RESOLUTION GRANTING SPECIAL FERMIT TO USE CERTAIN LAND FOR PURPOSES
NOT CONFORMING TO THE S0 CALLED ZONING ORDINANCE
RESOLVED BY THE COUNCIL OF THE CITY 01 STILLWAPER, THAT a special
permit is hereby granted to Herman C.R. Piper and his assigns to
use the land described below for a gasoline filling station and
for any other purposes now permitted in district classified as
industrial under said ordinance.
The land affected is: Lots 7,8,and 9 in block 1 in Churchill
and Nelson addition to Stillwater also that part of lot
two now owned by him in section 34 township 30 north of
- range 20 west being part of block 18 In Hersey, Staples
and Company's addition to Stillwater.

RESOLUTION PROVIDING FOR THE PAYMENT OF SPECIAL ASSESSMENTS IN
THREE INSTALLMENTS, LEVIED AGAINST REAL ESTATE BENEFITED, TO DEFRAY
THE COST AND EXPENSE OF SPRINKLING, TFEATING OR SURFACII. WITH
TAR AND GRAVEL AND CRUSHED ROCK, CERT:IN STREETS EMBRACED WITHIN
THE BOUNDARIES OF SPRINKLING LISTRICT NUMBER 18.
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER, that the payment
of special assessments levied against real estate benefited to
defray the cost and expense of sprinkling, treating or surfacing
with tar and gravel and crushed rock, certain streets embraced
within the boundaries of sprinkling district number 18, may be
made in three installemnns, the first installment to be due on
February 4, 1946, the second installment Lo be due on October 1,
1946, and the third installment to be due on October 1, 1947, by -
the owner of or any person interedted in, any lot, part of lot
or parcel of land against which said assessments have been levied,
who shall elect in writing to pay the same in three installments.
AND BE IT FURTHER RESOLVED, that said installments shall
bear interest at the rate of six per cent per anum, from the ex-
piration of thirty days after the publication of the notice required
to be given by the City Treasurer, in accordance with Section 244
of the Charter of the City of Stillwater.

AUTHORIZING THE TRANSFER OF RECREATION FUNDS TO THE STILLWATER CITY
SCHOOL DISTRICT
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER that in view of the
fact that the Recreation Committee of the City has terminated its ex -
/stance, and its duties have been taken over by the. Stillwater City
School District, the City Clerk is hereby authorized and directed to
transfer to the Stillwater City School District, the sum of one thousand
dollars (V1000) from the Recreation Fund of the City, to be used for
recreation purposes, and the City Clerk is hereby authorized and dir-
ected to draw his warrant on the City Treasurer accordingly.

RESOLUTION APPROVING FLANS, SPECIFICATIONS AND AN ESTIMATE OF THE
PROBABLE EXPENSE FOR BITUMINOUS SURFACING OF STREETS AND ROADWAYS
IN THE CITY OF STILLWATER, MINNESOTA, DURING THE YEAR 1946.
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER:
1. That the plane, specifications and estimated costa, as prepared
by the City Engineer, for bituminous surfacing of streets end road-
ways, in the City of Stillwater during the year 1946, as presented
to the Council for its consideration and approval be, and the same
are hereby approved and ordered filed in the Office of the City
Clerk.
2. That Tuesday the 5th day of March 1946, at 7:30 O'clock P.M.
be and is hereby designated as mime when the Council will meet
in the Council Chamber in the City Hall at a regular meeting, and
act in relation to the doing of the proposed work, and the City
Clerk is hereby directed to give notice of such meeting in accordance
with provisions of the charter.

RESOLVED SY THE COUNCIL OF THE CITY OF STILLWATER, that the City for
the consideration of one dollar ($1.00) convey by quit claim deed to
the Church of St. Joseph of Stillwater, Minnesota, a Minnesota Cor-
poration of Stillwater, the following described real estate:

of the Southwest quarter of Section 2d, Township 30 North, Range
Twenty (20) West, described as follows:
Beginning at the intersection of the West line of South Wi11.'nm

RPSOLt'TION VACATING A PART OF EAST HUDSON STREET
NEEWAS at a regular meeting of the City Oduroil of the
City of Stillwater, held December 4, 1945, a petition was presented
to the Council, praying for the vacation of the South Sixteen (16)
feet of Past Hudson Street between Fifth (5th) Avenue South and
Sixth (6th) Avenue South in the City of Stillwater, and
"WHEREAS at said meeting of the City Council, a resolution
entitled Resolution deeming It expedient to proceed with the peti-
tion for the vacation of a part of Fast Hudson Street", was passed

lieation in the official paper of the City for four successive weeks,
thto the effect that such Petition had been filed ea aforesaid, and
at maid petition would be heard and considered by the Council on

water Gawette, the official paper of the City on December 10, 1945;

