Council for hearing at the regular meeting held in the Council chambers at seven -thirty
o'clock P.M. on December 6, 1755, aid that said hearing was at that time continued to
seven -thirty o'clock P.M. on December 28, 1955, and said hearing was at that time con-
tinued to seven -thirty o'clock on January 5, 1956, and said hearing was then and there
had and comnleted, and it is now the Judgment of the Council that the vacation of cer-
tain of the streets described in said petition should be granted:

The above figures do not include any extra cosine -motion for the tarbage-refuse
collector's enterin+ into basements for garbage or refuse, for which a higher price
has been agreed unon between the collector and the nerson or persons whose garbage or
refuse was collected and removed. Such higher price does not en through the City books
and is a matter of nrlvate agreement between such verso, or nersons and the collector.
THEREFORE BE IT RESOI'TJ.0 BY TPF, 31UNCI1 OF THE CMllF STIIL'dATEH, that the City pay said
sum of 41665.00 to said Josenh Junker and Son, subject to any and all assignments here-
tofore made by said Josenh. Junker and Son and accented by the City.

a certificate of Indebtedness of the City of Stillwater in the amount of One Thousand
SIX 2undred Sixty Five and no/100 (1665.00) Dollars to nay Josent Junker and Son for
garbage and refuse collection, transnortatlon, burial and dlsnosition for the month of
December, 1955, 1n accordance with the .garbage -refuse contrast dated July 31, 1953, between
Josenh Junker and Son and the ;Sty. laid certificate shall be numbered Twenty Fight, .�
shall be hated January 16, 1956, and shall be payable to the bearer on or before Anil
30, 1956, with interest at the rate of four (4) ner cent per annum from the date of issue
until n,ld. It shall be executed on behalf of the 0lty by its Mayor, attested by the
City Clerk and shall bear the official seal of the City. It shall be sold by the City
clerk on the date of its issue or as soon thereafter as possible, at nar and accrued
interest.

Six Hundred Thirty-nine and 50/100 (1639.50) Dollars to pay Joseph Dunker and Son for
garbage and refuse collection, transportation, burial and disposition for the month
of April, 1956, in accordance with the garbage -refuse contract dated July 31, 1953.

lark Drive; Oriole Circle, in the City of Stillwater, Minnesota, as confirmed and
established by the Council of the City of Stillwater on April 3, 1956, may be made in
installments as provided in chapter 429, Minnesota Statutes 1953, Sub -division 3.
One -tenth payable on the first Monde, in Januar:, 1957; one -tenth payable on the first
Monday in January 1958; one -tenth payable on the first Monday in January 1959; one -

GARBAGE AND REFUSE COLLECTION AID REMOVAL FOR THE MONTH OF JUNE, 1956.
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER, that there shall be issued and sold
a certificate of indebtedness of the City of Stillwater in the amount of One Thousand
Six lOndred Fourteen and ns/100 (1614.00) Dollars to pay Joseph Dunker and Son for garbage
and r.fuse collection, transportation, burial and disposition for the month of June
1956, L. accordance with the garbage -refuse contract dated July 31, 1953, between Joseph
Dunker and Son and the City. Said certificate shall be numbered Thirty Four, shall be
dated July 6, 1956, and shall be payable to the bearer on or before October 31, 1956,
with interest at the rate of four (4) per cent per annum from the date of issue until
paid. It shall be executed on behalf of the City by its Mayor, attested by the City Clerk
and shall bear the official seal of the City. It shall be sold by the City Clerk on
the date of its issue or as soon thereafter as possible, at par and accrued interest.
THE FULL FAITS AND CREDIT OF THE CITY, voluntary payments by the owners or occupants
of the oremises from which garbage and refuse are removed and disposed of, and the
proceeds of special assessments as provided by state law are all here's. pledged to the

RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER that effective August 1st, 1956,
Joseph Junker is hereby employed as City Garbage and Refuse Collector, at an hourly
rate of nay of One Dollar and Seventy-five Cents ($1.75) per hour;
RESOLVFO FURTHER that there 1e hereby appointed an assistant to said Joseph Junker in
said w.:k, whose rate of compensation shall be the sum of One Dollar and Seventy-five
Cents ($1.75) Per hour. Said compensation to both said Dunker and said assistant shall
be payable by the City semi-monthly. Said Dunker and said assistant shall work eight
(8) hours per day, six days per week.
BE IT FURTRER RESOLVED that effective August 1st, 1956, the City is hereby authorized
to rent from said Joseph Junker the garbage and refuse truck now owned by said Junker and
which is presently being furnished by him in the work of collecting and transporting
garbage and refuse under a contract between the City and said Dunker which contract
expires July 11, 1956. The rental charge to be paid by the City to said Joseph Junker
for the use of said truck shall be the sum of Three Dollars and Twenty-five Cents
fRor all gasoline, oil,dlubrication,lrepairs, replacementut further st ofto the parts andyoth-rnish and necessary y
maintenance of said truck. The City shall pay the public liability insurance premium
on said truck and shall pay the rental coat of the land on to which said garbage and

RESOLUTION ESTABLISHING A SICK -LEAVE POLICY FOR CITY EMPLOYEES AND CITY CFFICERS
RESOLVED BY THE COUNCIL OF THE CITY OF STILVNATER that effective Augcst first, 1956,
the following plan for the granting and taking of sick -leave for City employees and
City officers shell be in effect:
Every new employee or officer of the City shall accumulate one day per month sick -leave
until a total of thirty (30) days is reached;

RESOLUTION establishing certain rules and instructions for the use of voting machines
in Stillwater, Minnesota es required by Section 209.02, Minnesota Statute for 1945.
BE IT RESOLVED by the Common Council of Stillwater, Minnesota as follows:
Section 1: That the Common Council does hereby adoot the following rules in
connection with the use of voting machines in the City of Stillwater, Minnesota:
a. POSTING SAMPLE BATLCTS i:I POLLING PLACE
The precinct election officials shall post at least two, and as many more as con-
venient, SAMPLE BALLOTS within the polling place, on the rails of the polling place,
and shell also oost SAMPLE BALLOTS in the hallways and approaches to the polling
place, for the purpose of enabling the voters to study such semole tallots before
proceeding to vote, sc as to familiarize themselves with the offices, candidates
and narties, if any, as well as such rrfeeendum ouesticns as may aooear on the
tallot. Such SAMPLE ALLOTS shall be attached to the walls by the use of Scoteh
Tane or similar adhesive material, so as not to damage the walls.

F. INSPECTING TIP BALLOT I.APEIS
The precinct election cffleinls shall compare the ballot Thiele of each voting
machine with the return sheets or stntemynts of canvass furnished, to make certain
that the n^mes of the political parties, and the referendum questions all appear
on the voting machines in their proper order, in exactly the same manier as on the
return sheets or statements or canvass furnished. In case any discrepancy is found
such machine or machines shell not be used until the City Clerk has been notified,
and he hne corrected it.
c. EXAI.'I ING TIE OPERATING LEVER ^,SAL
The preceinet election officials shall examine the metal sea] with which the voting
machine is sesled against operation to see that it is sealed and shows no evidence
of tempering, and they shall also compare the number on the seal with the numter
of such seal es shown on the envelope containing the keys for the voting, machine,
as furnished to them by the City Clerk. In case any discrepancy is found, such
machine or machines shell not to used until the City Clerk has bean notified and
has examined such machine and hes satisfied such election officials that such
machine is in proper order and ready for use. The numter of such seal on each
such voting mechine shell be recorded on the certificate furnished for that purpose.
d. EXAMINING T4E PROTECTIVE CCPNTER
The precinct election officials shall examine the protective counter on each voting
machine, and shall ecmnere the numter shown therein with the number shown for such
protective counter on the envelope rontainine the keys for such votine'machine, as
furnished to them by the City Clerk. In case any discrepancy is found, such machine
or machines shell not be used until the city Clerk has been notified and has examined
such machine and has satisfied such election officials that such machine is in proper
order and reedy for use. The number of such protective counter on each such voting
machine shall be recorded on the certificate furnished for that purpose.
e. INSPECTING THE REOISTERINC COUNTERS
The precinct election officials shall jointly examine each and every registering
counter and the public counter in each voting machine and shall see that each such
registering end public counter is set at ZERO (000). In case any discrepancy is
found, such machine or machines shallnot to used until the City Clerk has been
notified and has corrected such discrepancy and has reset such registering or public
counter to ZERO (000) and has satisfied the election officials that it has been
done. The precinct election officials shall sign a certificate furnished for that
purpose, certifying that it has been done.
f. INSTRUCTING THE VOTERS ON INSTRUCTION MODELS
Each voting machine is equipped with a mechanical instruction model which is replica
of a portion of the face of the voting machine end operated mechanically in the
same manner as the voting machine. Such instruction models shall be placed upon
a table in the polling place and at least one election judge shall remain in atten-
dance at such instruction models at all times during the voting and shall request
each voter to receive instruction thereon end shell instruct each voter who is willing
to received such instruction. The election judge shall first operate the instruction
model himself in the presence of the voter and shall then permit the voter to op-
erete it himself. Voters may also be instructed by use of the sample ballots fur-
nished.
r. TIME OF ARRIVAL OF ELECTION JUDGES AT POLLING PLACE
All election judges shall meet at their polling place et least one hour before
the time for opening the polls, so es to allow ample time for thorough inspection
of the voting machines and getting everything in readiness for the conduct of the
election.

