RESOLUTION NO. 4043
RESOLUTION VACATING A PART OF WILLOW STREET
WHEREAS, at a meeting of this Council held on the 14th day of November, 1967,
a petition was presented praying for the vacation of a part of Willow Street
in the City of Stillwater hereinafter described; and
WHEREAS, at said meeting the Council did, after due consideration, deem it ex-
pedient to proceed with said matter and did order the said petition to be filed
in the office of the City Clerk; and
WHEREAS. the City Clerk did thereupon and thereafter give notice by publication
in the Stillwater Evening Gazette, official newspaper of the City, for four
successive weeks beginning on Friday, November 17, 1967, and thereafter on Fri-
day of each week to and including December 8, 1967, to the effect that said
petition had been filed as aforesaid and stating concisely its objects and
that said petition would be heard and considered

at 7:30 o'clock P.M.; and
WHEREAS, at the time and place appointed in said notice, the Council at a duly
called and held meeting thereof, did investigate and consider said mattes and
did hear the testimony and evidence on the part of all parties interested, at
which meeting and hearing there was no opposition to said vacation;
WHEREAS, said matter was laid over and continued and pursuant to adjournment
came before the council for further consideration at a meeting duly calledand
held at the Municipal Building in said City on the 9th day of January,
whereat the Council determined that the vacation of said part of Willow Street
is in the public interest;
NOW,THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota, that the said petition be and the same is hereby granted and that
the following part of said street as presently laid out and dedicated in said
City be, and the same is hereby vacated, absolutely and forever, viz:
All of West Willow Street currently platted but undeveloped between
the east line of Fourth Street to the West line of Third Street.
BE IT FURTHER RESOLVED, that the Council deems substantial benefits will ac-
crue to the City from the vacation of that part of said street as herein pro-
vided, and the public benefits will be such that said vacation is hereby
ordered without payment of compensation;
BE IT ALSO FURTHER RESOLVED, that upon publication of this resolution accord-
ing to law, a transcript thereof, together with a duplicate of the plat show-
ing the part of said public street vacated hereby, certified by the City Clerk,
shall be filed for record and recorded in the office of the Register of Deeds,
of Washington County, Minnesota.

RESOLUTION CONFIRMING APPOINTMENT OF POLICE OFFICERS
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that the appointment of David Knefelkamp and Donald L. Beberg as police
officershof the City for a 1nery be, andlod of the sametis°hereby,six

that as such police the said David Knefelkamp and Donald L. Beberg shall
have the powers of police officers at common law or under the laws of the
State of Minnesota, and it shall be their duties to serve warrants, summons,
writs, subpoenas or other process issued by the Washington County Municipal
Court ,0 command the peace, suppress rioting or disorderly conduct within
the city and to arrest, with or without a warrant, as authorized by the
laws of this State, persons charged with the commission of any public of-
fense under the laws of the State of Minnesota or the ordinances of the
City, and to perform any and all other duties incidental to the office of
a policeman as directed by the Mayor, City Administrator or the Chief of
Police: and that the said David Knefelkamp and Donald L. Beberg, shall re-
ceive as compensation for services rendered as such police officers the
sum of $520.00 per month.

RESOLUTION NO. 4045
RESOLUTION FOR RE -ASSESSMENT OF PARKING FACILITIES IMPROVEMENT
BE IT RESOLVED by the City Council of the City of Stillwater, Minnesota, as
follows:
1. The assessment roll heretofore duly prepared for reassessment of
certain parcels of land included in Parking Facilities Improvement, and
now on file in the office of the City Clerk, is hereby approved as proposed
assessments for said improvement, and this Council shall meet athe

pal Building in said City on Tuesday, the 6th day of February, 19a
o'clock P.M. for the purpose of passing upon said assessments and hearing all
objections thereto.
2. The City Clerk is hereby authorized and directed to cause notice of
said meeting to be published in the Stillwater Evening Gazette, the official
newspaper of this municipality, and to be mailed to the owner of each parcel
of land described in said assessment roll, at least two weeks before the date
of said meeting.

RESOLUTION NO. 4048
WHEREAS, the 1967 Legislature of the State of Minnesota authorized the
acquisition by the County of Washington of sites and facilities for gar-
bage and refuse disposal, and
WHEREAS, the City of Stillwater and other communities within the County
are faced with an emergency situation relative to such dump facilities;.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Still-
water does hereby request and urge the Washington County Board of Commis-
sioners to proceed with all deliberate haste to implement the authority
given them by the 1967 Minnesota Legislature to secure and operate garbage
and refuse disposal facilities.

