GEOCODE ADDRESS DEFERRED CHARGE 33.030.20.21.0098 1015 Everett St S $12,355.00 NOW THEREFORE BE IT RESOLVED by the City Council of the City of Stillwater, Minnesota that 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the deferred assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. The deferred street assessment would be collected with interest at the annual rate of 4.5% until the sale, transfer or subdivision, or in any way conveyed to another by the fee owner qualified for deferred status, death, loss of homestead status, or Council determines no hardship of the property. 3. The class is an excellent opportunity for newer employees to get hands on experience driving on ice and snow. This class costs $200 for all four employee and the cost of the class would come out of the Streets Department Seminar & Conference Fees budget. RECOMMENDATION Staff recommends that Council approve the Customized Training Income Contract with Dakota County Technical College for the Defensive Snow Plow Driving class. ACTION REQUIRED If Council concurs with the staff recommendation, they should pass a motion approving the Customized Training Income Contract with Dakota County Technical College. Finance Director Provos reported there is little financial benefit to residents of extending assessments to a 20 year term. Mayor Kozlowski will explain this to the residents who may be interested. Community Development Director Gladhill updated the Council on the 200 Chestnut project now known as The Miller. He added that the Community Development department is doing a customer survey. City Clerk Wolf stated election head judges and staff attended de-escalation training. Sustainable Stillwater requested a donation of items for a fundraiser. PUBLIC HEARINGS To consider street and utility improvements on CSAH 5 (Owens St) from Olive to Sycamore Assistant City Engineer Abdullah reviewed the CSAH 5 Street Improvement Project Phase 2, which is being led by Washington County to improve County Road 5 (Olive and Owens Streets) from Pine Tree Trail to Sycamore. Work will consist of a mill and overlay the entire length and new curbs and sidewalks on Owens Street from Olive to Sycamore Street. Owens will be narrowed. The overall project cost is estimated to be $4,040,856 primarily funded by the County; the City is responsible for 50% of the new sidewalk, 50% of new curb and gutter, 100% of the sanitary manhole replacements and a prorated share on erosion control, striping and mobilization items. The total cost to the City is $485,923. Financing for the project would come from three sources: per -unit assessments, Municipal State Aid Funds and the Stillwater Water Department. It is proposed that costs associated with the curb and sidewalk improvement be assessed to affected property owners. This amounts to $269,186. Staff recommends that the Council hold the public hearing and pass a resolution ordering the improvement and directing the engineer to prepare plans and specifications. Mayor Kozlowski opened the public hearing. Rob SanCartier, 216 Owens Street South, showed a map with a suggested traffic plan, including converting some streets to one way, and a petition signed by residents. He has lived on Owens for many years and believes a traffic plan is needed because the City keeps allowing development projects, impacting traffic because of all the new construction. Public Works Director Sanders responded that Myrtle and Olive are County roads, so the County would have to partner in traffic changes. Staff can bring the ideas up to the County for input, and will report back to the Council and Mr. SanCartier. Mayor Kozlowski and Councilmember Polehna acknowledged that Owens and Myrtle, and Owens and Olive are bad intersections. A resident who lives at Myrtle and Owens Streets (no name given), urged that something must be done to improve how the intersection operates beyond a four way stop. The City needs to seriously think about all those intersections - Greeley/Olive/Myrtle/Owens. Jina Terry, 206 Owens Street, via Zoom, voiced concern about her $1,500 assessment because she knows someone else who lives on a County road who has not had to pay assessments. She also is concerned that narrowing the street may limit parking. Mr. Abdullah answered the County is not assessing the City for Olive, but on Owens the County is asking the City for a cost share, which is why Owens homeowners are being assessed. Mr. Sanders added that some parking will be eliminated around McKusick Road, but for the most part, where it is being narrowed it still allows for parking on both sides of the street. The purpose of the project is pedestrian safety and a wider sidewalk and boulevard space rather than having the sidewalk right next to the road. Mayor Kozlowski closed the public hearing. NEW BUSINESS City Wide Space Needs Study Contract City Administrator Kohlmann stated that two proposals were received and staff recommends the Council accept the proposal from Kraus Anderson for $86,933 plus an estimated $1,000 of reimbursables. Once the facility study is complete, the cost estimates will be plugged into the long-range financial plan. Motion by Councilmember Collins, seconded by Councilmember Junker, to accept the proposal from Kraus Anderson. All in favor. Terra Springs Trail and Access Agreements Public Works Director Sanders explained that it was discovered that a trail that was constructed around the perimeter of the Terra Springs condos was never dedicated to the City as intended, leaving a question of ownership and responsibility for the trail and access for maintenance of the City -owned wall. City staff and members of Terra Springs discussed options and agreed that ownership of the trail would be Terra Springs. Terra Springs would need to dedicate access easements for wall maintenance to the City, and would pay the City Park and Trail Dedication fees that were