RESOLUTION APPOINTING CARETAKER OF AMERICAN LEGION BATHII"G BEACH
AND FIXING HIS COMPENSATION.
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER that effective
January 1, 1950, Edward F. McKnight is appointed caretaker of the
American Legion bathing beach for the year 1950, and his compensation
is fixed in the sum of Fifty dollars (650.00) per month, payable
semi-monthly, on the 15th and last days of each month of serwlce;
and
THE MAYOR AND CITY CLERK are hereby authorized and directed to draw
their warrants upon the City Treasurer accordingly.

RESOLUTION AUTHORIZING THE CITY TREASURER TO FAY OUTSTANDING CERTIFICATES
OF INDEBTEDNESS.
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER, that whenever the City
Treasurer has received sufficient moneys from the collection of assessments
which will be levied against property benefited by bituminous surfacing
during the years 1949 and 1950, sufficient to retire any of the certificates
of indebtedness heretofore issued, in anticipation of the collection of said
i+ assessments, he shall retire the said certificates accordingly, in accord-
ance with the provisions of section 254 of the City Charter.
WHERE SAID CERTIFICATES are held by Stillwater banks, the City Treasurer
shall, so far as possible, pay such certificates so as to retire at one
time, certificates of the total, same amount held by each bank.
AND THE MAYOR AND CITY CLERX are hereby authorized and instructed to draw
their warrants upon the City Treasurer accordingly.

TREASURER AND DEPUTY CLERKS OF MUNICIPAL AND CONCILIATION COURTS
RESOLVE) BY THE COUNCIL OF THE CITY OF STILLWATER that effeotive
January let, 1950 the salary of the Deputy City Clerk, Deputy City
Treasurer and Deputy Clerks of Municipal and Conciliation Courts is
hereby fixed in the sum of one hundred sixty five and no cents (6165.00;
per month, payable /semi-monthly, on the 15th and last days of each
month of service;
AND THE MAYOR AND CITY CLERK are hereby authorized and directed to draw
their warrants upon the City Treasurer accordingly.

RESOLUTION FIXING SALARIES OF CITY OFFICIALS AND CITY EMPLOYEES FOR
THE YEAR 1950.
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER, that until further
action by the Council, the salaries of all City Officials and City
employees, including the salary of the Judge and Special Judge of the
Municipal and Conciliation Courts, for the year 1950, are hereby fixed
in the same amounts and on the same conditions as they are respectively
as of December 31, 1949; said salaries are to be paid at the same times
as are in effect on December 31, 1949.
THERE ARE EXCEPTED from the provisions of this resolution, the salaries
of Lester R. Brower, John R. Colombo, Albert Ranum Jr. and Marion J.
Sjoholm and this resolution has no application so far as they are concerned;
and
THE MAYOR AND CITY CLERK are hereby authorized and directed to draw their
warrants on the City Treasurer accordingly.

RESOLUTION NUMBER 1470
RESOLUTION APFOINTING ASSES:OR AND FIXING HIS COMPENSATION.
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER that, effective
January fat, 1950, Albert Ranum Jr. is hereby appointed assessor, at
a salary of two hundred fifty and no cents ($250.00) per month, payable
on the last day of each month of service; said salary is to include
any clerk hire which the assessor may require, it being the intent of
this resolution that if the assessor requires any clerk hire in the
conduct of his duties, such clerk hire is to be paid for , in Hill, by
the assessor out of the above compensation;
AND THE MAYOR AND CITY CLERK are hereby authorized and directed to
draw their warrants upon the City Treasurer accordingly.

