RESOLVED 3Y THE CO74'CIL OF THE CITY OF STILL'WATER that there shall be issued and sold certificates of indebtedness of the City of Stillwater in the sum of Fifteen Thousand (15,000) Dollars in anticipation of the payments of taxes for the general fund of the City of Stillwater in the year 1937. Said certificates shall be numbered, dated, and in amounts as follows; Certificate No. 1 dated January, 16, 1938 for Three Thousand Five hundred 4,500.00) Dollars; Certificate So. 2 dated February, 1, 1938 for Four Thousand (4,000.00) Dollars; Certificate No. 3 dated February, 16, 1938 for Three Thousand Five Hundred (3,500.00) Dollars; Certificate No. 4 dated March, 1, 1938 for Four Thousand (4,000.00) Dollars. Said certificates shall be a .general hbligatlon of the City; they shall he payable to the hearer on or before April, 15, 1938 with interest at four (4) per cent per annum from date of issue until paid, and shall be signed in the name of the City by its Mayor, sealed with Sta corporate seal, and countersisned by the City Clerk. Said certificates shall he sold by tho City Clerk on the respective dates thereof, or as soon thereafter as possible, at par and accrued interest, Passed and approved January, 4, 1938. Willard to W. Churchill Streets, by the City of Stillwater and the Federal Works Progress Administration as a jo'nt project, whereby the City agrees to furnish all the materials required, except cement, end to provide the necessary equipment and to direct the work to completion, and whereby the Federal Works Progress Administration agrees to furnish all the labor necessary, and to pay the wages therefore, and to provide all the cement required, and whereas said plans, specifications and estimates have been presented to and approved by the City Council and the Federal Works Progress Administration, it is hereby determined to proceed under this resolution with that portion of said improvement involving only the grading, constructing curbs, sidewalks, mall and steps and the general improving of sa+d street and that portion of the work involving the surfacing with gravel and ter shell be executed by the City under provisions as set up and provided for Sprinkling District Number 16, under dates of March, 1st and April, 5th, 1938. 2. Schorl olio. etc. 12.15 1 esed en.' f rr I • cn C d s • • 3 • RESOLUTION N0. 946 RESOLUTION FOR IMPROVEUENPS AT LOWELL PARR Whereas under the trust created by Elmore Lowell by an instrument in writing dated August, 19 1933; the First National Bank of Stillwater as trustee is authorised to maintain, beautify andimproveLowell Park in the City of Stillwater and has sufficient Dumb -belonging to said trust to pay for the improvements herein contemplated; and Whereas, the Stillwater Perk Commission had filed in the office of the City -Engineer of this city certain plansandspecifications for the improvement of said Lowell Park and has recommended that said improvements be made,cand Whereas, the City of Stillwater approves of said project, and desires to have said improvements made as expeditiously as possible according to such plans and specifications, with such variations from or addition! thereto, as the Park Commission may, from time to time, approve and recommend. NOW THEREFORE, BE IT RESOLVED B4 THE CITY COUNCIL OF THE CITY OF STILLWATER, that the City of Stillwater and its proper officers be and they are hereby authorised and directed to enter into a contract or contracts with any competent person or persona for the carrying out of said improvement of Lowell Perk, upon the following terms and conditions; 1. That the City Clerk of the City of Stillwater, under the direction of the Stillwater Park Commission, Shall advertise for bids for the doing of said work, including work and materials, said bids to be submitted prior to -Nay, 7, 1938, all bids to be in writing, all bids to be accompanied by a contractor's -certified check, payabletothe order of the City, for 6% of the -total amount of each "bid, said check to be held by the City conditioned upon -his entering into a contract -with the City within five (6) days after the aoceptanee of his bid for the doingofthe work and furnishing of materials provided in said plane and specifications according to his bid. 2. That all OfSaid°entreat or -contracts -entered into for the construction of said improvement shall contain a provision that the contractor shall furnish a surety bond for the faithful performance of the contraot in the amount Of Said bid. 3i That said, City may -apportion said contract or any part thereof to one, two`or more eentractora,-and that the City of Stillwater may reject any or all bids and that any contract or contracts entered into pursuant thereto shall be subjecttothe approval in writing before execution thereof by the Stillwater Park Commission, end by the First National Bank of Stillwater, as trustee underSaidtrust. 