LEAVING DUTIES FOR 'EALS DURING ELECTION
A majority of the election hoard shell always be in attendance at the polling place.
Election ,judges shall arrange the noonday absence for meals accordingly. All election
judges shall remain in attendance at the polling place from 3 P.M. until the final
canvass 1s completed and shall not atsent themselves for meals during such period.
I'ISTRUCTING VOTERS AFTER CURTAINS HAVE BEEN CLOSED
If any voter, after entering the voting machine tooth, shall ask for additional
instruction in operation of the voting machine, such instruction shell be given
him by two judges telcngine to opposite political parties, if such there he. after
giving such instruction, such judges shall retire from the voting machine booth
and such voter shall thereafter proceed to vote alone and in secrecy.

i. AIDI'.G VOTERS IJ VOTING
^'hen a voter ste.tes under oath that he cannot read the English language, or that
he is physically unatle to operate the voting machine, he may cell to his aid one
.� or more of the election judges, who shall then prepare his tallot on the vcting
machine es he may desire, and In as secret a manner as the circumstances permit.
When the voter also states that he cannot speak the Enrlish language or understand
it when spoken, the judges may select two persons from different political parties
to act es internreters, who shall take an oath similar to that taken by the judges,
and then assist such person in voting. Then the voter shall prefer, he may call
to his aid any voter residing in the same election district, who unaccompanied
by a judge, may retire with him to the voting machine booth and prepare such voter's
ballot on such voting machine for him; but no such person shall prepare the ballot
of more then three such voters at any election. Before reglsterinr his vote, such
'— voter shell show his Fe'lot es nrenered for recording, privately to a judge to
ascertain that it Is prepared as directed; tut a physically disabled voter, who is
able to determine for himself, need not show his ballot as prepared for recording.
No judge or other persons so assisting a voter shall in any manner request, persuade,
or induce, or attempt to persuade such voter to vote for any particular political
party or candidate, but shell prepare the ballot as requested, and shell not reveal
to any other person the name of any candidate for whom the voter has voted, or
anything thnt took place while so assisting him.
k. TIME ALLOWED ?ACT VOTER IN MACHINE
The fudges shall admit tut one voter to the voting machine et one time end only
after it has been ascertained that he is entitled to vote. The voting on the voting
machine shall be secret except as provided by law for voters needing assistance.
No voter shall remain within the voting machine booth longer then three minutes
and if he shall refuse to leave it after the lapse of three minutes, he shall be
removed by the judges.
1. RETRACTING A WRITE -IT VOTE
Whenever a voter has cast a ballot on the irregular tallot device, generally re-
ferred to es the "write-in device or write-in slides" and desires thereafter to
change his mind, and instead, to vote for a candidate whose name appears on the ballot
he shell be instructed to return all voting pointers to the unvoted position and
cross out or erase any votes recorded on the irregular ballot device, and the
election judges shell witness that this has been done. Such election judges shall
then cause the voting, machine to Ye returned to the original, unvoted position and
shell then permit the voter to begin from the beginning once more. Such operation
of the voting machineas in this case mentioned, shall be designated as a spoiled
voting machine ballot, end the election judges present shell make out and sign a
certificate stating the facts for each such case, which shall be returned to the
City Clerk with the official returns of the election.
m. SEALING MAC'MIIE AGAINST 'VOTING -CLOSE OP POLLS
As soon as the polls of the election are closed, the election judges shall immediately
turn down Lock No. 2, thus locking the voting machine against further voting, and
they shbll then seal each voting machine against Voting by inserting the numbered
metal seal furnished for that purpose into the slots on the voting machihe provided
for that purpose. The election judges shell then record the number of each such
seal for each such voting machine, by number, on the certificate furnished for
that purpose.
n. RECORDING NUMBER ON PUBLIC COUNTER
The election judges shall then record on the statement of canvass the number shown
on the Public Counter on each voting machine.
o. RECORDING NUMBER ON PROTECTIVE COUNTER
The election judges shall then record on the certificate furnished for that purpose,
the number shown on the Protective Counter on each voting machine.

