R SOLUTION NO. 1108
RESOLUTION AU'RORIE:INS THE IS..UANCE OF CERTIFICATES O. INDEBTEDNESS,
RESOLVED EY THE COUNCIL OF THE CITY OF STILLWATER that there shell be
issued and sold, certificates of indebtedness of the City of Stillwater
in the sum of Seventeen shousand (17,000)'Dollars in anticipation of
the payment of taxes levied for the General Fund of the City of Stillwater
in the year 1941. All of said certificates shall be a general obligation
of the City; to the bearer tonheyorhbefore December, e31,r1942, with fourinterestd latapayable (4)
per cent per annum from date of issue until paid; they shall he numbered
and in amounts as follows;
Certificate No. 1 for Seven thousand (7,000) Dollars.
Certificate Ao. 2 for Five Thousand (5,000J Dollars.
Certificate No. 3 for rive shousand (5,000) Dollars.

RESOLUTION FIXING THE SALARY OF THE CITY ASSESSOR FOR 1942
RESOLVED BY THE COUNCIL OF THE CITY OF STILLVATER that the salary
of the City Assessor for the year 1942 be, and the same hereby is, fixed
at the sum of ;1,000.00 payable as follows; 4150.00 on the first days of
April, May, June, July, August and September next, and 0.00.00 on
October, 1, 1942; and the City Clerk Is hereby authorized and directed
to draw his warrants on the City Treasurer accordingly.

RESOLUTION PROVIDING FOR THE PAYMENT OF SPECIAL ASSESSMENTS IN FIVE
INSTALLMENTS LEVIED AGAINST REAL ESTATE BENEFITED TO DEFRAY THE COST
AND EXPENSE OF LOCAL INPROVMENT NO. 45.
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATE'R, that the payments
of Special Assessments levied against real estate benefited to defray
the cost and expense arising from the relaying and constructing new
curbs, sidewalks and driveways on the north side of Commercial Avenue
from Myrtle Alley to N. Main Street, and new curbs, sidewalks, driveways,
and extending the ornamental street lighting system on both sides of
N. Main Street from Commercial Avenue to E. Mulberry Street and known
as Local Improvement No. 45, may be made in five installments, the first
installment to be due on April, 15, 1942, and the four succeeding install-
ments to be due on the first day of October, of the years 1942- 1943-
1944 and 1945, by the owner of, or any person interested in, any lot,
part of lot or parcel of land against which said assessments have been
levied, who shall elect in writing to pay the same in five installments.
AND BE IT FURTHER RESOLVED that said installments shall bear
interest at the rate of six per cent per annum from the expiration of
thirty days after the publication of the notice required to be given by
the City Treasurer, in accordance with Section 244 of the Charter of the
City of Stillwater.

OF SPRINKLING WITE WATER CERTAIN STREETS EMBRACED WITHIN THE BOu.;DARIES
OP SPRINKLING DISTRICT NUMBER 14. AND OF SPRINKLING, TREATING OR
SURFACING WITH TAR AND GRAVEL OR CRUSHED STONE CERTAIN STREETS EMBRACED
WITHIN THE BOUNDARIES OF SPRINKLING DISTRICT NUMBER 17, AND FIXING A
TIME WHEN THE COUNCIL WILL MELT TO ACT IN RELATION TO TEE DOING OF THE
PROPOSED WORN.
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER;
1. That the plans, specifications and eatimated coat of the proposed
work of sprinkling with water certain streets embraced within the
boundaries of Sprinkling District Number 14, and of sprinkling, treating
or surfacing with tar and gravel or cruahed stone certain streeta
embraced within the boundaries of Sprinkling Diatriet Number 17, as
prepared by the City Engineer and presented to the Council for its
consideration and approval be, and the same are hereby approved,
and ordered filed in the office of the City Clerk.
2. That Tuesday the 7th day of April, 1942, at 7.30 o'clock P.M. be
and is hereby designated as the time when the Council will meet in
the Council Chamber at a regular meeting end act in relation to the
doing of the proposed work, and the City Clerk 1a hereby directed
to give notice of such meeting in accordance with the provisions of
the Charter.

CERTAIN STREETS SHALL BE SPRINKLED WITH WATER, AND SPRINKLED, TREATED OR
SURFACED 'VITH TAR AND GRAVEL 0R CRUSHED STONE DURING THE YEAR 1942, AND
DIVIDING SAID TERRITORY INTO SPRINKLING DISTRICTS.
RESOLVED BY THE. COUNCIL OF THE CITY OF STILLWATER;
1. That it is hereby determined that these portions of the hereinafter
named streets situated in that territory of the City of Stillwater embraced mix
within the boundaries of the several sprinkling districts hereinafter
described shall be sprinkled with water, or sprinkled, treated or surfaced
with tar and gravel or crushed stone, as hereinafter designated during the
year 1942, which territory 1s hereby divided into two sprinkling districts
which are and shall be numbered, bounded and described as follows;

at 7.30 o'clock F.M. for doing and furnishing the commodities,
labor and service for the work as heretofor outlined, in accordance
with the detailed plans and specifications therefor, and proposed
contract on file in the office of the City Clerk.

district.

