RESOLUTION R0: 977
RESOLUTION DISCONTINUING APPROPRIATIONS FOR REST ROOM
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER that as of
January 1, 1939, all appropriations by the City for the maintenance
of the Public Heat Room in the City of Stillwater heretofore ordered
by the Council be discontinued; and the City Clerk is hereby directed
to make no further payments for or on account of such maintenance.

RESOLUTION N0. 978
RESOLUTION AUTHORIZING TUE ISSUAIICE OF CERTIFICATES OF
INDEBTEDNESS IN RENEWAL OF OUTSTANDING CERTIFICATES
WHEREAS the banks hereinafter named are the holders of certificates
of indebtedness Sseued by the City, all payable to the order of the bearer
on or before December, 31, 1938, with interest at 4% per annum, respectively
as follows;
First National Bank of Stillwater
Certificate No. 1 dated August, 3, 1939 for 04000.00
Certificate No. 4 dated October, 1, 1938 for 04000.00
Farmers & Merchants State Dank of Stillwater
Certificate No. 2 dated August, 16, 1938 for $4000,00
Cosmopolitan State Bank of Stillwater
Certificate No. 3 dated September, 1, 1938 for $4000.00;
and both the City and all of said banks desire to renew the principal of
all of said certificates, and all of said banks are willing to accept in
place thereof the new certificates to be issued as hereinafter provided;
BE IT THEREFORE RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER that
there shall be issued certificates of indebtedness of the City of
Stillwater in the total sum of Sixteen Thousand (16,000) Dollars in
anticipation of the payment of taxes levied for the General Fund of the
City of Stillwater in the year 1938. Said certificates shall be dated
December, 31, 1938, lettered and in amounts as follows;
Certificate A for Eight Thousand (8000) Dollars
Certificate 8 for Four Thousand (4000) Dollars
Certificate C for Hour Thousand (4000) Dollars
Said certificates A, B, and C shall be a general obligation
of the City; they shall be payable to the bearer on or before April, 15,
1939, with interest at Four (4) Percent per annum from date of issue until
paid, and shall be signed in the name of the City Ly its Mayor, sealed
with its corporate seal, and countersigned by its City Clerk.
Said certificates shall be forthwith disposed of as follows;
Certificate A shall be delivered to said First National Bank in renewal of,
and in place of, the principal amount of certificates Nos. 1 and 4 above
described.
Certificate B shall be delivered to said Farmers & Merchants State Dank in
renewal of, and In place of, the principal amount of certificate No. 2
above described.
Certificate C shall be delivered to said Cosmopolitan State Bank in renewal
of, and in place of, the principal amount of certificate No. 3 above described.
The delivery of said certificates shall be made by the City
Clerk, who shall at the time of delivery, take up said certificates Nos.1-
2-3 and 4.
BE IT FURT ER RESOLVED tnat all accumulated interest upon said v+
certificates Nos. 1-2-3-and 4, up to and including December, 31, 1937, be paid
at the time of delivery of said certificates A, B and C; and the City Clerk is
hereby authorized and directed to draw warrants upon the
City
� Treasurer accordingly.

RESOLUTION NO. 979
RESOLUTION AUTHORIZING THE ISSUANCE OF CERTIFICATES OF
INDEBTEDNESS.
RESOLVED DY THE COUNCIL OF THE CITY OF STILLWATER that there
shall be issued and sold certificates of indebtedness of the City of
Stillwater in the sum of Sixteen Thousand (16,000) Dollars in
anticipation of the payments of taxes levied for the General Fund of
the City of Stillwater in the year 1938.
Said certificates shall be numbered, dated and in amounts as follows;
Certificate No. 1 dated January, 16, 1939 for Four Thousand (4,000)
Dollars;
Certificate No. 2 dated February, 1, 1939 for Six Thousand (6,000)
Dollars;
Certificate No. 3 dated February, 16, 1939 for Six Thousand (6,000)
Dollars;
Said certificates shall be a general obligation of the City; they
shall be payable to the bearer on or before July, 31, 1939 with
interest at four (4) per cent per annum from date of issue until
paid, and shall be signed in the name of the City by its Mayor,
sealed with its corporate seal and countersigned by the City Clerk.
Said certificates shall be sold by the City Clerk on the respective
dates thereof, or as soon thereafter as possible, at par and
accrued interest.