CA`VASSING THE VOTES
The election judses shall then unlock end open the doors of the counter compartment,
in the presence of the watchers and any other persons who may lawfully be present
in the polling place. One of the election judges shall, under the scrutiny of another
election judge, of opaosed political interests, if such there le, in the order of
the offices as their titles are arranred on the machine, reed and announce in distinct
voice the designating number and letter belonging to each candidate, and the total
number of votes shown on such candidate's registering rounter. Re shall then an-
nounce the votes recorded on the "^:rite -in" tallot (paver roll), and shall also
announce the votes rerorded on each referendum svestion. As each vote is announced

arch vote for each candidate, each arch election judge who is recording the votes
as announced, shall immediately and loudly repeat the numler he hes recorded, so
the election !wires at the voting rachine counters cal check it with the candidates
registering counter.
After the polls are closed and the votes hove been counted on said voting machine
in the manner required by law, each judge shall then sign a certificate which shall
be a port of the Statement of Canvass stating that the results as shown on the
Statement of Canvass are the true and correct results of the election and that the
canvass has been completed in accordance with the law as provided by tie Statutes of
Minnesota.
VERIFICATION OF TIE CA`iVASS RESULTS
The election fudges who recorded the totals shall then change places with the
election judges who announced the totels from the voting machine counters, and
the entire process of making the original canvass shall be repeated for the purpose
of verifying the accuracy of the original canvass.
r. FAMILIARITY TIT'S MITMESOTA STATUTES COICERSIRG VOTING MACRIMES
Each election judge shell familiarize himself with all provisions of Chapter 209,
Minnesota Statutes, concerning the use of voting machines, and earh etch election
judge shall, at all times, act in compliance with all of such provisions of the
State law.
s. ATTEIDI'G ELECTION OFFICERS IRSTRUCTION MEETINGS
Rot More than 21 days before each election and primary thereshall be held under the
direction of the proper authority having charge of the conduct of the elections and
the primaries, a meeting or meetings for the purpose of instructing the judges
about the operation of the voting machine and the duties of election officials
when voting machines are used. Each election judge shall attend such instruction
meeting or meeting for which he shall receive the sum of one dollar, and no election
judge who falls to attend shall be eligible to serve on election day.
Section 2: That the rules regulating the use of voting machines as above set forth,
be submitted to the Attorney General of the State of Minnesota for his written approval.
Section 9: That copies of said rules as above set forth be printed upon cardboards
and posted In the polling planes hereafter at each time of election.

RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER:
1. That the plans, -including the establishment of Street Grades, specifications
and estimated costs, as prepared by the City Engineer for grading, installation of
concrete curbs, drainage structures, bituminous surfacing and any other improvements
as and where indicated on the plans therefor, of North First Street between East
Juniper and East Balsom Streets and on Bast Balsam Street between North First and
North Second Streets, in the City of Stillwater, Minnesota, as presented to the
Council for its consideration and approval be, and the same are hereby approved
and ordered filed in the office of the City Clerk.
2. Thet Tuesday the 2nd day of October, 1956, at 7:30 o'clock P.M. te, and is
hereby designated as the time when the Council will meet in the Council Chamber
in the City Nall at a regular meeting and act in relation to the doing of the

