total of Twenty years, from 1935 through 1954; and,
WHEREAS, he is now leaving his office as Mayor, voluntarily, and the Council desires
a kind farewell be given him;

I voluntarily. Thus, Mr. Linner has served twenty years as both Councilman and Mayor.
aDuring this long time of public service and in spite of the fact that he is a very
busy man, he seldom missed a Council meeting, general or special. He was never too
busy to c osider and discuss problems cf interest to the CITY, many tines when it
required serious sacrifice to his own personal interest. He brought to his office a

WHEREAS, Joseph Dunker and ion has filed with the City Clerk a list of agreement forms
containing the names end addresses of persons who have obligated themselves to pay to
the City fcr such garbage and refuse collection during the month of Derember, 1954,
according to the garbage refuse contract anted July 31, 1953, between said Joseph
Bunker and Son and the City as follows:

30, 1955, the City, by Ste Treasurer, must give the record holder thereof thirty days,
written notice of its intention to pay such certificate, addressed to the last known
address of the holder thereof.

RESOLUTION APPOINTIN TINO CARETAKERS AT Tor CITY DUMP.
RESOLVED PY TUE COUNCIL OF THE CITY OF STILLWATER that effedtive January 8th, 1955,
Frank Frederieksen and 0scar Josephson are hereby appointed Caretakers at the City
Dump. Each of them shall work a total of six (6) hours per day, except Sundays.
Their hours of employment shall be from 8 o'clock A.M. until 8 o'clock P.M., upon
a schedule to he arreed upon by themselves. Their compensation is hereby fixed in the
sum of One Hundred Twenty (120) Dollars per month, for each Caretaker, nayahle semi-
monthly.

RESOLUTION N0. 1752
RESOLUTION At'TR09IZING THE EMPLOYMENT OF SPECIAL COUNSEL.
WHEREAS, the City is engaged in the defense of a legal action now pending in the District
Court of the 19th Judicial District in and for the County of Washington, State of Minn-
esota, entitled "Harold Gilker, Plaintiff, V5. The City of Stillwater, Defendant",
and the City Attorney, on account of the condition of his health, is unable to conduct
the defense of such action without the assistenence of special counsel, and has asked
the City Council to appoint as such special counsel, Lyle J. Eekberg, Esq., to assist
the City in its defense of said action;
NOW THEREFORE BE IT RESOLVED FY THE COUNCIL OF TIE CITY OF STILLWATER that Lyle J.
Fckberg, Esq., is hereby retained by the City to assist the City Attorney in the trial
of said action, in accordance with Section 374 of the City charter.
THIS RESOLUTION shall take effect immediately upon its passage and publication.

JOHN COLOMBO joined the Fire Department of the City of Stillwater on December 21,
1928. By diligent application to Fire Department affairs he rose rapidly in the
service until July 1st, 1940, since which time he has served es Chief of the Fire

streets in the City of Stillwater, Minnesota, consisting of removal of present old
surface, replacing same a stabilized gravel base and applying a bituminous wearing
surface, all in accordance with the piens and specifications therefor, and as approved
by the City Cnpneil April 12, 1955;
South Third Street, between Bulington and Orleans streets,
North Martha Street, between W. Myrtle and W. Mulberry streets,

RESOLVED BY THE COUNCIL OF THE CITY OF STILLSATER that owing to the large amount of
extra legal work that will have to go through the City Attorney's office during
the next several months, the City Council hereby authorizes and.directs that a
special assistant be employed, on a part-time basis, to assist the City Attorney
with said extra work, pursuant to Section 374 of the City Charter. Said assistant
shall be appointed by the City Attorney and approved by the City Countil. His
compensation shall Fe fixed by the City Council and the term of his employment shall
terminate on October 31, 1955.

