RESOLUTION 2022-054
APPROVING ENCROACHMENT AGREEMENT FOR USE OF UNION ALLEY FOR
THE LUMBERJACK AND LOLITO
WHEREAS, Union Alley is dedicated public right-of-way; and
WHEREAS, Union Alley is not designed as a full public street and does not have
any public parking stalls; and
WHEREAS, in order to continue to advance its economic development goals,
the City Council desires to extend a limited pilot project for outdoor dining; and
WHEREAS, The Lumberjack and Lolito's have requested a similar approval from
2021 and 2022 for closure of Union Alley for outdoor seating.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Stillwater,
Minnesota that the request for Union Alley is hereby approved, directs the City Attorney
to draft an official Encroachment Agreement and authorizes the Mayor and City Clerk to
execute said agreement, contingent upon the following.
1. Building Egress Areas must not be blocked
2. Applicants should continue to explore better means of trash pick up
3. Any business approved for said use must enter into an Encroachment
Agreement
4. This continues to be a temporary, pilot project for 2022
5. Use must terminate by November 1, 2022
6. The mural project must be reviewed and approved by the Heritage Preservation
Commission (HPC)
Adopted by the Stillwater City Council this 5th day of April 2022.
