HomeMy WebLinkAbout2022-070 (Preliminary Plat for Myrtle View (Case No. 2022-13))City of Stillwater Washington County, Minnesota RESOLUTION 2022-070 A RESOLUTION APPROVING A PRELIMINARY PLAT FOR MYRTLE VIEW CASE NO. 2022-13 WHEREAS, Steve and Lynn Thron made application for the approval of the Final Plat known as MYRTLE VIEW; and WHEREAS, on April 27, 2022 the Planning Commission for the City of Stillwater held a public hearing on the preliminary plat and rezoning requests for MYRTLE VIEW and took testimony from the public; and WHEREAS, on April 27, 2022 the Planning Commission voted recommend approval to the City Council; and WHEREAS, on May 17, 2022 the City Council held a public hearing on the requests and found them to be substantially consistent with City development standards and the Stillwater Comprehensive Plan; and WHEREAS, on May 17, 2022 the City Council reviewed the Final Plat and plans for MYRTLE VIEW and found them to be consistent with the preliminary plat and plans. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Stillwater hereby approves the Preliminary Plat request for Myrtle View with the following conditions: 1 The site shall be developed in substantial conformance with the plans on file with the Community Development Department, except as may be modified by the conditions herein. 2. All electrical and communications utility lines shall be buried. This shall be specified in the plans submitted for final plat approval. 3. Drainage for this development shall not be directed onto adjacent properties. In the event drainage adversely effects adjacent properties, Myrtle View property owners shall be responsible for rectifying the drainage issues. 4 The developer will be responsible for paying development fees based upon the net developable acreage of the project, which, for 2021, is $3,787.07 for Trout Stream Mitigation ("AUAR"). If the fees are not paid in 2021, the fees will be adjusted annually. The fees will be payable prior to release of the final plat for recording with Washington County. 5. In lieu of park and trail land dedication, the developer shall be required to pay a $2,000 park and a $500 trail dedication fee for each new home lot created. The fees will be payable prior to release of the final plat for recording with Washington County. Adopted by the Stillwater City Council this 17th day of May, 2022.
