Tripp Lite Uniforms Unlimited Xerox Corporation Flags Publications Services Supplies Supplies Supplies Supplies Supplies Adopted by the Council this 9th day of January, 1968 Published: January 19, 1968 Attest: City Clerk 80.00 345.80 9.55 27.29 274.01 152.69 144.22 121.86 .Aayor • • • 201 , RESOLUTION NO. 4043 RESOLUTION VACATING A PART OF WILLOW STREET WHEREAS, at a meeting of this Council held on the 14th day of November, 1967, a petition was presented praying for the vacation of a part of Willow Street in the City of Stillwater hereinafter described; and WHEREAS, at said meeting the Council did, after due consideration, deem it ex- pedient to proceed with said matter and did order the said petition to be filed in the office of the City Clerk; and WHEREAS. the City Clerk did thereupon and thereafter give notice by publication in the Stillwater Evening Gazette, official newspaper of the City, for four successive weeks beginning on Friday, November 17, 1967, and thereafter on Fri- day of each week to and including December 8, 1967, to the effect that said petition had been filed as aforesaid and stating concisely its objects and that said petition would be heard and considered bythe he e9Cothuncil oatDthemMune ,cipalal Building in the City of Stillwater, Minnesota, on at 7:30 o'clock P.M.; and WHEREAS, at the time and place appointed in said notice, the Council at a duly called and held meeting thereof, did investigate and consider said mattes and did hear the testimony and evidence on the part of all parties interested, at which meeting and hearing there was no opposition to said vacation; WHEREAS, said matter was laid over and continued and pursuant to adjournment came before the council for further consideration at a meeting duly calledand held at the Municipal Building in said City on the 9th day of January, whereat the Council determined that the vacation of said part of Willow Street is in the public interest; NOW,THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that the said petition be and the same is hereby granted and that the following part of said street as presently laid out and dedicated in said City be, and the same is hereby vacated, absolutely and forever, viz: All of West Willow Street currently platted but undeveloped between the east line of Fourth Street to the West line of Third Street. BE IT FURTHER RESOLVED, that the Council deems substantial benefits will ac- crue to the City from the vacation of that part of said street as herein pro- vided, and the public benefits will be such that said vacation is hereby ordered without payment of compensation; BE IT ALSO FURTHER RESOLVED, that upon publication of this resolution accord- ing to law, a transcript thereof, together with a duplicate of the plat show- ing the part of said public street vacated hereby, certified by the City Clerk, shall be filed for record and recorded in the office of the Register of Deeds, of Washington County, Minnesota. Adopted by the affirmative vote of all members of the Council this 9th day of January, 1968. published: January 19, 1968 Mayor Attest: • • • • • RESOLUTION NO. 4044 RESOLUTION CONFIRMING APPOINTMENT OF POLICE OFFICERS BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that the appointment of David Knefelkamp and Donald L. Beberg as police officershof the City for a 1nery be, andlod of the sametis°hereby,six , confirmed; months, commencing January 1, 1968, that as such police the said David Knefelkamp and Donald L. Beberg shall have the powers of police officers at common law or under the laws of the State of Minnesota, and it shall be their duties to serve warrants, summons, writs, subpoenas or other process issued by the Washington County Municipal Court ,0 command the peace, suppress rioting or disorderly conduct within the city and to arrest, with or without a warrant, as authorized by the laws of this State, persons charged with the commission of any public of- fense under the laws of the State of Minnesota or the ordinances of the City, and to perform any and all other duties incidental to the office of a policeman as directed by the Mayor, City Administrator or the Chief of Police: and that the said David Knefelkamp and Donald L. Beberg, shall re- ceive as compensation for services rendered as such police officers the sum of $520.00 per month. The assessment roll heretofore duly prepared for reassessment of certain parcels of land included in Parking Facilities Improvement, and now on file in the office of the City Clerk, is hereby approved as proposed assessments for said improvement, and this Council shall meet athe munci- 7ic0 pal Building in said City on Tuesday, the 6th day of February, 19a o'clock P.M. for the purpose of passing upon said assessments and hearing all objections thereto. 2. The City Clerk is hereby authorized and directed to cause notice of said meeting to be published in the Stillwater Evening Gazette, the official newspaper of this municipality, and to be mailed to the owner of each parcel of land described in said assessment roll, at least two weeks before the date of said meeting. