HomeMy WebLinkAbout2022-044 (Approving the Resubdivision of Lot 7 & 8 Block 2, Churchill’s 2nd Addition (Case No. 2022-01)) City of Stillwater Washington County, Minnesota RESOLUTION 2022-044 A RESOLUTION APPROVING THE RESUBDIVISION OF LOT 7 & 8 BLOCK 2, CHURCHILL’S 2 ND ADDITION CASE NO. 2022-01 WHEREAS, Jamie Jacobson, landowner, made application to subdivide her lot into two parcels; and WHEREAS, the legal description of the subject lot to be resubdivided is: Lot 7 & 8, Block 2, Churchill’s Second Addition; and WHEREAS, the subject lot is to be resubdivided into two parcels described as follows: Parcel A Lot 7, Block 2, Churchill’s Second Addition, Washington County, Minnesota ; and Parcel B Lot 8, Block 2, Churchill’s Second Addition, Washington County, Minnesota ; and WHEREAS, on March 15, 2022 the City Council received and reviewed the resubdivision request and found it to be compatible with the neighborhood and consistent with the City's Zoning Code, Subdivision Code, Comprehensive Plan, and infrastructure. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Stillwater hereby approves the resubdivision of Lot 7 & 8, Block 2, Churchill’s Second Addition with the following conditions: 1. Plans shall be substantially similar to those found on file with Case CD 2022- 01, except as modified by the conditions herein. 2. Any substandard drainage and utility easements platted around the lots of the existing parcel must be vacated and new drainage and utility easements must be created by the owner around the two proposed parcels. These easements must be submitted to the City prior to release of approved deeds from City offices for recording with Washington County. 3. A $500 trail fee and a $2,000 park fee will be due to the City for Parcel B upon release of its deed from City offices for recording with Washington County. These fees do not apply to Parcel A. 4. Prior to the submittal of a building permit application for the new home on Parcel B, the new home's design shall conform to the Neighborhood Conservation (Overlay) District's guidelines and a Design Permit shall be obtained. All changes to the approved plans will need to be reviewed and approved by the Community Development Director in advance. Any major changes will need to the Planning Commission for Use Permit amendment review and approval. Adopted by the Stillwater City Council this 15th day of March, 2022.