RESOLUTION APPROPRIATING FUNDS TO STILLWATER ARMORY BOARD
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that under and pursuant to the provisions of Minnesota Statutes 193.35 the
sum of Two Hundred Fifty ($250.00) Dollars be, and the same is hereby appro-
priated to the Stillwater ArmoryBoard for use in maintaining and equipping
the Armory, located in the City, during the year 1967; and that a warrant

RESOLUTION FIXING COMPENSATION OF DRAFTSMAN -SURVEYOR
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that the compensation of James Dahlin, draftsman -surveyor, be increased
from the sum of $580.00 to $590.00 per month: said increase to be effective
from and after February 1, 1968.

RESOLUTION NO. 4054
RESOLUTION CONFIRMING APPOINTMENT OF FIREMAN
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that the following named person, heretofore appointed as a fireman
the City for a period of six months by resolution adopted July 11, 1967,
be, and he is hereby appointed as a regular fireman:
John Clarey;
and that said appointment shall be effective from and after January 16,
1968. As compensation for services rendered as such fireman, the said
John Clarey shall receive the sum of $520.00 per month, together with all
other benefits of employment in the Fire Department of the City.

RESOLUTION NO 4055
RESOLUTION PROHIBITING PARKING IN CERTAIN AREAS
WHEREAS, it has come to the attention of the City Council that due to the
�-.. location of the County Court Building on South Fourth Street
nthe both City of
Stillwater and the parking which has resulted therefrom, parking
sides of the street in this area has obstructed the, normal flow of traffic:
NOW, THEREFORE, BE IT RESOLVED, that the City Engineer is hereby directed
and instructed to erect "No Parking" signs on the South side of Pine Street
from its intersection with the West line of Fourth Street west for a dis-
tance of 150 feet, and that from and after the passage and publication of
this resolution and the erection of said signs it shall be unlawful to park
in the area described.

RESOLUTION NO. 4058
RESOLUTION ADOPTING ASSESSMENT LOCAL IMPROVEMENT NO. 65-66.
WHEREAS, pursuant to proper notice duly given as required by law, the
Council has met and heard and passed upon all objections to the proposed
assessment for installation of watermain in North Owen Street from West
Wi.lken Street to West Sycamore Street:
NOW,THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota:
1. That such proposed assessment is hereby accepted and shall constitute
the special assessment against the lands named therein, and each tract of land
therein included hereby found to be benefited by the proposed improvement in
the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments
extending over a period of ten (10) years, the first of the installments
to be payable on the first Monday in January, 1969 and shall bear interest
at the rate of six (6) percent per annum from the date of the adoption of
this assessment resolution. To the first installment shall be added interest
on the entire assessment from the date of this resolution until December 31,
1969. To each subsequent installment when due shall be added interest for one
year on all unpaid installments.
3. The owner of any property to assessed may, at any time prior to
certification of the assessment to the County Auditor, pay the whole of the
assessment on such property, with interest accrued to the date of payment, to
the City Treasurer, except that no interest shall be charged if the entire
assessment is paid within 30 days from the adoption of this resolution; he may
thereafter pay to the County Treasurer the installment and interest in process
of collection on the current tax list and he may pay the remaining principal
balance of the assessment to the City Treasurer.
4. The Clerk shall file the assessment roll pertaining to this assessment
in his office and shall certify annually to the County Auditor on or before
October 10 of each year the total amount of installments and interest which are
to be due in the following year on the assessment on each parcel of land included
in the assessment roll.

RESOLUTION NO. 4059
RESOLUTION REJECTING BIDS ON FURNISHING OF ROCK SALT.
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that the bid of Internaional Salt Co., 228 North La Salle Street, Chicago,
Illinois in the amount of $24.20 per ton and the bid of Cutler -Magner Company,
Ddluth, Minnesota in the amount of $19.40 per ton which were receioed in the
response to the City's call for bids for the furnishing of sixty (60) tons
of C. C. Rock Salt or equal for the year 1968, and the same are hereby,
rejected.

RESOLUTION NO. 4060
RESOLUTION ACCEPTING BID AND AUTHORIZING EXECUTION OF CONTRACT.
BE IT RESOLVED, by the City Council of the City of Stillwater. Minnesota,
that the bid of Stillwater Motor Company, Stillwater, Minnesota, in the amount
of $2,625.00, for the sale and delivery to the City of a new 1968 Chevrolet
Pickup Truck, which bid is hereby found to be the lowest responsible bid meeting
specifications be, and the same is hereby accepted; and the Mayor and the City
Clerk are hereby authorized and directed to enter into a contracc on behalf of
the City with the said Stillwater Motor Company for the purchase of said 1968
Chevrolet Pickup Truck, said contract to be in accordance with the specifications
and the proposal of the bidder which are on file in the office of the City Clerk.

