage the function of col-
lecting garbage and refuse in said City;
BE IT RESOLVED, that from and after the first day of October, 1957, the said
Leighton D. Charlsen shall be employed by the City Council of the City of Stillwater,
Minnesota, to supervise and menage the collection of garbage and refuse in said
City and that his compensation therefor shall be fixed at S25.00 per week;
BE IT FURTHER RESOLVED. that the said City shall, from and after the first day
of October, 1957, employe one truck driver and one helper to operate and man the
City's sanitation truck and that their compensation shall be fixed at j80.00
par week and $60.00 per week, respectively, on the basis of a 1,4 hour work -week.

RESOLUTION AUTHORIZING PAYMENT UNDER CIVIL DEFENSE ACT.
WHEREAS, the City of Stillwater has, through its Civil Defense Director, made
application to the Federal Civil Defense Administration requesting financial contri-
bution toward the purchase of certain organizational equipment, to -wit: 6 - all
purpose gas masks and canisters for same, 6 - canisters for Chemox self-contained
masks, 2 - carton dioxide fire extinguishers, 15 - rubber fireman coats, 15 - pair
rubber fireman toots, 15 - fireman helmets, at a total cost of $1,392.50; and
WHEREAS, of said total coat the share of the City of Stillwater is 50%, or $696.25;
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER, MINNESOTA, that in pursuance
of the Minnesota C1v11 Defense Act of 1951, the City shall pay the sum of $696.25 into
the state treasury, In trust, as its share of the cost of said organizational equipment
required by the federal government to be paid in advance, and a warrant is hereby
ordered drawn upon the City Treasurer, accordingly.

RESOLVED BY THE CCU'TCIL OF TIE rITY OF STILLWATER, that the sum of $241,279.00 be,
and the same hereby is levied against all of the taxable property of the City of
Stillwater, Washington County, Minnesota, for City purposes for the year 1950.

RESOLUTION AUTHORIZING PAYMENT UNDER CIVIL DEFENSE ACT.
WHEREAS, the City of Stillwater has, through its C1v11 Defense Director, made
application to the Federal Civil Defense Administration requesting financial con-
tribution toward the purchase of certain organizational equipment, to -wit: 1 -
Model 0-6-B Siren, Type B-3 (Combination Siren and Light); and
WHEREAS, of the total cost of said equipment, $192.00, the share of the City of
Stillwater is 50!6, or 196.00;
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER, M:INNESCTA, that in pur-
suance of the Minnesota Civil Defense Act of 1951, the City shall pay the sum of
396.00 into the state treasury, in trust, as its share of the cost of said organ-
izational equipment required by the federal government to be paid in advance,
and a warrant is hereby ordered drawn upon the City Treasurer, accordingly.

designating the extension of County State Aid Highway vo. 11 within the cor-
porate limits of the City of Stillwater as follows:
Beginning at a point on Trunk Highway No. 95 at the intersection
of Fairy Palls Road, thence along the established center line
of Fairy Palls road to the north city limits of the City of
Stillwater.

RESOLUTION ESTAFLIS1ING COST OF MAINTENANCE OF MUNICIPAL STATE AID STRE''TS IN THE CITY OF
STILLWATER, MINNESOTA.
WHEREAS, J. A. D. Abercrombie, City Engineer for the City of Stillwater, Minnesota. has
submitted an estimate of the anticipated maintenance cost of Municipal State Aid Streets
within the City of Stillwater, Minnesota, on a mileage tasis for the calendar year 1958.
NOR THEREFORE BE IT RESOLVED, by the Council of the City of Stillwater, Minnesota, that
the annual cost per mile of the anticipated maintenance of the Municipal State Aid
streets Numbered 101 to 109 inclusive, in the City of Stillwater as were adopted by
Resolution of the City Council on October 1, 1957, and thus designated by Order 'lumber
27211 of the State Commissioner of Highways dated November 25, 1957 shall be t1150.00
for the calendar year 1958. The Commissioner of Highways for the State of Minnesota
1s hereby requested to allocate to the City of Stillwater from state aid maintenance
funds, based on a total of 7.13 miles, the sum of 98199.50, in accordance with the pro-
visions of section 68, sub-divisicn 3, chapter 943, Laws of 1957, State of Minnesota.