1. That for a term ending May 1, 1"57, the following banks in Stillwater are hereby
designated depositories of public funds belonging to the City:
Cosm000?Stan State Bank of Stillwater in an amount not to exceed $100,000.00.
Farmers and Merchants State Bank of Stillwater in an amount not to exceed 125,000.00.
First National Bank of Stillwater In an am unt not to exceed 125,000.00.
2. That before any demerits of any kind are made in any of the said banks, each
of them desiring to receive such denosits shall cmmnly with all provisions of law
pertaining to security to be given the City for all denoslts of Public Funds.
3. That should any of said banks, for purposes of safe -keeping, desire to have
said securities held in escrow by another custodian, instead of by the City Treasurer,

4. Should any denository elect to withdraw as a denository at any tloh during said
term, said depository may do so by giving at least fifteen (15) ney's written notice
to the City, addressed to the City Clerk, o' such election.
Upon such withdrawal, the bond riven by such denository, If any has been given, shall
he cancelled and the nrbicinal and sureties theron discharged and the .City Treasurer
r• shall then deliver to such denository all coll+terel securities given by it to secure
the denoslt or the funds of the City therein, likewise such custodian holding col-
lateral securities in escrow shall surrender and return the same to the proper denos-
itory, but no bond shall be cancelled and no securities shall be returned until such

WHEREAS, Joseph Stinker and Son has filed with the City Clerk a list of agreement forms
containing the names and addresses of persons who have obligated themselves to pay
to the City for such garbage and refuse collection during the month of June 1955,
according to the garbage refuse contract dated July 31, 1953, between said Joseph
Dunker and San and the City as follows:

the above figures do not include any extra compensation for the garbage -refuse col -

books and 1s a matter of private agreement between such person or persons and the
collector.

GARBAGE AND REFUSE COLLECTION AID REMOVAL FOR THE MONTH OF JUNE, 1955.
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER, that there shall be issued and Bold
a certificate of indebtedness of the City of S111water in the amount of One Thousand
Six Hundred Sixty Eight and no/100 (1668.00) Dollars to pay Joseph Junker and Son for
garbage and refuse collection, transportation, burial and disposition for the month of
June 1955. in accordance with the garbage -refuse contract dated July 31, 1953, between
Joseph Dunker and Son and the City. Said certificate shall be numbered twenty two, shall
be dated July 9, 1955, and shall be payable to the bearer on or before October 31, 1955,
with-intbrbat- at -the rate of four (4) per cent per annum from the date of issue until
paid. It shall be executed on behalf of the City by its Mayor, attested by the City
Clerk and shall bear the official seal of the City. It shall be sold by the City
Clerk on the date of its issue or as soon thereafter as possible, at par and accrued
interest.
TIE FULL FAITH AND CREDIT OF TIE CITY, voluntary payments by the owners or occupants
of the premises from which garbage and refuse are removed and disposed of, and the
proceeds of special assessments as provided by state law are all hereby pledged to the
full payment of said certificate and interest.
TAT CITY TREASURER shall endorse upon each certificate when presented to him, the
name and poet office address of the holder thereof and shall keep a record in his
office of the name and post office address of such holder.
IN ORDER TO AVAIL ITSELF of the privilege of paying such certificate prior to
October 31, 1955, the City, by its Treasurer, must give the record holder thereof
thirty day's written hotice of its intention to pay such certificate, addressed to the
last known address of the holder thereof.

elect to work at the beach, if so requested, on the day which they would otherwise have

AND SPECIFICATIONS.
BE IT RESOLVED by the City Council of the City of Stillwater, Minnesota, as follows:
1. Notice of hearing on a watermain improvement in the City has heretofore been duly
published in the Stillwater Evening Gazette, the official newspaper of the City, on
July Btb and 15th, 1955, as required by Minnesota Statutes 1953, chapter 429, and as or-
dered by resolution of this Council adopted on July 5th, 1955.
2. A public hearing having been held on this date and opportunity having been given
at such hearing to all persons to make known their views on said improvement, and this
Council, being fully advised of the pertinent facto, does hereby determine to proceed
with construction thereof, in accordance with the description thereof contained in said
notice of hearing, and said Improvement shall hereafter be referred to as watermain
improvement number four of the City.
3. The area to be sssessed to pay the cost of said improvement shall include all of the
property designated as the area proposed to be assessed in the published notice of
hearing.