RESOLUTION NO. 4061
RESOLUTION ADOPTING RE -ASSESSMENT OF PARKING FACILITIES.
BE IT RESOLVED, by the City Council of the city of Stillwater, Minnesota
as follows:
1. That the amount proper and necessary to be specially re -assessed
at this time for parking lot improvement against those parcels of property
for which assessments had previously been vacated by the District Court of
Washington County and which are now being re -assessed have been duly cal-
culated on the basis of benefits without regard to cash valuation, in
accordance with provisions of Minnesota Statutes Chapter 429 and Chapter
459.14 and notice has been duly published and mailed as required by law
that this Council would meet to hear, consider and pass upon all objections,
if any, and said proposed assessment has at all times since its filing been
open for public inspection and an opportunity has been given to all interested
persons to present their objections, if any, to such proposed assessments.
2. This Council, having heard and considered all objections so presented
and being fully advised in the premises, finds that each of the lots, pieces
and parcels of land enumerated in the proposed assessment was and is specially
benefited by the construction of said improvement in not less than the amount
of the assessment set opposite the description of each such lot, piece and parcel
of land, and such amount so set out is hereby levied against each of the respec-
tive lots, pieces and parcels of land therein described.
3. That each of said parcels is determined by the Council to constitute
a separate benefit district and a different rate of assessment has accordingly
been assigned by the Council, taking into consideration the improvements on
the land and the present and potential use of the respective lots, pieces or
parcels during the anticipated period of usefulness of the facility providing
the benefits and further considering the proximity of each respective piece and
parcel of land to the improvement for which said assessment is levied.
4. The assessment against each parcel, together with interest at the
rate of six per cent (6%) per annum accruing on the full amount thereof from
time to time unpaid, shall be a lien concurrent with general taxes upon such
parcel and all thereof. The total amount of each such assessment shall be
payable in equal annual principal installments extending over a period of
fifteen (15) years, the first of said installments, together with interest on
the entire assessment from the date hereof to December 31, 1969 to be collec-
tible with general taxes in the year 1969 and one of each of the remaining
installments, together with one year's interest on that and all other unpaid
installments, to be payable with general taxes in each consecutive year there-
after until the entire assessment is paid.
5. Prior to certification of the assessment to the County Auditor, the
owner of any lot, piece or pacel of land assessed hereby may at any time pay
the whole or such assessment. with interest to the date of payment, to the City
Treasurer, but no interest shall be charged if such payment is madd within
thirty (30) days after the date of this resolution.
6. The. City Clerk shall, as soon as may be, prepare and transmit to the
County Auditor a certified duplicate of the assessment roll, with each install-
ment and interest on each unpaid assessment set forth separately, to be extended
upon the proper tax lists of the county, and the County Auditor shall thereafter
collect said assessments in the manner provided by law.

RESOLUTION AMENDING RESOLUTION NO. 3026.
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that R-solution No. 3026 of said City dated the loth day of March, 1967
Designating Depositories of Public Funds is amended to provide that each
of the depositories named therein to -wit:
The First National Bank of Stillwater, Minnesota; The Farmers
and Merchants State Bank of Stillwater, Minnesota; and the
Cosmopolitan State Bank of Stillwater, Minnesota;
are authorized as depositories in sums not to exceed the aggregate of One
Million (S1,000,000.00) Dollars at any one time in each of the said depositories
upon the terms and conditions set forth in said Resolution No. 3026; that said
Resolution No. 3026, be, and hereby is confirmed in all other respects.

RESOLUTION NO. 4068
RESOLUTION ACCEPTING PETITION AND ORDERING PREPARATION OF PRELIMINARY REPORT
WHEREAS, a petition was presented by several property owners: and said peti-
tion was found to be adequate and was accepted by the Council, and it has
been proposed to construct the following described improvements and to assess
the benefited property for all or a portion of the cost thereof, viz:
Installation of sewer and water extension in an extension of Pine
Tree Trail in the Northeast Quarter (NE4) of Section Thirty-two
(32), Township Thirty (30) North, Range Twenty (20) West.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota, that the said proposed improvement be referred to the City Engineer
for study and report; advising the Council in a preliminary way as to whether
the proposed improvement is feasible and as to whether it should be made as
proposed or in connection with some other improvement, and the estimated cost
of the improvement as recommended.

