RESOLUTION NO. 2022-165
A RESOLUTION SUPPORTING AND AUTHORIZING PARTICIPATION BY THE
STILLWATER POLICE DEPARTMENT IN THE MINNESOTA LAW ENFORCEMENT
SUPPORT OFFICE PROGRAM
WHEREAS, the United States Congress has authorized in the National Defense
Authorization Act the transfer of excess Department of Defense property to municipal,
county and state law enforcement agencies; and
WHEREAS, this initiative, known as the Minnesota Law Enforcement Support
Office Program ("LESO") or "1033 Program," allows local law enforcement agencies to
obtain, at little or no cost, surplus Department of Defense property, including vehicles,
weapons, and other equipment originally intended for use by the United States Armed
Forces; and
WHEREAS, participation in the Minnesota LESO program allows municipal law
enforcement agencies to obtain property they might not otherwise be able to afford in
order to enhance community preparedness, response and resiliency; and
WHEREAS, although this property is provided through the Minnesota LESO
program at no cost to municipal law enforcement agencies, these entities are responsible
for the costs associated with delivery, maintenance, and upkeep of the property, and for
specialized training on the operation of any acquired property; and
WHEREAS, the Stillwater Police Department has a need for additional and
specialized equipment for law enforcement officers and agrees that all items obtained
must have a direct application to the Police Department's public safety mission.
WHEREAS, On May 25, 2022, Presidential Executive Order (EO) 14074
"Advancing Effective, Accountable Policing and Criminal Justice Practices to Enhance
Public Trust and Public Safety" was signed. In accordance with EO 14074 (Section 12),
State, Tribal, local, and Territorial Law Enforcement agencies (LEAs) must:
1) Notify their Civilian Governing Body (CGB) (i.e., City Council, County
Government or other local governing body) of its intent to request property
from Federal sources, to include Federal funds or grants.
2) Notify the Local Community of its request for property transfers, purchases
from Federal funds, agencies or subcontractors (including existing transfer
contracts or grants).

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Stillwater does hereby acknowledge, support and authorize the Stillwater Police
Department's participation in the Minnesota LESO program.
BE IT FURTHER RESOLVED that the City Council authorizes the Stillwater Police
Chief to execute any documents necessary for participation in the Minnesota LESO
program.