required at the time of development, less the balance of a trail fund that was deposited to the City by the developer. Wall access agreements and sidewalk agreements have been prepared, and staff recommends that the Council approve the wall and sidewalk agreements and accept the Park and Trail Dedication fee in the amount of $220,124. Councilmember Junker stated back in 2000, the wall was not intended to become part of the development. Additionally, the development paid about $127,000 to rebuild the trail. City Attorney Land thanked the homeowner associations for their good cooperation. Motion by Councilmember Junker, seconded by Councilmember Polehna, to approve the trail and access agreements. Subsequent to said approval, the Applicant is now applying for the required Design Approval from the Heritage Preservation Commission for the construction of a new dwelling in the Neighborhood Conservation District. At their August 17, 2022 Meeting, the Heritage Preservation Commission denied the required Design Permit, finding that the scale and mass of the building was not compatible with the surrounding neighborhood and Stillwater Design Guidelines which did not respect the rhythm of the streetscape. The Heritage Preservation Commission also noted that the proposal lacked equal design treatment on all four sides of the structure. Zoning and Design District information: • RB: Two -Family District (underlying Zoning District) • Neighborhood Conservation District The Applicant is proposing a one -level 1,600 square foot home (building footprint) with a 1,000 square foot attached garage (most surrounding properties have either a detached garage in the rear yard or have a tuck under garage). Most of the surrounding structures are generally a smaller footprint, but 1.5 to 2 story structures. The scale and mass of the proposed structure is accentuated by grade changes/topography along Myrtle Street. The Applicant has chosen to propose a structure with a walkout basement exposed to Myrtle Street. This requires a change to grade. This grade is a steep slope with the high point over ten feet above street level at points. The natural topography is already going to make the structure appear to be a larger scale compared to surrounding properties. The Applicant could consider changing the walk -out basement to a full basement (keep the existing grade) to reduce the appearance of scale and mass. FINDINGS Related to the Stillwater Design Guidelines, the Neighborhood Conservation District guides this infill style of development/new construction. Generally speaking, this design review district requires high -quality design. The design guidelines allow for (and encourage) a more modern design, so long as said modern design is high quality (see Design Guidelines for more specifics on this standard). It is not the intent of the Design Guidelines to require new construction to match exact 1880s designs. Since the Heritage Preservation Commission Meeting, Staff has compiled additional data pertaining to scale and mass of surrounding properties. Additionally, the Applicant has provided additional supporting information attached to this report. Conditions i. Plans shall be consistent with those included in this report. ii. All minor modifications to the plans shall be approved in advance by the Community Development Department. All major modifications shall be approved in advance by the Heritage Preservation Commission. Determination of the distinction between "major" and "minor" is defined in the Zoning Ordinance. 2. Deny the appeal a. If the City Council agrees with the Heritage Preservation's decision to deny, it should also find that the proposal is not consistent with the Downtown Design Review District standards. We officially would like to appeal this decision. Our specific concern and reason for this appeal application is a direct result from the permitting process and requirements for submitting a building permit. As should be noted, when we asked for a building permit application following all necessary approvals by both the City and County as it related to the lot -split that made this a buildable residential site, there is no mention of the Heritage Preservation Committee or any submittal or approval process. From the point at which we were informed that the lot -split was officially recorded by Washington County and we were now allowed to submit for a building permit, we were never informed of the HPC or its approval process. As you will see on the Stillwater "New Home Construction Permit Application Package", there is no mention of any required approval(s) from the HPC in order to obtain a building permit. In fact, we did not learn of this process until after we submitted all necessary documents as required to obtain a building permit. This included the completed architectural drawings, completed engineering, completed site survey reflecting the building location, setbacks, driveway location and all elevations. It also included the necessary HVAC and Energy Code required information. Soon after all of this information was submitted along with our building permit application, we received an email from Tim Gladhill on August 11m. This is what we received from Tim: Team: We have received your application for Building Permit. Since this is located in the Neighborhood Conservation District, newly constructed homes require the approval of our Historic Preservation Commission. Their next meeting is scheduled for next Wednesday, August 16. If you get me the Design Permit Application (attached) today or first thing tomorrow (with required fees), we can still add to that agenda. Please note again, up until we received this email from Tim, we were never informed of this required approval. Even within the Design Permit Application, there is no mention of an HPC meeting requiring its approval. If we would have been informed of this required