NO. 224 WHEREAS, pursuant to resolution of the Council adopted June 5, 1984, a report has been prepared by Short -Elliott -Hendrickson, Inc., with reference to street and drainage improvements in Penthouse Acres, and this report was received by the Council on August 21, 1984; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF STILLWATER, MINNESOTA: 1. The Council will consider the improvement of such street in accordance with the report and the assessment of abutting and benefited properties for all or a portion of the cost of the improvement pursuant to Minnesota Statutes Chapter 429 at an estimated total cost of the improvement of $134,472.00. 2. A public hearing shall be held on such proposed improvement on the 13th day of September, 1984, at 7:00 P. M. in the Council Chambers of City Hall, and the City Clerk shall give mailed notice and published notice of such hearing and improvement as required by law. Adopted by the City Council this 21st day of August, 1984. Published: August 30, 1984 ATTES . dafr City Coordinator RESOLUTION N0. 7352 MAYOR RESOLUTION VACATING PARTS OF FORWARD STREET AND ST. CROIX AVENUE. WHEREAS, at a meeting of the City Council of the City of Stillwater, a petition was presented praying for a vacation of part of Forward Street and St. Croix Avenue in the City of Stillwater, hereinafter described; and WHEREAS, the City Council did determine that the petition was properly verified and signed by an owner abutting on the portion of the street proposed to be vacated; and the City Council determined that they are a Home Rule Charter City of the Third Class and that it was proper for them to proceed with the vacation pursuant to Minnesota Statutes 440.135; and WHEREAS, at a meeting duly called for that purpose, the City Council did on the 21st day of August, 1984, determine that the proposed vacation would not interfere or defeat the public interest oradversely affect the public and that it would be in the best interests of the City of Stillwater and the abutting owners that the portion of Forward Street and St. Croix Avenue be returned to the tax rolls. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Stillwater, Minnesota, that said petition be and the same is hereby granted and that the following part of said street as presently laid out and dedicated, be and the same is hereby vacated: All that portion of St. Croix Avenue abutting Lots 6 and 7, Block 7 Cooper's Addition lying North of the North right-of-way line for St. Croix Avenue described as follows: commencing at the Southeast corner of Lot 7, Block 7, Cooper's Addition, to the City of Stillwater, Washington, County, Minnesota; thence deflect left 18026'06" from the south line of Lot 7, a distance of 158.11 feet, to a point 50.00 feet South of the South line of Lot 7, thence deflect right 36 52'12", a distance of 158.11 feet to the Southwest corner of Lot 6, Block 7 and there terminating at the existing right-of-way on St. Croix Avenue. and All that part of Forward Street in Cooper's Addition of the perfected plat of the City of Stillwater, as recorded in the office of the County Recorder, Washington County, Minnesota, which lies north of the north line of St. Croix Avenue according to said plat and lies south of the westerly extension of the south line of the north 10.00 feet of Lot 2, Block 7 of said Cooper's Addition. RESOLUTION N0. 7354 RESOLUTION AUTHORIZING ISSUANCE AND SALE OF $4,850,000 GENERAL OBLIGATION IMPROVEMENT BONDS, SERIES 1984A BE IT RESOLVED by the City Council of the City of Stillwater, Minnesota, as follows: 1. BOND AUTHORIZATION. For the purpose of refunding a maturity of the City's $6,100,000 General Obligation Temporary Improvement Bonds, Series 1981A, dated November 1, 1981, this Council determines that, in addition to funds on hand, it is: necessary to sell and issue general obligation improvement bonds of the City in the amount of $4.850,000. 2. Sale Terms. Springsted Incorporated, bond consultants to the City, has presented to this Council a form of Official Terns of Offering of the sale of the bonds, and a form of Notice of Sale for publication, which forms are attached hereto and shall be placed on file in the office of the City Clerk. Each and all of the provisions of the Official Terns of Offering are hereby adopted as the terns and conditions of said bonds and of the sale thereof, and shall be made available to all prospective purchasers of the bonds. The City Clerk is authorized and directed to cause the Notice of Sale to be published once in the official newspaper of the City, and once in the Commercial West, a financial periodical published in Minneapolis, at least ten days before the date of sale. 3. Sale Meeting. This Council shall meet on Tuesday, September 11, 1984, at 4:30 P. M., to consider the bids received for the purchase of the bonds, and to take such actions thereon as is deemed in the best interests of the City.