WHEREAS, the bid of Sanitary Landfill for garbage and rubbish pickup in the
City of Stillwater in the amount of $2.20 per unit per month for rear yard
pickup is determined to be the low bid for this service and is determined
to comply with the specifications as submitted.
NOW, THEREFORE, BE PT RESOLVED, by the City Council of the City of Stillwater.
Minnesota that the contract for this service is awarded to Sanitary Landfill
and the Mayor and City Clerk are hereby authorized and directed to enter into
a contract on behalf of the City with said Sanitary Landfill for this service

RESOLUTION NO. 4082
RESOLUTION ALTERING BOUNDARY OF PRECINCTS
BE IT RESOLVED, by the City Council of the City of Stillwater. Minnesota,
hereafter for election purposes the First Ward of the City shall constitute
two election precincts which shall be bounded and described as follows, to wit:
FIRST WARD:
FIRST PRECINCT - All that part of the City lying within the boundaries of a line
drawn as follows: Beginning at a point on the shore of Lake St. Croix where the
center line of Nelson Street extended strikes said Lake Shore, and running thence
westerly along said center line of Belson Street to the center line of Second
Street; thence Southerly along said center line of Second Street to the center
line of Pine Street: thence Westerly along the center line of Pine Street to the
center line of Fifth Street: thence along the center line of Fifth Street to the
South City Limits.
SECOND PRECINCT - All that part of the City lying west of the center line of
Fifth Street and South of the center line of Pine Street to the West line of the
Southwest Quarter of the Southeast Quarter (SW% of SEA) of Section Twenty nine (29),
Township Thirty (30) Range Twenty (20), Thence South along the West line of the
Southwest Quarter of the Southeast Quarter (SA of SEA) of Section Twenty -Nine (29),
Township Thirty (30) North, Range Twenty (20) West; thence Westerly along the
North Line of Section Thirty -One (31) and Thirty -Two (32), Township Thirty (30)

BE IT FURTHER RESOLVED, that the boundaries of election precincts in the Second

RESOLUTION NO. 4084
RESOLUTION VACATING A PART OF SOUTH THIRD STREET.
WHEREAS, at a meeting of this Council held on the 12th day of March, 1968, a
petition was presented praying for the vacation of a portion of South Third
Street in the City of Stillwater hereinafter described; and
WHEREAS, at said meeting the Council did, after due consideration, deem it
expedient to proceed with said matter and did order the said petition to be
filed in the office of the City Clerk; and
WHEREAS, the City Clerk did thereupon and thereafter give notice by publication
in the Stillwater Evening Gazette, official newspaper of the City, for four
successive weeks beginning on March 15, 1968, and thereafter on Friday of each
week to and including April 5, 1968, to the effect that said petition had been
filed as aforesaid and stating concisely its objects and that said petition would
be heard and considered by the Council at the Municipal Building in the City
of Stillwater, Minnesota, on the 16th day of April, 1968, at 7:30 o'clock P. M.;
and
WHEREAS, at the tine and place appointed in said notice the Council at a duly
called and held meeting thereof, did investigate and consider said matter and
did hear the testimony and evidence on the part of all parties interested, at
which meeting and hearing there was no opposition to said vacation;
WHEREAS, said matter was laid over and continued and pursuant to adjournment
came before the council for further consideration at a meeting duly called and
held at the Municipal Building in said City on the 18th day of April, 1968,
where at the Council determined that the vacation of said part of South Third
Street is in the public interest;
NOW, THEREFORE, BE IT RESOLVED. by the City Council of the City of Stillwater,
Minnesota, that the said petition be and the same is hereby granted and that the
following part of said street as presently laid out and dedicated in said City
be, and the same is hereby vacated, absolutely and forever, viz:
A11 of that part of South Third Street from West Grove Street to
West Prairie Street, which lies between Block Thirteen (13) and
Fourteen (14) Webster's Third Addition as annexed to the City of
Stillwater as plotted and on record in the County Courthouse.
BE IT FURTHER RESOLVED. that the Council deems substantial benefits will accrue
to the City from the vacation of that part of said street as herein provided,
and the public benefits will be such that said vacation is hereby ordered without
payment of compensation;
BE IT ALSO FURTHER RESOLVED, that upon publication of this resolution according

on the 21st day of May, 1968, the following Resolution was offered by Councilman
Melstrom; seconded by Councilman wohlers; to+,wit:
WHEREAS, the Commissioner of Highways has prepared plans, special provisions and
specifications for the improvement of a part of Trunk Highway Number 45 renumbered
as [:Trunk Highway Number 212 within the corporate limits of the City of Stillwatet
from the Engineer's Station 641+75 to So. Corp. limits; and
WHEREAS, said plans are on file in the office of the Department of Highways, Saint
Paul, Minnesota, being marked, labeled, and identified as S.P. 8214-41 (T.H. 212=45);
and
WHEREAS, said special provisions are on file in the office of the Department of
Highways, Saint Paul. Minnesota, being marked, labeled, and identified as S.P.
8214-41 (T.H. 212=45), which, together with the Minnesota Department of Highways
Specifications for Highway Construction, dated January 1. 1964 as amended by
"Supplemental Specifications: dated February 1, 1966, on file in the office of the
Commissioner of Highways, constitute the specifications for said improvement of
Trunk Highway Number 45 renumbered as Trunk Highway Number 212; and
WHEREAS, copies of said plans and special provisions as so marked, labeled and
identified are also on file in the office of the City Clerk; and
WHEREAS, the term "said plans and special provisions" as hereinafter used in the
body of this resolution shall be deemed and intended to mean, refer to, and
incorporate the plans and special provisions in the foregoing recitals particularly