approval prior to submitting for a building permit, we would have submitted all necessary documents at a much earlier stage. This would have avoided major expenditures in this home's design and engineering as is required for a building permit and as outlined in in the "New Home Construction Permit Application Package". Obtaining the required design approval by the HPC should be a requirement by the City before a building permit application can be submitted. Such a requirement would have drastically changed the steps we followed in submitting the building permit, and ultimately would have saved the owner a substantial amount of costs in the process we are now involved with. As a final note, when this process was initially started, we were working closely with Abbi Wittman, who was a great help. We began with everything necessary to complete the lot split. We then moved on to the home's design. Abbi introduced us to the 93 page document "Stillwater Design Guidelines Manual". This was reviewed with Abbi several times and we were given direction on a preliminary design we reviewed with Abbi with no rejection. This preliminary design is extremely similar to the design we have submitted for permitting. At no point were we informed that this design would ultimately have to be approved by the HPC. Unfortunately, Abbi left the City of Stillwater before our final design was completed. We are now being asked to modify this drawing with very little direction as what needs to be completed for approval. This has become a very large expenditure to the owners unnecessarily and causing a substantial delay in the construction process. Our builder, PMI Homes Inc immediately contacted the city when we decided to build. He originally met with Abbi and discussed the process, presented a design of what style home we were looking to build and asked what requirements were needed. His direction is that we do not need to make it look historic or colonial, we just need to give it character. Our builder was told that after the final plat was approved and recorded in the county we could apply for permit. On August 11 th we were told that the address for 526 Myrtle St W would be changed to a Martha St N address since the driveway will be on Martha St and were informed we needed to go to HPC and have them review our design. We had no idea that this needed to be done. We were told to get the $25 fee to the City and that we could be put on the next meeting which was August 17th. On August 17th we met with HPC and since Tim graciously worked toward an approval sooner rather than later due to winter coming, it was determined not enough information or time for HPC to review and tabled. They did comment they wanted to know how it fits the guidelines in relationship to conserve character, massing, scale comparable with adjacent housing. Mostly 1.5 cable. 1 story walk out hip. Can be modern or contemporary. Does design change dramatically? Stone on front and not on side. Would like to see patterns and materials on all 4 sides. Has character but relate strongly to neighborhood. Garage in relationship to front door. Our builder had asked about massing but no specifics were given. Commissioner stated it can be modern or contemporary just needs to be relative to neighborhood. After that meeting we made changes to the drawing to reflect the comments from the meeting. We repositioned the front door, we added stone to the corners on the North east of both garage and home and siding changes to give it a look of foundation to siding. We did the same siding changes to the East side. The area to the North and East will be separated from adjacent properties with a fence (currently there is a fence on the East side). We felt this would add the stone material to all corners and pattern bringing in the colors of the home. We never received any direction on what do they mean about the massing. On September 21 st we again met with HPC. The design was denied. Instead of just wrapping the additional corners with stone, they would like more stone on the North and East sides. They would like more windows on the North side and enlarge smaller windows. They again commented on massing. In relationship too massing, we read that it is three dimension and not just from a single perspective, helping define both the interior and exterior shape of the building. In both meetings HPC stated it is a unique property because it is on a corner that people see when traveling Myrtle St. Because it is on the corner, we originally designed the property with an attractive entrance on the west side, so as traveling down (easterly) Myrtle you could look over at the architecture of a porch entrance. It added more character to that side. As you get to the front of the home, you would see the larger windows and doors to enter the home. The North side is to be on the back of an apartment building. To add privacy for both properties a fence will separate and decrease visibility to the new home. We did not incorporate additional full length stone on the bottom specifically because it will not be viewable and is more costly. We did not put in a lot of windows on that side for reasons of security to the garage on a side you cannot visually see from the home and monitor and due to the functional layout within the home which those sides would be kitchen cabinets and a walk in closet. If the massing question is due to size, the first floor finished is 1,657 Sq Ft. with the garage at 867 SF (basement 1,152 SF finished). We have met all the requirements for setbacks and coverages as already approved and once recorded why we applied for permit and then found out we needed to go present to HPC. It is not just a rectangular box because to give it exterior character and functional living to meet the coverages allowances we do not just have a gable roof. We are attempting to give it the more historical feel