RESOLUTION AUTHORIZING THE CITY TREASURER TO PAY EMPLOYEES OF THE
STREET DEPARTMENT UPON THE STATENEMP OF TIE WORKED AND RATE OF PAY
THEREFOR, A3 GIVEN HIM BY THE CITY ENGINEER.
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER that the City
Treasurer is hereby authorized to make payment to employees of the
street department upon the statement of time worked and pay bhere-
dor, as prepared and furnished him by the City Engineer, before
formai approval therefor by the City Council, it being understood,
however, that should discrepancy between the amount actually due
any employee and the amount shown on said statements to be due,
is Sound by the Council when such statements are considered by
the Council in the approval thereof, such discrepancy shall then
be adjusted to the Council's approval.
RESOLVED FURTHER that, until further action by the council the comp-
ensation to be paid employees of the street department for the year
1950 shall be that in effect as of December 31, 1949, and the state-
ment of time worked and pay therefor as prepared and furnished to the
Clerk by the City Engineer shall be made up on the basis of such
compensation.

in case he elects do to use it;

RESOLUTION FIXING COIekENSATION TO 3E kAID TO CERTAIN RJkLOYEES OF IFRE CITY.
F.ESOLVFC GY THE COUNCIL OF THE CITY OF STILL?ATER, that effective April
1st, 1950, the following increases in compensation be granted to employees
named below, in addition to the compensation paid to them by the City as
of March 31st, 1950:
1. A11 employees of the Fire Department except the Chief,
Fifteen (15) Dollars per month;
2. A11 employees of the kolice Deportment except the Chief,
Ten (lu) Dollars per month;
3. Semi-sk111ed workers of the Street Department,
Five (5) Cents per hour; Common
laborers of the Street Department,
Five (5) Cents per hour.
Said increases to be paid at the sane time or times that the
compensation being earned by such employees as of March 31, 1950, was paid.

EXPENSE OF RELAYING CURBS AND SIDEJALKS IN AND ALONG SOUTH THIRD STREET.
RESOLVED BY -THE COUNCIL OF THE CITY OF STILLWATER:
A. That the plans, specifications and estimate of the probable expense of
relaying curbs, sidewalks and other necessary work pertinent thereto,
in and along both sides of South Third Street between Chestnut and
Orleans Streets, as prepared by the City Engineer and presented to the
Council for its consideration be, and the same are hereby approved and
ordered filed in the office of the City Clerk.
2. That Tuesday the 9th day of May, 1950, at 7:3u o olook r. M. be, and la
hereby designated as the tsme when the Council will meet in the Council
Chamber in the City Hall to act in relation to the doing of the proposed
work and improvement, and the City Clerk is hereby directed to give notice
of such meeting, in accordance with the provisions of the city charter.

RESOLDTIOR NUMBER 1483.
RESOLUTION ArrEOVI NG NON -WAIVER AGREEMENT.
WHEREAS, a legal action has teen brought and is now pending against the
City in the District Court of the 19th Judicial District for Washington
County, Minnesota, by Joseph J. Eeaudet and Albert C. 3eaudet, as executors
of the estate of Joseph Ernest 3eaudet, deceased, as Flaintiffa, against the
City, for the recovery of damages to property alleged to have been caused
by or arising out of certain street improvements made by the City in July,
1949, at the intersection of Orleans Street and Second Avenue South in the
City; and
WHEREAS, the American Casualty Company of Reading, rennsylvania, under its
rolicy No. COL 2u135u was then carrying certain public liability insurance
for the City and aald Casualty Company has notified the City that it is not
obligated under said policy to defend the City in this particular legal
action, but the City does not agree with this contention; and
WHEREAS, both the Casualty Company and the City desire to have said legal
action defended without any prior determination of the mutual righta and
obligations set forth in said policy, and to that end, at a special meeting
of the City Council of Stillwater held on Aprii 11, i95u, said Casualty
Company presented to the City Council a "NON+WAIVER AGREEMENT" providing,
in substance, that the Casualty Company would, without waiving any of ita
rights under said policy, defend the City in said legal action when same
comes up for trial and in case of an adverse verdict against the City, to
have thereafter made a judicial determination of the question whether or not
said Casualty Company is obligated to pay any damages awarded to the plain-
tiffs in said legal action; and
WHEREAS, a copy of said non -waiver agreement is now on file in the office
of the City Clerk;
BE IT THEREFORE RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER that said
non -waiver agreement is hereby approved and the proper officers of the City
are hereby authorized and directed to execute said non -waiver agreement on
the part of the City.

