HomeMy WebLinkAboutHPC Resolution 2023-05 (Adopting Findings for Denial of a Demolition of a Pre-1946 Structure in the Neighborhood Conservation District, 320 Second Street North)City of Stillwater Washington County, Minnesota RESOLUTION HPC 2023-05 RESOLUTION ADOPTING FINDINGS FOR DENIAL FOR A DEMOLITION OF A PRE-1946 STRUCTURE IN THE NEIGHBORHOOD CONSERVATION DISTRICT FOR 320 2ND STREET NORTH WHEREAS, the City of Stillwater received demolition and design permit applications from Pat and Amy Estenson ("Applicant"), located 320 2"d Street North, legally described as in Exhibit A (the "Property"), regarding the demolition of a single- family home built in 1858 and the infill construction of a new structure; and WHEREAS, on March 15, 2023, the Heritage Preservation Commission for the City of Stillwater considered the request. NOW, THEREFORE, BE IT RESOLVED, that the Heritage Preservation Commission of the City of Stillwater hereby denies the demolition. The denial of the demolition and associated infill is based on the following findings: The proposed demolition does not meet the requirements of the Stillwater Demolition Ordinance, Sec. 31-215: (1) Demolition of the resource has been evaluated against and, on balance, has been found to not support of the goals and policies of the comprehensive plan and relevant area plans, taking into account factors such as: the merits of proposed new development on the site, the merits of preserving the resource, and the area's desired character; and (2) Denial of a demolition permit would not effectively deprive the owner of all reasonable use of the site, as the structure is currently occupied and is safe for human occupancy. (a) This would not be an investment property, so the reasonable rate of return standard would not apply. (b) As a non -income producing properties consistent of an owner -occupied single- or two-family dwelling and/or institutional use not solely operating for profit, the owner's has the ability to convert the property to a compatible and conforming use in its present condition or, if rehabilitated. (c) Noneconomic reason: There is not a situation substantially inadequate to meet the applicant's needs because of specific health and/or safety issues. Adopted by the Heritage Preservation Commission this 15th day of March, 2023.
