HomeMy WebLinkAbout6560 (Res.)Publish-10-6-78 6560 RESOLUTION ORDERING IMPROVEMENTS AND APPROVING PLANS AND SPECIFICATIONS AND DIRECTING CLERK TO ADVERTISE FOR BIDS, LOCAL IMPROVEMENT NO. 157. WHEREAS, by resolution adopted July 25, 1978, this Council did fix a date for a public hearing on proposed improvements consisting of the following: Sanitary Sewers, watermains, streets, drainage and other appurtenances to serve the Stillwater Industrial Park, Phase II. AND WHEREAS, pursuant to notice duly published in the Stillwater Evening Gazette, official newspaper of the City, on the 18th day of August and the 25th day of August, 1978, and mailed as required by law, said hearing was held at the Municipal Building at 7:30 o'clock P. M., on Tuesday, the 5th day of September, 1978, at which time and place all persons desiring to be heard on said improvements were given an opportunity to be heard. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota: 1. That the aforesaid improvement be, and is hereby, ordered as proposed at an estimated cost of $1,046,850, and that final detailed plans and specifications therefor, prepared by Short -Elliott - Hendrickson, Inc. pursuant to Council resolution be, and the same are hereby, approved and ordered filed in the office of the City Clerk. 2. That the Acting City Clerk be, and she is hereby, authorized and directed to advertise for bids on the construction of said improve- ments,publication thereof to be made least once in the official news- paper of the City, not less than ten days prior to the date hereinafter set for opening and consideration of bids. Said advertisement shall specify the work to be done, shall state that bids will be publicly opened for consideration by the Council at 3:00 o'clock P. M. on Thursday, November 9, 1978, and shall further state no bids will be considered unless sealed and filed with the Clerk and accompanied by a cash deposit, cashier's check, bid bond or certified check, payable to the City, for at least ten (10) percent of the amount of the bid. COUNTY OF WASHINGTON ) Phil Easton, being duly sworn, on oath says he is and during all the times herein stated has been the Publisher and Printer of the newspaper known as Stillwater Evening Gazette and has full knowledge of the facts herein stated as follows: (1) Said newspaper is printed in the English language in newspaper format and in column and sheet form equivalent in printed space to at least 900 square inches. (2) Said newspaper is a daily and is distributed Monday through Friday of each week, except holidays. (3) Said newspaper has 25% of its news columns devoted to news of local interest to the community which it purports to serve and does not wholly duplicate any other publication and is not made up entirely of patents, plate matter and advertisements_ (4) Said newspaper is circulated in and near the municipality which it purports to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75% of its total circulation currently paid or no more than three months in arrears and has entry as second-class matter in its local post -office. (5) Said newspaper purports to serve the City of Stillwater and surrounding area in the County of Washington and it has its known office of issue in the City of Stillwater in said county, established and open during its regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and maintained by the publisher or persons in his employ and subject to his direction and control during all such regular business hours at which said newspaper is printed. (6) Said newspaper files a copy of each issue im- mediately with the State Historical Society. (7) Said newspaper is made available at single or subscription prices to any person, corporation, partnership or other unincorporated association requesting the newspaper and making the applicable payment. (8) Said newspaper has complied with all the foregoing conditions for at least one year preceding the day or dates of publication mentioned below. (9) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State and signed by the Publisher and sworn to before a notary public stating that the newspaper is a legal newspaper.