changes in the West Mulberry Street Outlet Sewer System at the junction of
the main sewer with the West Laurel Street branches, as prepared by the
City Engineer and presented to the Council, for its consideration and

2. That, whereas said changes, thus approved, have been requested by the
Minnesota State Board of Health and agreed upon by the Stillwater Board
of Water Commissioners as a safeguard against contamination of the C1ty's

RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER that there shall be
issued and sold certificates of indebtedness of the City of Stillwater in
the total sum of Ten Thousand (10,000) Dollars in anticipation of the pay-
ment of taxes levied for the General Fund of the City in the year 1949.
All of said certificates shall be a general obligation of the CLty; they
shall be dated May 10, 1950, shall be payable to the bearer on or before
July 31, 1950, with interest at three (3) per cent per annum from date of
issue until paid; and they shall be numbered and in amounts as follows:
Certificate Number One for Five Thousand (5,000) Dollars;
Certificate Number Two for Five Thousand (5,000) Dollars.
They shall be signed in the name of the City by its Mayor, sealed with
its corporate seal and countersigned by the City Clerk. Said certificates

RESOLUTION VACATING A FART OF EAST SPRUCE STREET IN THE CITY OF'STILLWATER.
WHEREAS, at a special meeting of the City Council of the City of
Stillwater held on April 17, 1950, at 11:00 o'clock a. m., a petition
was presented to the Council praying for the vacation of part of East
Spruce Street in the City of Stillwater, to -wit:
Beginning on the East line of North Second Street extending
to the West Line of North First Street lying between Blocks
number thirty (30) and thirty-four (34S in Carli & Schulenburg's
Addition to Stillwater; and
WHEREAS, at said meeting the Council deemed it expedient that the
matter shall be proceeded with and ordered the petition to be filed in
the office of the City Clerk, and the City Clerk was lnatructed to give
notice by publication in the official paper of the City for four
successive weeks to the effect that such petition has been tiled as
aforesaid, and that said petition will be heard and considered by the
Council on the 22nd day of May, 1950, at 7:30 p. m., which date is not
less than ten (10) days afters the last publication of said notice; and
WHEREAS, a hearing on said petition in aoeordanee with the terms
of said notice has been duly had by the Council at a special meeting on
the 22nd day of May, 1950, at 7:30 p. m., and it is now the judgment
of the Council that said petition should be granted:

public benefits are such that said vacation is ordered without the pay-
ment of any compensation by the property owners along the vacated pert

RESOLUTION SUGGESTING TO MINNESOTA HIGHWAY DEPARTMENT A NEW LOCATION OF PART
OF TRUNK HIGHWAY NO. 95:
WHEREAS, the Council of the City of Stillwater is informed that the
Commissioner of Highways of the State of Minnesota is considering re -locating
State Trunk Highway No. 95 going north from the Village of Bayport; and the
Council of the City of Stillwater has spent much time and effort in consider-
ing this subject and feels that it is speaking for the entire population of
Stillwater in passing this Resolution.
THEREFORE, BE IT RESOLVED by the Council of the City of Stillwater that it
suggest to the Commissioner of Highways his earnest consideration of the follow-
ing route of Highway No. 95:
Beginning at the First State Dank corner in Bayport; thence running
north through the Village of Bayport on the West aide of the Wash-
ington County Fair Grounds and then following as closely as possible
the right-of-way of the C. St. P. N. & 0. Railroad until it forms a
junction with State Trunk Highway No. 212, as near as is practicable
to the present junction of State Highways 95 and 212.
FURTHER RESOLVED that the Clerk send to the Commissioner of Highways a
certified copy of this Resolution.