with the metal ash gray roof. If the massing question is in regard to height, we would like to point out adjacent buildings. The existing parcel, as stated in the councils March 23, 2022 meeting, had been previously subdivided and the plan for this home is similar to those homes (104 Harriet St, 108 Harriet St N and 112 Harriet St N) that were built on those lots. None of these homes on Harriet are as tall as the existing 516 Myrtle St W. Our height will be in relationship to those properties. Thus, if size is an issue we are here today with a plan reducing the footprint of the building. We are also adding additional windows to the garage on the North (security is our concern when doing this) and can add more stone if necessary. If approval can be made to not introduce these changes we would appreciate it but if the recommendation is to do this to allow it to pass we are here to accept and make those changes. In designing the plat a lot of discussion was made about access to the sub divided property at 516 Myrtle Street. Since Myrtle Street is a very busy city road for traffic to and from the downtown area it would be dangerous to access the new 536 Myrtle St W lot from Myrtle Street. On March 23 this is taken from the meeting notes: Though site has history associated with it, it has not been designated as a heritage preservation site by the City of Stillwater. Therefore, the City's Heritage Preservation Commission has no review authority of the variant nor the change in property address. We did not know we needed to go in front of the HPC committee for design. During our process it was recognized by staff, during the HPC meeting, that when HPC needs to be involved in the review, they should be put at the beginning of the process as well. We have made changes to the entrance and windows and material placement on the designs. We do not feel that the design of this home will impact the look and feel of the community in a negative way. We have designed the home in a way to make it visibly attractive from all site views. We also have begun a landscaping design which will take our existing wall, created by Boulder Images, to wrap that stone around the corner and highlight the home from Myrtle Street. It will be very attractive. In the beginning of the process, if we knew that we were unable to build the home we wanted we would never have split the lot and paid all the fees and costs associated with doing so. We have been approached, and still are, by many investors who would like to purchase the property. Steve has lived in Stillwater his entire life. We own the building at 115 Martha St N (aka 516 Myrtle St W) and take pride in making sure the building and landscaping are attractive to the neighborhood. Hoping to establish a home next door also ensures we will continue to make both properties look good for the neighborhood. In discussion with neighbors, they do not care that we are planning on building on this site. Our plans will include wrapping the boulder wall around the corner and introducing boulders and landscaping (our designer did not enclose that existing gap at the corner but that will be filled in). ENGINEER - Michael Nielson was present. Mr. Nielson reported on the following: a. Ads for Bid - Request for bids have been posted on QuestCDN (online bidding package) and also on our Township website. To date, we have received one bid for Snow Removal and one bid for Road & Trail Maintenance. Neither bid from Miller. The deadline to submit bids is 9/28/22. b. Road Striping - The Park Committee requested to remove the Otto Berg Park handicap stall parking off the (90th) roadway due to safety and move it off -road. There was a discussion to move it to the best location. Engineer Nielson recommends moving it to the head -in parking off 90th and then re -graveling the trail to connect up to the existing trail. The County does not do small striping projects like this; they gave the contact of Chad at Invision Services; but Steve from Miller was contacted to do this. The cost Steve bid was approximately $450 which includes grinding the old stripes off and add the striping in Otto Berg Park along with the stall along Town Hall. Fairy Falls Parking - Engineer Nielson reported that Craig Hansen from NPS requested the Township remove parking along the north end of Orwell Avenue on the east side of the road to allow for 6-8 parking stalls. NPS is planning a "soft" reopening Stillwater Town Board Mtg. — 090822 Page 2 this fall. They are working on proper signage. They plan to attend the October Town Board meeting. There was brief discussion on road striping. Further discussion will take place at the October meeting, discussion was tabled. d. Curve Sign - Residents at 9773 Mendel Rd requested signage due to limited visibility. Engineer Nielson met with the Homeowners, he recommended the Homeowner cut trees and brush back the best they can; then it can be revisited. The hesitation to sign one curve would open the door for more. If at that time it's determined it's needed it would be prudent to put in a sign. e. 2023 Street Improvement (request to begin bid prep) - Some projects were delayed from last year. Mr. Nielson is ready to prepare the specifications. He went over the project locations for Overlay and Chip (Otta) Seal projects. He discussed with the Board a variety of historical details of what has been done and what lasts. He was given authorization to begin the prep. 5. TREASURER - a. Report given. b. Claims and Checks #23919 through #23934 were approved for payment. Ms. Olson reported that some money is tied up in CD's. There have been some changes with reporting in the budget; There's been a movement with the MN Association of Townships (MAT) where they are simplifying the reporting process. (i.e., "Clerk" bucket would include all the duties; not broken out into separated categories such as "elections" or "parks") 6. PLANNER - a. Permit AOP Update - Planner Evan Monson reached out to Mike Isensee at Carnelian Marine St Croix Watershed District (CMSCWD) for an update. Mr. Isensee has been in contact with Contractor Sunde Engineering. The conditions required to grant the 2022 AOP permit have not been met and the 45-day deadline date has expired. Planner Monson suggested sending a notice to Miller that they are out of compliance. Supervisors agree for Planner Monson to work with our Attorney Soren Mattick to write and send a notice of noncompliance. 