RESOLUTION ON TEL NEATII OF WILLIAM J. 1.IADDLN
WHEREAS, the City Council of the City of Stillwater at special
session desires to take official cognizance of the death on April, llth,
1942, of 78111am .1. Madden.
IT IS THEREFORE IL1OLVED, by the Council, that the Clerk place
permanently upon the Council minutes the following remarks;
William J. Wadden was a splendid example of the best in American
life. 110 was a man of high character, kindly and unselfish towards all
his associates and possessed a friendly and cheerful disposition that
are attributes of but few of the best of our citizens. he was a busy man
with his own private affairs, but never too busy to devote much of his

_'HEAS the successful prosecution of the war in which the United States
is now engaged has created new and unusual conditions with the respect to w.
the storage of fuel oil in the City of Stillwater for use by the owner
in manufacturing processes associated with war effort, and in order to
control such conditions most efficiently, in the judgement of the City
Council, some relief from the provisions of the ordinances specified
below ought to be permitted temporarily; THEREFORE BE IT RESOLVED BY THE
COU_:CIL OF THE CITY OF
YTILLVJATER that the provisions of; "An ordinance regulating the keeping,
handling and storage of flamable liquids within certain limits in the
City of Stillwater, and providing a penalty for the violation thereof,"
passed February, 18, 1930, published February, 19, 1930, as amended by,
"An ordinance to amend Section I of an ordinance entitled "An ordinance
regulating the keeping, handling and storage of flamable liquids within
certain limits in the City of Stillwater, and providing a penalty for
the violation thereof ", passed June, 3, 1930, published June, 4, 1930,
so far as such provisions affect the storage of fuel oil for use by the
owner thereof, are hereby suspended for a period ending six months after
said war is over.
IT IS FURTHER BLIOLVED that, should there be any difference
of opinion as to the date on which said war is over, the Council may
officially determine said date and its action in doing so shall be
conclusive.

the cost and expense arising from the_conetruction of a sewer in and
along the center line of North Owens street from the now existing
sewer in Weat Laurel Street to the present sewer in the center of

RESOLUTION APPROVING SUBSTITUTION 0P SECURITIES HELD AS COLLATERAL
FOR THE DEPOSIT OF CITY FUNDS.
CAS, the First National Bank of Stillwater prior to September, 23,
1942, bad deposited with the Federal Reserve Bank of Minneapolis, es
security for the deposit in the said First National Bank of moneys
belonging to the City of Stillwater, U. S. Treasury 3/4% notes, Series
A-1945, due March, 15, 1945, of a par value of $28,000.00; and
WHEREAS, on September, 23, 1942, at the request of said First National
Bank the City Treasurer surrendered all of said 3/4% notes to said
First National Bank and took in substitution therefor, deposited with
the said Federal R ank of Minneapolis, U. S. Treasury Bonds of
1952-65-2-1/4S due June, 15, 1955 of a par value of 428,000.00;
IT IS THEREFORE RESOLVED by the City Council of the
City of Stillwater that the substitution of said 2-1/4% Bonds for
said 3/4% Bonds is hereby approved and the act of the City Treasurer
in surrendering said first named Bonds for those substituted therefor
is likewise approved.

RESOLUTION VACATING PARTS OF LOCUST STREET AND ROCK STREET
WHEREAS a petition for the vacation of certain parts of streets hereinafter
described, signed by more than one half of the property owners on the line
of the streets therein asked to be vacated, was presented to the City
Council of the City of Stillwater at a regular meeting held October, 6,
1942, and thereupon a resolution was duly adopted by the Council directing
that said petition be filed in the office of the City Clerk and that notice
thereof and of a hearing on said petition be given and published as provided
by the City Charter; and

WHEREAS a hearing as directed by said resolution and pursuant
to said notice and in accordance with the provisions of the City Charter
has been duly held by the Council at its regular meeting at the Council
Chamber in the City Hall in said City on the let day of December, 1942,
at 7.30 o'clock P.N. and no objections to said proposed vacation were
presented;
IT IS THEREFORE; RESOLVED BY THE COUNCIL OP THE CITY OF
STILLWATER that the following described parts of streets in the City of
Stillwater, County of Washington and State of Minnesota, be and the same
herebyare vacated absolutely and forever, to -wit;
All that part of Locust street in the Original Town, now
City of Stillwater and in Churchill and Nelson's Addition to Stillwater,
according to the respective surveys and plats thereof on file and of
record in the office of the Register of Deeds of said County, lying
between includingthe
theintersectionst line of ofhsaidadLocustnd the west line of Street and Rock street exceptstreet,
a strip twenty (20) feet in width, being Ten (10) feet on either side
of the center line of said Locust Street, commencing at said East line
of South Broadway end extending Easterly along said center line One
Hundred Seventy Five (175) feet; subject to the right of way of State
Trunk Highway dumber 212;
Also all that part of Rock Street lying North of the
routh line of Lot One (1) in Block Two (2) of said Churchill and Nelson'c
Addition to Stillwater, extended-asterly and South of the South line of
Locust Street.
IT IS FURTHER RESOLVED that the Council deems that
substantial P-nefite will accrue to the City from the vacation herein
provided for end that by reason of such public benefits said vacation
is ordered without the payment of any compensation therefor by any of
the property ownITS interested therein or