RESOLUTION NO.1236
RESOLUTION PERTAINING TO THE DISPOSAL OF SEWAGE IN THE CITY OF
STILLWATER.
WHEREAS the entire sewage system of the City of
Stillwater empties untreated into Lake St. Croix at the present
time, and the City Council realises this situation 1s in conflict
with the regulations of the State Board of Health and the State
Water Polution Control Commission; and
WHEREAS, realizing the undesirability of this situ-
ation, the City Council is conscious of the neeessity of relieving
it by the installation of some form of treatment of sewage disposal;
and as evidence of such realisation, calls attention to the fact
that on September 26, 1938, it adopted a Resolution authorising
an application to be made to the Federal Elsergency Administration
of Public Works for a Federal grant to help finance the cost of
constructing an intercepter sewer and a sewage and garbage treat-
ment plant, which application was not approved, and any plans in
connection therewith at that time, were then abandoned;
THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF STILLWATER:
1. That the City shall, as soon in the future us
adequate finances can be provided, cause plane and specifications
to be made for treatment of all sewage in conformity with the re-
quirements of the State Board of Health; and that the City shall
proceed to carry out said plane and specifications as soon thereafter
es practicable.
2. That a certified copy of this Resolution be filed
with the State Water Polution Control Commission.

of constructing a sewer West from N. Owens street in accordance with
...i "Detailed Plan No. 1" extending from the manhole at W. Laurel and
N. Owens streets westerly over and across Block 3 of SabinAS Addition
to a point in the center line of W. Maple street,45 feet east of
the northwest corner of.Sabin'e Addition; thence east along the
center of W. Maple street 487 feet to a point that is 131.9 feet
west from the center of N. Owens Street; and, or for the construction
of a sewer in W. Maple street only, in accordance with "Detail plan
No. 2! extending from the manhole at W. Maple and N. Owens streets
westerly along the center of W. Maple street to a point that is.

prepared by the City Engineer, and presented by the Council for its
consideration, be, and the same are hereby approved and ordered

WHEREAS it appears that the City of Stillwater has some interest
in the lands hereinafter described, which lands at one time formed
a part of John Street, said street havi:g long since been abandoned
but never vacated; and the City Council now considers said lands to
be of no value or use to the City;
THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER,
that the City convey by quit claim deed to Walter H. Reichow and Helen
V. Reichow, his wife, as joint tenants and not as tenants in common,
without consideration, the following described land, situate in the

RESOLUTION PROHIBITING ENCROACHMENTS
WHEREAS, the Commissioner of Highways of the State
of Minnesota hae now determined to designate and make permanent
the location of Trunk Highways Not, 95 96 & 212 formerly designated
Trunk Highways Not 9b, 96, & 46, as the same traverses the lity of
Stillwater, as shown upon the plan and map hereto attached and made
a part hereof, and
WHEREAS, said Commissioner of Highways proposes
to construct and improve said Trunk Highways No. 95, 96, & 45
through said City and has prepared plane, specifications, and
special provisions for said construction, and
WHEREAS, said construction and improvement is to
be accomplished with the aid of Federal funds, and
WHEREAS, Said project and aald plane, in order
to participate in Federal funds, require the approval of the
Federal Public Roads Administration, and
WHEREAS, said Public Roads Administration requires
as a condition precedent to such approval the assurance and
covenant that the City of Stillwater will not license or permit
hereafter, any encroachment of any nature, including curb gas
pumps or gas stations or billboards or other structures of any
kind whatsoever, on the right of way of said Trunk Highways
Not 95c 96, & 45 within the corporate limits of said City of
Stillwater as shown upon the plan and mapa hereto attached, and
WHEREAS, in the furtherance of the public well
being and aafety it is deelrable and neceasary to eliminate
traffic hazards by eliminating any encroachment whatsoever now
or hereafter existing in or upon the said Trunk Highways right
of way;
NOW THEREFORE:
BE IT RESOLVED, that said City does hereby agree
and covenant that it will never permit or suffer, within its
corporate limits, any encroachment of any kind whatsoever, in-
cluding curb gae pumps and gas stations, billboards or other
structures of any kind whatsoever, upon the right of way of
Trunk Highways Nos. 95, 96, & 45 as shown on the plan and maps
hereto attached and submitted by the Department of Highways,
State of Minnesota; and that to the above end said City hereby
agrees that it will never issue any license, permit, or grant,
or give any leave or liberty or any other consent of whatever
form for the construction or maintenance of any encroachment
whatsoever, including curb gas pumps and gas stations, billboards
or other structures of any kind whatsoever, upon aald right
of way; and that said City will cooperate insofar as possible
to eliminate existing encroachments constituting traffic hazards
and will further take any necessary action to eliminate any encroach-
ment that may hereafter exist on said Trunk Highways right of way.