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Still- water does hereby request and urge the Washington County Board of Commis- sioners to proceed with all deliberate haste to implement the authority given them by the 1967 Minnesota Legislature to secure and operate garbage and refuse disposal facilities. Adopted by the Council this 6th day of February, 1968 Published February 13, 1968 Mayor Attest Deputy C' y Clerk RESOLUTION NO. 4054 RESOLUTION CONFIRMING APPOINTMENT OF FIREMAN BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that the following named person, heretofore appointed as a fireman the City for a period of six months by resolution adopted July 11, 1967, be, and he is hereby appointed as a regular fireman: John Clarey; and that said appointment shall be effective from and after January 16, 1968. As compensation for services rendered as such fireman, the said John Clarey shall receive the sum of $520.00 per month, together with all other benefits of employment in the Fire Department of the City. WHEREAS, pursuant to proper notice duly given as required by law, the Council has met and heard and passed upon all objections to the proposed assessment for installation of watermain in North Owen Street from West Wi.lken Street to West Sycamore Street: NOW,THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota: 1. That such proposed assessment is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of ten (10) years, the first of the installments to be payable on the first Monday in January, 1969 and shall bear interest at the rate of six (6) percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1969. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property to assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; he may thereafter pay to the County Treasurer the installment and interest in process of collection on the current tax list and he may pay the remaining principal balance of the assessment to the City Treasurer. 4. The Clerk shall file the assessment roll pertaining to this assessment in his office and shall certify annually to the County Auditor on or before October 10 of each year the total amount of installments and interest which are to be due in the following year on the assessment on each parcel of land included in the assessment roll. BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that the bid of Internaional Salt Co., 228 North La Salle Street, Chicago, Illinois in the amount of $24.20 per ton and the bid of Cutler -Magner Company, Ddluth, Minnesota in the amount of $19.40 per ton which were receioed in the response to the City's call for bids for the furnishing of sixty (60) tons of C. C. Rock Salt or equal for the year 1968, and the same are hereby, rejected. Adopted by the Council this 13th day of February, 1968 Published: February 19, 1968 Mayor RESOLUTION NO. 4060 RESOLUTION ACCEPTING BID AND AUTHORIZING EXECUTION OF CONTRACT. BE IT RESOLVED, by the City Council of the City of Stillwater. Minnesota, that the bid of Stillwater Motor Company, Stillwater, Minnesota, in the amount of $2,625.00, for the sale and delivery to the City of a new 1968 Chevrolet Pickup Truck, which bid is hereby found to be the lowest responsible bid meeting specifications be, and the same is hereby accepted; and the Mayor and the City Clerk are hereby authorized and directed to enter into a contracc on behalf of the City with the said Stillwater Motor Company for the purchase of said 1968 Chevrolet Pickup Truck, said contract to be in accordance with the specifications and the proposal of the bidder which are on file in the office of the City Clerk. Published: February 20, 1968 Mayor Attest: Jtv Deputy City Clerk 211. • • • RESOLUTION NO. 4061 RESOLUTION ADOPTING RE -ASSESSMENT OF PARKING FACILITIES. BE IT RESOLVED, by the City Council of the city of Stillwater, Minnesota as follows: 1. That the amount proper and necessary to be specially re -assessed at this time for parking lot improvement against those parcels of property for which assessments had previously been vacated by the District Court of Washington County and which are now being re -assessed have been duly cal- culated on the basis of benefits without regard to cash valuation, in accordance with provisions of Minnesota Statutes Chapter 429 and Chapter 459.14 and notice has been duly published and mailed as required by law that this Council would meet to hear, consider and pass upon all objections, if any, and said proposed assessment has at all times since its filing been open for public inspection and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessments. 2. This Council, having heard and considered all objections so presented and being fully advised in the premises, finds that each of the lots, pieces and parcels of land enumerated in the proposed assessment was and is specially benefited by the construction of said improvement in not less than the amount of the assessment set opposite the description of each such lot, piece and parcel of land, and such amount so set out is hereby levied against each of the respec- tive lots, pieces and parcels of land therein described. 3. That each of said parcels is determined by the Council to constitute a separate benefit district and a different rate of assessment has accordingly been assigned by the Council, taking into consideration the improvements on the land and the present and potential use of the respective lots, pieces or parcels during the anticipated period of usefulness of the facility providing the benefits and further considering the proximity of each respective piece and parcel of land to the improvement for which said assessment is levied. 