RESOLUTION VACATING PARTS OF ST. LOUIS STREET AND A PART OF SECOND AVENUE
SOUTH IN TEE CITY OF STILLWATER.
WHEREAS, at a Special Meeting of the City Council of the City of
Stillwater, held on May 26, 1950, at 7:30 p. m., a petition was presented
to the Council praying for the vacation of parts of St. Louis Street and
a part of Second Avenue South in the City of Stillwater, to -wit: -
St. Louis Street Easterly from the Eenterly line of the
Intersection of Third Avenue South and St. Louis Streets
to the Westerly line of Lot One (1), Block Two (2), Hersey
Staples & Company, Addition to Stillwater.
Ten (10) feet of the North portion of the present Sixty-six
foot (66) St. Louis Street lying between Third Avenue South
and Fourth Avenue South.
Second Avenue South from the Northerly line of Lot Five (5),
of Block Three (3), and Lot Ten (10) of Block Two (2), Hersey
Staples & Company, addition to Stillwater. In lieu thereof,
a forty (40) foot public roadway will be dedicated from this
point running in a Northwesterly direction to the Interesection
of Third Avenue South and St. Louie Streets.
WHEREAS, at said meeting the Council deemed it expedient that the
matter shall be proceeded with and ordered the petition to be filed in
the office of the City Clerk, and the City Clerk was instructed to give
notice by publication in the official paper of the City for four (4)
successive weeks to the effect that such petition has been filed as
aforesaid, and that said petition will be heard and considered by the
Council on the 5th day of July, 1950, at 7:30 p. m., which date is not
less than ten (10) days after the last publication of said Notice, and
WIMREAS, a hearing on said petition in accordance with the terms of
said notice has been duly had by the Council at a Regular Meeting on the
5th day of July, 1950, et 7:30 p.m., and It is now the judgment of the
Council that said petition should be granted.

such that said vacation 1a ordered without the payment of any compensation
by the property owners along the vacated part of said street;
IT I5 FURTHER RESOLVED, that after the publication of this Resolution
according to law, the City Clerk is hereby ordered and directed to file for
record in the office of the Register of Deeds of Washington County, Minne-
sota, a transcript of said Resolution, together with a duplicate of the plat
showing the part of said street herein ordered to be vacated, duly certified
by him.

RESOLVED, that the City Council of the City of Stillwater, Washington
County, Minnesota, hereby accepts the offer of the NORTHERN STATES POWER COMPANY,
Minneaota corporation, to furnish electric energy, lamp and glassware renewals,
and other services for the operation and maintenance of the City's ornamental
street lighting system, consisting of:
73 - Single - light steel standards (Business District)
4 - single - light Navigation Lights
all located or to be located in said City, and hereby approves all rates, terms,
conditions, and specifications contained in the proposed form of Ornamental Street
Lighting Contract made a part of the offer of said Company, and the Mayor of the
City Council and the City Clerk are hereby authorised and directed to execute the
aforesaid Contract for and In the name of the City and to affix the corporate
seal thereto. •

REFUNDING BOND ISSUE DATED APRIL 1ST, 1941.
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER that the City pay
to the First National Bank of Minneapolis, Minnesota, the sum of Four
Hundred Twenty (420) Dollars, being semi-annual interest due October
lat, 1950, on balance of $48,000.00 outstanding of 690,000.00 1-3/4%
refunding bonds dated April 1st, 1931, plus service charge of $1.05;
said sum of 6420.00 to be paid out of the Bond Interest Account and
said sum of 01.05 out of the General Fund of the City;

RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATLR:
That the assessments made against the several lots, parts of lots and
parcels of land as presented to the Council for its consideration at a
Special Meeting held on Friday the 25th day of August, 1950, at 7:30
o'clock p. m., and ordered filed in the office of the City Clerk, and as
amended at the public hearing duly held for the purpose on Tuesday the 5th
day of September, 1950, at 7:30 o'clock p. m., for defraying a portion of the
cost of bituminous surfacing including necessary grading and graveling pre-
paratory thereto of South Fifth Street between Churchill and Oreleans Streets,
West Hancock Street between Fourth and seventh Streets, North and South
Sherburne Streets between Olive and Linden Streets, South Holcombe Street

