HomeMy WebLinkAbout1944 Resolutions• RESOLUTION RESOLUTION AUTHORIZING THE ISSUANCE OF CERTIFICATES OF INDEBTEDNESS RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER that there shall be issued and sold certificates of indebted )ssorss ofef thelCitytofipation of Stillwater 1n the sum of. Six 'Thousand (6,e of the payment of taxes levied for the General Fund of the City of Stillwater in the year 194e. All of said certificates shall be a general obligation of the City; they shall be dated December, 31, 1943, and shall be payable to the bearer on or before December, 31, 1944, with interest at four (4) per cent per annum from date of issue until paid; they shall be numbered and in amounts as follows; Certificate No. 1 for Two 'Thousand (2,000) Dollars. Certificate No. 2 for Two Thousand (2,000) Dollars. Certificate No. 3 for Two Thousand (2,000) Dollars. -� They shall be signed in the name of the City by its mayor, sealed with its corporate seal and countersigned by the City Clerk. RESOLVED BY THE COUNCIL OF TEE CITY OF STILLWATER; 1. That it is hereby determined that these portions of the hereinafter named streets situated in that territory of the City of Stillwater embraced within the boundaries of the several sprinkling districts hereinafter described shell be sprinkled with water or sprinkled, treated or surfaced with tar and gravel or crushed stone, se hereinafter designated during the year 1944, which territory is hereby divided into two sprinkling districts, which are and shall be numbered, bounded and described as follows; Sprinkling District Number 14. (To be sprinkled with water) Along N. and S. gain Street, from the north line of Commercial Avenue to the north line of Nelson street, along 5. Water Street, from the north line of E. Published March, 8, 1944. At tes City Clerk 4 Mayor nst • 1 299 • • RESOLUTION NO. 1173 RESOLUTION CONSENTING TO ASSIGNMENT OF RIVER TERMINAL LEASE. WHEREAS, a written contract dated January, 20, 1939, exists between the Industrial Contracting Company, a Minnesota corporation of Minneapolis, Minnesota, and the City of Stillwater, a municipal corporation of Minnesota, with respect to the leasing by the City to said corporation AA of the so-called River Terminal property on the west bank of the St. Croix River in the City, which contract has heretofore been modified by proper instruments in writing under the respective dates of rune, 13, 1940, July, 1, 1941 and April, 12, 1943; and, WHEREAS, the said Industrial Contracting Company has notified the City in writing that it Is going to liquidate its business and desires to assign said or,ginel contract as heretofore modified, to Frank A. Raven, on condition that if such assignment is accepted by the City, said Industrial Contracting Company be relieved of any and all further obligations to the City under said contract; and, WHEREAS, said Frank A. Raven has notified the City that he is willing to accept such assignment, he to assume, and to be bound by, all the obligations imposed upon said lnduetrial Contracting Company in said original contract as heretofore modified; and, WHEREAS, it is provided by said contract that the said Industrial Contracting Company shall assign no part of said contract to anyone without first having obtained the written consent of the City; and, WHEREAS, the City is willing to consent to said assignment; THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER that, if said industrial Contracting Company so assigns said contract, and said Frank A. Raven accepts the assignment, the City hereby consents to the same, with the understanding that said industrial Contracting Company be relieved of any further obligations to the City under said contract, and that said Frank A. Raven assume and agree to perform all the obligations imposed upon said industrial Contracting Company in said contract as heretofore modified, particularly the obligation to pay the minimum rental of 41000.00 a year provided for in the contract, beginning in the year 1944. WHEREAS at a regular meeting of the City Council of the City of Stillwater, held on October 3, 1944, a petition was presented to the Council, praying for the vacation of the north sixteen (16) feet of East Hudson Street between Fifth (5th) Avenue South and Sixth (6th) Avenue South in the City of Stillwater, and WHEREAS at said meeting of the City Council, a resolution entitled "RESOLUTION deeming it expedient that the matter of the vacation of a part of Eaat Hudson Street be proceeded with" was passed by the Council, ordering that said petition be filed in the office of the City Clerk, and instructing said clerk to give notice by publication in the official paper of the City for four successive weeks to the effect that such petition had been filed as aforesaid, and that said petition would be heard and considered by the Council on December 5th, 1944 in the Council Chambers at seven thirty (7:30) o'clock P.M. , Which said Resolution was duly published in the Stillwater Gazette, the official paper of the City on October 5, 1944; and whereas said petition has been so filed and the notioe provided for in said Resolution has been duly given; and WHEREAS a hearing on said petition in accordance with the terms of said Resolution and notioe has been duly had by the Council at its regular meeting on December 5th, 1944, and it is now the judgement of the Council that only the West one hundred and forty (140) feet of the north sixteen (16) feet of said East Hudson Street should be vacated; IT IS THEREFORE RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER, that the west one hundred and forty (140) feet of the north sixteen (16) feet of East Hudson Street, in Hersey, Staples and Company$; addition to Stillwater is hereby vacated absolutely and forever, with however, the following reservation, to wit: the City is to have a perpetual right and privilege to enter upon said vacated portion of said East Hudson Street at suoh times as it may desire, for the purpose of the construction, maintenance and repair hereinafter mentioned, and to construct, maintain and repair thereon, or thereunder, sewers, water mains and gas mains for use in connection with the general system of sewers, water mains and gas mains of the City. Should the City exercise any of the privileges so reserved to it. It shall do so under an obligation to leave the surface of the vacated part of said street, after such sewerswater mains or gas mains are constructed, maintained or repaired, in condition as good as existed immediately before such privileges were exercised, due consideration to be given, however, to the character of the work necessarily done in exercising said privileges. IT IS FURTHER RESOLVED BY THE COUNCIL that the Council deems that substantial benefits will accrue to the City from the vacation herein without the and the pyiare thereforthat anysaid of thevacation propertyordered the payment ofany compensation owners along the line of that part of East Hudson Street, herein ordered vacated. IT IS FURTHER RESOLVED that after the publication of this Resolution according to law, the City Clerk is hereby ordered and directed to file for reeord in the office of register of deeds of Washington County, Minnesota, a transcript of said Resolution together with a Duplicate of the plat, showing in red, the part of said East Hudson Street herein ordered to be vacated, duly certified by him.
