HomeMy WebLinkAboutHPC Resolution 2023-02 (Permit To Facilitate The Placement Of A Seasonal Food Vending Trailer At 425 Nelson Street (Dock Café))City of Stillwater Washington County, Minnesota RESOLUTION HPC2023-02 DESIGN PERMIT TO FACILITATE THE PLACEMENT OF A SEASONAL FOOD VENDING TRAILER AT 425 NELSON STREET (DOCK CAFE) WHEREAS, the City of Stillwater received a Seasonal Food Vending Permit application from John Koch ("Applicant"), located at 425 Nelson Street, legally described as in Exhibit A (the "Property"), regarding the placement of a food vending trailer; and WHEREAS, the requested food vending trailer is proposed to remain in place for a period of 20 hours or greater; and WHEREAS, on March 15, 2023, the Heritage Preservation Commission for the City of Stillwater considered the design permit. NOW, THEREFORE, BE IT RESOLVED, that the Heritage Preservation Commission of the City of Stillwater hereby approves the design permit for a seasonal food vending trailer. The approval of the design permit is subject to the following conditions: 1. The Planning Commission must approve an Interim Use Permit for the use for more than 20 hours. 2. The Applicant must comply with all requirements and regulations of the Seasonal Food Vending Permit before locating the trailer at the property. 3. The Applicant must submit a signage plan for review and approval by Planning Staff. 4. Plans shall be consistent with those included in the Staff Report. 5. All minor modifications to the plans shall be approved in advance by the Community Development Department. All major modifications shall be approved in advance by the HPC. Determination of the distinction between major" and "minor" is defined in the Zoning Ordinance. Adopted by the City Planning Commission this 15th day of March, 2023.