RESOLUTION AWARDING CONTRACT FCR TIE CONSTRUCTION OF WATERMAIN IMPROVEMENT NUMBER 4.
BE IT RESOLVED !Iv the Council of the City of Stillwater, Minnesota, as follows;
1. It is hereby found, determined, and declared that the lowest responsible bidder
for the work and materials necessary for the construction of watermain improvement
number 4 of the City is, Wolff Construction Company of St. Paul, Minnesota, that the
bid of said bidder is in the total base amount of 815,583.20; that said bid is in
all respects in accordance with law and with the published advertisement for bids and
with the plans and specifications heretofore approved by the Council and now on file
in the offices of the City Clerk and Engineer; and that the City Engineer has re-
commended that said bid be accepted and said bid is hereby accepted.
2. The Mayor and City Clerk are hereby authorized and directed to make and execute
a contract on behalf of the City in accordance with the terms of said bid, when said
bidder shall have furnished a contractor's performance bond in the amount of the
bid, conditioned as required by law.
3. The Clerk 1s hereby authorized and directed to retain the certified check fur-
nished by said contractor until the execution and filing of said contract and per-
formance bond in his office, and to return the certified check and bid bond furnished
by the other bidders.

RESOLVED that the City Council of the City of Stillwater, Washington County, Minnesota,
hereby accepts the offer of the Northern States Power Company, a Minnesota corpor-
ation, to furnish electric energy, lamp and glassware renewals, and other services
for the operation end maintenance of the City's ornamental street lighting system,
consisting of:
68- 6000 Lumen Lamps
all located or to be located in said City, and hereby approves all rates, terms,
conditions, end specifications contained inthe proposed form of ornamental Street
Lighting Contract made a part of the offer of said Company, and the proper officers
of the City are hereby authorized and directed to execute the aforesaid Contract
for :.and in the name of the City and to affix the corporate seal thereto.

and sold a certificate of Indebtedness of the City of Stillwater in the amount
of One Thousand Six Hundred Seventy ;even and no/100 (1677.00) Dollars to pay
Joseph Junker and Son for Tarbage and refuse collection, transportation, burial
and disposition for the with of August 1955, in accordance with the garbage -
refuse contract dated July 31, 1953, between Joseph Junker and Son and the
City. Said certificate shall be numbered twenty four, shall be dated September
In, 1955, and shall be payable to the bearer on or before April 30, 1956, with
interest at the rate of four (4) per cent per annum from the date of issue
until paid. It shall be executed on behalf of the City by its Mayor, attested
by the City Clerk and shall bear the official seal of the City. It shall be
sold by the City Clerk on the date of its issue or as soon thereafter as pos-
sible, et Oar and accrued interest.
THE 'ULi FAITH AND CREDIT OF THE CITY, voluntary payments by the owners or
occupants of the premises from which garbage and refuse are removed and
disposed nf, and the proceeds of soeciel assessments as nrovided by state law

HE IT RESOLVED BY the City Council of the City of Stillwater, 1innescta, as follows:
1. This Council has investigated the facts necessary to ascertain and does hereby
find, determine and ieclere that the City of Stillwater has heretofore on July 19,
1155 duly ordered the construction of 'intermain Improvement No. I; of the City,
pursuant to public hearinr and notice thereof as required by law, and has ordered
and apnroved plans and specifications for the construction of said improvement, and
has received bids submitted for the construction of said improvement, after public
advertise-ent for such bids, as required by law, and has duly awarded the contract
for the construction of said improvement; that the total cost of snid improvement
Is estimated to be enproximately equal to end not less than 919,000.00, including
all items of cost from the inception to the completion of the improvement and all
fees and expenses incurred in connection therrwith; that the total benefits result-
inC from said improvement to the assessable lots, nieces end parcels of land affected
thereby and to the City et large w111 be substantially in excess of the total cost

2. There is hereby created a special fund to be designated "Watermain Improvement
No 4 Fund," to be held and administered by the City Treasurer separate and apart
from all other funds of the City. Said fund shall be continued and maintained in
the manner herein specified until all of the improvement bonds herein authorized
and interest thereon shall have been fully naid. In said fund, there shall be
maintained two separate acrornts, to be designated as the "Construction Account",
and the "Sinking Fund Account." The proceeds of sale of the improvement bonds herein
authorized, less accrued interest received thereon, shall be credited to the Ccn-
strurtion Account, from which there shall be paid all costs and expenses of making