RESOLUTION VACATING A PORTION OF SOUTH GROVE STREET
WHEREAS, at a regular meeting of the Council of the City of Stillwater, held on May 1, Cr,
1956, a petition was presented to the Council praying for the vacation of a portion ne
of South Grove Street in the City of Stillwater, described as follows,
All that part of Grove Street lying South of a line 174.1 feet South of the South line
of Pine Street.
AID SAID PETITION, upon the order of the City Council, was filed in the office of the
City Clerk and said Clerk was ordered to give notice by publication in the official
newspaper of the City for four successive weeks to the effect that said petition had
been so filed and that a hearing would be held on said petition by the Council at the
regular meeting to be held in the Council Chambers in the City Hall at Stillwater at
Seven -Thirty o'clock P.M. on June 5, 1956, which publication has been duly made in the
STILLWATER EVENING GAZETTE;
AND WHEREAS, in accordance with the terms of said notice, said petition carob before the
Council for hearing at the regular meeting held in the Council Chambers at Seven -thirty
o'clock P.N. on June 5, 1956, and that said hearing was then end there completed, and it
is now the judgement of the Council that the vacation of a portion of Grove Street
described In said petition should be granted:
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF TIE CITY OF STIILWATER that the following
portion of South Grove Street is hereby vacated absolutely and completely, to -wit:
A11 that part of Grove Street lying South of a line 174.1 feet South of the South line
of Pine Street.
IT IS FURTHER RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER that the Council consider
the foregoing Vacation to be for the test interests of the public end make It possible
to construct new homes and that the Council consider getting such new home or hones
upon the tax rolls of the City adequate crnsideration for the said vacation and therefore
does not order any cash payment to be made therefore.
IT IS FURTHER RESOLVED that after the publication of this resolution according to law,
the City Clerk is hereby ordered to file for record in the office -of the Register of
Deeds of Washington County, Minnesota, a transcript of this resolution, together with
a duplicate plat showine the vacation of the Street herein described.

GROUP of Stillwater, a non-profit, unincorporated civic society, for a period of
one year, from and after October qth, 1956, that certain building known as the
Schulenberr, School House, located at the corner of North Second Street and Willow
!a, Street, in Stillwater, In condition as it now is.

THE CONSIDERATION to be paid and accepted for such leasing is the sum of one collar.
As a part of the consideration-hereinbefore mentioned, the Lessee 1s to have the
option to renew the said lease, upon the sane terms and ronditlons, from and after
the termination date. In order to avail itself of this option, the Lessee shall •
notify the Lessor, 1n writing, addressed to the City Clerk, City Mall, Stillwater,
not later than September 4th, 1957, of its intention so to renew.
THE LESSEE shall at all times during the term of this lease carry fire and extended
coverage insurance on said building in the amount of at least $2500.00, with the
lose -payable clause in favor of the City, as their interest may appear, and shall
also carry adequate and sufficient liability and property damage insurance on said
building. No land is to be covered by said lease, except the land upon which the
said building rests.

WHEREAS, John R. Colomto, retired former Chief of the Stillwater Fire Department,
died on October 8, 1956; end,
WHEREAS, the Council of the City of Stillwater deems his death of sufficient importance'
r• and public interest to instruct the City Clerk to make permanent upon the Council
minutes the following remarks pertaining to Mr. Colombo:
John R. Colombo Coined the Fire Department of the City of Stillwater on December
21, 1928. ry diligent application to Department affairs he rose rapidly in the
service until July 1st, 1940, on e..rich date he was appointed Chief of the Department.
He served as Chief until his resign. -ion, due to ill health, in March, 1955. His

at the 1957 session of the State Leeisletrre on behalf of the Pocrd of Water Com-issloners

THE EFFECT OF SAID PROPOSED LEGISLATION would relate to the amount of water frontage
tax which may be assessed arninst land in front of which water mains are or shall
hereefte- he laid. Said Proposed legislation shall elso authorize and permit the Poard
of Water Commissioners to make such assessments, rather than the City Council. Said
Proposed leeislation may, also, if so determined to to wise and advisable, cavern the
number of installments in which said water frontage tax shell be payable, and may,