Fixing the Compensation of Jtreet Employees.
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER, that effective
July 16, 1946, the compensation to be paid street employees shall be as
follows:
REGULAR E LOYE=S: 84 per hour for a 54 hour week, with tine
and one-half for all work In excess of 9 hours in any one day. Such
employees shall be riven two weeks ernual vacation: with pay t.nd 54 hours
sick leave during the year, not accumulative.
EXTRA LIEN: per hour, with time and one-half for work done
over 9 hours in any ore day.
EXTRA TRUCK AID DRIVER: $1.65 per hour and time and one-half for
work done over 9 hours in any one day.
FOREMEN: $1.00 per hour for a 54 hour week, with time and one-
half for all wort. done over nine hours In any one day. Foremen shall
be given two weeks annual vacation with pay and 54 hours sick leave during
the year.

On Centrally Collected Taxes cm

l:TiEREAS Minnesota's present tax system limits municipalities, C:J
virtually to the property tax; and this tax has become less productive
and thoroughly inadequate to finance municipal needs;
AND WHEREAS the best way to relieve this situation, is the
imposition of modern taxes throughout the state, with central collection
by the state and dedication of a substantial portion of the tax proceeds
to municipalities;
AND WHEREAS the tax committees of the Legislature have repeatedly
suggested that such tax sharing with municipalities will impair the state
government's own budget unless new tax sources are found or present tax
rates increased;
RESOLVED BY THE COUNCIL 09 1EL CITY OF STILL':YATER, that the Council
urges the Legislature to follow the general proposition that a substantial
portion of centrally collected state-wide taxes be allocated to municipal-
ities for municipal government purposes;
RESOLVED FURTHER that the Council recommend to the Legislature
that as a start toward the establishment of such a system, the following
specific tax changes;

September 8, 1946, and the Council of the City of Stillwater wishes
to take official notice of her death;
THEREFORE BE IT RESOLVED BY THE COUNCIL that the Clerk
place the following remarks upon the Council minutes pertaining to her:
She was City Treasurer for nearly ten years and at all times she
conducted her office in a careful, exact and courteous manner. She
was a credit to the official organization of the City and a public offi-
cial who merited and enjoyed the confidence and respect of all citizens.
She will be missed both by the City government and the people of the
City generally.

RESOLUTION PERMITING THE REROUTING OF TWIN CITY MOTOR BUS COMPANY BUSES
t F.REAS, in order to enable the Twin City Neter Bus
Company to make use of the Northern Pacific Railway Depot, located
on Water Street between Chestnut Street and Myrtle Street, as a waiting
shelter for its bus passengers, it is necessary to reroute its present
bus line within the City of Stillwater:
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF STILL'VJATER,
that the Twin City Motor Bus Company is authorized to operate its buses
i within the City of Stillwater over the following described route:
From the City Limits at 4th Street, thence on 4th Street to Pine
L
Street, thence on pine Street to 3rd Street, thence on 3rd Street
to Chestnut Street, thence on Chestnut Street to Water Street,
thence on Water Street to Myrtle Street, thence on Myrtle Street
to Main Street, thence on Main Street to Chestnut street.
Returning to 4th Street and the City Limits via the same route.

RESOLUTION AUTHORIZING THE LEASING OF THE SO-CALLED RIVER TERMINAL
FROPERTY.
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER, that
the assignment by Frank A. Raven of all of his interest in the so-called
River Terminal Lease now exlating$i'io aSi3 the City, to Stillwater St.
Croix Barge Terminal Co., a Minnesota Corporation of Stillwater, Minnesota,
which assignment is in writing dated November 29, 1946, is hereby con-
sented to and accepted by the City, upon the condition that all moneys
now due and to become due to the City under said River Terminal Lease,
for the year 1946, as provided therein, are paid in full to the City
by said Barge Terminal Co.
FURTHER RESOLVED, that said River Terminal Lease, as
so assigned is hereby cancelled, subject to the foregoing condition;
FUPTHER RESOLVED, that a new contract covering a lease
of the ao..called River Terminal Property, to said Barge Terminal Co.
Se hereby approved, and the proper officers of the City ere hereby
authorized and directed to algn, on behalf of the City, said new Contract
.a copy of which new contract is attached hereto and, by reference,
hereby made a part hereof.