Find, in accordance with the cffer heretofore mace by said Allison-".illiams Company,
to purchase the same subject to the terms and conditions herein prescribed, at
a price of par plus interest tc Berme to the date of delivery and nnyment. Said
proposal is hereby frond and determined to be reasonable and for the best interests
of the City and shall be and is hereby accepted. Said bonds shall he dated Sept-
ember 1, 1955, shall he 19 in number and numbered from 1 to 19, inclusive, each
in the denomination of e,1000, and shall nature serially, on January 1, in the
amount of 1..2,010 in each of the years 1953 through 1961, 0.,000 in 1962, and
.A2,010 in each of the years 1963 through 1967. bonds numbered 1 through 4 shall
be payable on their respective stated maturity dates, without notion of prior
payment; these numbered 5 thrcurh 19 (maturing in the years 1960 through 1967)
e. shall each be subject to redemption and prepayment at the option of the City on
,canary 1, 1959 and any interest payment date thereafter, at a price of par and
accrued interest plus a premium of 520 for each bond redeemed 1f redemption is

said date. All redemptions shall be made upon notice of call for redemption mailed
by the Clerk to the holder of each bond so called, if known, and to the bank at
which princinal and interest are payable, not leas than 30 days before the date
specified for such redemption, and said Clerk shall maintain a record of the
names and addressee of holders of prepayable fonds for the purpose of mailing
such notice. Lend of said issue ahell hear interest at the rate of 2.90% per
annum, payable on July 1, 1956 and semiannually thereafter on January 1 and

office of Northwestern National Penk of Minneapolis, in Minneapolis, Minnesota,

paving event for the receipt and disbursement thereof.
5. Said improvement bonds and the coupons thereto attached shall he in substan-
tially the form of bond and coupon approved this date.
6. Said bonds shall be prepared under the direction of the City Clerk end shall
be executed on behalf of the City by the signature of the Mayor, attested by the
City Clerk, and the corporate seal shall be affixed thereto, and the interest
coupons shall be executed and authenticated by the orinted, engraved or lithographed
facsimile signatures of said Mayor and City Clerk. When said lends have been
so executed end authenticated, they shall be delivered by the Treasurer to the
purchaser thereof, upon payment by the purchaser of the price heretofore agreed
upon, and said purchaser shall not be required to see tc the application of said
purchase price.
7. The City Clerk is hereby authorized and directed to file a certified copy
of this resolution with the County Auditor of Washington County, together with
such other information as he shall require, and to obtain from said County Auditor
a certificate that said bonds have been entered on his bond register in accordance
with the provisions of Minnesota Statutes 1953, Sections 475.62 and 475.63.
8. The officers of the City and the County Auditor of Washington County are
hereby authorized and directed to prepare and furnish to the purchaser of said
ponds, and to the attorneys approving the legality of the issuance thereof, certified
conies of all proceedings and records of the City, and such other affidavits,
certificates and information as may be required to show the facts relating to the
legality and marketability of said bends as the same anpear from the books and
records under their custody end control or as otherwise known to them, and all
such certified conies, certificates and affidavits, including any heretofore
furnished, shall be deemed representations of the City as to the facts recited
therein.

soon as possible thereafter, at par and accrued interest.
THE PRINCIPAL AND INTEREST OF SAID CERTIFICATES shall be a first -charge on all
the moneys received from the collection of said assessments.
THE CITY TREASURER SHALL indorse upon each certificate when presented to him,
the name and neat office address of the holder and shall keep a record in his
office of the names end addresses of all such holders. In order to avail itself
of the privilege of paying any or all of said certificates prior,tc the date of
maturity shown above, the City, by its Treasurer, must give the record holder
thereof thirty days, written notice of its intention to pay said certificate,
addressed to the lest known address cf the holder thereof.

P'RENTS GRO^P of Stillwater, a non-profit, unincorporated, civic society, for
a period of one veer, from and after October 4th, 1955, that certain building
known as the Schnlenberg School louse, located et the corner of North Second
Street and Tallow Street, in Stillwater, in condition as it new is.
That the consideration to be paid end accepted for such leasing is the sum of one
dollar. As a part of the consideration hereinbefore mentioned, the Lessee is
to have the option to renew the said lease, upon the same terms and conditions,
from and after the first year's termination date. In order to avail itself of
this option, the Lessee shall notify the Lessor, in writinm, addressed to the
City Clerk, City Hall, Stillwater, Not lacer than September 4th, 1956, of its
intention so to renew.
The Lessee shell at all times during the term of this lease carry fire and extended
coverage insurance on said building in the amount of at least S2500.00, with the
loss-pa^able clause in favor of the City, as their interest may appear, and shall
also carry liability and property damage insurance on said building. No land of
any kind is to be covered by said lesae; the building, alone, is the only prop-
erty to be leased.