4. The assessment against each parcel, together with interest at the rate of six per cent (6%) per annum accruing on the full amount thereof from time to time unpaid, shall be a lien concurrent with general taxes upon such parcel and all thereof. The total amount of each such assessment shall be payable in equal annual principal installments extending over a period of fifteen (15) years, the first of said installments, together with interest on the entire assessment from the date hereof to December 31, 1969 to be collec- tible with general taxes in the year 1969 and one of each of the remaining installments, together with one year's interest on that and all other unpaid installments, to be payable with general taxes in each consecutive year there- after until the entire assessment is paid. 5. Prior to certification of the assessment to the County Auditor, the owner of any lot, piece or pacel of land assessed hereby may at any time pay the whole or such assessment. with interest to the date of payment, to the City Treasurer, but no interest shall be charged if such payment is madd within thirty (30) days after the date of this resolution. 6. The. City Clerk shall, as soon as may be, prepare and transmit to the County Auditor a certified duplicate of the assessment roll, with each install- ment and interest on each unpaid assessment set forth separately, to be extended upon the proper tax lists of the county, and the County Auditor shall thereafter collect said assessments in the manner provided by law. BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that R-solution No. 3026 of said City dated the loth day of March, 1967 Designating Depositories of Public Funds is amended to provide that each of the depositories named therein to -wit: The First National Bank of Stillwater, Minnesota; The Farmers and Merchants State Bank of Stillwater, Minnesota; and the Cosmopolitan State Bank of Stillwater, Minnesota; are authorized as depositories in sums not to exceed the aggregate of One Million (S1,000,000.00) Dollars at any one time in each of the said depositories upon the terms and conditions set forth in said Resolution No. 3026; that said Resolution No. 3026, be, and hereby is confirmed in all other respects. WHEREAS, at a meeting of this Council held on the 12th day of March, 1968, a petition was presented praying for the vacation of a portion of South Third Street in the City of Stillwater hereinafter described; and WHEREAS, at said meeting the Council did, after due consideration, deem it expedient to proceed with said matter and did order the said petition to be filed in the office of the City Clerk; and WHEREAS, the City Clerk did thereupon and thereafter give notice by publication in the Stillwater Evening Gazette, official newspaper of the City, for four successive weeks beginning on March 15, 1968, and thereafter on Friday of each week to and including April 5, 1968, to the effect that said petition had been filed as aforesaid and stating concisely its objects and that said petition would be heard and considered by the Council at the Municipal Building in the City of Stillwater, Minnesota, on the 16th day of April, 1968, at 7:30 o'clock P. Said bonds shall be printed under the direction of the City Clerk and shall be executed on behalf of the City by the manual signature of the Mayor, attested by the manual signature of the City Clerk, and the corporate seal of the City shall be affixed thereto. On the reverse side of each bond shall be printed a copy of the legal opinion rendered by bond counsel, authenticated by the certificate and facsimile signatures of the Mayor and City Clerk. The interest coupons appurtenant to each bond shall be executed and authenticated by the printed, engrave or lithographed facsimile signatures of the Mayor'and City Clerk. When the bonds have been so executed and authen- ticated, the City Treasurer shall cause them to be delivered to the purchaser upon receipt of the purchase price heretofore agreed upon, and the purchaser shall not be' obligated to see to the application of the purchase price. 6. There are hereby created "separate and special improvement funds for each of the improvements described in paragraph 1".of Resolution No. 4161, adopted onNovember19, 1968, each such fund to be held and administered by the City Treasurer separate and apart from all other funds of the City. The proceeds of sale of the :improvement bonds herein authorized less the accrued interest received upon delivery, and less such portion of thepurchase price which exceeds $220,600, shall .be credited and paid into said funds in the amount of the estimated cost of each improvement stated in paragraph 1 hereof. There shall also be credited to each fund, until completion of the improvement on account of which it was created, all collections of special assessments levied to "pay the cost of such. improvement. The moneys on hand in each fund shall be used .solely to defray the expense of constructing the improvement on account of which it was created, and to pay principal of and interest on the improvement bonds herein authorized. Upon the completion of each "improvement and ;payment of all the costs thereof, any balance of bond proceeds remaining in the fund pertaining thereto may be transferred by the Councsl to the fund" of any other improvement instituted under MS.SA., Chapter 429.