RESOLUTION NO. 981
RESOLUTION AUTHORIZING THE LEASE OF THE SO-CALLED
RIVER TERMINAL PROPERTY
WHEREAS, City Officials authorized for the purpose and
representatives of the Industrial Contracting Company, a Minnesota
Corporation of Minneapolis have been negotiating together with respect
to a lease 'by the City for a term of Twenty (20) years with a renewal
option of an additional Twenty (20) years to said Industrial Contracting
Company of the so-called River Terminal Property on the West beak of the
St. Croix River in the City of Stillwater, and as a result of such
negotiations, a proposed agreement for such lease has been prepared by
said officials and representatives and ie now on file in the offioe of
the City Engineer and by reference hereto is hereby made a part hereof.
BE IT THEREFORE RESOLVED BY THE COUNCIL OF THE CITY OF
STILLWATER that the City enter into such proposed agreement with said
Industrial Contracting Company and the Mayor and City Clerk are hereby
authorized and directed on behalf of the City to execute such agreement.
BE IT FURTHER RESOLVED that a copy of such agreement be
published as a part of this resolution.

RESOLUTION NO. 982
RESOLUTION AUTHORIZING THE PURCHASE OF LAND
RESOLVED BY TEE COUNCIL OF THE CITY OF STILLWATER that the
City purchase from William M. Sumner° for a consideration of Five Hundred
Fifty (550) Dollars, the following described land situate in 'Washington
County, Minnesota;
Tract No. 1
All that part of the Southeast :,uarter of the Northwest 4uarter (SE9 of mil
of section number three (3) in Township number twenty nine (29) North, of Range
number twenty (20) West, described as follows; Beginning at the Southeast
corner of the above mentioned tract and running thence North along the East
line of said tract twenty (20) rods, more or less, to the South line of
Block number seven (7) of Beach's addition to Oak Park extended East fifty (50)
feet across First Street; thence Weat along said South line and South line
extended, three hundred twenty ore (321) feet, more or less, to the Southeast
aodirecter flinek h owitmber the Easttline of Block Beach's
number eightaddition;
(8) twenty (20)South
rods,
more or less, to the South line of said tract; thence Easterly along said
South line to the place of beginning, containing 2.4 acres, more or less; also
Tract No. 2
All that part of the Southwest quarter of the Northeast quarter (Sw2, of NEB) of section number three (3) in Township number twenty nine (29) North, of
Range number twenty (20) West, described as follows;
Beginning at the Southwest corner of the above mentioned tract and running
thence North along the West line of said tract twenty (20) rods; thence East
to the Centerline of the so-called Stillwater- Point Douglas Road(now
known as State Aid Road Number Three (3); thence Southerly along said center
line to a point where said centerline crosses the South line of the above
mentioned tract; thence Weat to the point of beginning, containing 0.5 acres,
more or less;
said consideration to be paid as soon as the grantor furnishes to the
City an abstract of title showing good title of record free from all
incumbrances to said real estate as of January, 31, 1939, to be in said
William M. Summers and accompanies said abstract with warranty deed from
the grantor and his wife to the City approved by the City Attorney.
And the City Clerk is hereby authorized and directed to draw
his warrant upon the City Treasurer accordingly.

RESOLUTIOI: DESIGI:ATII:O LEPOSITORIES FOR IU3LIC FUUDS
RESOLVED BY TILE COUI.CIL OF THE CITY OF STILLVATER;
1. That the following banks located in Stillwater are
hereby designated for a term ending December, 31, 1940, depositories of
public funds belonging to the City;
First National Bank in an amount not to exceed t,25,000.00
Cosmopolitan State Bank in an amount not to exceed 0_5,000.00
Farmers & Merchants State Bank in an amount not to exceed S15,000.00
2. That, before any deposits of any kind are made in any
of said banks, each of them desiring to receive such deposits, shall comply
with all the provisions of law pertaining to security to be given the City
for all deposits of public fluids.
3. that, should any depository elect to withdraw as a
depository at any time during said term, such depository may do so by
giving at least 15 days written notice to the City, addressed to the City
Clerk, of such election. Upon such withdrawal, the bond given by such
depository, if any has been given, shall be cancelled end the principal
and sureties thereon discharged, and the City Treasurer shall deliver to
such depository, all collateral securities given by it to secure the deposit
of hands of the City therein, but no bond shall be cancelled and no security
shall be returned until such depository has delivered to the City Treasurer
all moneys in its possession belonging to the City; should the City elect to
withdraw its designation of any such depository during said term, it may do
so by giving a similar notice of such election to the depository. Upon the
designation of any depository being so withdrawn, such depository shall
deliver to the City Treasurer, all funds belonging to the City in its
possession.