7. COMMUNITY SERVICE DEPARTMENT - Mark Caroon was present to report. • There were 2 burning permit issued in August. • There were 76 total monthly calls for August. • There were a couple animal complaint calls for August that require follow-up. • September Events: 1. Boom Site Log Run (Sept. 17); special use permit was issued. 2. Yoga Fest - Sept. 23-25th 8. CLERK - a.) Passive -Use Inquiry - Resident Brenda Oseland, a member of the American Sewing Guild, was present to request the use of the Town Hall building. They are a non- profit. They would likely meet 1x/month. Chair Untiedt brought forth the concerns of the "how" to allow and the "who" would be responsible for letting users in and out of the building. Supervisor Sinclair would like to find a way to do this. Supervisor McMahon Stillwater Town Board Mtg. — 090822 Page 3 suggested a lockbox or a unit that would work using Wi-Fi. Township Supervisor McMahon will look into upgrading the door lock system to accommodate public use. Clerk Riehle brought up the fact that in the winter months there would be a greater need to clear snow. Supervisor Sinclair asked about the heating system and who would make sure it was an acceptable warmth in the building. Ms. Oseland suggested they could choose days that the building could utilize the heat best. The use of tables would be great as well. Clerk Riehle will be in touch with Ms. Oseland. b.) Printer/Computer - Clerk Riehle and Deputy Clerk Maes were able to get their township cell phones to communicate with the Brother's printer in the office to print from their phones. The printer model however, does not do a lot of the functions and capabilities that would be ideal in the future which could greatly simplify clerk work. In addition, Deputy Clerk Maes will be putting in a computer upgrade request by the end of the year. c.) Ordinance 195 - Supervisor Chair Untiedt signed the ordinance. Clerk Riehle will send to publication and update the index on the website. There was discussion about the Ordinance Library that is on the website is confusing and in great need of updating. Supervisors discussed the need to rewrite the ordinances and make them able to be searched online easily. Supervisor McMahon is working on a process and will report back. d.) 2023 Calendar - Clerk Riehle has drafted a 2023 meeting calendar. The three fire extinguishers all need to be inspected and retagged by the end of September, this has yet to be completed but will be done. In addition, the Town Board Supervisors were invited to celebrate Fire Prevention Week and received invitations to upcoming events. f.) Elections - Clerk Riehle is arranging a site visit from the County to help with the flow of traffic on election day. General Election planning is already underway. All election judges for both the Primary and General will be paid by the end of the year. g.) Township Zoom Account - Supervisors discussed who would be able to administrate during meetings? How? With what device? Supervisor McMahon will look into purchasing an updated Chromebook for the office and anyone could administrate as long as we are connected to Wi-Fi at Town Hall. OLD BUSINESS • HVAC - Supervisor Mike McMahon reported that work was delayed and is now set to be performed on Wednesday, Sept. 14t" • Hot Water System - The current tank either needs to be replaced or an on -demand unit explored for efficiency. PUBLIC HEARING 14411 Dellwood Rd N- Consideration of an application request from Tim and Debbie Sinclair, for a variance request from setback requirements in order to create a 5-acre lot with a buildable area of 12,500 SF. Chairperson Sheila -Marie Untiedt opened the public hearing. TKDA Planner Representative Larry Poppler Jr., PE was introduced as the evening Planner substitute for Evan Monson. Mr. Poppler gave an overview of the request from the staff report. The applicant is looking to split 5-acres, through lot averaging, to create a new lot from the 20-acre parcel for a single-family residence. The 20-acre lot is narrow, with Hwy-96 to the North and the Brown's Creek Trail to the South. There are criteria for setbacks related to Brown's Creek as well as Hwy-96. The Township Ordinance requires a minimum 150 feet setback from arterial roads (Hwy-96) from the centerline, or 75 feet from the right-of-way (ROW), whichever is greater. New lots require one acre of "buildable" land outside of the setbacks. With the Brown's Creek and the Bluff, the Shoreland Overlay Zone/Developmental Code has a setback requirement of 200 feet. This requirement is unable to be met. The Brown's Creek Watershed District commented concerns about approving, noting a number of challenges on the site. Washington County commented 'significant concerns' with the proposed request stating "Variances are only granted when the plight of the landowner is due to circumstances unique to the property, not created by the landowner. This standard would not be able to be met since [a] non -buildable lot would be created by the landowner. Therefore, Washington County recommends the Township refrain from approving the potential lot split." Staff reviewed the proposed request. An evaluation was done based on the following six criteria followed by staff comment: • Variances shall only be permitted when they are in harmony with the general purposes and intent of the Comprehensive