BE IT RESOLVED, by the City Council Of the City of Stillwater, Minnesota, that
the bid of American LaFrance, 100 East LaFrance Street, Elmira, New York in the
amount of $77,899.00 and the bid of General Safety Equipment Corporation, North
Branch, Minnesota in the amount of $84,470.00 which was received in response to
the City's call for bids for the furnishing of one 80 foot Aerial Platform for
use in the Fire Department, and the same are hereby, rejected.

of a street garage.

RESOLUTION ORDERING HEARING ON IMPROVEF.NTS AND DIRECTING THE CLERK TO ADVERTISE
FOR BIDS ON LOCAL IMPROVEMENT #69-1968.
WHEREAS, this Council, did on the 14th day of May, 1968, receive the preliminary
report of the City Engineer that the following described improvements are
feasible, and may be made as proposed, in connection with Local Improvement
No. 69, viz:
Surfacing, curb, gutter and other appurtenances on West Orleans
Street from its intersection with South Fourth Street to South
Harriet Street.
and the engineer has prepared plans and specifications for said improvements; and
WHEREAS, the City Engineer has further reported to the Council that the estimated
cost or said improvement is $29,488.00.
WHEREAS, a hearing was held on June 18, 1968 including property owners abutting
and non -abutting and that additional property was added to the assessment district:
THEREFORE, this hearing was resched•.iled to include the additional properties not
included in the original hearing described as follows:

RESOLUTION CONFIRMING APPOINTMENT OF POLICE OFFICERS.
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that David IO:efelkamp and Donald L. Beberg, heretofore appointed as police
officers of the City for a period of six months by resolution adopted
January 9, 1968 be, and they are hereby, appointed as regular police officers
with the same powers and duties as set forth in said resolution of January 9,
1968; that said appointments shall be effective from and after July 1, 1968;
and that as compensation for services rendered as such police -officers, the
said David Rnefelkamp and Donald L. Beberg shall receive the sum of $540.00
per month, together with all other benefits of employment in the Police
Department of the City.

WHEREAS, at a meeting of this Council held on the 7th day of May, 1968,
a petition was presented praying for the vacation of a portion of west
Street in the City of Stillwater hereinafter described; and
WHEREAS, at said meeting the Council did, after due consideration deem it
expedient to proceed with said matter and did order the said petition to
be filed in the office of the City Clerk; and
WHEREAS, the City Clerk did thereupon and thereafter give notice by
publication in the Stillwater Evening Gazette, official newspaper of the
City, for four successive weeks beginning on June 5, 1968, and thereafter
on Wednesday of each week to and including June 26, 1968, to the effect
that saaig petition had been filed as aforesaid and stating concisely its
object:/!hat said petition -: would be heard and considered by the Council
at the Municipal Building in the City of Stillwater, Minnesota, on the

RESOLUTION NO. 4119
RESOLUTION ACCEPTING BID AND ORDERING REPAIR OF LIFT STATION.
WHEREAS, the Council did, by motion of Councilman Peterson, seconded by
Councilman Nolde on July 9, 1968, authorize the City Clerk to advertise
for bids returnable at 4:30 o'clock F. M. on Tuesday. July 23, 1968 for
the complete overhaul of three Fairbanks Morse pumps.
AND WHEREAS, it appears from the affidavits of publication presented by
the City Clerk that pursuant to said motion an advertisement for bids
for said project was duly published in the Stillwater Evening Gazette.
official newspaper of the City, on July 12, 1968;
AND WHEREAS, it appears that Tri-State Drilling & Equipment Co., Highway
55 West, Wayzata, Minnesota, is the lowest responsible bidder for said
project with a total bid of $6,100.00;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota:
1. That said complete overhaul of three Fairbanks Morse pumps
be, and it is hereby, ordered as proposed.
2. That the bid of said Tri-State Drilling & Equipment Co. be,
and the same is hereby, accepted; and that the Mayor and
the City Clerk are hereby authorized and directed to enter
into a contract in the name of the City with the said Tri-
State Drilling & Equipment Co. for said complete overhaul
of the three Fairbanks Morse pumps for the contract price
aforesaid and in accordance with the plans and specifications
therefor.
3. That no part of the cost of said project shall be assessed.
The Council of the City of Stillwater hereby authorizes and
directs the City Treasurer to pay the cost of said project
from the City's Sewer Revenue Fund.
4. That the City Clerk shall retain the deposits made with the
three lowest bidders for thirty days from and after July 23,
1968, or until a contract is signed, whichever event first
occurs.

