RESOLUTION PC2022-05
VARIANCE REQUEST TO INCREASE THE AMOUNT OF IMPERVIOUS SURFACE
TO FACILITATE CONSTRUCTION OF A DECK AT 3625 SUMMIT LANE
WHEREAS, the City of Stillwater received a Variance application from Dan Larson
("Applicant"), located at 3625 Summit Lane, legally described as in Exhibit A (the "Property"),
regarding the construction of a 256 square foot deck; and
WHEREAS, the requested variance is for a 256 square foot increase to the 25%
impervious lot coverage provision of the RB Two -Family district; and
WHEREAS, the on September 28, 2022, the Planning Commission for the City of
Stillwater considered the variance and held a public hearing and took testimony from the
public.
NOW, THEREFORE, BE IT RESOLVED, that the City Planning Commission of the
City of Stillwater hereby approves the variance for 256 square feet. The approval of the
variance is subject to the following conditions:
1. Plans shall be substantially similar to those found on file with CD Case No. 2022-67.
2. The applicant shall comply with recommendations made by the Browns Creek
Watershed District to mitigate the additional impervious surface added to the
Property to ensure the stormwater system continues to function at the required 25%
for structural impervious surface.
3. All changes to the approved plans will need to be reviewed and approved by the
Community Development Director. Any major changes will need to go to the
Planning Commission for review and approval.
Adopted by the City Planning Commission this 26th day of October, 2022.