RESOLUTION FIXIING THE SALARY OF THE CITY ASSESSOR
RESOLVED BY THE COL'IICIL OF THE CITY OF STILL::ATER that the
salary of the City Assessor for the year 1939be, and the same hereby is,
fixed at the sum of Five Hundred (500) Dollars payable at the rate of One
Hundred (100) Dollars per month on the first days of April, May, June, July,
and August, 1939 respectively.
And the City Clerk 1s hereby authorized and directed to
draw warrants upon the City Treasurer accordingly.

probable expense of constructing a sewer in and along the center line of
North William Street, extending from a point 6.. feet Lorth of the center-
line of West Lllkin Street and along said centerline to a point 135 feet
Southerly therefrom, and fixing a time when the Council will meet to act
in relation to the doing of the proposed work and improvement.

extending from a point 6.5 feet North of the center line of West Wilkin

filed in the office of the City Clerk.
2. That Tuesday, the 28th day of February, 1939, at 7.30 o'clock P.M. be

Resolution approving plans, specifications and en estimate of the
probable expense of relaying sewer and installing surface water connections
in South Second Street between East Churchill Street and East Orleans Street,
and rescinding approval of plans as approved February, 7, 1939, and fixing a
time when the Council will meet to act in relation to the doing of the
proposed work and improvement.
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWLI:'i
1. That the plans, specifications end estimate for the proposed work of
relaying the sewer and installing surface water connections in and along
South Second Street from East Churchill street to East Orleans Street as
prepared by the City Engineer and presented to the Council for its
consideration and approval be, and the same are hereby approved and ordered
filed in the office of the City Clerk and be it further resolved that the
plan for constructing a new sewer in East Hancock Street between South First
Street and South Second Street as approved February, 7, 1939 be and the same
is hereby rescinded.

Resolution approving plans, specifications and an estimate of the
expense of sprinkling with water certain streets embraced within the boundaries
of Sprinkling District Number 14, and of sprinkling, treating or surfacing
with tar and gravel or crushed stone certain streets embraced within the
boundaries of Sprinkling District Number 16, and fixing a time when the
Council will meet to act in relation to the doing of the proposed work.
RESOLV1D BY THE COUNCIL OF THE CITY OF STILL::ATER;
1. That the plans, specifications and estimated cost of the proposed work
of sprinkling with water certain streets embraced within the boundaries of
Sprinkling District Number 14, and of sprinkling, treating or surfacing with tar
and gravel or crushed stone certain streets embraced within the boundaries
of Sprinkling District Number 16, as prepared by the City Engineer and
presented to the Council for its consideration and approval, be and the
same are hereby approved and ordered filed in the office of the City Clerk.
2. That Tuesday, the 4th day of April, 1939, at 7.30 o'clock P.M. be and is
hereby designated as the time when the Council will meet in the Council
Chamber at a regular meeting and act in relation to the doing of the proposed

1939 arid dividing said territory into sprinkling districts.
RESOLVED BY T!I COUNCIL 0p TIIE CITY OF STILLWATER;
1. That it is hereby determined that these portions of the hereinafter named
streets situated in that territory of the City of Stillwater embraced within
the boundaries of the several sprinkling districts hereinafter described shall
be sprinkled vith water, or sprinkled, treated or surfaced with tar and
gravel or crushed stone as hereinafter designated, during the year 1939
which territory is hereby divided into two sprinkling districts which are
and shall be numbered, bounded and described as follows;
Sprinkling District Number 14. To be sprinkled with water
Along N. and S. Main Street, from the N. line of Commercial Avenue to the N.
line of Nelson Street; along Union Street from the S. line of E. Myrtle
Street to the N. line of East Chestnut Street; along S. Second Street from