the Street Department and Chainman in the survey crew of the City for a period.

appointed as permanent Light Equipment Operator:

and that said appointment shall be effective from and after August 1, 1968. As
compensation for services rendered as such Light Equipment Operator, the said

Union of Operating Engineers, AFL-CIO executed the 6th day of June, 1967, together
with all other benefits of City employment.

RESOLUTION NO. 4124
RESOLUTION VACATING A PART OF STILLWATER AVENUE
WHEREAS, at a meeting of this Council held on the 18th day of June, 1968,
a petition was presented praying for the vacation or a portion of Stillwater
Avenue in the City of Stillwater hereinafter described; and
WHEREAS, at said meeting the Council did, after due consideration. deem it
expedient to proceed with said matter and did order the said petition to be
filed in the office of the City Clerk;and
WHEREAS, the City Clerk did thereupon and thereafter give notice by publication
in the Stillwater Evening Gazette, official newspaper of the City, for four
successive weeks beginning on July 3, 1968, and thereafter on Wednesday of each
week to and including July 24, 1968,. to the effect that said petition had been
filed as aforesaid and stating concisely its objects and that said petition
would be heard and considered by the Council at the Municipal Building in
the City of Stillwater, Minnesota, on the 6th day of August, 1968, at 7:30
o'clock P. M.; and
WHEREAS, at the time and place appointed in said notice, the Council at a
duly called and held meeting thereof, did investigate and consider said matter
and did hear the testimony and evidence on the part of all parties interested,
at which meeting and hearing there was no opposition to said vacation;
NOW. THEREFORE, 8E IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota, that the said petition be and the same is hereby granted and that
the following part of said street as presently laid out and dedicated in said
City be, and the same is hereby vacated, absolutely and forever, fiz:
All of that part of Stillwater Avenue which lies between
Block 13 and Block 14 of Cooper's Addition to the City of
Stillwater.
BE IT FURTHER RESOLVED, that the Council deems substantial benefits will
accrue to the City from the vacation of that part of said street as herein
provided, and the public benefits will be such that said vacation is hereby
ordered without payment of compensation;
BE IT ALSO FURTHER RESOLVED, that upon publication of this resolution according
to law, a transcript thereof, together with a duplicate of the plat showing the
part of said public street vacated hereby, certified by the City Clerk, shall
be filed for record and recorded in the office of the Register of Deeds of
Washington County, Minnesota.

WHEREAS, by resolutions adopted May 21, 1968, this Council did fix a date for
public hearings on proposed improvements consisting of the following, to -wit:
Surfacing, curb, gutter, storm sewer, and other appurtenances
on Weat Orleans Street from its intersection with south Fourth
Street to South Harriet Street.
Surfacing, curb, gutter and other appurtenances on West Marsh
Street from South Fifth Street to South Sixth Street.
Surfacing, curb, gutter and other appurtenances on West Ramsey
Street from Sherburne to Grove Street.

RESOLUTION AUTHORIZING ACQUISITION AND EXCHANGE OF LAND.
BE IT RESOLVED, that the Mayor and City Clerk of the City of_Stillwater,
Minnesota are hereby authorized and directed to execute a conveyance of
the following described property to -wit:
That part of the Chicago, Milwaukee and St. Paul Railway Company's 100
foot right of way (now abandoned) in the Northwest Quarter of the North-
east Quarter of Section 3, Township 29 North, Range 20 West and Government
Lot 5 of Section 34, Township 30 North, Range 20 West, conveyed by
Warranty Deed dated August 7, 1884 and recorded on September 4, 1884 in

which lies North of the South line of Mill Road, which South line is

RESOLUTION IN TRIBUTE TO THE MEMORY OF DR. R. E. CARLSON.
WHEREAS, Dr. R. E. Carlson, did serve the City of Stillwater in the
capacity of City Health Officer from the 1st day of February, 1947,
until the date of his death, November 16, 1968, a continuous period
of over twenty-one years of honest, fa.thful, dutiful service.
BE IT RESOLVED, by the Council of the City of Stillwater, Minnesota,
that to perpetuate the memory of the late Dr. R. E. Carlson, City
Health Officer and in recognition of his unselfish dedication to the
duties of his office and the welfare of the community, the City Clerk
is hereby authorized and directed to enter this Resolution upon the
official record of proceedings of the Council and to forward a certified
copy thereof to the widow and family of the said Dr. R. E. Carlson.