Plan and official controls. Granting the requested variance to buildable area requirements does not appear to be in harmony with the Comprehensive Plan and official controls. Stillwater Town Board Mtg. — 101322 Page 2 • The property owner proposes to use the property in a reasonable manner not permitted by an official control. The applicant does not propose a reasonable use under conditions allowed by the official controls. • The plight of the landowner is due to circumstance unique to the property, not created by the landowner. The plight of the landowner is created by the landowner. • The variance if granted, will not alter the essential character of the locality. The variance, if granted, would not alter the essential character of the locality. • Economic conditions alone shall not constitute a hardship if reasonable use for the property exists under the terms of the Zoning Ordinance. Economic conditions alone do not constitute a hardship. • The Board may consider the inability to use solar energy systems as a "hardship" in granting of the variance. N/A; the requested variance is not related to solar energy systems having adequate access to sunlight. The Town Board may either do one of the following: 1. Approve, with or without conditions. 2. Deny, with findings for denial. 3. Table the request. Chair Untiedt asked whether the changes in TH96 from State to County Road would have any change in setback requirements? Planner Poppler replied no, it would still remain arterial. Surveyor, Paul A. Johnson from P J Land Surveying spoke in representation of the applicants. Mr. Johnson believes this is a beautiful and unique piece of property that the Sinclair's purchased 36 years ago. At that time none of the current ordinances were in place. He believes the setbacks are extreme in this case. They have 12,000 SF to build on, and only need 4,000 SF to build a home. Applicant, Tim Sinclair spoke on behalf of his application. He stated that the bluff lines were 50-70 feet above the creek; whereas a home would not be visible at the creek or by the trail. In addition, there are mature trees along the ROW; again, limited visibility. There are buckthorn and black locusts. An opening was created. Limited impact to the 5-acre property with 4.7 acres of open space. Soil testing and wetland determination was done. No wetlands were found and no impact to the creek noted. They desire to maintain the rural character and protect the vision statement as Mr. Sinclair was a member of the Planning Commission at the time and was a part of writing the language for the Vision Statement. New rules came into effect in 2018. He noted that currently there are 4 houses south of Hwy 96 (north of the creek); noting two of the houses (one being on 2.5 acres and 35 feet from the creek; the other is .80 acres and is approximately 150 feet from the creek). Since the property is narrow, there is limited placement for a house. Mr. Sinclair believes he has been a good steward of the property that he purchased 36-years ago. At that time, they donated 20+ acres to the DNR on the east end that abuts Hwy95. In addition, he has granted the DNR a fishing easement and a non -vehicular easement which ties in. He asks for consideration as the Town Board reviews the proposed request. Stillwater Town Board Mtg. — 101322 Page 3 Supervisor Rod Hunter had concerns for setting a precedence for lot splitting of the remaining 15 acres. Mr. Sinclair responded that under current lot averaging it would not be allowed. Currently, 2/20 acre and 4/40 acre allowed. Resident Barbara Medinger- 8802 Stonebridge Trail - spoke during the public hearing to say she believes the Sinclair's are great neighbors and excellent stewards of the natural resources of their property. As a former member of the Brown's Creek Watershed Board and neighbor, she feels strongly in support of their request as the Sinclair's have allowed testing and easements be done from their land. The public hearing was closed at 7:18PM; there will be further discussion during the regular meeting under "Planner". The regular meeting was opened. REGULAR MEETING 1. AGENDA - M/S/P Hunter/Sinclair moved to adopt the amended agenda to edit as follows to Add: 1.) Clerk: PC, Printer, Router. 2.) Park Committee: Drinking fountain repair proposal- approve cost. 3.) Sinclair variance request discussion - Chair Untiedt opened the discussion with a comment that there are a number of regulations now, that would require variances. Is there a way to restrict further subdivision? Ms. Untiedt added that the creek is not affected by this proposal. Supervisor Robert Geisen commented that whatever decision is made will outlive them, that whoever owns the property in the future then the precedence has then been set. This property is not grandfathered in. There is other already approved small lots created through subdivision in the community that have been grandfathered. Supervisor Rod Hunter commented that the consideration is that they have been good stewards of the land, have donated 20+ acres and have been cooperative with various agencies. Mr. Hunter was in favor of this consideration. In addition, he suggested a 10- acre parcel split to mitigate any changes of subdivision issues in the future. Chair Untiedt suggested the Board table the request, connect with Attorney Soren Mattick and get feedback on whether there is a way to prevent any future subdivision. Permit AOP Update - Planner Larry Poppler reported that a letter was sent to the owner regarding they were out of compliance. There have been conversations with Stillwater Town Board Mtg. — 101322 Page 4 Steve St. Claire from Miller Excavating regarding the completion of plans to meet specifications of the Watershed District which are being completed by Sunde Engineering. Steve St Claire responded that he sent an email to Planner Evan Monson in response to the letter. Mr. St Claire