AND :ARBOR CONGRESS AND APPROPRIATING MONEY FOR EXPENSES
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER that the
Mayor and A. W. Eleinschnitz be authorized and directed to attend the
National River end Harbor Congress to be held at Washington, D. C.
March, 21, 22, 23 and 24, 1939, as representatives of the City, and as
such representatives, to use every effort possible to get the support of
the Congress in obtaining legislation from the Congress of the United
States favorable to the further development of the St. Croix River as an
artery of commerce in and out of Stillwater.
BE IT FURTHER RESOLVED that the sum of Three Hundred Fifty
(350) Dollars be appropriated from the General 'rand of the City to defray
the expenses of such representatives while traveling to and from and
attending said Congress; and the City Clerk is hereby authorized and
directed to draw a warrant upon the Treasurer in favor of the Mayor for

Stillwater and the Federal Works Progress Administration as a joint project,

RESOLUTION APPROVING PLANS, SPECIFICATIONS AND AN ESTIMATE OF
THE COST TO RELAY AND CONSTRUCT CURBS, SIDEWALK; APrD DRIVEWAYS.
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER;
1. That the plans, specifications and estimated cost to relay and.
construct curbs, sidewalks and driveways in and along North Second
Street, from Mulberry Street to a point that is 106 feet south of
the north line of Commercial Avenue, also in and along South Third
Street between Locust and Willard Streets, as prepared by the City
Engineer and presented to the Council for its consideration and
approval be, and the same are hereby approved and ordered filed in
the office of the City Clerk.
2. That Tuesday, the 5th day of September, 1939 at 7.30 o'clock P.M.
be and is hereby designated as the time when the Council will meet
in the Council Chamber at a regular meeting and act in relation to
the doing of the proposed work, and the City Clerk is hereby directed
to give notice of et.ch meeting in accordance with provisions of the
charter.

RESOLUTION PROVIDING FOR THE PAYMENT OF SPECIAL ASSESSMENTS
IN FIVE INSTALLMENTS LEVIED AGAINST REAL ESTATE BENEFITED TO DEFRAY
THE COST AND EXPENSE OF LOCAL IMPROVEMENTS NUMBERED 38- 39 and 40,
AS LISTED BELOW;
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER, that the
payments of Special Assessments levied cgainat real estate benefited
to defray the cost and expense arising from the grading and improving
East and West Orleans Street from Fourth Avenue South to South Fourth
Street and known as Local Improvement No. 38, and for grading and
improving South Fifth Street from West Willard Street to West Churchill
Street and known as Local Improvement No. 39, and for the construction
of a sewerin and along the center line of West Elm Street from North
William Street to North Owens Street and known as Local Improvement
No. 40, may be made in five installments, to be due on October, 1st,
of each year beginning with the year 1939, by the owner of, or any
person interested in any lot, part of lot or parcel of land against
which assessments have been levied, who shall elect in writing to
pay the same in five installments.
AND BE IT FURTITR RESOLVED that said installments shall
bear interest at the rate of six per cent per annum from the expiration
of thirty days after the publication of the notice required to be given
by the City Treasurer in accordance with Section 244 of the Charter of
the City of Stillwater.

• RESOLUTION AUTHORIZING THE ISSUANCE OF CETITIFICATES OF INDEBTEDNESS
RESOLVED BY THE COUNCIL OF THE CITY OF STILL'WATER that there shall be
issued and aold certificates of indebtedness of the City of Stillwater
in the sum of Twenty Thousand (20,000) Dollars in anticipation of the
payments of taxes levied for the General Fund of the City of Stillwater
in the year 1938.
Said certificates shall be numbered, dated and in amounts as follows;
Certificate No. 1 dated August, 2, 1939 for Eight Thousand (2,000) Dollars;
Certificate No. 2 dated August, 16, 1939 for Six Thousand (6,000) Dollars;
Certificate no. 3 dated September, 1, 1939 for Six Thousand (6,000) Dollars;
bald certificates shall be a general obligation of the City;
they shall be payable to the bearer on or before December, 31, 1939 with
interest at four (4) per cent per annum from date of issue until paid,
and shall be signed in the name of the City by its Mayor, sealed with its
corporate seal, and countersigned by the City Clerk.
Said certificatea shall be sold by the City Clerk on the
respective dates thereof, or as soon thereafter as possible, at par and
accrued interest.