BE IT RESOLVED, by the City Council of the City of Still+ater, Minnesota,

1. It is hereby found and determined to be necessary and expedient for
the City to issue its improvements bonds in the amount of $220,600 for the
purpose of paying part of the cost of making certain local improvements pursu-
ant to Minnesota Statutes, Chapter 429, the total estimated or actual cost of

2. It is further found and determined to be necessary and expedient that
the amount of bonds to be issued be increased to the total amount of $225,000,
for the purpose of providing the additional sum of $4,400 to be represented by
the first -maturing bonds of said issue, constituting interest as authorized
by Minnesota Statutes, Section 47r.56.
3. The City Clerk is hereby authorized and directed to cause to be
published in the official newspaper of the City and in the Commercial West, a
weekly financial periodical published in Minneapolis, Minnesota, notice of sale
of $225,000 Improvement Bonds of 1968, to be issued to finance local improvements.
This Council shall meet in the City Hall on December 10, 1968, at 8:00 o'clock
P. M., to receive, open and consider bids for said bonds received pursuant to
said notice, and to take such additional action with respect to said bonds as is
then appropriate.
4. The form of notice of sale submitted to the Council this date and
now on file in the office of the City Clerk is hereby approved. Each and all
of the terms and provisions of said form of notice is hereby adopted and confirmed
as the terms and conditions for the sale and issuance of said bonds as fully as
though separately set forth herein.

RESOLUTION NO. 4163
WHEREAS Laws 1967, Chapter 687, Section 1, provides that members of the
Public Employees Retirement Association may exercise an option to pay
retroactive contributions at the rate of six percent of total salary
covering the period from July 1, 1957 through June 30, 1967, with accrued
interest thereon at four percent per annum compounded annually; and
WHEREAS said Chapter 687, Section 1, further provides that the governmental
subdivision in which the service involved in any such purchase was rended,
may assume the obligation to pay the required matching amount; and
WHEREAS pursuant to the above mentioned statute, the governmental subdivision
may pay the matching amount from the proceeds of a tax levy made pursuant
to M. S. 1965, Section 353.28, as amended: Therefore be it
RESOLVED, That the City Council of the City of Stillwater hereby assumes the
obligation to pay the matching amount in all cases where members of the
Public Employees Retirement Association pay retroactive contributions plus
the specified interest based on total earnings covering the period from
July 1, 1957 through June 30, 1967; and be it
RESOLVED further, That the City of Stillwater will honor all certifications
made by the Public Employees Retirement Association under M. S. 1965,
Section 353.28, as amended, covering payment required pursuant to Laws

RESOLUTION ACCEPTING WORK - LOCAL IMPROVEMENTS NO. 63. 64, 67, and 68, 1967.
WHEREAS, pursuant to written contract signed with the City on the 27th day
of September. 1967, R. W. Moore Company, of St. Paul, Minnesota, has
satisfactorily completed construction of Local Improvements No. 63, 64,
67 and 68 (Surfacing, curb, gutter and tither appurtenances on South Sixth
Street from West Hancock Street to West Orleans Street; North Brick Street
(Birchwood Drive North) from West Myrtle Street to West Linden Street;
Echo Lane from West Myrtle Street to West Linden Street; West Linden Street
from North Owens Street to westerly dead end;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,

RESOLUTION CONFIRMING PRANCISE VOTE.
WHEREAS. the City Council of the City of Stillwater, Minnesota. did adopt
Ordinance No. 428 granting to F. M. MCCarten, his heirs and assigns, a
franchise for the operation of a community antenna television system and did by
appropriate proceedings cause the question of whether or not such franchise
should be approved to be submitted to the voters of the City of Stillwater at
a general election held on November 5, 1968 and thereafter on the 7th day of
November. 1968 the City Council did canvass the returns of said election and
did determine that 2297 voted for the ordinance and 1595 voted against the
ordinance;
NOW, THEREFORE, BE IT RESOLVED, and declared that said Ordinance has been
approved by a majority of the qualified electors voting on the same and that
said Ordinance is in full force and effect after the publication of this
resolution as provied by law and by the Charter of the City of Stillwater.