added that the Watershed District sent information on October 7th, which recommended for approval. Jay Riggs from the Conservation District was planning to give a presentation at the next meeting. The next meeting is November 10th c. CUP - Sandstrom ground mount solar - 14033 120TH St N - Conditional Use Permit (CUP) request to have a ground -mounted solar array at a size of over 800 SF, located on a parcel of land 20 or more acres in size. TKDA Planner Representative Larry Poppler Jr., PE; the Planner substitute for Evan Monson. Mr. Poppler gave an overview of the request from the staff report. The Planning Commission reviewed the application request at their October 6th meeting. They heard comments from both the applicant and the contractor and through findings the criteria had been met. The Planning Commission recommended to the Town Board to approve the CUP based on the following four conditions being met. 1. The proposed solar energy system shall adhere to the plans submitted to the township and reviewed with this CUP request. 2. The proposed ground -mounted system shall not exceed the size as shown in the submitted plans of 1,112 SF. An increase in size of the ground -mounted solar energy system shall require an amendment to this CUP. 3. The applicant shall secure any other applicable Federal, State, County and local permits required for the project. 4. The applicant shall pay all fees and escrows associated with this application. Supervisor Giesen asked the Planner a question regarding if there was division of the lot in the future what would need to happen? The CUP application would need to be amended or reduce the size of the solar use. Supervisor Sinclair asked whether it involves just personal use? Applicant Chad Sandstrom answered that it is scaled to meet 103% average energy use. Supervisor McMahon asked whether they had roof panels? Applicants answered; No, because of trees and the positioning of the roof would not work. In addition, the barns are old and may not be able to withstand the weight due to their age. Supervisor Hunter commented that there are a lot of panels, what is the level of use? The property is Agricultural so it serves the hobby farm and the ground mount served as dual purpose to provide shade for their livestock. ENGINEER - Michael Nielson was present via Zoom and reported on the following: a. Bids - Snow Removal - Bids for the 2023-2025 Snow Removal Contract were opened at the Sambatek Offices on Wednesday, September 28, 2022 at 2PM. Two bids were received. One bid from Miller Excavating in the amount of $145,400 and one bid from Dresel Contracting in the amount of $224,200. The bids included an estimated number of hours for various tasks and identified an hourly rate for each piece of equipment with labor. It was recommended to award the Snow Removal Contract to Miller Excavating on an as hourly needed basis at the unit rates bid in the form. Chair Supervisor Untiedt questioned "if by example, they only plow $90K worth of work this season, are we obligated at the $145K or the hourly?" A: Engineer Mike Nielson responded "We are not obligated at any minimum or maximum; we pay for the hours, it's an estimate that has been used in the past. Hard to predict the snow levels." Supervisor Sinclair noted that the other bid by Dresel could be higher to accommodate for the travel from Chisago. WASHINGTON COUNTY - Engineer II Andrew Giesen was in attendance to present an update on the Jurisdictional Transfer of TH96 (Dellwood Rd) to the County from MnDOT. Mr. Giesen gave an overview of the PowerPoint which covered the History of the Highway, Functional Classification and Jurisdiction, what does it mean to be a County Highway and Next Steps. This 9-mile segment, TH96 Turnback has been planned for many years. Roads are classified by the function they serve. There are two primary road functions, they are "Access" and "Mobility". Roadway Jurisdiction is who owns and operates the roadway. By properly aligning roadway jurisdiction helps ensure the best value and use of funds for maintenance and future improvements and helps to maintain or improve the role of the roadway in the transportation system. A County Highway serves Functional Classification, Speeds, Commuter & Truck Routes and have better County Highway Characteristics such as wide shoulders. This transfer is scheduled to occur in the spring of 2023. The County begins operation and maintenance this Fall 2022; This Winter, the County is only responsible for plowing (snow and ice control). In the Spring of 2023, when the Turnback is fully executed, then the County will take on full maintenance responsibilities. Continued collaboration and studies will be done to identify both short-term and long- term needs. Future improvements will follow the County's Cost Participation Policy. Any enhancements the Township would need to participate in sharing those costs. Supervisor Sinclair asked whether there is money following the Turnback? Mr. Giesen reported that they are taking on the 9-mile segment "as -is". Negotiations and future needs are being reviewed. The State would pay the County an estimated $14M. Supervisor Sinclair asked if a Roundabout is in the long-term planning? Mr. Giesen reported that an intersection control evaluation and the corridor study would be performed and anticipate there to be community requests. Supervisor Chair Untied asked whether the money would be escrowed? Mr. Giesen reported that the money would not be escrowed. There are three different funding sources which will be coming in 2023 but they do know there will be capital improvements made to this corridor in 5-15 years. Commissioner Gary Kriesel was present and added that the triangular piece of property would be included. 