BE IT RESOLVED BY THE CITY COUNCIL OF STILLWATER, MINNESOTA: 1. A certain petition requesting streets and utilities for the Interlachen Hills Development filed with the Council on June 7, 1983 is hereby declared to be signed by the required percentage of owners of property affected thereby. This declaration is made in conformity to Minnesota Statutes, Section 429.035. 2. The petition is hereby referred to Short -Elliott -Hendrickson, Inc. and they are instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed tnprovement is feasible and as to whether it should best be made as proposed or in connection with some other improvement, and the estimated cost of the improvement as recommended. WHEREAS, at a meeting of the City Council of the City of Stillwater, a petition was presented praying for vacation of a part of Forward Street in the City of Still- water, hereinafter descrived; and WHEREAS, the City Council did deermine that the petition was properly verified and signed by an owner abutting on the portion of the street proposed to be vacated; and the City Council determined that they are a Home Rule Charter City of the Third Class and that it is proper for them to proceed with the vacation pursuant to Minnesota Statutes 440.135; and WHEREAS, at a meeting duly called for that purpose. the City Council did on the 7th day of June, 1983, determine that the proposed vacation would not interfere or defeat the public interest or adversely affect the public and that it would be in the beat interest of the City of Stillwater and the abutting owners that the portion of Forward Street be returned to the tax rolls. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that said petition be and the same is hereby granted and that the follow- ing part of Forward Street as presently laid out and platted, be and the same is hereby vacated; That portion of Forward Street adjacent to and between the south line of Blocks 4 and 8 to its northerly terminous all in Cooper's Addition to the City of Stillwater, according to the plat thereof now on file and of record in the office of the County Recorder of Washington County, Minnesota. BE IT FURTHER RESOLVED, that a copy of this resolution duly certified by the City Clerk shall be recorded in the office of the County Recorder of Washington County, Minnesota.