5. Said bonds shall be printed under the direction of the City Clerk
and shall be executed on behalf of the City by the manual signature of the
Mayor, attested by the manual signature of the City Clerk, and the corporate
seal of the City shall be affixed thereto. On the reverse side of each bond
shall be printed a copy of the legal opinion rendered by bond counsel,
authenticated by the certificate and facsimile signatures of the Mayor and
City Clerk. The interest coupons appurtenant to each bond shall be executed
and authenticated by the printed, engrave or lithographed facsimile signatures
of the Mayor'and City Clerk. When the bonds have been so executed and authen-
ticated, the City Treasurer shall cause them to be delivered to the purchaser
upon receipt of the purchase price heretofore agreed upon, and the purchaser
shall not be' obligated to see to the application of the purchase price.
6. There are hereby created "separate and special improvement funds for
each of the improvements described in paragraph 1".of Resolution No. 4161,
adopted onNovember19, 1968, each such fund to be held and administered by
the City Treasurer separate and apart from all other funds of the City. The
proceeds of sale of the :improvement bonds herein authorized less the accrued
interest received upon delivery, and less such portion of thepurchase price
which exceeds $220,600, shall .be credited and paid into said funds in the
amount of the estimated cost of each improvement stated in paragraph 1 hereof.
There shall also be credited to each fund, until completion of the improvement
on account of which it was created, all collections of special assessments
levied to "pay the cost of such. improvement. The moneys on hand in each fund
shall be used .solely to defray the expense of constructing the improvement on
account of which it was created, and to pay principal of and interest on the
improvement bonds herein authorized. Upon the completion of each "improvement
and ;payment of all the costs thereof, any balance of bond proceeds remaining
in the fund pertaining thereto may be transferred by the Councsl to the fund"
of any other improvement instituted under MS.SA., Chapter 429. A11 moneys_"
remaining in any such fund and not so transferred, and all subsequent receipts
of, special assessments levied with respect to the improvement,' shall becredited
and paidinto the Improvement Bond Account hereto fore,. established!' in thesinking
fund . of the City; which account shall be continuedand maintained. in said
sinking fund untilthe bonds herein authorized and all other general obligation
improvement "bonds designated by the Council as payable therefrom shall have been
fulty paid with interest. in accordance with M.S.A., Chapters 429 and 475. Into
said account shalt also be paid the taxes hereinafter levied for payment, of the
bonds herein authorized.
7. 'It is hereby covenanted and agreed with the purchaser and holders from
timetotime of the bonds herein authorized, thatnotless than 20% of .:the cost
of each improvementshall be assessed against properties specially benefited
thereby. It is presently estimated that not less than $196,000'of the cost of
said improvements will be paid by the special assessments levied or to be levied
upon all lots, pieces and parcels of land subject to assessment and lying within
the areas heretoforedetermined to be assessable for said improvements. which
assessments shall be in amounts prgortionate to the benefits received by said
lots, pieces and parcels of land respectively: Said assessments are or'will-be
payable in the respective principal amounts shown below, with an equal install-
ment of each such amount payable with interest at the rate of 6% per annum in
each of the collection years stated below as follows:

The City hereby covenants and agrees that it will do and perform all acts
and things necessary for the final and valid levy of special assessments
as above set forth. In the event that any such assessment be at anytime
held "invalid with respect to any lot. piece or parcel of land, due to any
error, defect or irregularity in any action or proceeding taken or to be
taken by the City or by This Council or by any of the City'f officers or
employees, either in the making of such assessment or in the performance of
anycondition precedent therefo, theCityshall forthwith do all such.

8. The full faith, credit and taxing powers of the City are hereby

RESOLUTION IN TRIBUTE TO THE MEMORY OF LEO CARTONY.

Police Officer and First Sergeant from the 1st day of February, 1958, until
the date of his death, December 3, 1968, a continuous period of over ten
years of honest, faithful, and dutiful service.

to perpetuate the memory of the late Leo Cartony, City Police Sergeant
and in recognition of his unselfish dedication to the duties of his office

1969, be, and the same is hereby, confirmed; that as such police officer
the said Timothy Bell shall have the powers of police officers at common
law or under the laws of the State of Minnesota, and it shall be his duty
to serve warrants, summons, writs, subpoenas or other process issued by
the Washington County Municipal Court; to command the peace, suppress.
rioting or disorderly conduct within the City and to arrest, with or with-
out a warrant, as authorized by the laws of this State, persons charged
with the commission of any public offense under the laws of the State of
Minnesota or the ordinances of the City, and to perform any and all duties
incidental to the office of a policeman as directed by the Mayor, City
Administrator or the Chief of Police; and that the said Timothy Bell shall
receive as compensation for services rendered as such police officer the
sum of $530.00 per month.

RESOLUTION NO. 4178
RESOLUTION AUTHORIZING PAYMENT OF MEMBERSHIP DUES IN CENTRAL WASHINGTON
COUNTY PLANNING COMMISSION.
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that the payment of the sum of One Hundred ($100.00) Dollars to the Central
Washington County Planning Commission for membership dues for the year
1968-69 be, and is hereby approved, and a warrant therefor is hereby ordered
drawn upon the City Treasurer for that amount.
