HomeMy WebLinkAboutResolution PC2023-07City of Stillwater Washington County, Minnesota RESOLUTION PC2023-07 INTERIM USE PERMIT TO FACILITATE THE PLACEMENT OF A SEASONAL FOOD VENDING TRAILER AT 425 NELSON STREET (DOCK CAFÉ) WHEREAS, the City of Stillwater received Interim Use Permit and Seasonal Food Vending Permit applications from John Koch (“Applicant”), located at 425 Nelson Street, legally described as in Exhibit A (the “Property”), regarding the placement of a food vending trailer; and WHEREAS, the proposed food vending trailer will be located at 425 Nelson Street from April 1st, 2023 through October 31st, 2023. WHEREAS, on March 29, 2023, the City Planning Commission for the City of Stillwater considered the interim use permit. NOW, THEREFORE, BE IT RESOLVED, that the Heritage Preservation Commission of the City of Stillwater hereby approves the design permit for a seasonal food vending trailer. The approval of the design permit is subject to the following conditions: Findings  The use conforms to the Zoning District  The date or event that will terminate the use can be identified with certainty  Permission of the use will no impose additional costs on the City if it is necessary for the City to take the Property in the future  The user agrees in writing to any conditions that the Planning Commission deems appropriate for permission of the use Conditions of Approval 1. The Applicant shall submit a complete Annual Food Vending Permit for administrative approval to the Community Development Department, including all required attachments and inspections before the trailer may be located at the site and/or in operation. 2. The proposed trailer and the Dock Café shall operate as separate entities, including service, menu availability and seating. 3. A waste water discharge plan shall be submitted to the Engineering Department for approval. 4. All plans shall be reviewed and approved by applicable fire and building inspection personnel prior to location and/or operation. 5. The Applicant must secure all necessary approvals from Washington County health officials. 6. Permit expires on August 31st, 2023 and applicant must reapply for a new Interim Use Permit upon expiration. 7. Storm water mitigation (rain garden/storm pond) must be addressed prior to reapplication of new Interim Use Permit. 8. Parking mitigation fees for number of stalls lost due to placement of trailer be paid to the City. 2 Adopted by the City Planning Commission this 26th day of April, 2023.