4. That the total cost of said improvement as provided for in said contract or oontraota shall not exceed an amount of money agreed to be paid for such improvement by said First National Bank of Stillwater, as trustee. - 5. That before any bid or bide for the doing and completion of said work are accepted by the City of Stillwater, and contract or contraots entered into, the said First National Bank of Stillwater as trustee !ball file with the City Clerk of this City an agreement in writing satisfactory to the Counoil that it will pay thefullamount of money agreed to be paid for the doing of said work and the carrying out of said contract or contracts, and that the City of Stillwater shall not be required to pay any sum whatsoever therefor. Mayor RESOLUTION NO. 952 RESOLUTION CREATING A RECREATIONAL COMFITTEE RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER, that the Mayor appoint a commission of nine (9) citizens of the City to be known as a recreational commission to serve at the pleasure of the council. Such committee shall investigate recreational conditions in the City, advise with, and place before the Council its recommendations as to a playground and recreational program for the City for the year 1938 and to the extent hereinafter mentioned to provide such recreational equipment as said committee may think necessary. BE IT FURTHER RESOLVED that the sum of one hundred (100) dollars be donated from the general fund of the City to the committee to cover the coat of such equipment; and the City Clerk is hereby authorized and directed to draw his warrant on the City Treasurer accordingly. City Clerk Mayor RESOLUTIONI N0. 959 RESOLUTION FOR STATE RELIEF FUNDS TO BE USED ID SIX MONTHS. whereas, Governor Benson anticipating the relief needs of the State of Minnesota, urged the passage of a Q17,000,600 relief bill during the regular and special sessions of the legislature in 1937, and Whereas, in July 1937, the County Welfare Boards end County Commissioners assembled at St. Paul stated that their relief needs for the coming year were as much as or greater than they had been for the past year, and 'Whereas, the Senate dominated state legislature granted only Q11,100,000, and Whereas, by legislative action less than p2,750,000 is available for direct relief for the coming twelve months, and Whereas, the amount of State Relief Funds granted 'Washington County for the coming twelve months is far short of what this County must have, and Whereas, the Legislature meeting January, 1939, can pass a deficiency relief appropriation, Therefore be it resolved that we, the Council of the City of Stillwater of Washington County urge that the State Funds available for direct relief be spent in six months instead of twelve. Owens Street, by the City of Stillwater and the Federal Works Progress Administration as a joint project, whereby the City of Stillwater agrees to provide all the materials required and to prosecute and direct the work to its completion, and whereby the Federal Works Progress Administration agrees to supply all the labor necessary and to pay the wages therefor, and whereas the said plans, specifications and estimated expense thereof have been presented to and approved by the City Council and the Federal Works Progress Administration, that it is hereby determined to prose& with the work of constructing said sewer as heretofore outlined and described. z. That the City Clerk is hereby directed to advertise for bids in accordance with the provisions of the Charter, returnable at an adjourned meeting of the Council to be held in the Council Chamber, in the City Nall, on Tuesday, the 27th day of September, 1938, at 9 o'clock A. A. Lawkinson and Associates and now on file in the office of the City Engineer. 2. That the doing of all things authorized to be done pursuant to this resolution is contingent upon the obtaining by the City from the Federal Emergency Administration of Public "+orks of a free grant of sufficient moneys to pay forty-five (45) percent of the total cost of acquiring and constructing said plant end system including an intercepter sewer, municipal sanitation plant and sludge and garbage disposal plant. 3. That the balance of the total cost of acquiring and constructing said plant and system is to be paid from the proceeds of the sale of revenue bonds, so called, to be issued by the City in a total amount not to exceed Two Hundred Fifty Thousand (a250,000) Dollars. .Said bonds shall be payable to the bearer in such denominations as the Council may fix; they shall draw interest at the rate of Four (4) percent per annum, payable semi-annually on dates to be fixed b' the Council, they shall become due and payable over a period of Thirty (30) years from the date of issue and shall be retired serially in equal annual installments, the first installment to become due and payable two years after date of issue. A11 of such bonds shall be issued and sold strictly in accordance with the laws of +uinnesota and the provisions of the charter of the ,ity of ltillwater applicable thereto. 4. 'hat all of such bonds shall be retired solely from rents or charges to be made to the persons, firms, or corporations whose premises are served by suoji .plant and system directly or indirectly, in accordance with the provisions of chapter 221 of the session Laws of Minnesota for 1965. 5.