8. NPS - Fairy Falls - parking/striping discussion - Craig Hansen, Superintendent with the St. Croix National Scenic Riverway and Lisa Yager, Chief of Resource Stewardship and Education with the St. Croix National Scenic Riverway were present to discuss the Stillwater Town Board Mtg. — 101322 Page 7 Day Use Area at Fairy Falls (54 acres). The NPS manages this site location. The Park was closed approximately two years. In the last year, there have been many meetings. There were the following discussion points: ➢Signage - provided by NPS ➢Social trails (not maintained or marked trails) by tree placement to discourage use ➢Parking - Orwell Avenue and possible move to Hwy 95; 6 cars enforcement; no striping ➢Day Use Area - sunrise to sunset ➢NPS - not patrolling ➢Originally closed for health and safety; now general trail conditions deemed unsafe ➢6-8 weeks plan for soft reopen Engineer Mike Nielson commented that the appropriate signage is necessary. He is in agreement that monitoring would be necessary for erosion control and not to stripe at this time. M/S McMahon/Sinclair moved to have the "no parking" signs removed. No vote. Supervisor Geisen would like to amend the motion to remove the no parking signs but then have signs for the space now pending their request at township cost. The amended motion was not accepted. Supervisor Hunter had concerns and Supervisor Untiedt would like to inform the neighbors. Supervisor Untiedt would like to have the NPS put up the signs at their cost. M/S/P McMahon/Sinclair moved to approve removal of the "no parking" signs when the NPS is ready to post their signs for a length of six cars. (5 ayes) 9. CLERK - a.) Elections - Clerk Riehle presented a request to adopt a Resolution appointing Election Judges for the November 8, 2022 General Election with Exhibit A. The Board agreed to adopt the Resolution. M/S/P Hunter/McMahon (3 ayes); Supervisor Sinclair abstained due to conflict of interest. Supervisor Geisen abstained due to conflict of interest; he will be serving as an election judge. Clerk Riehle met with a County Elections Representative for a site visit; the goal was to get another set of eyes and a view of our location so that flow could be best utilized. Now that we are two precincts, a suggestion was to look at another larger site for hosting elections for the Presidential election in two years. Clerk Riehle will discuss this further as necessary following this years' General election. b.) ORI - sunsetting - Clerk Riehle was contacted by Darlene Pankonie with the Washington County Sheriff's Office. In November 2020, Stillwater Township decommissioned our police department. The Township now has a "Community Service" Department. Stillwater Township had been assigned Originating Agency Identifier (ORI) of MN0822400. Given the decommission of the police department, this ORI can be retired from the Minnesota Bureau of Apprehensions systems. Stillwater Town Board Mtg. — 101322 Page 8 M/S/P Hunter/McMahon moved to sunset the ORI and retire MN0822400. (5 ayes) c.) Unpermitted Driveway - Clerk Riehle received a phone call from MnDOT regarding an unpermitted driveway that was put in off Hwy 96/Dellwood Rd. The location happens to be in the bi-pass lane. A review was conducted and will be addressed prior to the Turnback transfer from MnDOT to Washington County. Clerk Riehle had not received the letter to date; but will follow up on this. d.) PC, Printer, Router - Supervisor Mike McMahon looked into cost and features of a Chromebook. He noted that a 12" at $179; was not the best size for ease and accessibility and recommended a 17" Chromebook at the approximate cost of $500- $600. The computer would be accessible for meetings and office use. M/S/P Sinclair/Geisen moved to approve an amount not to exceed $600 for a 17" Chromebook. (5 ayes) The current office printer is basic, outdated and has limited functions. Supervisors feel that the dated model is inhibiting productivity; it doesn't have the scanning capability nor the ability to copy double sided documents and only prints in black and white. Clerk Riehle and Deputy Clerk Maes will consult and look into options and will bring back to the Board. The current internet router is with Century Link. Supervisors discussed an update to the router is needed. It may not increase Internet service but may be needed for reliability. Further discussion was tabled. 10. PLANNING COMMISSION - Commission member Alan Robbins -Fenger was present to give a summary from the Planning Commissions meeting last week. The Commission has continued to work on a Short -Term Rental Ordinance. 11. PARK COMMITTEE - The committee met recently. Supervisor Liaison Hunter reported that the committee will go on seasonal hiatus. Mr. Hunter spoke on a $50,000 grant that the committee learned was available; this is for enhancement through the Legacy fund which would benefit Little Carnelian Park. The Township would have to provide 5% of the funding. The Park Committee is looking to apply. Deputy Clerk Jennifer Maes reported that the drinking fountain is cracked. Park Member Noah Smith is willing to fix this but needs funding for materials to do so. M/S/P McMahon/Hunter moved to approve the amount needed not to exceed $400 for repair of the drinking fountain. He noted that the "nest" thermostat is not compatible with the "G-Suites" email accounts so a separate Gmail account will be set up to allow for ease of use. • Hot Water System - Supervisor McMahon reported that he talked with Township resident and plumber Ron Haussner who suggested something other than the on - demand unit. A new system could be updated by using Covid funds. Supervisor McMahon will put together a formal proposal. • Street Signs - Supervisor Robert Geisen reported that the street sign at the intersection of Mayfield/Mendel is in need of replacement because it is unreadable. Also, the street sign at Mendel Rd./101st St. is laying on the ground as it must have been hit. Clerk Riehle will contact CSO Mark Caroon for follow-up on these. 16.
