RESOLUTION HPC 2023-13
DEMOLITION PERMIT FOR PARTIAL DEMOLITION OF A PRE-1946
STRUCTURE FOR 112 HARRIET STREET SOUTH
WHEREAS, the City of Stillwater received a demolition permit application from
Chris Rustad ("Applicant"), located 112 Harriet Street South, legally described as in
Exhibit A (the "Property"), regarding the partial demolition of a single-family home built in
1878; and
WHEREAS, the partial demolition is to facilitate the removal of a hazardous and
deteriorated rear portion of a single-family dwelling; and
WHEREAS, on the May 17, 2023, the Heritage Preservation Commission for the
City of Stillwater considered the request.
NOW, THEREFORE, BE IT RESOLVED, that the Heritage Preservation
Commission of the City of Stillwater hereby approves the partial demolition. The approval
of the demolition is based on the following findings:
FINDINGS
The proposed demolition meets the requirements of the Stillwater Demolition Ordinance,
Sec. 31-215:
1. Demolition of the resource has been evaluated against and, on balance, has been
found supportive of the goals and policies of the comprehensive plan, especially
those dealing with the health, safety and welfare of the community, and relevant
area plans, taking into account factors such as: the merits of proposed new
development on the site, the merits of preserving the resource, and the area's
desired character; and
2. Denial of a demolition permit would effectively deprive the owner of all reasonable
use of the site as the owner would be unable to convert the property to a
compatible and conforming use in its present condition. There is a situation
substantially inadequate to meet the applicant's needs because of specific health
and safety issues.
CONDITIONS OF APPROVAL
1. Plans shall be consistent with those included in this report.
2. All minor modifications to the plans shall be approved in advance by the
Community Development Department. All major modifications shall be approved
in advance by the HPC. Determination of the distinction between "major" and
"minor" is defined in the Zoning Ordinance.