RESOLUTION
WHEREAS no railroad track scales are located in the City of
Stillwater at the present time; and there are certain persons who
would like to ship coal for sale to the Minnesota State Prison St --
Stillwater and possibly others into Stillwater via the Mississippi
and St. Croix Rivers providing they can be assured of the use of
railroad traok scales at Stillwater after the barges containing such
coal arrive at the Stillwater river terminal; and the City is anxious
to encourage the development of coal shipping by water through the
Stillwater Barge Terminal;
THEREFORE BE IT RESOLVED BY PRE COUNCIL OF THE CITY OF STILLWATER
that providing the contract for the 1939-40 coal supply to the Minnesota
State Prison is awarded to persons who will ship the coal into Stillwater
via the Mississippi and St. Croix Rivers through the Stillwater Barge
Terminal, the City will assure such persons that a railroad track scales
for the weighing of such coal will be available for the use of such
shippers when said coal arrives at Stillwater.

RESOLUTION AUTHORIZING THE SALE OF REAL ESTATE
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER that the City
accept the offer of Robert Harrigan to pay One Hundred (100) Dollars for
Lots 'Twenty-two (22) and Twenty-three (2s) in Block Forty-two (42) of the
Original Town, now City, of Stillwater; and the proper officers of the
City are hereby authorized and instructed to execute for the City a
warranty deed conveying said real estate to said Robert Harrigan upon
the payment by him of said sum to the city treasurer.

OF SPRINKLING DIDTRICT NUMBER 16.
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER, that the payment
of the Special Assessments levied against real estate benefited to

tar and gravel or crushed rock, certain streets embraced within the
boundaries of Sprinkling District Number 16, may be made in three
installments, the first installment to be due on October, 10, 19a9,

installment to be due October, 1, 1941, by the owner of, or any
person interested in, any lot, part of lot or parcel of land against
which said assessments haves been levied, who shall elect in writing
to pay the same in three installments.

RESOLVED CY TTY: COUNCIL OF TEL CITY OF STILDI'.:TER;
1. That the plans, specifications and an estimate of the probable expense
have been prepared by the City engineer for relaying and constructing curbs,
sidewalks and driveways in and along North Second otreet from Mulberry
Street to a point that is 106' south of the north line of Commercial Avenue,
also in and along South Third Street, between locust and Willard streets, by
the City of Stillwater and the Federal Works Progress Administration as a
Joint project, whereby- the City agrees to furnish all materials required,
except cement, and to provide the necessary equipment and to direct the work
to completion, and whereby the Federal Works Progress Administration agrees
to furnish all the labor necessary and to pay the wages therefore, and to
provide all the cement required, and whereas said plans, specifications and
estimates have been presented to end approved by the City Council and the
Federal Works Progress Administration, it is hereby determined to proceed
with the work as above outlined.
2. Whereas the cost of materials to be provided by the City for the work as
thus outlined will be less than five hundred dollars it is hereby further
determined that the acceptance of formal bids will not be required.

for the weighing of coal upon its arrival at the so called River Terminal
providing the Minnesota State rrison awarded its 1939-1940 coal contract
to persons who would ship the coal into the prison by way of the 5t. Croix
River and through the Stillwater laver 'Terminal; and whereas the City
has just learned definitely that the i.iinnesota State Prison has awarded
its 1939-1940 coal contract to persons who will bring such coal into
Stillwater via the 5t. Croix River and over the ctillwater Terminal and
in accordance with said resolution passed Au5-ust, 28th, it now becomes
necessary for the City to provide the ::ailroad Track Scales contemplated

EREAS if the regular procedure for the buying and installation
of said scales provided in the charter of the City of Stillwater were
followed much time that is now very vital to the City's interests will
be lost, and the lateness of the season and the imminence of frost threatens
materially to hinder and delay the installation of such settles and there
is an urgent necessity for getting them installed immediately;
TT IS THEREFOR: :1%soLvED TH C9'uNTIL 01' THE CITY OF STILLWATER
that an emergency, oath respect to the quick acquisition and installation
of said scales, is hereby declared to exist in order to make certain that
such scales may be available for use before the St. Croix River freezes over
and can be installed before frost conditions render the work of installation
more onerous and expensive if the ordinary provisions of the Charter were
followed with respect to the purchase and installation of such scales.
IT IS FORT:ER RESOLVED that the City itigineer immedl-tely negotiate
for the purchase of suitable Railroad Track Scales, new or used, without
advertising for bids, the actual purchase of the seme to be approved by
the Council; and that the City nn-lneer make immediate arrangements for
the installation of said scales with any competent persons or person who
will do or supervise the work of installation at a total cost, in excess
of the purchase price of the scales, not to exceed Thirty-five hundred
(3500) Dollars, the actual contract for such installation to be approved
by the Council.