Charter; One -Fifth on or before October lst, 1951; One -Fifth on or before
October let, 1952; One -Fifth on or before October lst, 1953, and one -fifth
on or before October let, 1954. Interest at the rate of four (4%) per cent
per annum shall be paid upon such installments, beginning thirty days after
the publication of said Notice by the City Treasurer.
IN ORDER FOR THE OWNER or anyone interested in any of the lots so assessed
to obtain the right to pay said assessments in said installments, such owner or
interested party shall, within thirty days after the publication of said Notice
of the City Treasurer, make a request to the City Treasurer, in writing, in
duplicate, to pay said assessments in said installments, in accordance with
Section 245 of the City Charter.

RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER that there shall be
issued and sold a certificate of indebtedness of the City of Stillwater in
the sum of Five Hundred Sixty -Seven and 02/100 (4567.02) Dollars in anti-
cipation of the collection of assessments levied against property benefited
by bituminous surfacing and grading during 1949 (and 1950) on the following
projects:
South Fifth Street between Churchill and Orleans Streets;
West Hancock Street between Fourth and Seventh Streets;
North and South Sherburne Streets between Olive and Linden Streets;
South Holcombe between pine and Hancock Streets; and
West Anderson Street between Holcombe and Greeley Streets,
which assessments were by Resolution duly confirmed and established by the

'RESOLUTION NUMBER $1518.
RESOLUTION AUTHORIZING THE ISSUE OF CERTIFICATE OF INDEBTEDNESS.
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER that there shall be issued
and sold a Certificate of Indebtedness of the City of Stillwater, in the sum of
Fifteen Thousand (15000) Dollars. Said Certificate shall be dated November 14,
1950, shall be payable to the bearer at the office of the City Treasurer, on or
before December 31, 1950, with interest at three (3) per cent per annum from
date of issue until paid. Said certificate shall be signed on behalf of the
City by its Mayor, attested by the City Clerk and sealed with the official seal
of the City. Said certificate shall be payable out of and be a firs: lien
thereon of the proceeds of two United States Savings Bonds now belonging to the
City, numbered X236264F and X236265F, dated as of June 1st, 1945, due June 1st,
1967, of matured value of Ten Thousand (10000) Dollars, each, said bonds having
been heretofore purchased by'the City out of its Beneral Fund and now in the
process of being sold and the proceeds collected, through the First National
Bank of Stillwater.
SAID CERTIFICATE shall be sold by the City Clerk on the day of the date
thereof or sa soon thereafter as possible, at par and accrued interest.

RESOLUTION APPROVING THE DESIGNATION OF EXTENSIOKS TO STATE AID ROADS NUMBER
18 AND NUMBER 11 WITHIN THE CITY OF STILLWATER, MINNEoOTA.
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER:-
WHEREAS, Washington County has designated as an extension to State Aid Road
Number 18 from where said road intersects with the north limits of the City of
Stillwater, described as a point in said road approximately 710 feet east of
the north and south quarter line and approximately 500 feet hcrth of the south
line of Section 20, of Township 30 north, Range 20 West, and continuing thence
southeasterly along said road to its intersection with N. Owens and W. Laurel
streets, a distance approximateing 0.8 of a mile, and whereas, ►ashington has
designated as an extension to State Aid Road Number 11 from where said road
intersects with north and westerly limits of the City of Stillwater, described
as a point in said road where same intersects with the east line of Section
20, of Township 30 North, Range 20 West approximately 1170 feet north of the
southeast corner thereof, continuing thence southerly and easterly to N. Owens
street, and thence southerly along No. Owens street to an intersection with
W. Laurel street and State Aid Road Number 18, a distance approximating 0.7 of
a mile; that the designated extensions of the two heretofore described roads be,
and the same are hereby approved, and that a -copy of this resolution be filed
with the County Auditor of Washington County, and a copy with the Minnesota
Department of Highways.
