Utilities Superintendent Benson called the meeting to order at 8:00 a.m. Present: Chairman Speedling, Commissioners Hudak, Jensen and Whitcomb, Councilmember Polehna Absent: Commissioner Hutter Staff: Utilities Superintendent Benson, Public Works Director Sanders APPROVAL OF MINUTES Possible approval of minutes of November 10. 2022 meeting Motion by Chairman Speedling, seconded by Commissioner Hudak, to approve the minutes of the November 10, 2022 meeting. All in favor. OPEN FORUM There were no public comments. CLOSED SESSION Motion by Chairman Speedling, seconded by Commissioner Hudak, to close the meeting pursuant to Minnesota Statute 13d.05 Subd. 3b for attorney client privilege to discuss the White Bear Lake litigation. All in favor. REOPEN MEETING Motion by Chairman Speedling, seconded by Commissioner Jensen, to resume the regular meeting. All in favor. The meeting was reopened. Present: Chairman Speedling, Commissioners Hudak and Jensen, Councilmember Polehna Absent: Commissioners Hutter and Whitcomb Staff: Utilities Superintendent Benson, Public Works Director Sanders NEW BUSINESS Discussion on Annual Water Rate Increase Public Works Director Sanders stated that prior to the merger of the Water Board into in the City, the Board was considering a 5% rate increase for water usage but there was no formal action taken by the Commission on the increase. Additionally, the report by CliftonLarsonAllen did not mention whether a rate increase should occur for commercial properties. Staff recommends that the Commission members, if they so choose, approve the 5% increase for residential properties and discuss whether or not to include commercial properties. At the suggestion of the Finance Director, the rate increase would begin with first quarter water usage and be on the April billing beginning 2023. Chairman Speedling said he would like more information on whether the omission of commercial properties was intentional, and Mr. Benson said he will clarify with Chris Knopik, CliftonLarsonAllen. The consensus of the Commission was to postpone action on the water rate increase to next month. Discussion on Water Utility Base Fee Utilities Commission Meeting December 8, 2022 Mr. Sanders stated that the Finance Department asked the Commission to consider adding the base fee rate to commercial properties to be fair to all users. The City Council would be the body for final approval. Motion by Commissioner Hudak, seconded by Chairman Speedling, to recommend that commercial properties' base fee be equitable and similar to residential properties starting in April 2023. All in favor. UNFINISHED BUSINESS There was no unfinished business. DIRECTOR/SUPERINTENDENT UPDATE Monthly Gallons Pumped Mr. Benson gave the number of gallons pumped in November. COMMISSIONER ITEMS There were no Commissioner items. ADJOURNMENT Motion by Chairman Speedling, seconded by Commissioner Jensen, to adjourn. All in favor. THE BIRTHPLACE OF MINNESOTA Date: February 9, 2023 To: Utility Commission Members From: Shawn Sanders, Director of Public Works Subject: Water Utility Annual Rate Discussion DISCUSSION At the October Utility Commission Meeting, the commission discussed an agenda item regarding rate increases for water usage. As background, the last rate study analysis conducted by the Water Board, a residential rate increase of 5% was recommended in addition to the establishment of a new rate. (It is also worth mentioning that the increase did not occur for residential properties in 2022). At the time of the study there was no recommendation of an annual increase for commercial properties. Staff was directed to contact CliftonLarsonAllen, and discuss the merits of an annual increase of the commercial property, the conversation was held and did not receive any opposition. Upon discussion with the Finance Director, all other utility funds (sanitary, storm and lighting fund) have been approved for annual increase of 3% and felt that in order to be consistent, the water rate for both residential and commercial properties should be 3% as well. RECOMMENDATION Staff recommends that the commission members discuss and approve an annual increase for residential properties and commercial properties. At the suggestion of the Finance Director, the rate increase would begin with the first quarter water usage of each year for the April billing beginning 2023. i11water. THE BIRTHPLACE OF MINNESOTA Date: February 9, 2023 To: Utility Commission Members From: Shawn Sanders, Director of Public Works Subject: Discussion on Availability for Sewer and Water Hookups. BACKGROUND At the November Utility Commission meeting, an item was presented and discussed on what is considered available when it comes to the topic of sewer and water connection. In many instances, both sewer and water main are adjacent to a property and is considered available. There are several areas in the City where only one utility is available, mainly watermains in the western part of the City where water was extended to serve a development and passes by existing homes that weren't part of the development. Current code requires connection to water when it is available at the time sale of the home, and is stated below: Water Department Sec 28-3. subd 16. Immediate Connection Required. Any building within the which has available to it city water services must be connected to the City water system if and when they connect to the city sewer system or upon sale or transfer of title to the property In working with the City attorney, the wording has been changed to: If both sewer and water are available to the property, then upon sale or transfer of title, the owner must connect to the water system. Any new building that has city water service available to the property must connect to the city water system upon construction. This change eliminates any confusion of when water hook up is required especially when only water is the only utility in place. RECOMMENDATION Staff recommends that the commission consider, discuss and approve the change in the ordinance. THE BIRTHPLACE OF MINNESOTA Date: February 9, 2023 To: Utility Commission Members From: Shawn Sanders, Director of Public Works Subject: Water Efficiency Grant Program Update BACKGROUND Earlier this year, the City received a grant from the Metropolitan Council as part of their Water Efficiency Grant Program in the amount of $25,000. The program required a 20% matching fund by the City, for a total amount of $31,250. The program provides property owners, who replace certain household items and install new water efficient and/or energy efficient items, an opportunity for a rebate for the purchase. Three items that are eligible for a rebate at the City are washing machines, toilets and smart irrigation controllers.
